TO THE PRELIMINARY PLAN ORDINANCE NO.
1993.065 TO ALLOW CONSTRUCTION OF A
WOODEN DECK IN THE REAR YARD AT 85 S

WHEREAS the Village of Buffalo Crove is a Home Rule Unit pursuant to the
lllinois Constitution of l97O; and
WHEREAS The Malnati Organization, LLC is the owner of the Property; and
WHEREAS in 1993, the Village Board approved Ordinance No. ]993-065
granting a preliminary plan for the expansion of the Lou Malnati's building and
parking lot at 85 S Buffalo Crove Road; and
WHEREAS the Planning & Zoning Commission held a public hearing on June.l8,2025, concerning the request; and
WHEREAS the Planning & Zoning Commission determined that the request
for preliminary plan approval was appropriate for the property and compatible with
adjacent properties, as described in the minutes attached hereto as Exhibit C; and
WHEREAS the Planning & Zoning Commission voted 8-O to recommend
approval of the requested Amendment to the Preliminary Plan; and
WHEREAS the Corporate Authorities of the Village of Buffalo Crove hereby
determine and find that the requested Amendment to the Preliminary Plan is
reasonable and will serve the best interests of the Village; and
WHEREAS the proposed Amendment to the Preliminary Plan approved by
Ordinance No. 1993-065 shall be in accordance with and pursuant to the following
exhibits:

WHEREAS 85 S Buffalo Crove Road, Buffalo Crove, lL ("Property") is a stand-
alone restaurant building in the BJ: Limited Retail Business District and is
hereinafter legally described in Exhibit A; and
WHEREAS The Malnati Organization, LLC, ("Petitioner") has filed a petition
requesting an amendment to Ordinance No. 1993-065 to construct an approximately
3,2OO square foot wooden deck with a pergola in the rear yard for outdoor dining at
the subject property; and

NOW THEREFORE BE lT ORDAINED by the President and Board of Trustees of the
Village of Buffalo Crove, Cook and Lake Counties, lllinois, as follows:
SECTION 2. The Corporate Authorities hereby adopt a proper, valid, and binding
ordinance approving an Amendment to the Preliminary Plan Ordinance No. 1993-
O65 to allow construction of a wooden deck and pergola in the rear yard for outdoor
dining at 85 S Buffalo Crove Road, Buffalo Crove, lL, subject to the following
conditions:
1. The proposed development shall be constructed in substantial conformance
with the plans attached and in accordance with Section 16.20.070 of the
Development Ordi nance.
2. Final Engineering plans shall be revised in a manner acceptable to the Village
as required.
SECTION 3. lf any section, pa rag raph, clause or provision of this Ordinance shall be
held invalid, the invalidity thereof shall not affect any other provision of this
Ord ina nce.
SECTION 4. This Ordinance shall be in full force and effect from and after its passage
and approval and shall not be codified.
