AN ORDINANCE APPROVING A SPECIAL
USE FOR A CHILD HOME DAYCARE IN THE
R-9 RESIDENTIAL ZONING DISTRICT

WHEREAS the Village of Buffalo Crove is a home rule unit pursuant to the
lllinois Constitution of l97O; and
WHEREAS the real property ("Property") is zoned R-9, and is occupied by a
single-family detached residence commonly known as 456 Chicory Lane, and is
hereinafter legally described in Exhibit B; and
WHEREAS Katerina Shafran is the owner of the Property and
WHEREAS Katerina Shafran ("Petitioner") who resides at the property has
petitioned the Village for a special use to operate a child home daycare at the
Property; and
WHEREAS the Village Planning & Zoning Commission conducted a public
hearing on March 5,2025 concerning the petition for approval of the Special Use; and
WHEREAS the Planning & Zoning Commission voted 9 to O to unanimously
recommend approval of the requested Special Use; and
WHEREAS the President and Village Board of frustees after due and careful
consideration have concluded that the proposed Special Use is reasonable and will
serve the best interest of the Village; and
WHEREAS the proposed use shall be operated in accordance with and
pursuant to the following exhibits:

WHEREAS the Planning & Zoning Commission made findings and determined
that the petition meets the criteria for Special Uses and Special Uses for Home
Daycares as set forth in the Buffalo Grove Zoning Ordinance, as described in the
minutes attached as Exhibit D; and

NO\,v THEREFORE BE lT ORDAINED by the President and Board of Trustees of the
Village of Buffalo Crove, Cook and Lake Counties, lllinois, as follows:
SECTION 2. The Corporate Authorities hereby adopt a proper, valid, and binding
ordinance approving the Special Use for the Property at 456 Chicory Lane, Buffalo
Grove, lL, subject to the following conditions:
l. Petitioner shall comply with the standards set forth in Section 17.12.141, Section
fi.2A.O4O and Section 17.2A.060 of the Village Zoning Ordinance.
4. The special use shall be automatically revoked if the Petitioner fails, for any
reason, to have a valid license issued by the lllinois Department of Children
and Family Services (lL DCFS).
5. The Petitioner shall obtain a Village business license to continue the operation
of the child daycare home and shall renew the business license annually.
6. The special use does not authorize any use in violation of any covenants
running with the Property.
7. No person who has been convicted of a felony or misdemeanor involving
violence against a person shall be permitted to reside in the day care home at
any time, on a temporary or permanent basis, or otherwise be allowed to be
present in the day care home at any time when children are present. The
petitioner must agree to permit the Village of Buffalo Crove to conduct, or
cause to be conducted, a criminal background check of every person residing
in the day care home.
SECTION f. This Ordinance is made pursuant to and in accordance with the Village's
Zoning Ordinance and the Village's Home Rule powers. The preceding whereas
clauses are hereby made a part of this Ordinance.
2. The special use shall continue in effect until the conclusion ofthe current
calendar year, followed by an additional period of two (2) years subsequent to
the end of the year in which this Ordinance is re-authorized. The petitioner is
required to submit an application to the Village for the re-a uthorization of the
special use in accordance with Section 17.28.O6O.C of the Village Zoning
Ordinance every two (2) years at the conclusion of this calendar year, in order
to be re-authorized alongside the other Village Home Day Cares.
3. The petitioner shall maintain their DCFS license. A copy of the DCFS license
shall be provided to the Village annually prior to the issuance of a business
license.

8. Petitioner shall maintain the Property in full compliance with Village property
maintenance standards at all times, as determined by the Village in its sole
discretion.
9. This special use is granted to Katerina Shafran. Said special use does not run
with the Property and is not granted to any business entity. Said special use is
not transferable to another person or entity, and may not be used by any
other person or entity.
SECTION 3. lf any section, paragraph, clause or provision of this Ordinance shall be
held invalid, the invalidity thereof shall not affect any other provision of this
Ordinance.
SECTION 4. This Ordinance shall be in full force and effect on and after its passage
and approval, subject to the Petitioner's execution ofthe Acceptance and
Agreement attached hereto as Exhibit A, incorporated herein and made a part
hereof, and the filing of said executed Acceptance and Agreement form with the
Village. This Ordinance shall not be codified.

Katerina Shafran does hereby accept and agree to abide by and be bound by each of the terms,
conditions, and limitations set forth in this Ordinance, duly passed and approved by the Village of
Buffalo Grove, Illinois, authorizing the special use for the child home daycare at 456 Chicory Lane.
The undersigned acknowledges that she has read and understands all of the terms and provisions of said
this Ordinance, and does hereby acknowledge and consent to each and all of the provisions, restrictions,
and conditions of said Ordinance.
