1984-02-06 - Resolution 1984-05 - ACCEPTING THE AGREEMENT FOR PHASE 1-B ENGINEERING SERVICES FOR THE BG RD (LAKE-COOK TO DUNDEE) STREET IMPROVEMENTRESOLUTION NO. 84-5 A RESOLUTION ACCEPTING THE AGREEMENT FOR PHASE I-B ENGINEERING SERVICES FOR THE BUFFALO GROVE ROAD (LAKE.COOK ROAD TO DUNDEE ROAD) STREET IMPROVEI'1ENT WHEREAS, the President and Board of Trustees of the Village of Buffalo Grove desire to cause the implementation of the Buffalo Grove Road (Lake-Cook Road to Dundee Road) Street Improvement, and; WHEREAS, an agreement with a consulting engineer for Phase I-A services was approved on November 2l , 'l983, and; WHEREAS, an additional agreement with the consulting engineer for Phase I-B services is required in order to proceed with the necessary engi neeri ng of the projecti NOl.l, THEREFORE, BE IT RES0LVED by the President and Board of Trustees of the Village of Buffalo Grove, Cook and Lake Counties, Illinois that the Pres'ident and Clerk be, and they are hereby authorized and directed to execute the "Agreement for Consultant Services Between the Village of Buffalo Grove and Midwest Consulting Engineers, Inc." (SP 1.1.8) wherever the word DEpARTuENf is used, it shall be constructed to mean the VILLAGE, except the word DEPARTMENT shall also include fDOT in Subsections 2.!2, 2.24, 2.3L, 2.32, and Section 6 of the STANDARD PROVISIONS, in its entirety. 1.1.8 Combined Re rt - Report that contains both 7.2 (S.P. 2.11) The following is added: I'or the conduct of environmental studies and prepara_ tion of environmental reports, fuIIy gual_ified persons who are not registered in anycategory may be employed in responsible charge of elements of such work. -6- 7.1 .7 the Corridor Location Studies and the Design Location Studies. The is contained supp lementa 1 in the STANDARD of work to this work for Preliminary Right-of-Way for the PROJECT covered bythis AGREEMENT shall be completed as set forth applicable provisions of Section 6 of the PROVISIONS and applicable provj.sions amended below. 2. t.r (S.P. 6.tI8) This work shal1 include preparation of p: eli.minary right-of_way acquisition p1ans, plats and lega1 descriptions for ten (,.0) parcels. The work will also include c ct,rj.ning titJ.e letters, obtai,ning windshield appraisals and preparing preliminary right-oi-way acquisition costs for securing programming of Eederal funds. The work shal1 be performed in accordance with Section 6.48 of the STANDARD PROVISIONS. -7- 2.L.2 The CONSULTANT shal1 exclusively furnish to the VILLAGE, all reports, data, or other information prepared, obtained or assenbled by him under this AGREEIiENT, unless otherwise directed by the VILLAGE. 3. Project Schedule The CONSULTANT shall commence work within five calendar daysafter date of authority to proceed. The work wiII be completed within the following period: Authority to proceed is estimated to be received by March 11984. On this basis, the work is scheduled to be by April 15, 1984 (1t calendar months). comp leted 4. Prime Compensation 4.1 Phase 1 Subject to an Upper Limit of Compensation of 9L2,776, the CONSULTANT shaLl receive, as fulL payment for completing the phase I work reguired of him under this AGREEIT{ENT, reimbursement of his eligible actual costs j,n accordance with Section2.45 of the STANDARD PROVISIONS, plus a Fixed Anount of S1,067 (see Exhibit D). The retainageprovisions contained in Section 2.42 of the STANDARD PROVISIONS shall not apply to Direct Non-Salary Costs. -8- 5.2 5.3 The Prine Compensation may be increaseat or decreased by subseguent agreement betrdeen the contractual and approving parties if there iE a major change in the scope, character or complexity of the work. prime Compensation nray be adjusted by Phase in accordance uith Section 2.21 of the STANDARD PROVISIONS if the duration of the work in any phase extends more than six months beyond the date of completion stated in Section 4 of this AGREEIIENT due to no fault of the CONSULTANT. When requested by the VILLAGE, the CONSULTANT shalI prepared and submit a cost estimate for such extra work. In the event the CONSULTANT, upon written order from the VILLAGE, is required to perform Extra Work, he shall, in addition to the prime Compensation, receive payment for such Extra Work on the following basis: Subject to a pre-agreed Upper Linit of Compensation for each item of Extra Work, the CONSULTANT shalI be paid at the specified hourly rates of pay for each class of employee as Iisted in Exhibit 'An for the actual time the CONSULTANT directly utilized each such employee on the Extra Work, plus the CONSULTANT, s payroll burden and overhead -9- t. co6ts as listed in Exhibit B and C, plus actual expenses for transportation, subsistence, and electronic computer service incidental to the Extra Work.
