1980-05-19 - Resolution 1980-28 - Contract with Long Grove Rural Fire Protection District 1.014.1.0 RESOLUTION NO. 80- 1.9 A RESOLUTION AUTHORIZING EXECUTION OF A CONTRACT (Long Grove Rural Fire Protection District) WHEREAS, the Corporate authorities of the Village of Buffalo Grove deem it in the best interests of said Village and the residents there- of that certain territory of the Long Grove Rural Fire Protection Dis- trict, the Vernon Fire Protection District and the Wheeling Township Rural Fire Protection District, lying within said Village, be discon- nected from said fire protection districts ; and WHEREAS, the Village has filed a disconnection case in Lake County, Illinois, under case number 80 MC 2 to effectuate said disconnection; and WHEREAS, the Village, pursuant to its Home Rule Powers , the Illinois Intergovernmental Cooperation Act and Illinois State statutes , desires to provide fire and ambulance protection to the disconnected area by contractual services. NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT and BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK and LAKE COUNTIES , ILLINOIS, as follows : SECTION 1. The Village President and Village Clerk are hereby authori- zed and directed to execute the contract attached hereto as Exhibit "A", with LONG GROVE RURAL FIRE PROTECTION DISTRICT. APPROVED: (55'w‹: age res ent ATTEST: -- Vi }1*1 J Cltl Lam.: lage Clerk A_ AGREEMENT THIS AGREEMENT, made and entered into this 7th day of May, 1980 by and between the VILLAGE OF BUFFALO GROVE, Cook and Lake Counties, Illinois, hereinafter referred to as the "Village" and the LONG GROVE RURAL FIRE PRO- TECTION DISTRICT, hereinafter referred to as the "District". WITNESS THAT: SECTION 1. FIRE PROTECTION SERVICES WHEREAS, the Village has requested fire protection service from the District for that territory described in Exhibit "A", attached hereto and made a part of this Agreement. NOW, THEREFORE, A. The District Agrees: 1. To furnish the Village with fire protection and fire control ser- vices within the territorial boundaries of Exhibit "A" for a period beginning upon disconnection from the District and ending December 31, 1980. 2. To operate and maintain in good working order all of its fire trucks, equipment, materials, and supplies as would be required to enable the District to comply with this Agreement. 3. To furnish all necessary fire equipment as is needed by it and to use such thereof as is necessary when responding to alarms within said Territory. 4. To respond to all fire calls and to all emergency calls, excluding ambulance calls, within said Territory in the respective order in which said calls are received. It is further agreed, that if, while attending one alarm and another alarm is sounded, the District will call, if necessary, to its assistance, one of the neighboring fire departments with which it has a mutual aid agreement, all with- out additional expense to the Village. 5. To accept in full for furnishing fire protection service to the Village, the sum of $750.00 (Seven Hundred Fifty Dollars) plus tax levy for 1979, it being understood expressly that the District shall make no other charges to any persons in said District for fire protection. B. The Village Agrees: 1. To pay the District the sum of $750 (Seven Hundred Fifty Dollars) for the Fire Protection services to be rendered under this Agreement by the District to the Village for the period beginning upon disconnection from the -2- District and ending December 31, 1980, of which payment shall be made at the commencement of this Agreement. SECTION 2. PARAMEDIC RESCUE AND EMERGENCY AMBULANCE SERVICES WHEREAS, the Village has requested Paramedic Rescue and Emergency Ambul- ance services from the District for that territory described in Exhibit "A", attached hereto and made a part of this Agreement. NOW, THEREFORE, A. The District Agrees: 1. To furnish the Village with Paramedic Rescue and Emergency Ambul- ance services within the territorial boundaries of Exhibit "A" for a period beginning upon disconnection from the District, and ending December 31, 1980. 2. To operate and maintain in good working order all of its ambulances and paramedic rescue equipment, materials and supplies as would be required to enable the District to comply with this contract. 3. To respond to all paramedic rescue calls and to all emergency ambulance calls, within said Territory in the respective order in which said calls are received. It is agreed that the District will extend a mutual aid assistance program to the Village without additional expense to the Village. 4. To accept for furnishing paramedic rescue and emergency ambulance services the sum of $750 (Seven Hundred Fifty Dollars) plus tax levy for 1979 for the year 1980 beginning upon disconnection and ending December 31, 1980. B. The Village Agrees: 1. To pay the District the sum of $750 (Seven Hundred Fifty Dollars) plus tax levy for 1979 for the Paramedic Rescue and Emergency Ambulance ser- vices to be rendered under this Agreement by the District to the Village for the period beginning upon disconnection of said territory and ending December 31, 1980, which payment shall be made at the commencement of this Agreement. SECTION 3. IT IS MUTUALLY AGREED AS FOLLOWS: A. In the event the District does not maintain its equipment in a good state of repair or does not properly furnish the services hereinabove provided for, the Village may terminate this Agreement by giving the District written notice of intention to terminate this Agreement sixty (60) days prior to such termination. s -3- B. If the Village fails to abide by the terms of this Agreement, here- above set forth, the District may terminate this Agreement by giving the Village written notice of intention to terminate this Agreement sixty (60) days prior to such termination. C. This Agreement may be extended from year to year upon mutual agreement of said Village and District.
