1972-01-03 - Resolution 1972-01 - Village purchased land to be leased to Park District L �/ VILLAGE OF BUFFALO GROVE RESOLUTION #72-1 WHEREAS, the Village did acquire certain land from the owner and developer, and WHEREAS, President and Board of Trustees have determined that said land is not immediately needed for the purposes for which it was obtained, and WHEREAS, the Buffalo Grove Park District has represented that if the land were leased to it, the same would be put to immediate use for park and/or recreational purposes. NOW THEREFORE BE IT RESOLVED THAT: The President and Clerk execute a lease to the Buffalo Grove Park District for a term of 5 years, in the form attached hereto and made a part hereof as Exhibit "A" . The legal description of the land to be leased is as follows: Lot C (except storm drainage ditch) in Buffalo Grove, Unit #6, being a subdivision in the East 1/2 of Sec- tion 5, Township 42 North, Range 11, East of the Third Principal Meridian in Cook County, Illinois. 11,, / 9 '7=Z DATED: rj t.v.maser S� , 1971. 0 , &�>> fiiffc lla. - Preside, t Village Clerk V LEASE THIS INDENTURE, made this day of _ a , A.D. , 1971, between BUFFALO GROVE PARK DISTRIC , a municipal corporation, State of Illinois, Lessee, and VILLAGE OF BUFF- ALO GROVE, a municipal corporation, State of Illinois, Lessor. WITNESSETH: 1. Premises and Term. Lessor, in consideration of the covenants of Lessee, hereinafter set forth, hereby leases to Lessee the following described property, to-wit: Lot C (except storm drainage ditch) in Buffalo Grove Unit #6, being a subdivision in the East 1/2 of Section 5, Township 42 North, Range 11 East of the Third Principal Meridian in the Village of Buffalo Grove, County of Cook and the State of Illinois. To have and to hold the same to Lessee, from the 3rd day of January, 1972, to the 31st day of December, 1976. 2. Rent. Lessee, in consideration of the leasing of the premises as above set forth, covenants and agrees with Lessor to pay Lessor, at the Buffalo Grove Village Hall as rent for the same, the sum of One Dollar per year during the term and any extension thereof. 3 . Possession at End of Term. Lessee covenants with Lessor that upon termination, by expiration or otherwise, Lessee will yield up the premises to Lessor without further notice, in the same condition that existed on January 3, 1972. 4. No Subletting without Consent. It is further agreed by Lessee that neither Lessee nor Lessee's legal representatives will sublet said premises or any part thereof, or assign this lease without obtaining the written consent of Lessor. 5. Purpose . Premises shall be used solely for park and/or recreational purposes and shall at all times during the term hereof be maintained in a clean, sightly and healthy condition. Provided, however, the Lessor shall maintain the storm water drainage ditch and shall have unlimited access over the remaining property for such purpose. No refuse of any kind shall be allowed in said ditch. Lessee shall erect such protective devices agreed upon by the Village and Park District Boards . 6 . Termination. The Lessor or Lessee may terminate this Lease at any time upon giving 30 days written notice. 7 . Insurance. On or before 10 days from date hereof , Lessee shall furnish the Lessor insurance policies or certi- ficates of insurance, naming Lessor as an additional insured, as follows : a. Public Liability $1,000 ,000 umbrella coverage b. Property Damage $10 ,000 A and B above shall include any property damage, personal injury or loss of life sustained as a result of the afore- said storm drainage ditch. 8 . This Lease shall inure to the benefit of and be binding upon the parties hereto, their respective success- ors and assigns . -2- 40. Several months later the Village presented the Park District with a five year lease which was the product of a compromise between our two attorneys . Due to problems caused by on site engineering , the irregular topography and poor weather conditions , the skating pro- ject was abandoned and the lease was never executed by the Park Board. In the intervening months we have had professional evaluations made of the subject property. In brief, the findings show that the site has little or no recreational value due to problems of ingress and egress and the continuing nature of environmental problems at the site. (The site definitely should not be used as a mini bike course as was suggested at a recent meetingof your Board) . The lack of accessibility alone reduces the value of this site to the residents below the standards of a good passive recreational area. The Buffalo Grove Park District hereby returns the unsigned lease to the White Pine Property with the recommendation that the site be turned over to the newly formed Environmental Protection Agency for their de- velopment as a a Nature area. The Park Board feels that the area could and should be used as an experimental station for several types of ground cover , including a large area to raise saplings for a future reforestation program to enhance the beauty of the whole village .
