Recommendation of Action
Staff recommends approval.
The Petitioner installed a 6 foot solid white fence on the rear property line without a permit. The Petit ioner
was unaware at that time a fence permit was required to construct a fence. After review of the fence
permit, the Petitioner was notified that all 6 foot solid fences required a variation and applied for a fence
variation request.

REQUEST: A variation for an existing six (6) foot solid fence installed on the
rear property line of the subject property.
EXSITING LAND USE AND ZONING: The property is improved with a single-family home currently
zoned R5A.
COMPREHENSIVE PLAN: The approved Village Comprehensive Plan calls for this property
and the immediate neighborhood to be single family detached.
PROJECT BACKGROUND
The Petitioner installed a 6 foot solid white fence on the rear property line in May, 2019 separating the
neighbor’s house located at 605 MacArthur Drive. The Petitioner was unaware at that time a fence permit
was required to construct a fence.
A few days after the fence was installed a complaint was received about the fence installed in the rear
property line at the subject property. A notice of violation was given to the Petitioner on May 17, 2019
advising the Petitioner to apply for a fence permit. The Petitioner was willing to comply and reached out
to the Village to apply for a fence permit. After review of the fence permit, the Petitioner was notified
that all 6 foot solid fences required a variation and applied for a fence variation request.
PLANNING & ZONING ANALYSIS
The Petitioner is requesting to keep
the existing 6 foot solid white vinyl
fence on the rear property line.
The Petitioner has noted that the 6
foot solid fence is for privacy.
There is no fence installed along
the north and south property line
of the subject property. The only
fence installed is on the east
property line at the rear of the subject property.

fencing material that is over five feet in height shall be of a design that is open so as to allow
visibility.

Village Department Comments
Engineering The Village Engineer has reviewed the proposed fence location and
does not have any engineering or line of sight concerns or objections
with the proposed location of this fence.
SURROUNDING PROPERTY OWNERS
Pursuant to Village Code, the contiguous property owners were notified and a public hearing sign was
posted on the subject property. The posting of the public hearing sign and the mailed notifications were
completed within the prescribed timeframe as required. As of the date of this Staff Report, the Village has
received no calls inquiring about the proposed fence variation.
STANDARDS
The Planning & Zoning Commission is authorized to grant variations of the Fence Code based on the
following criteria:
1. The plight of the owner is due to unique circumstances;
2. The proposed variation will not alter the essential character of the neighborhood;
3. There are practical difficulties or particular hardships in carrying out the strict letter of this
Chapter which difficulties or hardships have not been created by the person presently having an
interest in the property; and,
4. The proposed variation will not be detrimental to the public health safety and welfare.
The petitioner has provided a written response to the standards for a variation which are included in
this packet.

Hi Rati,
The reason we feel like a 6 foot solid fence is necessary is because our backyard neighbor is
constantly looking into our house and into our backyard watching my mother work on the
garden as well as watching inside our house when the blinds are up. I just feel this is an
invasion of our privacy and this one was of the only ways to somewhat have some privacy.

PROJECT BACKGROUND
The Petitioner is proposing to install a 5 foot board on board fence which encroaches into the corner
yard setback along Orchard Lane which requires a variation.
The 5 foot board on board fence continues along the north property line and turns to continue on the
east property line of the subject property. This location of the fence meets Code.
PLANNING & ZONING ANALYSIS
The Petitioner is proposing to install a 5 foot
board on board fence setback 4 feet from the
property line along Orchard Lane.
The second segment of the fence turns in line
with the building setback line parallel to Park
Avenue.
The adjacent neighbor to the east (40 Park
Avenue) has a 5 foot board on board fence
located in the rear property line and along Main
Street and the rear property line. The Petitioner
has mentioned to use the same type of fence to
bring about continuity.
There is an existing landscape bed in the northwest corner setback 1 foot from the property line.
The proposed fence setback 4 feet from the property line will cut through a portion of this

plans to install the proposed fence 4 feet from the property line.

Fences may be erected placed and maintained on corner lots to a height not to exceed six feet above
ground level. No such fence shall be located nearer to any street than the building setback line.

PROJECT BACKGROUND
The Petitioner is proposing to install a 6 foot board on board fence which encroaches 28 feet into the
corner yard setback along Twilight Pass which requires a variation.
The adjacent neighbor at 741 Silver Rock Lane has a 5 foot black open chain link fence setback 4 feet from
the property line along Twilight Pass. The second segment of the 5 foot black open chain link fence
separates the subject property and the neighbor’s property on the northeast side.
The Planning and Zoning Commission approved this fence variation on October 1, 2014 to allow for the 5
foot open chain link fence to encroach into the corner yard setback along Twilight Pass.
PLANNING & ZONING ANALYSIS
The Petitioner is proposing to install a 6
foot board on board fence setback 4 feet
from the property line (5’ from the
sidewalk) along Twilight Pass.
The second segment of the fence turns in
line with the rear corner of the building
parallel to Checker Drive.
Staff has had a discussion with the

concerns about the cars parked along Checker Avenue for a home daycare located across the street.
Also, the Petitioner has mentioned the subject property slopes down towards Twilight Pass.
The Village Engineer has reviewed the contour plans for the subject property and feels that there is
no significant slope difference to create the need to have a 6 foot tall fence for privacy.
Variations requested

The intend of this letter, is to explain the reasons behind the fence variance application for my
residence in 720 Checker Dr in Buffalo Grove. Of a 6 feet high Solid Wood Fence.
Three main points are needed to highlighted
1)Safety; Currently my backyard is open to all the perimeter of the house, being the most
exposed area to the side of the house in Twilight Pass. My main concern is that there is
nothing to protect my 18 months toddler and my second son to come in July 12th from any
potential thread from the street. That is why any person coming next to the side walk can still
have access to the house if a lower fence is erected, same as any other potential thread as
coyotes are common in the area. The recommended height of a fence to be protected from this
species is, at least, 6 feet high.
2)Privacy; The backyard has a slope from the center of the yard all the way to the sidewalk.
My estimate of the slope inclination from the center of the backyard to the side walk is around
2 feet. Making a 5 Feet tall fence no difference, privacy wise. A 6 feet tall fence still will bring
no privacy from the other side of the side walk due to the slope, bu at least will help next to
the side walk.
3)Privacy/Safety; On the right side in front of the house there is a early Learning center, in
which several parents park on Twilight Pass, creating a potential safety issues, since several
times a lot of cars are parked on my side of the road. Additional if a 5 feet tall fence is erected,
this wont bring any privacy due to the slope in the yard.
These are my main concerns and reasons why the 6 feet tall fence needs to be erected, as well
as the solid fence type.

EXSITING LAND USE AND ZONING: The property is improved with a single-family home currently
zoned R5A.
COMPREHENSIVE PLAN: The approved Village Comprehensive Plan calls for this property
and the immediate neighborhood to be single family detached.
PROJECT BACKGROUND
The Petitioner is proposing to install a 6 foot board on board fence which encroaches 23 feet into the
corner yard setback along Country Lane. The proposed fence would be setback 2’ from the property line.
The 6 foot board on board fence continues along the east property line and turns to continue on the south
property line of the subject property. This location of the fence meets Code.
PLANNING & ZONING ANALYSIS
There is an existing 5 foot scalloped baord
on board fence along the building setback
line which is setback 25 feet from the
property line. This fence is not in a good
condition and the Petitioner has planned to
remove this fence.
The subject property has a 3 foot wide
landscaping bed from the sidewalk along
Orchard Lane. The Petitioner is proposing to
install a 6 foot board on board fence setback
2 feet from the property line and 3 feet
from the sidewalk along Country Lane

The second segment of the fence turns in line to meet the east corner of the building and runs parallel
to Timber Hill Road.
Variations requested
A corner side yard variation from Section 15.20.040.B from the Buffalo Grove fence code states that
Fences may be erected placed and maintained on corner lots to a height not to exceed six feet above
ground level. No such fence shall be located nearer to any street than the building setback line.

DEPARTMENTAL REVIEWS
Village Department Comments
Engineering The Village Engineer has reviewed the proposed fence location and
does not have any engineering or line of sight concerns or objections
with the proposed location of this fence.
SURROUNDING PROPERTY OWNERS
Pursuant to Village Code, the contiguous property owners were notified and a public hearing sign was
posted on the subject property. The posting of the public hearing sign and the mailed notifications were
completed within the prescribed timeframe as required. As of the date of this Staff Report, the Village
has received no calls inquiring about the proposed fence variation.
STANDARDS
The Planning & Zoning Commission is authorized to grant variations of the Fence Code based on the
following criteria:
1. The plight of the owner is due to unique circumstances;
2. The proposed variation will not alter the essential character of the neighborhood;
3. There are practical difficulties or particular hardships in carrying out the strict letter of this
Chapter which difficulties or hardships have not been created by the person presently having an
interest in the property; and,
4. The proposed variation will not be detrimental to the public health safety and welfare.
The petitioner has provided a written response to the standards for a variation which are included in
this packet.

STAFF RECOMMENDATION
Village staff recommends approval of the variation request subject to the following conditions:
1) The proposed fence along Country Lane shall be setback a minimum of 4 feet from the property
line and be of a board on board (Shadow box) design. The remaining portion of the fence along
the east and south property line can be up to 6 feet high and shall be of a board on board design.
ACTION REQUESTED
The Planning & Zoning Commission (PZC) shall open the public hearing and take public testimony
concerning the variation. The PZC shall make a final decision on whether or not to approve the variation.

requesting our fence be:
1. 6 foot even on the Country Side of our house . We have submitted pictures showing there is
an 18" drop from our patio/ screen porch to where the fence will be placed.
With a shorter fence, our privacy is not being protected in the same manner that our privacy is
being allowed between our side and back yard neighbors. If anything- it should be EASIER to
approve the 6' fence on the street side for safety and privacy to our home.
2. We are requesting that our fence be allowed to be placed 3' from the sidewalk. We have
beautiful bushes that line our property along Country . If the fence is required to be 5' from
the sidewalk that will leave a 2' patch of grass between the fence and the bushes. That path of
2' will be difficult to maintain as we won't be able to mow or weed wack between the fence
and the bushes. That would not enhance the beauty of our neighborhood.

Call to Order
The meeting was called to order at 7:32 PM by Chairman Frank Cesario
Public Hearings/Items For Consideration
1. Consider Multiple Variations for a Fence at 104 Sunridge Drive (Trustee Johnson) (Staff

Christopher Bock (104 Sunridge Drive) was present and sworn in.
Christopher Bock reviewed his proposal for his fence plans, the encroachment and the
want to install a privacy fence. Amended request to 5’ shadowbox on corner side, 5’ solid
along the rear and 6’ sold on interior side
Commissioner Weinstein asked for clarification on the purpose of the 6 foot privacy
fence between the proposer’s house and his neighbors.
Christopher Bock explained that the house next to his has been in disrepair for several
years and would like privacy.
Commissioner Weinstein had concerns about the style of the fence and explained the
importance of the corner cut for visibility for those using the bike path.
Christopher Bock asked for clarification on the corner cut and what the exact
measurements would be.
Deputy Village Manager, Chris Stilling, described and showed the corner cut shown in
the packet. He said staff would work with him to mark out the corner of his lot.
Commissioner Moodhe discussed the placement of the bushes in relation to the fence
and expressed the importance of the line-of-sight. He commented that he would like to
see the same style of fence all the way around the property at 5 foot. Bock asked about
the concern having the 6’ foot solid fence. Com. Moodhe explained the importance of the
aesthetics.
Commissioner Goldspiel asked about the bushes and whether they would be inside or
outside the fence.
Christopher Bock said the fence would be inside the bushes.
Commissioner Goldspiel explained the importance of a line of sight and agrees with the
staff recommendation.
Commissioner Moodhe asked staff about the other 6’ variation. He is not supportive of a
6’ fence.
Chairperson Cesario summarized the discussion and proposed that a 5 foot fence of the
same shadow box style would be preferred.
Christopher Bock understood the concerns of the style and height of the proposed fence
by the commissioners and was amenable to making the proposed changes with the help
of staff identifying the corner cut out.

The public hearing was closed at 7:56 PM.
Commissioner Weinstein made a motion to grant a 5 foot shadowbox fence on all sides
subject to conditions.
1. The proposed fence located in the corner side yard shall be setback a minimum of 5’
from the
existing sidewalk and shall be of a shadow box or other open design.
2. The proposed fence location shall be revised in a manner acceptable to the Village. The
fence
location at the southeast corner of the lot shall be revised so as not to create a line of
site issue
as shown in the staff exhibit attached as part of this report.
Commissioner Moodhe seconded the motion.
Chairperson Cesario is fully supportive of the amended request and thanked Christopher
for his ability to work with the commission.

Deputy Village Manager Chris Stilling and Fire Chief Mike Baker were both present and
sworn in.
Chris Stilling discussed the proposed development of the CAFT facility and described the
purpose and use of building. He also specified the location of the proposed CAFT facility
and the need for an amendment to a previously granted Special Use Ordinance.
Commissioner Goldspiel asked how the new proposed building would look.
Chis Stilling said the new CAFT Facility would look more residential.
Commissioner Goldspiel asked for clarification on the location of the CAFT facility and
the colors that would be used on the building.
Chis Stilling described the location of the building. He said the colors were not picked out
yet.
Commissioner Moodhe asked about the shower and the layout of the bathroom as well
as the size of the garage.
Chief Baker described code requirements for bathrooms and the shower. He mentioned
that the garage would not be used very often, but can fit some of their smaller fleet. He
said that the CAFT facility would be used very little as a staffing facility.

Commissioner Moodhe asked if the building of the CAFT facility would affect the current
ISO Rating.
Chief Baker said that the building would not affect their ISO Rating.
Commissioner Moodhe asked if it would make more sense to build the building larger
now rather than later.
Chief Baker discussed the agreement with the several departments who are a part of the
CAFT project. He continued to describe the positives of the new site and the amount of
parking that will now be available to host the different departments for trainings.
Commissioner Goldspiel asked for clarification on the amount of parking at the facility.
Chief Baker said that the parking at the facility is adequate and meets ADA
requirements.
Chairperson Cesario asked to explain the change of not having a classroom.
Chief Baker advised they have had to cancel training due to station 26 not having
enough parking to accommodate.
Chairperson Cesario entered the Village Staff report as Exhibit One.
The public hearing was closed at 8:12 PM.
Commissioner Weinstein made a motion to grant recommendation of approval to the
Village Board for an amendment to Special Use Ordinance 1996-35, as amended by
Ordinance 2000-53 and Ordinance 2010-42 to allow for the construction of a new
permanent training building subject to the following condition:
1. The proposed development shall conform to the plans attached in Exhibit One as part of
this petition.
Commissioner Moodhe seconded the motion.
Commissioner Moodhe commented on the need and importance of a new CAFT building
for the Fire Departments.
Commissioner Weinstein noted that the previous building was a temporary structure.
The new building will be larger and look nicer.

Chairman's Report
Chairperson Cesario mentioned the new member of the commission, Kevin Richards, as well as
the departure of Deputy Village Clerk as recording secretary.
Deputy Village Clerk Julie Dziewior introduced Katie, HR Management Analyst, as the new
recording secretary.

None.
Staff Report/Future Agenda Schedule
Chris Stilling mentioned that next meeting there will be four fence variations. He also mentioned
that he would like to cancel the meeting in July 3rd meeting with a possible special meeting on
July 10th.
Chris Stilling congratulated Nicole Woods on her promotion to Deputy Director of Community
Development
Nicole Woods congratulated Chis Stilling on his promotion to Deputy Village Manager.
