1983-07-18 - Resolution 1983-23 - SUPPORT THE VILLAGE OF LAKE BLUFF'S POSITION REGARDING MUNICPAL JURISDICTION WITHIN 1-1/2MILE PLANNING AREA RESOLUTION NO. 83- �3 (IN SUPPORT OF THE VILLAGE OF LAKE BLUFF'S POSITION REGARDING MUNICIPAL JURISDICTION WITHIN THE 1-1/2 MILE PLANNING AREA) WHEREAS, pursuant to Sections 11 -12-5, and 11-12-11 of the Illinois Municipal Code, municipalities are granted the authority to apply their subdivision regulations to unincorporated areas contained within the terri- tory governed by their official plan or map; and, WHEREAS, pursuant to the case of City of Urbana vs. County of Champaign, the Supreme Court of Illinois determined that a Planned Unit Development can be considered as a subdivision pursuant to State Statutes; and, WHEREAS, the Village of Lake Bluff has an adopted official plan and subdivision regulations which define a planned unit development as being subject to said regulations; and, WHEREAS, a 7 acre, 72 unit apartment development was proposed within the unincorporated planning area of the Village of Lake Bluff; and, WHEREAS, the Village of Lake Bluff objected to said development because of the developers failure to submit improvement plans to the Village for review under its subdivision ordinance; and, WHEREAS, it appears that Lake County and the developer were working together in an attempt to avoid the application of the Lake Bluff subdivision ordinance; and WHEREAS, the Trial Court Judge imposed the requirement that under the Urbana case, the Village must show that the construction would have a developmental impact on the health and safety of the residents of the Village; and, WHEREAS, the Judge determined that the avoidance of developer school and park contributions, the adverse traffic impact and potential drainage problems to Lake Bluff was insufficient showing of impact; and, -1- -2- WHEREAS, the Village of Lake Bluff has appealed this decision; and, WHEREAS, the outcome of this lawsuit will directly affect the Village of Buffalo Grove in our ability to protect jurisdictional rights with- in one and one-half miles of our corporate limits: NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: 1 . That the Village of Buffalo Grove fully supports the attempts of the Village of Lake Bluff to protect its statutory one and one-half mile planning area through the application of their subdivision ordinance.
