A RESOLUTION ACCEPTING THE "AGREE}4ENT FOR RIGHT-OF-WAY ACQUISITION, FEDERAL
PROJECT M-6003(333)" CONCERNING THE BUFFALO GROVE ROAD (LAKE-COOK ROAD TO
DUNDEE ROAD) STREET IMPROVEMENT
IIHEREAS, the President and Board of Trustees of the Village of
the Village of Buffalo Grove desire to cause the implementation of the
Buffalo Grove Road (Lake-Cook Road to Dundee Road) Street Improvementi and
WHEREAS, the approval of a joint agreement with the Illinois
Department of Transportation and the County of Cook is necessary in order to
proceed with the right-of-way acquisition for the project;
NOl,rl, THEREFORE, BE IT RES0LVED by the President and Board of
Trustees of the Village of Buffalo Grove, Cook and Lake Counties, Illinois
that the agreement entitled, "Agreement for Right-0f-Way Acquisition,
Federal Project M-6003(333)' is hereby approved and that the Village Manager
is hereby authorized and directed to execute the agreement. A copy of said
agreement is attached hereto and made a part hereof.

DEPARTI{ENT OF TB,ANSPOMATION, heTeinafteT called the STATE, the COT,NTY OF COOK
of the State of Illinois, hereinafter called the Cot NTY, and the VILIAGE Ol'
BUFFATD GROVE, acting through its PRESTDENT AND BOARD OF TRUSTEES, hereinafter
called the VILLAGE.
WIIEREAS, the STATE, the COUNTY and the VILIAGE, in order to facilitate the
free flow of traffic and insure safety to Che motoring public, are desirous of
widenj.ng and otherrrise improving approxirnately L.0 mile of Buffalo crove Road
(FAU Route 2657) from Dundee Road to Lake-Cook Road, VILIAGE Section
83-00033-01-wR, Federal Project M-5003(333) (STATE Job No. R-90-035-84) (for
right of r,ay acquisi.tion) ' hereinafter called the PROJECT t and
I{HEREAS, the VILI"AGE has heretofore agreed to provide the Preliminary
Engineering and the COUNTI has agreed to receive bids, award the construction
contract and provide the Conatruction Engineering for the PROJECT, and the
STATE, the COT NTY and the VILIAGE wiII enter into separate Joint Agreenents
cover ing the engineering, construction and subsequent maintenance and juris-
diction of the completed PROJECT i and
WEEREAS, the VILLAGE, before the PROTECT can be constructed, is required to
obtain, or cause to be obtained, additional right of way.

the parties hereto agree as follorrs:
1. The VILLAGE shal1 prepare or cause to be prepared right of way
plats and legal descriptions of all fee acquisitions, condem-
nationa, easements, dedications and construction pernits to be
acquired, and shall record and register all instruments of con-
veyance (except tenporary construction pernits), all in accor-
dance with the applicable portions of the COITNTY I S Procedure
Menorandum 7.5.18 (revised July 20, L977't r a copt of which is
attached hereto as iExhibit A", subject to the folloning
revisions and additions there to 3
A. The follorring is added to Art.icle A-1: rA cover sheet
conforming to Exhibit L.02-2A of the STATETS iLand
Acquisition Manual' shall be included as Sheet Nunber I
of the Right-Of-Way P1anstr.
B. Articles A-8 (f) and B-3(f) are revised to read: rThe
appropriate Municipal and Cook County Highway Depart-
ment aPProval s ignatures'.
The VILLAGE shall also afford the COt NTy the opportunity to
revievr all plats and legal descriptions prepared by or for the
VILLAGE prior !o submission of same for approval signalures.
The VILIAGE shall obtain or cause to be obtained, in the name of
the County of Cook, the necessary right of way (including all
temporary and permanent easements) for the PROJECT in accordance
with Section 5 of this Agreement, the appticable portions of the
COTNTYIS Procedure Iitemorandum 7.5.18 (.Exhibit A,) and the
following additional requ j.renents:

Said right of iray shall be acquired in accordance with
the requirements of Tit1es II and III of the Uniform
Relocation Assistance and ReaI Property Acquisition
Policies Act of 1970. The requirements of said Titles
II and IIl shall be carried out in accoldance with
established STATE Land Acquj.sition Policies and Pro-
cedures, as now or hereinafter revised or amended.
AII deeds, permanent eaaements and dedications shall
be conveyances rFor Use by the Public for Highray
Purposesn, in the COUNTY I S name, and nust be recorded.
AlI acquisition agreements shall be approved by the
COT'NTY.
Title approval shall be provided by the COT NTY in
accordance rrith normal COT NTY procedures. In the event.
any of said acquisitions are by condennation, then such
action shall be brought by the COUNTY in its own name.
The acquisition costs for said right of way shall
include the purchase price thereof as well as the cost
of negotiators, appraisals, Commitments for Title
Insurance, forrens Certificates (where applicable) ,
recording fees, relocation assistance and palments,
property rnanagement and such legal service as may be
necessary to acquire said right of way.
AlI appraisers util,ized by the VILIAGE for this PROJECT
shall either be included in the COUNTY-approval List,
or be approved by the COUNTY. Appraisal forms used
shall be in accordance with Article 2.OZ of the STATET S
"land Acquisition Manualr. Aive (5) copies of each

appvisal received by Ehe vrLIAGe snl/r be submitted
to the COT NTY for review and aPProval of a negotiating
figure. After each appraisal is reviewed and a nego-
tiating figure approved by the COUNTY, two (2) copies
of the appraisal shall be subnnitted directly to the
STATE i S Central Bureau of Land Acquisition for revieU
and subnittal, to the Federal Highvay Mministration,
rrith a copy of the letter of transnittal forwarded to
the District Engineerrs office. At any time follovring
this submittal the VILLAGE nay initiate negotiations
for the purchase of the parcel involved.
If necessary, relocation assistance and payments shall
be provided for aII individuals, fanilies and
businesses dispJ.aced by reason of the construction of
the PROJFcT, in accordance rrith established State
Relocation Assistance Procedures. Any phase of the
staters Relocation Assistance Procedures to be per-
formed by any qualified agency other than the STATE
shall be covered by separate contractual agreement or
agreements with said agency and are subject to prior
approval of the Federal Highray Mministration.
llanagement of said right of way, including but not
Iimited to rental or disPosal of improvenents located
thereon, pending its use for the PRorEct or any part
thereof, shall be in accordance rrith STATE ProPerty
!4anagemen! Procedures. The VILLAGE, by virtue of its
participation j.n the cost of the right of way, shall
receive a credit for a ProPortionate anount of the

vvproceeds of any sale or rental of imProvenents acguired
within said right of rray, or as a direct result of the
right of rray acquis ition.
H. Prior to the CoITNTY advertising for lhe construction
irork to be perforned on the PRo,JECT, the VILLAGE sha1l
certify to the COUNTY that all necessary right of eay
has been secured, paid for and vacated, and aLl
requirenents of titles II and III of the aforementioned
Uniforn Act have been conplied with. The COI,NTY in
turn, shall certify to the STATE that the VILIAGE has
conplied rrith said requirements. The COIiNTY rrill
advert.ise for bids after these certifications by the
VILLAGE and the COT NTY have been accepted subject to
approval by the Division Administrator of the Federal
Higheay MninistraEion.
I. The STATE and the COUNTY shalL provide such guidance,
assistance and supervision, and monitor and perform
audits, to the extent necessary to assure validity of
the certification, by the VILIAGE, of conpliance with
the requirements of Titles II and III of the aforesaid
Act .
J. All right of way costs which are later deternined to be
ineligible for Federal participaEion due !o cited
deficiencies in some facet of the acquisj.tion process
shall be borne 100t by the VILLAGE.
The VILIAGE has appropriated, or shall appropriate, such funds as
are necessary to pay it.s share of the cost of the right of way
acquisition for the PROTECT, and shall keep conplete and accurate
records of these costs.

A. The STATE shall reimburse the VILIAGE for the federal
share of the cost of each parcel of right of h,ay as it
is acquired, provided that the invoice for said parcel
clearly defines Ehe cost involved and includes evidence
of palment by the vrLr,AGE.
