WHEREAS, the President and Board of Trustees of the Village of Buffalo
Grove desire to cause the implementation of the Buffalo Grove Road (Lake-Cook
Road to Dundee Road) Street Improvement, and;
WHEREAS, the approval of an i ntergovernmen ta I agreement for construction
is required in order to proceed with the completion of the project;
N0W, THEREF0RE, BE IT RES0LVED by the President and Board of Trustees
of the Village of Buffalo Grove, Cook and Lake Counties, Illinois that the
agreement entitled, "Agreement for Federal Project M-6003(255),, is hereby approved
and that the Village President is hereby authorized and directed to execute the

WLLAGE conpleted lhe Prelininary (Phase I) Engineering $ith its own funds.
NOI{, TEEREFORE, in consideraEion of lhe nutual covenants contained hereinr
the parties hereto agree that prior to the completion of the phase II Engineer-
ing for the PROJECT:
I. The VILLAGE shall make or cause to be nnade jU surveys and soil
investigations and prepare the necessary soii reports (in accor-
dance lri.th the COIiNTY, S .Spec if i.cations for Hi.ghway soiLs
Surveysi, adopted tlarch 20, 1957 and revised February 23, LgG5,
Addendum (Page 13), Novenber 1, 1969, and complete or cause to be
completed the plans, speci.fications and estinales in accordance

the COUNrY at Ieast once each month in order to give
the COITNTY perj,odic opportunity to revier the PROJECT
design and plan preparaCion, and thus expedite COUNTY
approval.
E. The VILIAGETS consultant shall approve shop drawings
for aII prefabricated construction itens incLuded in
the PROJECT lrhich require such approval.
TIIE PARTIES HERETO further agree that upon successful completi.on of the
Phase II Engineering and right of way acquisiEion for lhe PROJECT:

2 tne COYty, after the STATE approve" aYna"n", shall receive bid6
and award the contract for construclion of the PFOJECT, sublect to
Lhe concurrence of Che STATE. Execution of thi.s Agreement consti-
tutes the concurrence of the VILLAGE in the award of said contract
to the responsibl-e low bidder as deternined by tl,e COUNTY ano con-
currecj in by the STATE. The COUNTY shatl. furnish the resident
engineering, provioe or cause to be provided the material inspec-
tion and f j.eld proportioning during conslruction, and cause Lhe
PRO,JECT to be buiIt. in accordance eith the approved plans, speci_
fications and contract.
The VILIAGE shall assune responsibility for coordinating aII re-
quired utitity adjustment workl which responsibility shall be
I j.mited to the extent to which such responsibilities may be trans-
ferred to private utility cornpanies pursuant to exisling utility
franchise agreements. In additj.on, the VILIAGE shall exercise ita
franchise right to cause such utility adjustments to be done at no
expense to the STATE or COUNTY. The VILTAGE I S re spons ibil it ie6 in
connection with the PROJECT shaLl be as follorrs:
A. P1ans shall be sent to the utility companies, and t,he final
plans shall indicate the correct types and locations of all.
private utilities within the Iimits of the PROJECT.
B. The proposaL documents shall include a schedule entitled
'status of Utilities to be Adfusted., listing the names ano
addresses of each utility company to perform aatjustment
work, the locati,on and description of aII rork to be per_
forned, and the estinated completion date for each company.
C. Existing nunicipal utilities shall be accurately described
and located on the final plans.

regulated, on a continuing basis, in the manner set

4. The COUNTY, on Decenber 11, 1984, appropriated, by sepalaEe reso-
lution, $2r8001000.00 to pay the cosL of construcling the PROJECT
, and the VILLAGE, on April 23, 198{ appropriated 8254,000.00 to pay
its share thereof, and both agencles will in the future pass supple-
mental resolutions to provide additional. funds for their shares if
the amounLs appropriated prove to be insufficient to cover said
costs.
5. The VILLAGE shall have adopted, and have in effect prior to the
COUNTY advertising for the work to be performed hereunder, an
ordinance prohibiting parking on the improved sections of roadray.
5. The VI LLAGE shall bave adopted, and have in effect prior to the
COUNTY advertising for the work to be performed hereunder, an
ordinance prohibiting the discharge of sanitary andlor industrial
waste xater into any storm serrer constructed as a part of the
PROJECA.
7. The VILIAGE agrees not to authorize or permit any operationr. p!ac-
tice or encroachment shich wiII impeoe o! interlupt the orderly
flow of vehicular traffic on the completed PROJECT, and Lo enforce
Iocal ordinances that affect trafficsuch lraf f ic regulations and
operations thereon.

The VILLAGE agrees not to pernit driveray entrance openings to
be nade in the curb as constructed r.ithout the irritten consent
of the CoIJNTY.
The dlspo8ition of encroachnenCs, if any, shall, be cooperaEively
deterDined by representatives of the STATE, the COT NTY and lhe
VILIAGE.
The COUNTY and lhe VILLAGE agree to provide to the STATE, prior
to the COUNTY advertising for the work !o be performed hereunder,
$rriBten approval of the plans and specifications as prepared.
Upon conpletion of the PROJEC? the COUNTY agrees to ret.ain
ju!isdiction, naintenance and conLrol of Buffalo crove Road
within the linits of the PRO,IECT.
A. The VILIAGE agrees to maintain, or cause to be
maintained, all new or exiseing sidewalks, and aII
VILIAGE-oyned utilities and appurtenances.
Upon complet.ion of the tlafflc signal work incLuded in the
PROJECT and acceptance thereof by the SIATE:
A. The responsibility for naj.ntenance and electrical energy
costs for the signals at Buffalo crove Road and Dundee
Road shall conti.nue to be as outlined in the i{a6ter
AgreemenE executed by the STATE and the VILI"AGE on
February 9, L982-
B. The COUNTY shall naineain the traffic signals at'
Buffalo Grove Road and Bernard Drive.
(f) the \IILIAGE shalL pay thirry-three and one-
third Pelcent (33-I,/3$) of the mainlenance
and electricaL energy costs for said signals.

ponsibili,ties for the traffic signals included in the
PROJECT shall commence at the time eacb set of signaLs
ia turned on and accepted by the STATE, and that the
COUNTY shall make arrangements with the local poh,e r
company to furnish lhe required electrical energy for
the signals.
The COUNTv and the VILLAGE shall comply with aU applicable
Executive orders, State and Federal larrs and Regulations pertain-
ing to Equal Employment Opportunity and Nondiscr ininat ion.

of the PROTECT either the VILIAGE shall pay to the
COUNTY, in a like nanner, the renainder of said

VI LLAGE for any overpaynent, based upon final PRO\,ECT
costs.
B. The STATETS share is 12.41C of the traffic signal costs
at Buffalo Grove Road and Dundee Road (excluBive of the
emergency vehicle priority system), an anount estimated

COT NTY in accordance with current billing procedures
established for STATE-Pa rt ic ipat ion projects.

said cost.
The COUNTY agrees to naintain aLl construction records, to make
lhem available for revier and,/or audit by STATE and Federal
personnel during the PROJECT construction stage, and to retain
said records for a period of three (3) years after final accep-
tance of the PROI ECT.
The parties hereto mutually agree that fail,ure on the part of the
COUNTY and/or the VILLAGE to fulfiII the respons i.bil it ie s covered
in Items 5,5,7. LL, L2, 13 and l8 of this AgreeDent will render
the COUNTY andlor the VILIAGE ineligible for Federal-Aid partici-
pation in future highway projects for rrhich they have sinilar
responsibilities, for as long a6 such failures renain uncorrected.

subsequent amendments to this Agreement relatlve to budgetary and
other items, upon approvaf of the STATIi, as long as the anendments
do noL alter the toLa1 cost of the PROJECT or effect major changes

This Ag reement and the covenants contained herein shall becone
null and void in the event the contract covering Lhe construction
work contemplated herein is not awarded prior to JuIy 1, 1988.
