2025-07-21 - Ordinance 2025-084 - APPROVING AN AMENDMENT TO THE PUD AND PRELIMINARY PLAN APPROVED BY O-87-44 AND MODIFIED BY O-93-82, WITH A ZONING VARIATION FOR 720 W LAKE COOK ROAD - Epicure Dining, LLC 720 W Lake Cook Rdh,\'ca - BUFEAI.O GROVE oRDtNANCE 2025-OA4 AN ORDINANCE APPROVING AN AMENDMENTTO THE PLANNED UNIT DEVELOPMENT ANO PRELIMINARY PLAN APPROVED BY ORDINANCE NO. 87-44 AND MODIFIED BY ORDINANCE NO.93.A2, WITH A ZONING VARIATION FOR 72O W LAKE COOK ROAD Epicure Dining, LLC 72O W Lake Cook Rd WHEREAS the Village of Buffalo Crove is a Home Rule Unit pursuant to the lllinois Constitution of l97O; and WHEREAS 72O W Lake Cook Road, Buffalo Crove, lL ("Property") is a l.I-acre site in the Bl Business District which is currently vacant, improved with a stand- alone restaurant building and surface parking lot and is hereinafter legally described in Exhibit A; and WHEREAS Epicure Dining, LLC, ("Petitioner") has f iled a petition, to open and operate a 6,600 square foot banquet facility and restaurant use at 72O W Lake Cook Road on the Property, and is requesting the following approvals: l. An amendment to the Planned Unit Development and Preliminary Plan previously approved by Ordinance 1987-044 and modified by Ordinance t993-O82; and 2. To be permitted to operate a banquet facility, 3. The following Variation f rom the Zoning Code: a. Section 17.36.040 to allow fewer parking spaces than are required for an eating and drinking establishment; and WHEREAS the Planning & Zoning Commission made findings and determined that the testimony and exhibits presented by the petitioner at the public hearing demonstrated support for the requested development as set forth in the minutes attached hereto as Exhibit C; and WHEREAS the Planning & Zoning Commission voted S-O to recommend approval of the requested amendment to the planned unit Development and Preliminary Plan approved by ordinance Ba7-44, as modified by ordinance 1993-82,with a zoning variation; and WHEREAS the corporate Authorities of the Village of Buffalo crove herebydetermine and find that the requested amendment to the pranned Unit Page t of 5 smart with heart. 50 Raupp Blvd, Buffato Crove, tL 60O89 \ 847-459_2500 , vbg.otg WHEREAS the Planning & Zoning Commission held a public hearing on luly 2,2025, concerning the request; and Development and Preliminary Plan with a zoning variation is reasonable and will serve the best interests of the Village; and WHEREAS the proposed Epicure Dining Banquet and Restaurant shall operate in accordance with and pursuant to the following exhibits: EXHIBIT A Legal Description of the Property EXHIBIT B Plan Set NOW THEREFORE BE lT ORDAINED by the President and Board of Trustees of the Village of Buffalo Crove, Cook and Lake Counties, lllinois, as follows: SECTION l. The fore going recitals are hereby adopted and incorporated and made a part of this Ordinance as if fullysetforth herein SECTION 2, The Corporate Authorities hereby adopt a proper, valid, and binding ordinance approving the amendment to the Planned Unit Development and Preliminary Plan previously approved by Ordinance BA7-O44 and modified by Ordinance 1993-082, with a Variation to the Zoning Code, to allow Epicure Dining, LLC, to open and operate a banquet facility and restaurant at 72O W Lake Cook Road, subject to the following conditions: .1. The banquet and restaurant facility shall be operated in substantial compliance with the business description and plans provided as part of this petition. 2. The Planned Unit Development approval is granted to Epicure Dining, LLC to operate a banquet and restaurant facility at 72O W Lake Cook Road, which shall not run with the land. 3. The Planned Unit Development Ordinance shall become null and void if the parking agreement between the 75O W Lake Cook Road property owner and Epicure Dining, LLC at72o W Lake Cook Road is terminated. 4. Event parking shall be limited to on site and those spaces allowed via parking agreement with neighboring property owners. sEcrloN 3. lf any section, paragraph, clause or provision of this ordinance shall beheld invalid, the invalidity thereof shall not affect any other provision of this Ord ina nce.
