1985-04-15 - Resolution 1985-18 - AUTHORIZING THE EXECUTION OF THE REVISED SERVICE CONTRACT BTWN VBG AND WHEELING TOWNSHIP RURAL FIRE PROTECTION DISTRICTRESOIUTION NO.8 s-18 A RESOIUTION AUTHORIZING THE EXNCUTION OF TIIE REVISED SERVICE CONTRACT BETWEEN THE VILIAGE OF BUFFALO GROVE AND T1{E I./HEELING TOLTNSHIP R1JRAL FIRE PROTECTION DISTRICT WHEREAS, pursuant to Village Resolution No. 80-26, the Village entered i-nto an agreement wlth the Wheellng Rural Fire Protection Distrlct and the then exlsting Buffalo Grove lire Department ' Inc. which agreement provided among other things' for fire protectlon and ambulance service by the Village within certain disconnected lands from the District; and' WIIEREAS, the V111age, pursuant to its Home Rule Powers, the Illinols Intergovernmental Cooperation Act, and lll1nois State Statutes, desires to provide flre and ambulance protectlon service to the disconnected area by contractual services; and, WHEREAS, on May 21, 1984' the Vil-lage ?resldent and Board of Trustees adopted Resolution No. 84-35 rrhich authorized and dlrected the President and Vlllage Clerk to execute a contract between the Village and Dlstrlct to provide fire and ambulance protection to the disconnected areas' for the period May f, 1984 Ehrough April 30, 1985; and' mIEREAS, 1t is now necessary to readopt the service a8reenent between the Village and Dlstrict for the period from May 1, 1985 through APril 30, 1986, as amended. SECTION 1. The Village President and Village Clerk are hereby authorlzed and directed to execute the contract attached hereto as Exhiblt rr1 rt with the Wheeling Towoshlp Rural Flre ProtecElon District to Provlde fire and ambulance protectlon for the period from l4ay 1, 1985 through Aprll" 30, 1986. WHEREAS, the District ls a Dunicipal corporatl"on organized and exlstlng under Chapter L27-ll2 of the Illinois Revised Statutes of L975 as amended; and I.IHEREAS, the Dlstrlct ls empowered under such Statute to contract wlth any corporatlon, adjacent fire protectlon dlstrlct or village to furnlsh flre Pro- tection servlces and eroergency ambulance servlces withtn all or a Portlon of the territory of the Dlstrlct; and WIIEREAS, the Dlstrlct ls desirous of enterlng lnto a contract rrith the V11lage to provlde such fire protecEj.on services and ambulance servlces to a poltlon of the territory of the DisErlct; and WHEREAS, the Village ls a municlpal corporatlon organlzed and existlng under the Statutes of the State of ll-linols; and IIIiEREAS, the Vlllage has an operatlng fire department and emergency ambulance servlce; and WIIERXAS, the Village 1s deslrous of enterlng lnto a contract wlth the Distrlct to provlde fire protectlon and eoergency ambulance servlce. NoW, THEREFORE, IT IS AGREED AND IJNDERSTOoD by and between the District and the DepartDent as follows: ARTICLE I That for the perlod beglnning on l.lay 1, 1985 and expirlng on Apr1l 30, 1986, the Vtllage shalI furnlsh all fire fightlng, fire protectlon' fire pre- ventloo and emergency ambulance servlces; all flre ftght1flg, flre protection, fi-re preventlon and ambulance equipment; all personnel whether volunteer or paid; and all necessary faclllties to house. and adnlnister the equipmeDt and personnel to be provldedl necessary in the Judgnent of the Vlllage to provide fire protection and emergency anbulaoce servlce for the territory so desi8nated in red on EXHIBIT A attached. , FIRE TIGHTING AND PROTECTION SERVICES: June, 1985 paynent EMERGENCY AMBULANCE SERVICES: $5,425.00 Deceuber, 1985 payment $5,425.00 In the event that tax revenues are not recelved as anti.cipated by the Dlstrlct, the paynents hereinabove referred to sha1l be made as soon after the lnstallment or due date as the f l-nances of the Dlstrlct aIl-ow, but 1n no event later than Jsnuary 1, 1986. It 18 to be understood that the total of S10'850.00 of payoents referred to above 1s based upon the final 1983 assessed and equallzed valuatlon sithln the area deslgnated ln red on EXIIIBIT A and defl-ned on EXITIBIT B attached hereto nultlplled by the Village flre tax levy rate for the 1984 tax levy of $.56 per $100 assegsed and equallzed value, lesa a credit of $695.04 applied to prlor contractual fee. It ls further understood that upon year end verlflca- tion of the estlEations, next yearrs contract will be nodlfled upwards or dom- wards to reflect the actual assessed and equalized valuation and actual tax rate for concluding contract perlod. ARTICLE VIII That alL flre flghtlng, fire prevention, fire protection, eEergency procedures and emergency ambulance procedures conducted by the Village here- under shall be under and ln accordance with the regulatlons and ordinances of the Department, the Vll1age of Buffalo Grove, the Dlstr1ct, and also under and in accordance rrith the State Statutes and other State Regulations. In the event that the scene or emergency ls covered by the Vlll-age and any other entity having a contract with the Distrlct, the above described responsibllities shal1 be shared jointly and nutually between the respectlve Flre Chlefs. ARTICLE IV That all expenses of malDtai-nlng equipoent and apparatus, salarles, insurance premj.ums and any and alL other lteEs of expense connected wlth the services, equipnent, personnel and faclllties to be supplled by the Village shal1 be rhe total responsibil,iry of the Vlllage and the Vlllage agrees to hol-d the District harmless and to lDdennify the District wlth respect to any and all causes of action rrhlch occur from the activltles performed under thls ConEract. ARTICLE V Ttlat the sole responsl.blltty of the Distrlct under the contract Is to pay to the DepartEent the sulos calIed for under Article VII herein. ARTICLE VI That from time to tlne durlng the term of this contract the Buffalo Grove Fire Chief shall- meet rrith the truatees of the District and the r.ire Chiefs of other enEities having contracts rrith the Department so as to beneflt the publlc and to carry further the intentions and purposes of this Agreement. ARTICLE VII That for the perlod of t ine covered by this Agreement the Dlstrict agrees to pay and the VilJ,age agrees to accept in fulL and complete payment for its flre fighting and ernergency anbulance servi.ces provided hereuader the sums of $5,425.00 and $5,425.00 respectively.
