1980-05-19 - Resolution 1980-26 - Contract with Wheeling Township Rural Fire Protection District • RESOLUTION NO. 80- 1( A RESOLUTION AUTHORIZING EXECUTION OF A CON- TRACT (Wheeling Township Rural Fire Pro- tection District) WHEREAS, the Corporate authorities of the Village of Buffalo Grove deem it in the best interests of said Village and the residents there- of that certain territory of the Long Grove Rural Fire Protection Dis- trict, the Vernon Fire Protection District and the Wheeling Township Rural Fire Protection District, lying within said Village, be discon- nected from said fire protection districts ; and WHEREAS , the Village has filed a disconnection case in Lake County, Illinois, under case number 80 MC 2 to effectuate said disconnection; and WHEREAS , the Village, pursuant to its Home Rule Powers , the Illinois Intergovernmental Cooperation Act and Illinois State statutes, desires to provide fire and ambulance protection to the disconnected area by contractual services. NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT and BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK and LAKE COUNTIES, ILLINOIS, as follows: SECTION 1. The Village President and Village Clerk are hereby authori- zed and directed to execute the contract attached hereto as Exhibit "A" , with WHEELING TOWNSHIP RURAL FIRE PROTECTION DISTRICT. APPROVE Village res . ent ATTEST: illags Clerk 6 AGREEMENT THIS AGREEMENT, entered into this f Q day of 2 oy1980, by and between the Village of Buffalo Grove, Coo k and Lake Counties, Illinois, hereinafter described as the "VILLAGE" , the Buffalo Grove Fire Department, Inc. , an Illinois non-profit corporation, hereinafter described as the "DEPARTMENT" , and the Wheeling Township Rural Fire Protection District, hereinafter described as the "DISTRICT" . W I T N E S S E T H: WHEREAS, the Village is now in three Fire Protection Districts, } to-wit, Wheeling Township Rural Fire Protection District, Long Grove Rural Fire Protection District and Vernon Fire Protection District; and WHEREAS, there is a substantial difference between the facilities, services, tax structures and extent of territory within each District; and WHEREAS, the District has no facilities or equipment to service the area within the District, but contracts for use of equipment and services; and WHEREAS, the District has no outstanding bond issue at this time; and WHEREAS, the Department was incorporated for the purpose of operating a fire department and training personnel to be firemen basically in and for the Village; and WHEREAS , the Village permits the Department to use its facilities at no charge; and otherwise aids and cooperates with the Department; and • WHEREAS, in cooperation with the Department and the District, the Village is initiating a Court proceeding to disconnect certain property from the three aforementioned districts, pursuant to Chapter 127-1/2 , section 35 of the Illinois Revised Statutes, i.e. , Case No. 80 MC 2 entitled Village of Buffalo Grove, et al. v. Long Grove, Wheeling and Vernon Fire Protection Districts pending in the Circuit Court of the Nineteenth Judicial Circuit, Lake County, Illinois; and WHEREAS, the Village, has by ordinance, created a municipal fire department, and has passed a referendum in order to tax for fire protection and ambulance service; and WHEREAS, all parties hereto agree that a municipal department servicing all property now within and hereafter annexed to the Village will either eliminate and/or simplify the tax, servicing, personnel, etc. problems; and WHEREAS, the Village, through its municipal department because of monetary constraints will not be able to provide fire protection and ambulance protection to the disconnected property from the date of the disconnection to an implementation date hereinafter described; and WHEREAS, the Village and the District desire to fairly and equitably fund a municipal department between the disconnection and implementation date. NOW, THEREFORE, in consideration of the stipulations and conditions herein set forth, it is covenanted and agreed by and between the parties hereto as follows: -2- � `..% 1. The Village will prepare, circulate, file and prosecute a Petition to disconnect certain Village properties lying within the Long Grove Rural Fire Protection District, Vernon Fire Protection District, and the Wheeling Township Rural Fire Protection District. 2. The real property to be disconnected (hereinafter referred to as "SUBJECT PROPERTY") from the District is as legally described in Exhibit "A" attached hereto and made a part hereof and this contract is contingent upon said disconnection becoming effective. 3. The Department and the District will cooperate in the above Petition and the District will file in Court the necessary appearances and consents to disconnect the said property. 4. It is understood and agreed by the District that certain lands presently within the corporate limits of the Village will not be disconnected from the District in order that the District will remain contiguous to itself (A map describing these particular lands is attached hereto as Exhibit "D") . 5. The District, through contract with the Department, will continue to provide fire protection and ambulance service to those areas remaining within the District and within the corporate limits of the Village, as described in Paragraph 4 herein. 6. Because of monetary constraints, the tax extension practices of Cook County and time necessary to form a Municipal Department, the Village will be unable to provide fire protection and ambulance service to the Subject Property from the date of the final order disconnecting the subject property to April 30 , 1981. • -3- 7. The District, through contract with the Department, shall continue to provide fire protection and ambulance service to the Subject Property from the date of the disconnection to April 30 , 1981. This service shall be paid for through the use of all or a portion of the taxes collected during the period between the disconnection and April 30 , 1981 from the subject property (including the first installment payment of property taxes in 1981 whenever collected) . 8. There shall be no cost to the Village for service provided in paragraph 7 hereof from the disconnection date to April 30 , 1981. 9. The District will not, after the date of this Agreement, lease, purchase or contract to purchase any personal property, and/or building within the District for fire protection purposes without first consulting with the Village. The District will assign on March 31, 1981 any and all leases to the Village and convey to the Village title to personal property, lands and/or buildings lying within the Village as shown on Exhibit "B" which is attached hereto. As of the same date the Village will assume the then outstanding balance on the first mortgage with respect to the Dundee Road Fire Station. The Department on May 1, 1981 will assign any and all leases to the Village and convey to the Village title to the personal property in Exhibit "C" , which is attached hereto and made a part hereof. 10. On May 1, 1981, the Village agrees to enter into an annual contract or contracts with the District, if the District so desires, to provide fire and ambulance service to areas within the District -4- described in Exhibit "E" . The contract or contracts shall be reasonable in terms and shall involve a contractual price which is the lesser of: a) the cost of providing fire protection and ambulance service to comparable properties located within the Village; or b) the actual taxes collected by the District from the property covered by the service contract less the District's overhead and • administrative costs attributable to such property provided that the tax rate assessed on the property shall be not less than .60 per 100 equalized assessed valuation. The contract service is payable to the Village in December of each year. 11. The Department does not now have under contract to buy any real estate, or equipment, and will not purchase or contract to purchase the same without written consent of the Village. 12. During the term of this agreement, the Village will continue to permit the Department to use the 1970 Howe Aerial Truck at no charge. The Department will, at all times during such period, repair and maintain said vehicle at no cost to the Village. During such period, the Village will continue to allow the Department the use of the housing now provided by the Village. Provided, the Village may at its option, provide equivalent additional housing in the northern area of the Village. -5- • • u• 13. Upon the implementation date July 1, 1981, the Department will dissolve Buffalo Grove Fire Department, Inc. , an Illinois Corporation. 14. Upon formation of a Municipal Fire Department, the Village will take all steps permitted by statute to give full time personnel then in the Department the same rank then held by them. This shall mean that full and legal appointments to equal rank under the Police and Fire Commission. The Chief of the Department shall receive the highest rank under the Police and Fire Commission and shall be appointed to the rank of Chief of the Department for a minimum period of two years to insure an orderly transition of control subject to the Personnel Rules and Regulation of Village of Buffalo Grove. Nothing herein contained shall bind the Village to employ more men than are, in the judgment of the Village, required for fire protection purposes . 15. Pay scales for full time personnel, including the Chief, shall be pursuant to the Village salary administration plan then in effect. 16. Working hours and other working conditions relating to the operation of the Municipal Department shall be set by the Village Manager. 17. All those employed whether full time, part time or volunteers, shall be employed under the same policies governing the full time and part time employees of the Village as outlined in the Village Personnel Rules and Regulations. 18 . The present retirement plan of the Fire Protection Department must be cancelled upon the formation of a municipal department. It is not the intent of the Village to fund this pension fund. State Statutes governing Fire Protection Department Pensions shall apply where pertinent. 19. The Village will allow the District to conduct its business to maintain offices and records at 505 West Dundee Road, Buffalo Grove, Illinois, at no expense to the District, subject to scheduling approval of the Fire Chief. 20. This Agreement shall be binding upon and enure to the benefit of the parties hereto, their successors and assigns for a period of five (5) years from the date hereof and may be extended from time to time upon the agreement of the parties. 21. It is understood that prior to April 30, 1981, the Department will undertake to provide fire and ambulance services to a portion of Lake County lying within the boundaries of the Village. These services will be paid for by the Village at a cost which is mutually agreeable to the Village and to the Department. The level of service provided to this area shall in no manner decrease the level of service provided to the remaining area served by the Department pursuant to its contract with the District. 22. This Agreement shall be enforceable in any Court of Law or equity. 23. The parties hereto shall each pass and approve appropriate resolutions authorizing execution hereof. 24. The parties hereto will cooperate with each other in an effort to bring about the ultimate goal of establishing a Municipal Fire Department. 25.
