1985-05-06 - Resolution 1985-24 - APPROVING A MOSQUITO CONTROL SERVICE CONTRACT FOR THE 1985 AND 1986 SEASONRESOLUTION No. 85- 24 A RESOLUTION APPROVING A MOSQUITO CONTROL SERVICE CONTRACT FOR THE 1985 and 1986 SEASON WHEREAS, sealed bids were opened at 10:00 AM on April 1, 1985 after a notice of bid letting had been published; and, WHEREAS, one responsive bid was received and found acceptable; and, WHEREAS, alternate provisions for an extention of the service for two seasons at the bid unit prices for 1985 and the use of an alternate mosquito adulticide in some cases has been found desire - able; NOW THEREFORE, BE IT RESOLVED by the Village President and Board of Trustees of the Village of Buffalo Grove, Illinois as follows: 1. The contract with the Clarke Outdoor Spraying Company, Inc. entitled "1985 and 1986 Mosquito Control Service Agreement" is approved. A copy of this agreement is attached hereto and made a part hereof. 2. The Village Manager is authorized and directed to execute the said agreement. AYES: 6 - Marienthal, O'Reilly, Glover, Reid, Shields, Kowalski NAYES: 0 - None ABSENT: 0 - None PASSED: May 6 ,1985 APPROVED: z \ Vil age President ATTEST: Vill-dge Clerk 1985 AND 1986 MOSQUITO CONTROL SERVICE AGREEMENT THIS AGREEMENT entered into by and between Clarke Outdoor Spraying Company, Inc. hereinafter referred to as the "Contractor" and the Village of Buffalo Grove, with offices located at 50 Raupp Boulevard, Buffalo Grove, Illinois, Cook County, Illinois hereinafter referred to as the "Municipality." WHEREAS, "Contractor" will be performing various work under contracts with the said "Municipality" entered into and to be entered into from time to time, which work will be performed on and/or off the premises of the "Municipality" and said "Contractor" may have subcontractors or one or more employees engaged in the performance of said work: NOW, THEREFORE, in consideration of the mutual covenants and agreements herein contained, and other good and valuable consideration received and to be received, the "Contractor" hereby agrees: 1. To comply with all applicable laws, regulations and rules promulgated by any Federal, State, County, Municipal and/or other governmental unit or regulatory body now in effect or which may be in effect during the performance of the work. Included within the scope of the laws, regulations and rules referred to in this paragraph but in no way to operate as a limitation, are all forms of traffic regulations, public utility and Intrastate and Interstate Commerce Commission regulations, Workmen's Compensation Laws, Prevailing Wage Laws, the Social Security Act of the Federal Government and any of its titles, FEPC or FEOC statutory provisions and rules and regulations. 2. To protect, indemnify, hold and save harmless and defend the "Municipality" against any and all claims, costs, causes, actions and expenses, including but not limited to attorney's fees incurred by reason of a lawsuit or claim for damages or compensation arising in favor of any person, corporation or •.other entity, including the employees or officers or independent contractors or subcontractors of the contractor or municipality, on account of personal injuries or death, or damages to property occurring, growing out of, incident to, or resulting directly or indirectly from the performance by the "Contractor" or "subcontractor" of their officers, agents or employees hereunder, whether such loss, damage, injury or liability is contributed to by the negligence of the "Municipality", its officers, agents, employees, independent contractors, or by premises themselves or any equipment thereon whether latent or patent, or from other causes whatsoever, except that the "Contractor" shall have no liability or damages or the costs incident thereto caused by the sole negligence of the "Municipality." 3. To keep in force, to the satisfaction of the "Municipality," at all times during the performance of the work referred to above, Broad Form, Public Liability Insurance including contractual liability and Automobile Liability Insurance with Bodily Injury each with limits of not less than $5,000,000.00, Broad Form Property Damage Insurance with limits of not less than $1,000,000.00 and workers compensation and related insurance coverage at amounts required by statute. The "Contractor" agrees that at any time upon the demand of the "Municipality," proof of such insurance coverage will be submitted to the "Municipality." There shall be no additional charge for said insurance to the "Municipality." At the request of the "Municipality" the "Contractor" will furnish certificates of insurance for the insurance coverage required herein, naming the "Municipality" as an additional assured and providing that such policies may not be cancelled or amended without ten days' prior written notice having been given to the "Municipality." 4. To furnish any affidavit or certificate, in connection with the work covered by this agreement as provided by law. 5. To indemnify "Municipality" for any loss it may sustain by theft or other cause from the acts or negligence of the employees of the "Contractor" or of the subcontractors. 6. Whenever in this Agreement the term "Municipality" is used with regard to the obligation of the "Contractor" to indemnify, hold harmless or defend, the word "Municipality" shall include the officers, employees and independent contractors of the "Municipality." ,IT IS_MUTUALLY UNDERSTOOD AND AGREED that the "Contractor" shall have full control of the ways and means of performing the work referred to above and that the "Contractor" or his/its employees, representative or subcontractors are in no sense employees of the "Municipality," it being specifically agreed that in respect to the "Municipality," the "Contractor" and any party employed by the "Contractor' bears the relationship of an independent contractor. It is also mutually agreed that the "Contractor" shall perform services as proposed in their April 15, 1985 submittal to the Village which is attached hereto as Exhibit A in 1985 and shall also provide these services in 1.986 at'the same unit prices. The work and responsibilities shall conform to the Village of Buffalo Grove specifications for 1985 Mosquito Control Services which are attached hereto as Exhibit B, except that when adulticiding is performed at temperatures below 73° and at other times agreed to by the Village representative, then the alternate adulticiding agent specified in Appendix E of Exhibit A shall be used at the quoted price. It is mutually agreed that half the adulticiding applications are projected to occur using the Appendix E alternate. This Agreement shall be in effect from the 7th day of May, 1985, until the lst day of December, 1986 inclusive. Although your specifications call for a one year proposal, as in past years, we have offered the Village a contract extension for the 1986 season with a not to exceed 5% increase. In general, our proposal includes those quantities and products called for in your specifications. At the Village's choice, however, quantities and/ or products can be altered to custom design your program. I have included correspondence from our insurance carrier addressing our ability to provide a certificate of insurance. As part of the appendices, I have included in addition to a list of full-time staff and description of vehicular and aircraft equipment, the following: 1. List of consultants on our staff 2. Description of physical facilities (warehouse, laboratory, etc.) In efforts to meet your map submittal requirements, I have included "copies" of our master maps. I have chosen to include copies because the masters provide a better source to duplicate maps for operational purposes. The masters can be made available, at your request. I do not feel that this inclusion is an exemption to your specifications. We appreciate your business in the past and look forward to a successful control season in 1985. We would be happy to host a physical inspection of our facilities and equipment for your staff and the Village Board as part of the bid review process. Early May First press releases will be given to local newspapers. Early May First helicopter larvicide application to all designated breeding areas. Mid -May First of the weekly inspections begins. Mid -May Mosquito HOT-LINE available for citizen response (1-800-942-2555). Mid -May* Monitoring of local rainfall and temperature begins. Late May Light trap network begins operating three nights per week. Mid -June Mosquitofish (Gambusia affinis) released in suitable mosquito breeding areas. Mid -,June Second press release describing special control techniques. Mid -June Delivery of U.S. Public Health pamphlets to the Village Hall. Mid -June Second helicopter treatment to all designated mosquito breeding areas. Mid -June Treatment of all open street catchbasins with a Dursban emulsion. Mid -July Third press release given to local papers on encephalitis suppression efforts. Mid -July** Activation of up to five late summer ULV cold misting treatments for nuisance control and/or the reduction of potential encephalitis transmission. Late July Third helicopter larvicide treatment. Mid -September Last ULV cold misting treatment to prevent encephalitis is applied. Late September Light trap network removed. Post Season Annual Report delivered to Public Works Department. * The Village will be kept abreast of floodwater mosquito brood migrations. When the light trap monitoring system is averaging above 20 female mosquitoes per catch (above the acceptable annoyance level of two bites within five minutes at dusk), Clarke will advise the Village of possible excessive annoyance and recommend the exact date to provide the most effective adult control. With this data and with the knowledge of the general annoyance being experienced in the Village, your desi- gnated representative will decide whether to do ULV misting for nuisance control. ** The encephalitis virus takes 12 to 14 days to develop within the adult mosquito. From approximately July 15th to September 15th, ULV treatments should be applied at not greater than 10-day intervals to break the encephalitis transmission cycle. (2) SERVICE INFORMATION SHEET 1. PI A- VILLAGE OF BUFFALO GROVE SPECIFICATIONS FOR 1985 MOSQUITO CONTROL SERVICES Sealed proposals will be received, in the manner and time published, by the Village of Buffalo Grove, Illinois, for Mosquito Control Services in accordance with the following specifications. A company making a proposal, hereinafter called Contractor, is to furnish all labor, material and equipment to perform the complete Mosquito Control Service Program. The Director of Public Works or his designated representative is authorized to administer this service contract for the Village. Each item of work to be performed in the Village shall be verbally authorized before the work is done. The Village reserves the right to increase or reduce quantities without limitation except that in no case shall the total value of the service exceed the Contract total value. Any alternate proposal shall be submitted in writing. A full explanation of why any item of this specifica- tion is proposed for variation shall also be submitted in writing with the alternate proposal. SPECIFICATIONS I. General Services The contractor shall monitor rainfall, temperature and mosquito population density in the Buffalo Grove area from May 15th to September 15, 1985. At least one New Jersey type light trap shall be maintained in the Village at a Village approved location for this purpose. This trap shall be inspected at least three times per week and mosquitoes shall be identified by specie and sex. From June 15th through September 1st, the contractor shall also maintain one ovi position trap at an approved Village location for monitoring culex pipien mosquitoes. This trap shall also be inspected three times per week with the number -of female culex pipien mosquitoes counted. The results of this monitoring activity shall be available to the Village -upon request. At least three press releases to local newspapers servicing the Village, which describe the control techniques being used and the encephalitis suppression effort being employed, shall be issued in early May, mid -June and mid -July. The contractor shall maintain a supply of U.S. Public Health pamphlets, or Village approved alternate pamphlets, at the Village Hall, which describe homeowner mosquito control techniques. Monthly reports shall be submitted to the Village denoting contract activities performed and summarizing the data which has been monitored. A final report shall be submitted to the Village by December 1, 1985. This report shall summarize the activities performed and items monitored under the contract. Recommendations for reducing sources of mosquitoes shall be provided in this report. The final report shall also provide a revised map denoting all potential breeding locations, breeding locations which can support mosquito fish, prehatch treatment areas, final revisions of the Lake and Cook County ULV misting route course maps along with a final revised list of the mapped areas which are indexed to the final report maps. This work shall be paid for as a lump sum for general services. II. Site Inspection Larval Control A. Inspection of Breeding sites 1. Thirteen (13) inspections of all potential mosquito breeding areas in Lake County within and adjacent to the boundaries of the Village shall be performed. between May 15, 1985 and September 15, 1985. Inspections are to be conducted in an effective relationship to the larval development cycle every 7 to 10 days. Reports of inspections in a form acceptable to the Village shall be promptly submitted denoting site locations and intensity of breeding. The basis of payment shall be: (1) the cost for each inspection of all vendor identified sites in Lake County; and, (2) a price for each site added or deleted from each inspection by the Village. B. Larval Control 1. Larviciding treatments of any portion of the potential mosquito breeding acres as needed should be done at the time of inspection. Treatments will be made utilizing 5 - 10 lbs. per acre of 2.5% B.T.I. granules. In areas of extreme organic pollution, 5 lbs. per acre of 1% Dursban shall be utilized. The basis of payment for this service --shall be by acre of breeding site actually treated. 2. Control of Catch Basin Structures One (1) treatment of all catch basin structures with a Dursban emulsion shall be performed. The basis of payment for this service shall be per catch basin treated. 3. Mosquito fish (Gambusia affinis) shall be released at a rate of 500 per -acre in all suitable mosquito breeding areas in Lake County in early June. This shall be paid for at the unit price per fish stocked. 4. Three (3) helicopter Larvicide treatments (early May, mid - June and late July) of potential mosquito breeding areas in Lake County shall be performed with 5# of 1% Dursban granules per acre (AI 0.05# per acre). This service shall be paid for on the basis of acres treated. III. Adult Mosquito Control 1. The Village shall be kept abreast of flood water mosquito brood migrations. When the light trap monitoring system is averaging above twenty (20) female mosquitoes per catch (above the acceptable annoyance level of two bites within five minutes at dusk). The Contractor shall advise the Village of possible excessive annoyance and recommend the exact date to provide the most effective adult control. With this data and with the knowledge of the general annoyance being experienced in the Village. The Village's designated representative will decide whether to do ULV misting for nuisance control. 2. Adult mosquito control shall be accomplished by ultra low volume, (ULV) mechanical equipment. This equipment shall be equipped with tacographs. A copy of each tacograph shall be submitted with the payment request for this work. 3. The material to be used shall be 91% malathion, applied at a rate as specified on the EPA,registered label directions. 4. Alternate adulticides may only be utilized if prior approval is obtained and alternate unit prices are submitted with this bid submittal. 5. ULV,.applications shall be applied over all of the Village streets (denoted on the attached map. Contractor shall have sufficient available ULV equipment to provide complete Village -wide coverage within one (1) night. 6. A twenty-four (24) hour per day hot line shall be maintained for complaints. A list of all complaints shall be filed with the Village promptly. Residents who have requested advance notifica- tion of spraying must be notified in advance. 7. The basis of payment for ULV applications shall be-(1) on a per application basis for Lake and Cook County adjusted by (2) a unit cost for the number of route miles added or deleted by the Village. IV. Insurance 1. Contractor shall carry public liability, environmental impairment liability and property damage insurance of at least $5,000,000.00. 2. Contractor shall carry vehicle liability insurance on each vehicle operated within the Village including aerial equipment. Both aerial and vehicle insurance coverages shall be supplemented with an umbrella type liability coverage with limits of $5,000,000.00. 3. Contractor shall carry Workmen's compensation insurance on each employee. 4. A Certificate of Insurance, naming the Village as additionally insured, shall be furnished for each of the above as part of this bid submittal. 5. Contractor shall show evidence that the Village will be defended, at no cost to the Village, against any legal action resulting from environmental pollution associated with the application of mosquito control chemicals. There shall be no environmental exclusion clause in the Contractor's insurance coverage. V. -- Personnel and Equipment 1. All personnel shall be properly licensed by the Illinois Department of Agriculture as required by the "Illinois Custom or Public Application of Pesticides Act." 2. Sufficient staff including technical specialists such as entomologists, biologists and geographers, other specialists and management personnel shall be available to direct and implement ,.the,entire Mosquito Control program. 3. All services provided under this contract shall be provided by the Contractor's directly employed personnel and with company owned equipment. No subcontractoring shall be allowed. VI. Guarantees Contractor shall guarantee that the mosquito control procedures have been accomplished as specified for each pay item before payment is requested or made for that pay item. All requested information shall be furnished on the attached forms where spaces are provided. All other requested information shall be attached. Proposals are to be accompanied by cash, certified check or bid bond payable to the Village, in the amount of ten percent (10%) of the total annual bid price. The bid deposit of all unsuccessful bidders will be retained by the Village until an award has been made, at which time these deposits will be returned except that of the successful company's proposal. The proposal deposit of the successful company will be returned if a 100% Performance and Payment Bond, executed contract and accompanying documents are submitted to the Village within ten (10) days of the notification of contract award.
