Santucci is desired to acconrnodate the Village's water distribution system; and, WHEREAS, the Village is required to approve the required grant of easement. The Grantee hereby lrarrants and agrees not to cause any liens, claims, suits or encumbrances against the Grantor's property arising out of any work performed by it pursuant to this Grant of Easement. In that respect, the Grantee agrees to have the property tlescribed on Exhibit. C includecl withj.n the designated service area in any applications for pernits submitted to the Environmental Protect.ion Agency (EPA), the Department of Public Works or any other governing body, ancl to show an estimated use for the property described on Exhibit C based upon a mixeCl-use development of Grantor's property, incluiling commercial, office, industrial antl multi-family uses. Notwithstanding the above, the Village of Buffalo crove's warranty that the water line wiII be of aclequate design to service crantorr s property shall not apply unless the crant.orrs property is annexed to t.he Village of Buffalo crove.
