1974-09-16 - Resolution 1974-22 - Objection to rezoning of a parcel of land in Lake County RESOLUTION NO. 74-22
WHEREAS, the petition for rezoning by the County of Lake of a
43. 4 acre parcel of land located on Weiland Road
approximately 1200 feet south of Busch Road in Vernon
Township identified as Zoning Board of Appeals Docket
Number 2369 lies within the mile and one half
jurisdictional area of the Village of Buffalo Grove;
and
WHEREAS, the Village of Buffalo Grove was duly represented at
the Public Hearing held on June 25 , 1974 , and has since
considered the evidence presented;
NOW, THEREFORE, BE IT RESOLVED BY the President and Board of Trustees
of the Village of Buffalo Grove, Cook and Lake Counties , Illinois,
that:
SECTION 1. The Village of Buffalo Grove hereby officially objects to
the granting of the petitioned rezoning for the following
reasons :
(a) The storm water drainage systems should be designed
to prevent additional storm water drainage from
entering into the Aptakisic Creek, thereby increas-
ing the amount of flooding in downstream areas.
(b) The development will cause increased vehicular
traffic on Weiland Road along the Aptakisic Tripp
Elementary School.
(c) This developer has not met with our Village Plan
Commission and Village Engineer to review their
plan as it relates to our Comprehensive Land Use
Plan 1990 and Official Map which were adopted on
November 19 , 1973, by Village Ordinance No. 73-55
and properly filed with the County of Lake and to
insure that this development will build according
to the Village Standards all of which is required
under Sections 11-12-5 of the Illinois Municipal
Code.
(d) The proposed density of this project exceeds the
density of our Comprehensive Land Use Plan 1990
for this area. Our Land Use Plan projects a den-
sity of four to six units per acre not the 10. 3
units per acre proposed by the developer. Further,
the incentive provisions of our Planned Unit
Development Ordinance would only permit 4 . 64 units
per acre for this development as presented to Lake
County.
(e) The developer of this property has not satisfactorily
met our policy for school and park donations. If
this development was being developed in Buffalo Grove,
the developer would be required to make a payment
of $165 ,266 to Elementary School District 102 , and
$30 ,652 to High School District 125 and to donate
a 10 acre public recreation site to the Buffalo Grove
Park District. This land donation would be reduced
if recreational uses such as tot lots , swimming pool,
club house, tennis courts were provided.
(f) The developer is not providing public or private
recreational facilities which is contrary to the
planning needs of this area. This development will
further compound the needs for comprehensive recrea-
tional facilities in this area. It is recommended
that this developer annex into the adjacent Park
District and meet with them to resolve the recrea-
tional needs of this development.
(g) Because of the distance from the Long Grove Fire
Protection Station, the common townhouse walls
should be constructed with a two hour fire protec-
tion rating between each unit to protect the lives
and property of neighboring townhouse units if a
fire does occur.
(h) The proposed development will increase the demand
on the existing water aquifer which would reduce
the water table in this area. This will result in
an additional maintenance expense to the Village
water utility system when the bowl assemblies of
all the wells must be lowered to the new water
table.
SECTION 2 . The Village Clerk is directed to forward certified copies
of this resolution to the County Board and to the Zoning
Board of Appeals of Lake County, Illinois.
