1978-05-25 - Appearance Control Commission - Minutes 0-3 • APPEARANCE CONTROL COMMISSION VILLAGE OF BUFFALO GROVE, ILLINOIS THURSDAY, MAY 25, 197E, 1. CALL TO ORDER The meeting was called to order at 7:44 P.M. by Dominic Saviano, Building Department, on Thursday, May 25, 1978 in the Administration Building 2. ROLL CALL Present: Chairman Don Hardt, Commissioners Kirby, Brodie, Gibbs , Paolillo, Berins, and D. Saviano , Bldg.Dept. Absent : Commissioner Knaak. QUORUM PRESENT 3. APPROVAL OF MINUTES It was noted that the date on the minutes was incorrect- they read May 10 and it should be May 11. Roll Call Vote was taken. AYE - Commissioners Kirby, Brodie, Gibbs , Paolillo and Berins . ABSTAIN -- Chairman Hardt. The minutes were accepted as corrected and ordered placed on file . 4. NEW BUSINESS Windfield, formerly Tanglewood . Developer - Kaufman and Broad Homes , Inc. Kalman Bowen, Vice President and Jeffrey Ian Hyman, Director of Marketing and Sales were present as representatives. • Chairman Hardt stated that his Company has worked with this Company in Buffalo Grove , therefore, he said he would leave during the discussion. He appointed Commissioner Kirby to act as Chairman. Mr. Hyman begin the presentation by calling attention to the fact that the name of the development was changed to Wind- field. It is located at the corner of ryichols and Arlington Heights Roads . The entry will have a monument effect, being a decorative wall surrounded by shrubbery. The maintainence of such a structure was questioned because it would be located on two homeowner lots and usually similar landmarks are neglected. Commissioner Kirby asked that Mr. Hyman proceed with the presentation one phase at a time , before the questions are discussed. Beginning with SIGNAGE: Mr. Hyman showed the color chart showing the signage on the Models, the large billboards and the wall identification. The sales office signs within the complex will be sandblasted, which brings out the texture of the wood it cream color, with dk. brown lettering, and an orange border,the same as the graphics shown . The billboard will be double: faced on Nichols Road, - 1/4 mile West of Arlington Heights Road; Approximately 400 ft. in size . Flans are for a wrought iron fence in the center of • the entrance with DuraPly letters , cut out and mounted . • Mr. Saviano related that in other situations where pillars have been constructed for model cornlexes , they have not been maintained by the homeowners even though they knew when they purchased the property. The' sizeof the fence will require a variance by toe Zoning Board of Appeals . -It is too high and too long to comply with the ordinance . Mr. Bowen stated that they would stipulate removal of the Wall if at the end of the time use the Village would so desire. He suggested creating an easement with the option for eaintainance by the Homeowner's Assn. at a small annual fee. Mr, Hyman explained the policy of presenting homeowners with a disclosure statement upon purchase for the purpose of informing them of special conditions such as the wall which will be in- eluded. • Commissioner-Gibbs commended Kaufman and Board Homes, Inc. for an outstanding presentation. He made' a lotion to accept the signage and the wall as shown. Seconded by Commissioner Brodie. SEE THE SUMMARY STATEMENT - Motion No. 1 - ATTACHED. Motion passed unanimously. TEMPORARY SALES OFFICE, SITE LANDSCAPING AND SIGNAGE ON TRAILER Mr. Hyman presented the drawings of the Temporary Sales Office . It is a new: trailer which will be screened with landscaping. It has a deck on the front. Plans are to sink the trailer down so that it will be approximately three steps high. They hope to have the trailer on site and operational by June 9, 1978 and hope to have the models completed by late Sept. or early Oct . 1978. - _ R Suggestion was made to add landscaping to the North end of the trailer. This was agreeable . There will be landscaping lights near the trailer. The name will be mounted on the trailer using the same lettering, size being approximately 3 ft. x 10 ft . In answer to questions concerning the parking lot ; There will be an entry off Nichols Road with Entry and Exit lanes. Also parking places will be provided with bumpers . Complete set of color graphics will be presented to the Building Department. Appearance Control Commission • May 25, 1978 - - Page Two Commissioner Paolille made a motion to accept the Temporary ' Sales Office, Site Landscaping and Signage on the Trailer. Seconded by Commissioner Gibbs. SEE THE SUMMARY STATEMENT - Motion No. 2 - ATTACHED. Motion passed unanimously. MODEL AREA SITE PLAN The Models will be constructed on Windfield Ceurt just off Wind- Drive . The total number of units - 173, with Phase I to have 53 units. The signs will be moved from the Temporary Sales Office to the Permanent Site as soon as possible. Commissioner Berins noted the recommendations of the Forester and pointed out that the trees shown on the plans are not all appropriate' - such as Sugar Maples. The developer was asked to comply with the Forester's suggestions and Mr. Bowen was very agreeable because they want the plantings to last . Commissioner Gibbs asked about the sewage in relation to the trees and Mr. Saviano answered that the Forester takes all sewage problens into consideration. Mr. Hyman agreed. to in- clude the quantity and sizes of landscaping. in the disclosure statement . • Mr. Saviano informed the developer- that the stockade fence as shown (6 ft . ) would need a variance because the ordinance allows for up to 5 ft . fences . The developer agreed to change to 5 feet . The stockade fence , as well as ether special fee- tures will be en the Models and will be sold to the homeowners . The split-rail fences are removable , knockdown and mill come down when the models are sold. • The patio shown on the plans are preba'Ay :going to be made of pre-cast aggregate blocks set in stone frathed with railroad ties. • . The 20 ft. light pole will be stained to match the dark color of the wood. The driveway material has not. yet been decided upon, concrete or asphalt. Commissioner Brodie made a motion to accept the Midel Area Site Plan. Seconded by Commissioner Berins'. - • SEE SUMMARY TATEMENT - Motion No. 3 -ATTACHED. Motion passe unanimously. LANDSCAPING AHD STREET TREE -PLANTING A copy of the Forester' s recommendations •was given to the developer and he was very agreeable to having his Landscape Architect work with Mr. Davis to comply with the suggestions therein. The developer agreed to discuss the amount of top- soil because he cannot stipulate 6 incises as requested. . APPEARANCE CONTROL COMMISSION May 25, 1978 - - - Page Three . The developer will stipulate all future plantings will be as shown in all subdivions . He will agree with the land planner as to types of trees, and will agree to use 2 inch staked or 2i unstaked trees . mt. Saviano said that the Engineering Dept. takes care of all final grading, etc. The Detention Area was discussed . It will drain Northwest to Southeast . The developer stated that the farm on the South is part of the Happ farm . The area Mt11 usually be dry and will probably be used as play area, but the decision has not been made concerning grass er -shrubs. The Commission was concerned about the appearance of the area along Arlington Heights Road. Mr. Bowen agreed to have their engineer and the Forester dis- cuss the situation and come to a solution. The same tree- spacing will be maintained as exists now along Arlington Mts . , Commissioner Gibbs made a motion to accept the Landscaping and Street Tree Planting. Seconded by Commissioner Paolillo. SEE SUMMARY STATEMENT - Motion No. 4 - ATTACHED. Motion passed unanimously. ELEVATIONS FOR MODELS NOS. 30 to 33. Mr. Hyman presented the four models, nos. 30 to 34 and stated that a Ranch Model is being completed and will be presented at a later date . Three models are 2-story homes and one is a split level. They are designed to have Colonial, Old World. Traditional values, with exterior treatment of brick, columns , on the front with aluminum siding on the sides. The colors and material samples were shown.. The roof trim and siding will match. Clers - muted earth tones, sequenced and colored-out . Thera will be variety so that no two homes or the same color will be placed side by side (They follow the monotony Code . ) Plan 30 • Two story,buyers have option for roof and side treatment, roof could be regular standard asphalt shingle -.r"cedar shake and for the side , either regular aluminum or a wood product (cedar?) on a horizontal plane . Since no rear elevations were presented, the developer was asked to place the chimnies and furnace vents on the back or the roofs, and that they be painted out to match the roof. The iptiiars are concrete . The window shown on the garage will be an add on feature . Gutters and downspouts will be painted out to match thesoffit. Commissioner Kirby explained the ACC request that side elevations on corner lots receive special treatment to make them more appeal-' ing. She asked that shutters be added to the side of # 30 mode . • APPEARANCE CONTROL COMMISSION May 25, 1978 - - - Page Four. Plan 31 The Commission asked that garages be placed on interior lot line when the house is on a corner. Also that the window on the corner be shuttered. Gutters and Downspouts painted the same as the soffit. Plan 32 The plan is O.K. as it is with the same stipulations as already stated on corners, concerning gutters and downspouts etc. Plan 33 Split Level House - 1 story. The side would net be°•.too high so no corner stipulation will be necessary. Other specifica- tions the same. Illustrations show two trees en corners . Several other general statements of information relative to all the models were discussed: Buyers will have a choice of one color aluminum, but the color package has about 30 different color combinations are available . The cupola on garages shown will be the same color as the .siding. Homes will be landscaped in a man- s ner similar to the renditions offered. Commissioner 3erins made a motion to- accept the Model Plans. Seconded by Commissioner Gibbs. SEE SUMMARY STATEMENT - Motion No. 5 - ATTACHED. Motion passed unanimously. COLOR TRIM PACKAGE There are 30 color combinations . The- gutters will match the soffits and. trim. Brick will be in the .natural range . Stain used of Olympic . If the builder cannet. secure the materials shown he will return with alternate selections . • Commissioner Gibbs made a motion to accept the Color Trim Pack- age . Commissioner Paolillo seconded the motion. SEE SUMMARY STATEMENT - Motion No. 6.` - ATTACHED. Motion passed unanimously. I • The street lights will be sodium standard with concrete poles and aluminum arms . Mr. Saviano said that all engineering re- quirements will be met . • • Commissioner Brodie commended the Developers on the quality of the presentation and thanked them for noming. All the other Commissioners ,also voiced approval . of the proposed sub-division. A SHORT BREAK WAS TAKEN AT THIS POINT. • APPEARANCE CONTROL''COMMISSION • May 25, 1978 = - - Page Five. • Chairman Hardt returned and the meeting reconvened ._10:30 P.M. b. VANCO and KARIBU TROPICS - Non-conforming signs at Kohl's Commons. Representing Vance - Ed Vandermeuler. Representing Karibu Tropics Ed Gerali and Al Letchinger. Chairman Hardt explained the Situation for the benefit of the new Commissioners . The reason these companies are in violation of the sign ordinance is that they had previously ordered their signs before coming to the Appearance Control Commission and had agreed to additional wording to be erected. Both parties are tenants of Aohl' s Commons, a shopping center at Dundee and Buf- fAlo Grove Roads, and they statedithat the agent had never in- formed them of the original sign package before they had the signs pre-fabricated. Because of the hardship in cost to have new signs made, the ACC suggested that the name Vance be added in 9 inch letters above the words WALL COVERINGS : and the name Karibu above ?ET and GIFTS . Both Parties agreed to have this done by March 1, 1978. ,siNow they are again pleading hards ip. Mr. Gerali acted as spokesmallas He explaine*- that beca se of the cost they had gene without signs for months and then decided to go together to the same sign company, giving them a larger order, thus they .were able to make a "deal" , They gave the sign company a copy of the lease and told they to comply with the terms therein. The lease was misinterpreted. When the signs were presented to the ACC, they learned of the Kohl's sign package which states that stores must. have the name of the company, not an advertising sign showing the product. Mr. Gerali submitted a copy of this lease to Chairman Hardt, who read, as follows* • Except for such sign of lessee, or other signs on such pylon (?) in customary directional traffic sign controls ; no other ground signs shall be maintained on the shopping center site, nor shall be maintained on the exterior of the premises of the shopping center, any signs of ether than tenants or other lawful occu- pants of the shopping center site which sign shall :- 1) be located. only on the facia,or facade and not extend over the roof of the premises oc- cupied by the individual tenants ; 2) designate and advertise only the tenants lawful occupant's business on the shopping center site ; 3) not be painted on the building's surfaces , •:r employ painted and/or non-illuminated letters The discussion that followed was quite repetitious :_ Mr. Gerali's statement that they took for granted that they were correct and are now at the disposal of the Appearance Control Commission. Mr. Hardt maintained the agreement made previously to add 9" letters above the existing signs was a Compro- mise because the ACC would have voted down the signs that were presented, requiring the conditions of the lease to be met. He suggested asking the builder and Appearance Control Com. - 5/25/78 - Page Six agent to help bear the liability. Mr. Gerali said they have seen the landlord and he refused to come with them. He likes the signs as they are, in spite of the fact that it was the builder who had presented the sign package initially and it was he who had wanted the business names displayed . it was pointed out that the Sign Compamy holds some liability for erecting sign in this Village. Commissioner Kirby brought out the following points :- 1) Ignorance is not an excuse . It appears that the parties have come to place the ACC in the middle . of the situation, by stating they were innocent in the beginning. Actually ,;hey have legal recourse against the owner of the development 2) The gentlemen did not return to the ACC to plead hardship until they were notified by the Village , that they are in violation. 3) The sign package species Identification Sign. 4) The Cambridge Cleaners - Men's Wear was in the same position and he also agreed to add his name , which .he did, therefore the ACC could be guilty of putting hardship upon one business and not another. 5) You (Both Parties) agreed to the compromise and :should comply. • After further discussion concerning the liability, the possibil- ity of a cancelled lease, (because the lease has no automatic renewal close) the expense and the need for the builder to come in for a variance - Mr. Hardt gave these possiblities :- 1) Take, down the signs and put up right ones . 2) Have Mr. King request a variance of the original sign package. (See Item .D. - One line (name) sign. ) Y - " Mr. Gerali asked for time to contact Neil King and Bill Simnsn to discuss the matter and return. Chairman Hardt asked for a motion to decide whether a variance would be allowed. The following motion was made by Commissioner Gibbs :- I make a motion that the Coamission vote mot to accept the signs sets & Gifts ; and Wall Coverings, - as they are because they are in violation of the aA ..;_t yam.___ e , 1069141TIOOrsign package and they are also in violation of the variation of this Board the last time they came . Seconded by Commissioner Kirby. Roll Call Vote was taken. Motion passed unanimously. Chairman Hardt advised the petitioners that they have the right to appeal to the Village Board. APPEARANCE CONTROL COMMISSION May 25, 1978 - - Page Seven. a , Look & Hear - Panasonic Entertainment Salon Howard L. Treshansky - Owner Mr. Treshansky explained his predicament to the Commission. He has an approved sign but because of a misunderstanding a sign was erected on the GroveCeurt Pylon. He, therefore , has no sign above his very large store and people often can- met locate the establishment. He has appealed to the Village • Board in Jan. 1978 and was told that if he would agree to covering the existing sign they would agree to let him put up the facia sign. Then when the new sign ordinance is in effect both signs would be acceptable . Advertising is expensive and they are having an anniversary sale soon. They have looked. into the possibility of having the sign removed but that is a cost of approximately $900. He has tried several methods to cover the sign but most are unsightly: covering them with boards or plastic ; turning them around and leaving them dark. Mr. Hardt informed the new Commissioners that when Greve Court submitted the Pylon Sign, they were told to return if any additional tenants wished to be added to it, They did not de this so the sign is in non-compliance . Mr. Hardt had visited the location during the first hearing this evening and he believes the sign can be removed by taking out the 4 belts that appear to be holding it. The tenant can do this himself. Several methods of covering the sign were suggested. Commissioner Brodie informed Mr. Treshansky of a peel and stick material called MILLSTICK which could be put on masonite er plywood to cover the sign panels . A motion was made by Commissioner Kirby:- I move that we make a recommendation for temporary eliminatin of the Look and Hear nylon Sign with th CP following order of preferences ?). • -a) removal of entire sign, b) use of wood or some other epague panels to . block out opening and make if duronetic co oI r C) turn sign as proposed without lights . The motion was seconded by Commissioner Knaak. Roll Call Vote was taken. Motion passed unanimously. 5. WORKSHOP a) Chairman Hardt reported that the Sign Ordinance was presented to the Village Board . It was a brief presentation and it was approved to hold a public meeting (June 20 possibly) . The staff will review the ordinance and make recommendations . The Board all agreed favorably with the ordinance ! b) Mr. Hardt had a meeting with Tom Fennell, Building Commissioner and they discussed the probability of joint meetings between the ACC and the staff to set forth guidelines for the Appearance Commission and the scope of interests . After all recommends:. tions are made, more detailed guidelines will be implemented . APPEARANCE CONTROL COMMISSION May 25, 1978 - - Page Eight . • Basically what was discussed was having seminars 4n the Lighting, Landscaping and Architecture: having Landscape and Architectural review submitted by staff or a consultant 40 the ACC before the meetings so that we can gain from their expertise . We would not be required to fellow it but At can be used for input and will be valuable in helping reach our decisions . More was discussed and the ACC will be kept inform- ed as the plans progress . It would have been helpful to have a sign count with respect to the amount of income that will be derived by the Village based upon the fee structure . This can possibly be done by the members of the ACC before the next meeting. The following questions were asked of Dominic Savinos- a) 'Dunell. Shopping Plaza Sign is still a hole. The light bulbs have been removed. Was a .notice presented? (no) b) On Grove Court Sign - If they are in non-compliance, can the ACC call them in? (?) • e) Eagle - Osco Sign has holes in it. (Will note) d) Dominick's temporary sign at' Buffalo Grove Mall is buckling. (Noted) e) True 'Value has 5 temporary signs. All spring planting signs which are part of their business. Early Learning Center moving to 83 and Arlington Heights Road . Everything was approved by the ACC previously. =Now the brick, te ._. 'not available --as shown. He came tonight with four possible bricks , one the original and three alternates , one of which was very close in nature , a bit smaller to submit to the Board tonight. In order not to make him wait around I advised him and now I want to make a recommendation that we accept the alternate as presented, with stipulation that he try to obtain the size and shape as first presented if possible . Commissioner Kirby so moved. Commissioner Brodie seconded the motion. Roll Call Vote was taken. Aye-' Commissioners Kirby, Brodie, Berins, Paolillo and Hardt. No - Commissioner Gibbs. Motion passed - 5 to 1. Commissioner Paolillo asked that the Secretary inform the Commission of any additional items of business when she calls for quorum cheek on the day of the meeting. (Agreed.) 6. ADJOURNMENT Motion to adjourn - Commissioner Kirby. Seconded by Com . Brodie. The meeting was adjourned at 11:55 P.M. by unanimous vote. The motion was seconded by Commissioner Gibbs. Roll Call Vote was taken. Motion passed unanimously. 3. MODEL AREA SITE PLAN • Motion was made by Commissioner Brodie:- I move we accept the Model Area Site Plan with the following stipulations : a) that the Sugar Maples be deleted in favor of Norway Maples or Seedless Green Ash; • b) that the underground facilities be staked prior to planting with the possible addition of an on site placement with the Forester. c) included in the disclosure statement the builder shall specify the size and ouantity of landscaping; d) the stockade fence be changed to five (5) feet to meet our current ordinance; • e) light pole shall be stained to match the fence. Motion was seconded by Commissioner Berins. Roll Call Vote was taken. Motion passed unanimously. • 4. LANDSCAPING and STREET TREE PLANTING • Motion was made by Commissioner Gibbs; • - • I move we accept the plans with the reservations as put forth in the recommendations from the consulting Forester, a copy of which the Builder has . We recommend his land developer contact • our Forester and/or his engineer to work out the proper spacing of trees-, the proper variety of trees , and the addition of trees along Arlington Heights Rd . and also the detention area. That they also discuss the amount of top soil that is necessary to meet the requirements of the Village of Buffalo Grove; and that whatever is settled upon that this decision be continued in the whole sub-. division,to eliminate the builder coming back for each phase. On the island - the recommendation being very much in accord with the presentation which was presented, and which will require minimum maintenance , shown were two (2) trees and small growing types of evergreens. Also provide that where two (2) inch trees are used they shall be staked ; or if two and one-half (2i) inch trees - not staked. Treatment of the detention area to be negotiated with the Forester and engineer. The motion was seconded by Commissioner Paelillo. Roll Call Vote was taken. Motion passed unanimously.
