A RESOLUTION ACCEPTING A PROPOSAL FOR APPRAISAL SERVICES FOR PROPERTY
ACQUISITION FOR THE BUFFALO GROVE ROAD (LAKE-COOK ROAD TO DUNDEE ROAD)
STREET IMPROVEMENT
I,{HEREAS, the Village President and Board of Trustees of the
village of Buffalo Grove desire to have the Buffalo Grove Road (Lake-cook
Road to Dundee Road) Street Improvement implemented; and,
WHEREAS, the approval of an agreement for property acquisit.ion
appraisal services is required in order to proceed with the implementation
of the improvement;
NOl.l, THEREFORE, BE IT RES0LVED by the Viltage president and Board
of Trustees of the village of Buffalo Grove, cook and Lake counties, Illinois
that the agreement for appraisal services entitled, "proposal for Appraisal
Services" is hereby accepted and that the village l'lanager is hereby authorized
and directed to execute the agreement. A copy of said agreement is attached
hereto and made a part hereof.

4. It is understood that appearances in court and pretrial conferences nay
be required in relation to the appraisal services called for hereln and it is
agreed that such appearance or appearances shal,L be made upon request ofVlllage or lts trlal counsel.
5. Appraiser wlII no! furnlsh a copy of any appralsal, or reveal the find-ings or results contalned thereln to any other person or agency unless author-

6. construction sectlon, countyr Job nunber, proJect number and parcel numbers.
Invoices for servlces 1n connecLlon wlth pre-trial conferences and court
testlmony lriLl show bhe ilems lisled above and, Ln addition, wilt lnclude a
statenenb of the nature of servlces performed and anount of tine thereon.
8. Appralser warrants bhat he has not eDployed or retalned any coEpany or
person, other than a bona flde employee worki.ng solely for hln, to sollclt or
secure thLs contracg, and that he has not pald or agreed to pay any conp.rny or
person, other than a bona fide enployee worklng so1ely for hln, any fee,
coDmission, percentage, brokerage fee, glft, or any other conslderation,
contingent upon or resulting froo the award or naklng of thls contnact. For
breach or vlol.ation of thls rarranby, V111age shall have the right Uo annul
fhls contract wlthout llabltity.
9. Appraiser hereby certifles for hlnself and the lndlvidual named ln Item 2
above that he has no lnterest, present or contenplated, in any of the afore-
nentloRed parcels. If any conflicl of interest arlses, he w111 lmmedlately
lnform the Vlllage and return all naterlal,s furnished to hln for re-assignnentto others.
10. Any dlspute concernlng a question of fact arlsing under thls proposal
sbalL be decided by the Vlllage Manager for Vl1lage accepblng thls proposal
and such declslon shall be final and concluslve,
1'1. Changes 1n Uhe work to be perforned under thls proposal Eay be oade at
any tL6e 1n wrltlng by Vlllage. If such changes Justify an increase or
decrease in the charges set forth on E(hiblt A hereof, an equitabl,e adjusbnent
sha1l be Eade and thls contracb shall be modifled accordingly. DocuBentation
whlch ls considered lnadequate wlll be augnented and errors will be corrected
upon request rrlthout addiiionaL cost.
12. Village may termlnate thls proposal at any tioe and for any cause by a
notice in writlng to Appraiser. In the event of such teroination, paynentlrilI be made to Appralser for the appralsals whlch have been completed.
Appraisals ln the process of coEpletion shaLl be conpensated for on an eqult-abre basia and aLr incomplet,e revlew appralsars and data collected ln connec-fion rrlth theB shall be lurned over and become the property of VilLage;provided' however, that shourd this proposar be terninated solely because Lheprogress or quality of the work 1s unsatj-sfacbory as deternined by theVltlage, then no paymen! w1II be nade or denanded by Appralser for any ap_pralsal reports whlch have not been conpleted and delivered to vi.llage prlor!o t'he date of sald ternlnation. rn no event, shal1 thi-s be constrJe<l thatAppraiser cannot retain a copy of the data and appralsals for hls flles.

15. In bhe event this proposal is acceptedr it shall constltute a conLracl as
of the date it 1s accepted by the Vlllage and shalI be blndlng on Appraiser,
hj-s execubors, admlnistrators, successors or asslgnsr as may be appllcable.
16. IL ls understood and agreed that Exhlbit B shall be a par! of this con-
bract and Appralser agrees to be bound by the terns and provisions contalned
lherein; all references j.n E)(hibit B to the State of llllnols and its Depart-
nent of Transportation shall also include tbe ViIIage of Buffalo Grove.
17. Appnalser ls hereby notifled that Vllla8er in accordance with the provi-
slons of Tltle vI of the clvil Rights AcL of 1964 (78 Stat. 252) and the
ReguLations of the Department of Connerce (15 C.F.R.' Part 8), issued pursuant
to such Act, wlll afflrnatively insure that any contract entered lnto pursuant
to this proposal wj.11 be awarded to the lorrest responslble bldder flithout
dlscrlnination on the ground of race, color or natlonal origln.
