MINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE
VILLAGE OF BUFFALO GROVE HELD IN THE COUNCIL CHAMBERS, 50 RAUPP BOULEVARD,
BUFFALO GROVE, ILLINOIS ON WEDNESDAY, JUNE 19, 2019
Call to Order
The meeting was called to order at 7:30 PM by Chairman Frank Cesario
Public Hearings/Items For Consideration
1. Consider a Variation for a 6' High Fence in the Rear Yard for 605 Patten Drive (Trustee
Johnson) (Staff Contact: Chris Stilling)
Ms. Chow (605 Patton Drive) presented on behalf of her son and sworn in. Ms. Chow
stated that they want a privacy fence. Chairperson Cesario clarified that this fence is
for a fence that was put in the rear yard of 605 Patten Drive without a permit.
Ms. Chow explained she wanted coverage and privacy from her neighbors and did not
know that they needed a permit for the fence because it was their first time. They
bought at 6’ fence because the stores only showed a 6’ fence.Chairperson asked why
they put up a white fence. The discussion was opened to the commissioners.
Ms. Chow explained that the white fence looks clean and nice.Com. Khan asked when the
residents moved into the house and if there was an existing fence.
Ms. Chow said she had been there for two years and there was an existing fence that was
5’.Com. Khan asked what kind of shape the fence was in Ms. Chow installed the fence
because she wanted privacy
Ms. Houseline was sworn in.Com. Weinstein asked what contractor or company installed
the fence. Ms. Chow said the person who installed the fence is a friend/handyman. Com.
Weinstein asked if the rest of the fence was chain link.Ms. Chow answered that the rest of
the fence is chain link. Com. Moodhe asked staff who made a complaint. Staff responded
that the complaint was anonymous.Com. Moodhe asked the other in the audience if they
were also neighbors.
Chairperson Cesario invited the residents to come up and state their name and address.
Bonnie, Mr. Smith and Ms. Spence were sworn in. Chairperson Cesario entered the

Ms. Spence brings up pictures that she has taken from her backyard showing the different
fences she can see in her backyard. She discusses she doesn’t mind the 6’ fence, however,
she does mind the other remaining fences and poorly installed new 6’ fence. Mr. Smith said
that weeds grow between the different fences. Bonnie discusses that the gap in the fence is
from the slop in the yard.
Com. Khan asked if Ms. Chow can work on maintaining the year between the fences. Ms.
Houseline said she would help Ms. Chow.
Mr. Smith and Ms. Spence discuss their dislike for the different levels of fence and the
poorly installed fence as well as the weeds in between the fences.
Staff explains they will have an inspector come out and assess the slop and the level of
the fence and that they maintenance of the space between the fences will be enforced
by the ordinances in the Village Code.
Ms. Spence sent pictures to Village Staff to see the different levels of fences in the rear
yard as well as the gap under the fence.The commissioners and neighbors discussed
the pictures assessing the different fences, the gap under the fence as well as th e
needed maintenance between the fences in the rear yard.
Com. Weinstein discussed the different options the commissioners could take and the
possibility of conditions.
Ms. Chow said she understood the options and the conditions that are possible
Ms. Spence and Mr. Smith clarified they do not mind the 6’ fence as long as the gap was
fixed.
Chairperson Cesario discussed the levelness of the fence and the maintenance between
the fences.Bonnie discussed that they would figure out the maintenance between the
fences.
Ms. Spence clarified that she does not like the look of the three fences stacked up on
each other.
Chairperson Cesario asks the commissioners if they are comfortable or uncomfortable
with the 6’ fence in the rear yard.Com. Khan states that a 6’ fence is common in that
area and is in favor of the variance.
All members of the Planning and Zoning Commissioners agree, they are in favor of the
variance as well as the neighbors figuring out the maintenance for the yard between the
fences.
Chairperson Cesario entered pictures in as Exhibit Group Two.

Com. Weinstein made a motion to grant a variation for a 6’ solid fence installed on the
rear property line of the subject property subject to conditions.
1. The petitioner removes chain link fence in the rear yard

Commissioner Khan seconded the motion.
Chairperson Cesario summarizes the conversation and thanks everyone for being
productive.
2. Consider a Variation for a Fence at 50 Park Avenue (Trustee Weidenfeld) (Staff Contact:
Chris Stilling)
Mr. and Ms. Thakkar are sworn in.
Ms. Thakkar described the fence they wanted to install on their corner lot for safety and
privacy. She also explained that during the night, people can see into their home from
the street. They want to go 1’ off of the property line to include their flowerbed.
Chairperson Cesario mentioned that a 4’ fence all the way around.
Mr. and Ms. Thakkar are okay with the 4’ fence but would like to include the flowerbed.
The Village Attorney clarified that the variation request is only for a 5’ board on board
fence which encroaches into the corner yard setback along orchard lane and that
anything else would have to be a separate request.
Rati, Associate Planner, said the issue is really a line-of-sight issues.
Chairperson Cesario described the request and the portion of the setback.
Com. Weinstein asked if the neighbors are aware of the request. Mr.
Thakkar said that they had the signs out and the neighbors are okay with
the request.
Chairperson Cesario discussed the design of the fence as well as the corner lot and the
setback.Com. Moodhe states that he is okay with the setback Com. Khan states that
he is okay with the setback as well.Mr. and Ms. Thakker are okay with the variation
they are requesting.
Chairperson Cesario entered the Village Staff report as Exhibit One. The public
hearing was closed at 8:49 PM
Com. Weinstein made a motion to grant approval for this variation to install a 5 foot
board on board fence setback 4’ feet from the property line along Orchard Lane:
1. The fence shall be installed in accordance with the documents and plans submitted as
part of this petition.
3. Consider a Variaition for the Fence in the Corner Side Yard at 720 Checker Drive
(Trustee Weidenfeld) (Staff Contact: Chris Stilling)

Mr. Buganza explains that his request for a 5’ board on board fence which encroaches
into the corner yard setback along Country Lane.
Con. Goldspiel asked about the staff recommendation.
Rati clarified that staff recommends a 5’ fence and that a 5’ fence was approved for the
neighbors.
Com. Moodhe understands why Mr. Buganza wants the 5’ fence to match the
neighbors.Com. Khan discussed the location of the house and how no one else in the area
has a 6’ fence and discussed staff’s recommendation and the possibility of using bushes to
supplement the fence.Chairperson Cesario states there is no unique reason to allow for a
6’ fence.
Mr. Buganza is amenable to the recommendation made by staff.
Chairperson Cesario entered the Village Staff report as Exhibit one.
The public hearing was closed at 9:16.
Com. Weinstein made a motion to approve the variation request subject to the following
condition:
1. The proposed fence must be a 5 foot tall board on board fence setback at a minimum of
4 feet property line.
Commissioner Moodhe seconded the motion.
4. Consider a Variation for a Fence at 159 Timber Hill Road (Trustee Johnson) (Staff
Contact: Chris Stilling)
Mr. and Ms. Wright were sworn in.
Mr, and Ms. Wright discussed their proposal and their concerns. They also provided
photos to the commissioners.
The photos were entered as exhibits two and three.
Chairperson Cesario discussed other that have a 6’ fence in the area and that none of
them are on the side walk.
Com. Moodhe discussed that he doesn’t want the fence to come out that far and that
the corner is very appealing to the neighborhood.
Mr. and Ms. Wright discussed that their neighbors are okay with their request.
Chairperson Cesario entered staff report as Exhibit One.
The public hearing was closed at 9:43.
Chairperson Cesario clarifies the recommendation.
Mr. and Ms. Wright are amenable to the recommendation set by staff and the
commissioners.

Com. Weinstein made a motion to grant approval of the variation request subject to the
following conditions:
1. The proposed fence along Country Lane shall be setback a minimum of 4 feet from the
property line and be of a board on board (Shadow box) design. The remaining portion of
the fence along the east and south property line can be up to 6 feet high and shall be of
a board on board design.
