SERVICE CONTRACT BETWXEN THE VILLAGE OF BUFFAIO GROVE
AND TI1E WITEELING TOWNSHIP RURAL FIRE PROTECTION DISTRICT
WIiEREAS, pursuant to Vlllage Resolutlon No. 80-26, the Vll,lage entered
lnto an agreement wlth the Wheellng Tolrnshlp Rural Flre Protectlon Distrlct and
the then exlstln8 Buffalo Grove Fire Department, Inc. whlch agreement provlded
aoong other thlngs, for fire protectlon and ambulance servlce by the Vlllage
rrlthln certaln dl-sconnected lands frm the Dlstrlct; and,
WHEREAS, the V111age, pursuant to its llome Rule Powers, the I1l1nols Inter-
governmentaL Cooperatlon Act, and Illlnols State Statutes, deslres to provide flre
and ambulance protection to the disconoected area by contractual- servlces I and,
WIIEREAS, on March 2L, 1983, the Village Presldent and Board of Trustees
adopted Resolutlon No. 83-9 erhich authorlzed and dlrected the ?resldent and
V{l1age Clerk to execute a contract between the Vlllage arld the Dlstrlct to pro-
vlde flre and ambulance protecELon to the dlscotrnected areas, for the perlod May 1,
1983 through Aprll 30, 1984; and,
WIIEREAS, lt ls now necessary to readopt the servlce agreemeot between Ehe
Vlllage aod Dlstrlct for the period from May L, 1984 through Aprl1 30, 1985, as
anended:

SECTION 1. The Village President and villagle clerk are hereby authorized and
alirected to execute Ehe contract attached hereto as Exhiblt rt ' with the Wheellng
Townshlp Rural Flre Protection Dlstrict to Provide fire and ambulance Protectlon
for the perlod from Uay l, 1984 through Aprll 30' 1985.

FIRE PROTECTION AND EMERGENCY
AMBI'LANCE SERVICE CONTRACT
CONTRACT made and entered into this lst day of May A.D. 1984, by and
between the h,HEELING ToWNSHIP RURAL FIRE PROTECTION DISTRICT, a municipal
corporation, Wheeling Townshlp, Cook and Lake Counti.es, Illinois (hereinafter
referred to as the "District'r), and fhe VILIAGE OF BUFFAIO GROVE, a municipal
corporation, Buffalo Grove, Ill"inois (hereinafter referred to as the ',Vi1l-age,,).
WIIEPAAS, the District is a nunlcipal corporatlon organlzed and existing
under Chapter L27-l/2 of the lllinois Revised Statutes of 1975 as auendedl and
WIEREAS, the Distrlct ls empowered under such Statute to contract wlth any
corporation, adjacent fire protection district or vlllage to furnish fire pro-
tectlon services aod emergency ambulance services r,rlthin all or a portion of
the territory of the Di.strlct; and
WEEREAS, the District ls desirous of entering into a contract wlth the
Village to provj.de such fire protection services and ambulance services to a
portlon of the territory of the District; and
I.IIIEREAS, the Village is a munici-pal corporation organized and exlsting
under the Statutes of Ehe State of lllinols; and
WHEREAS, the Village has an operating fire department and emergency
ambulance service; and
. WI{EREAS, the Vl11age is desirous of entering lnto a contract with the
District to provi.de fire protection and emergency ambulance servlce.
NoW, TITEREFORE, IT IS AGREED AND UNDERSTooD by and between the District
and the Department as follows:
ARTICI,E I
Ttat for the period beginnlng on May 1' 1984 and exPiring on Aprll 30,
1985, the Village shall furnlsh al1 fire fiShting' fj.re Protectlon, fire pre-
vention and emergency ambuLance services; all fire fiShting, fire protectlon'
fire prevention and ambulance equipment; all personnel whether volunteer or
paid; and all necessary facilities !o house and administer the equipment and
personnel to be providedl necessary in the judgnent of the Village to provlde
fire protectlon and emergency ambulanee servi.ce for the territory so designated
in red on EXI{IBIT A attached'
ARTICLE 1I
Ttrat during the existence of this contract the Village shall cooperate with
the DistricE and wi-th other entlties havlng contracts with the District so as
to promote the health, safety, welfare and convenience of the publLc residing
within the territory of the District.
ARTICLE III
That the Fire Chlef of the Village shall have the sole exeluslve right and
responsibillty !o prescribe the manner of giving the alarm for fire or other
emergency in the territory designated and shal1 further have the sole and exclus-
ive authority and responslbllity to direct and control any and all flre fighting,
fire protection and preventlon and emergency ambulance operations carrj-ed on
within the territory designated in red on EXITIBIT A attached hereto. In the
event that the scene or eoergency is covered by the Village and any other entity
having a contract with the District, the above described responsib il it ies shall
be shared jointly and mutually betlreen the respective Fire Chiefs.
ARTICLE IV
That all expenses of maintaining equipment and apparatus, salaries, insurance
premiums and any and all other itens of expense connected with the serviees,
equipment, personnel and facilities to be supplied by the Village sha11 be
the total responsibility of the Village and the Village agrees to hold the
District harmless and to indemnify the District with respect to any and all
causes of action which occur fron the actlvitles performed under thls Contract.
ARTICLE V
That the sole responsibility of the District under the contract is to
pay to the Department the sums called for under Artlcle VII herein.
ARTICLE VI
That fron tLme to Eime during the term of this contract the Buffalo Grove
Flre Chlef sha1l meet with the trustees of the District and the Iire chiefs of
other entities having contracts with Ehe DePartment so as to benefit the public
and to carry further the intentions and purposes of this Agreement'
ARTICLE VIl
That for the period of time covered by this Agreement the District agrees
to pay and the Village agrees to accept ln full and complete Payment for its
fire fighting and emergency ambulance servj-ces provlded hereunder the suES of
$6,5f0.00 and $6,510.00 resPectively' The Village shall have no liabilitv for
any exPenses of the District'

In the event that tax revenues are not received as anticlpated by the
District, the payments hereinabove referred to shall be made as soon after the
installDent or due date as the fi.nances of the District allolr, but in no event
l"ater than January 1, 1985. It is to be understood that the total of $13,020.00
of payments referred to above is based upon the final 1982 assessed and equalized
valuation within the area designated in red on EXHIBIT A and defined on EXHIBIT B
attached hereto multiplied by the Village fire tax levy tate for the 1983 tax levy
of $.56 per $100 assessed and equalized value, less a credit of $1,995.70 applied
to prior contractual- fee. It is further understood that upon year end verifica-
tion of the esEimations, next yearrs contract l.rill be modified upwards or down-
wards to reflect the actual assessed and equalized valuation and actual tax rate
for concluding contract period.
Ihat all fire fighting, fire prevention, fire protection, emergency
procedures and emergency ambulance procedures conducted by the Village here-
under sha11 be under and in accordance with the regulations and ordinances of
the Department, the Village of Buffalo Grove, the District, and also under and
in accordance with the State Statutes and other State Regulat.ions.
IN WITNESS WHEREoF, the parties have caused this Contract to be executed
by their respective officers pursuant to proper authorization and having caused
their corporate seals to be affixed hereto this lst day of May A. D.' 1984.
