IDOT - Department of Transportation, State of I11inois. -4- 1.1.5 Section 4 (F ) Land - An y land from a public 1.1.6 Environmental Assessment - An y action that is not classified as a Categorical Exclusion and for which the Environmental Studies and early coordination indicate that the proposed action will not have a significant impact on the guality of human environment. 1.1.7 (SP 1.1.8) wherever the word DEPARTMENT is used, it sha1l be constructed to mean the VILLAGE, except the word DEPARTUENT shall also include IDOT in Subsections 2.12, 2.24, 2.31 , 2.32, and Section 6 of the S?ANDARD PROVISIONS, in its entirety. 1.1.8 Combined Report - Report that contains both the Corridor Location Studies and the Design Location Studies. A combined report is prepared for projects in which only the existing corridor is feasible. 1. .2 -5- I I r I i park, recreation area, wildlife and leater fowl refuge or historic site which a trans- portation plan or project proposes to use (From the Department of Transportation Act, 1966) (S.P. 2.11) The following is added: For the conduct of environmental studies and prepara- tion of environmental reports, fully qual- ified persons who are not registered in any category may be employed in responsible charge of elements of such work. 1.3 (S.P. 2.411 2.41 is deleted anct the following inserted in its place: The CONSULTANT shall invoice the VILLAGE. 2.0. Scope of Consultant Services 2.L Scope of Work - Phase 1 Upon receipt of vrritten authorization of notice to proceed, the CONSULTAI{T sha11 provide the services for environmental studies and reports. The studies and reports for the PROJECT shall be completeal as set forth in applica- b1e provisions of 3, 4,5, and 7 (revised) of the STANDARD PROVISIONS and applicable provisions amended below. 2.7.L (SP 3) Information shall be assembled in accordance with Section 3.2. Sections 3.1, 3.3r 3.4,3.5, and 3.6 are not applicable provisions of this AGREEMENT. 2.1.2 (SP 4.1) Section 4.1 of the STANDARD PRo- VISIONS is deleted, since this is a combined corridor antl design location study and report . (SP 4.2) Topographic base maps developed by field survey methods will be provideil by the Since this PROJECT reguires a Combined Corridor and Design Location Report and a Cornbined Hearing and since the Corridor aspects of the Report are limited, the Design Locat:on Study wilI cover detailed variations over the entj.re length of the pRoiIEcT. It is anticipated that one design will be studied in detail and that variations to this design in several locations will also be studied for the entire length of the PROJECT. 2. L.3 -6- 2.t.5 2.L.6 CONSULTANT. The field survey wi1l be per- formed in accordance yri.th Sections 6.21 and 6.22 Of thE STANDARD PROVISIONS. ACTiAI mosaics or plans at a scale of l" = 5Or hrill be inc1uded to show aLternate designs. (SP 4.3) The first sentence of Section 4.3 of the STANDARD PROVISIONS is changeil to read,nUsing the existing corridor and location, study all feasible alternate designs to elimj.nate all those which are not accept- ab1e". Add to Section 4.30 b, "No action on land protecteil by Section 4 (f) or requiring an Environmental Impact Statement under the Department of Transportation Act is known to be included or required in this PROJECT. In the event that a Section 4 (f) Statement or Environmental Impact Statement is required, it will be paid for as Additional Work. (SP 4.32) A preliminary pavement evaluation and report will be required. The work will be completed in accordance with the applicable portions of Sections G. 23 (c) , 6.23 (d) and 6.23 (e) of the STANDARD PROVISIONS. Cost for the work will be included in the Prime Conpensation. (SP 4.33(d)) Add: This work sha1l include the evaluation of flood plain encroachments in accorilance with FHPM 6-7-3-2. (SP 4.35) The following is added to Section 4.35: "A11 watershed areas affecting the proposed improvement sha1I be identified and shown on a DraS.nage Map. This map will -7- 2.7.7 2.t.4 2.1.8 2. t.9 2.1.10 include the drainage area flood plains if ?.y, preliminary storm sewer design, and required openings for all streams crossing the proposed improvement. preliminary applications to the IDOII Divisi.on of Water Resources and Army Corps of Engineers will be made. Final permits will be obtain during the final design of the PROJECT. ', (SP 4.61 & 4.62) The CONSUITANT shall furnish ten copies of the Draft Report for review by the VILLAGE, IDOT and FEDERAL HIGHWAY ADMfN- ISTRATION. After approval , he sha1l furnish 15 copJ.es of the Final Report. (SP 5.3) This section is modified to read, 'Study all feasible alternate designs in sufficient detail to eliminate those which are not acceptable. For the remaining alternates, follow the same procedure as outlined in Sections 4.3, 4.4, 4.5 and 4.6 as modified and expanded in the AGREEMENT". The work r^rill be completed within the following periods: Phase I - Authority to proceed is estimated to be received by December 1, 1983. On this basis, phase 1 is scheduled to be completecl by April 15, 1984 14\ calendar months) . 4. Prime Compensat j.on Subject to an Upper Limit of Compensatj.on of $51,548, the CONSUITANT shalI receive, as ful1 payment for completing the Phase 1 work required of him under this AGREEMENT, reimbursement of his eligible actual costs in accordance with Section 2.45 of the STANDARD PROVISIONS, plus a Fixed -9- The CONSULTANT shall assist the 1ega1 counsel of the VILLAGE in the review of project- related documents as necessary. 3. Project Schedule 4.1 Phase 1 5.2 5.3 Arnount of$s,792 (see Exhibit D). The retainage provisions contained in Section 2.42 of the STANDARD PROVISIONS shalI not apply to Direct Non-SaIary Costs. The Prime Compensation may be increased or decreased by subsequent agreement between the contractual and approving parties if there is a major change in the scope, character or cornplexity of the work. Prime Compensation may be adjusted by Phase in accordance with Section 2.21 of the STANDARD PROVISIONS if the duration of the work in any phase extends more than six months beyond the date of completion stated in Section 4 of this AGREEMENT dUE tO NO fAUlt Of thE CONSUTTANT. In all j,nstances where the VILLAGE sha11 request specific services of the CONSULTANT, the CONSUITANT sha1l indicate to the VILLAGE whether the work shall be considered 'Extra Workn. When reguested by the VILLAGE, the CONSULTANT shal1 prepared and submit a cost estimate for such extra work. fn the event the CONSULTANT, upon \rritten order from the VILLAGE, is reguired to perform Extra t{ork, he shall, in addition to the prime Compensation, receive payment for such Extra Work on the following basis: Subject to a pre-agreed Upper Limit of Compensation for each item of Extra Work, the CONSULTANI shaIl be paid at the specified hourly rates of pay for each class of employee as listed in Exhibit nA" for the actual time the CONSULTANT directly utilized each such employee on the Extra Work, plus the CONSULTAIiIT i s payroll burden and overhead - 10- costs as listed in Exhibit B and C, plus actual expenses for transportation, subsistence, and electronic computer service incidental to the Extra Work.
