A RESOLUTION APPROVING THT D.M. SANTUCCI WATERMAIN EASEMENT (MILWAUKEE AVENUE
WATERMAIN)
|IHEREAS, an easement from D.M. Santucci is desired to
acconrnodate the Village's water distribution system; and,
WHEREAS, the Village is required to approve the required grant
of easement.
NotlJ, THEREFoRE, BE IT RESoLVED by the Village President and
Board of Trustees of the Viliage of Buffalo Grove, Cook and Lake Counties,
IIlinois, that the Village President and Village Clerk are hereby authorized
and directed to execute the grant of easement of which said grant is
attached hereto and made a part hereof.

GRANT OF EASEMENT
Trustee for Dorothy Santucci Estat,e Trust, clateit December 2l ,
1958, (hereinafter calleal the "crantorn), and the VILLAGE OF
BUFFAIO GROVE, an Illinois municipal. corporation (hereinafter
caIled the "Grantee " ) .
For and in consideration of the sum of TWENTY FIVE TEOUSAND
DOLLARS ($25r000.00) anil other good and valuable consideration,
the receipt of which is hereby acknowleilged, crantor hereby
grants to Grantee, its successors and assigns, a non-exclusive
right and easement in, upon, along anal under the real property
Ie9a1Iy described on Exhibit A attacheil hereto and incorporatsed
herein. Said easement shall be for the purposes of constructing,
operating, maintaining and repairing water Iines ancl for ingress
anil egress thereto for said purposes.
In atldition to the easement granted above, Grantor hereby
grants to Grantee a non-exclusive temporary work and construction
easement over the real property 1e9a1Iy described in Exhibit B
attached hereto anil incorporated herein. Said work and
construction easement shall be for the limited purposes of
constructing and installing the aforesaiil utility system and
ingress and egress thereto for the personnel and equipment
necessary or required for such construction anil installation.
Saitl temporary work antl construction easement shalI terminate
upon installation antl completion of the aforesaiil utility system.

The Grantorrs property sha11 be restored to its original
conditsion after completion of the aforesaitl utility system.
The Grantor, her successors anal assigns, sha11 have the
right to tap-in and connect to the water line constructeil by
Grantee proviileil crantor's property is annexed to the Village of
Buffalo Grove.
The Grantee hereby lrarrants and agrees not to cause any
liens, claims, suits or encumbrances against the Grantor's
property arising out of any work performed by it pursuant to this
Grant of Easement. Further, the Grantee hereby warrant.s and
agrees to indemnify antl holtl crantor harmless from any
Iiabilities, 1iens, claims, suits or causes of action arising out
of or relating to any work performed by it pursuant to this crant
of Easement, inclutling aIl costs, expenses anal aCtorneysr fees
incurred by Grantor, her successors and. assigns. SpecificalIy,
the Grantee agrees to procure all appropriate certificates of
insurance to cover all work performed by it, including
comprehensive general liability, all risk buildlers and workmens
compensation insurance. Certificates of insurance shall be
subnitted to Grantor prior t.o commencement. of any nork on
Grantorrs property.
A1I work performetl by the crantee shall be performed in
accordance with all rules and ordinances reguired by the Village
of Buffalo crove or by any other regulatory agency or governing
body and upon completion of the water line to be installeil antl
constructeil hereuntler, it shall maintain, service anal repair

Grantee hereby warranEs and represents that the water line
to be installed and constructed hereunder shall be twelve (12)
inches in size. The Grantee hereby warrants anal represents that
the water line to be constructed shall be of adequate design to
service Grantort s property describetl on Exhibit C to accommodate
a daiJ.y use to service a mixed-use development of Grantorrs
property, including commercial, office, industrial and multi-
family uses. In that respect, the Grantee agrees to have the
property tlescribed on Exhibit. C includecl withj.n the designated
service area in any applications for pernits submitted to the
Environmental Protect.ion Agency (EPA), the Department of Public
Works or any other governing body, ancl to show an estimated use
for the property described on Exhibit C based upon a mixeCl-use
development of Grantor's property, incluiling commercial, office,
industrial antl multi-family uses. Notwithstanding the above, the
Village of Buffalo crove's warranty that the water line wiII be
of aclequate design to service crantorr s property shall not apply
unless the crant.orrs property is annexed to t.he Village of
Buffalo crove.
Grantor hereby reserves the right to the use of said
property for all purposes not inconsistent with the grant herein
made and not unreasonably interfering with the exercise of the
rights hereby granted, except that no permanent builclings,
structures or obstructions may be constructed thereon.
