APPEARANCE CONTROL COMMISSION MEETING
VILLAGE OF BUFFALO GROVE
SEPTEMBER 9, 1976
In the absence of Chairman Glauner, Acting Chairman Ronald Helms called the meeting
to order at 8:20 P. M. in the Municipal Building, 50 Raupp Blvd. Roll call was taken.
Those present: Acting Chairman, Ronald Helms, Commissioner Dennis Gramm, and
a prospective Commissioner, a Landscape Architect, Mr. Russell Tolle, sitting in for
his first meeting. Administrative Assistant, William Whited was also present.
Acting Chairman Ronald Helms moved to waive approval of the minutes of the last
regular meeting of the Appearance Control Commission because of the lack of members
present.
The Buffalo House
Commissioner Gramm was excused from participation at this time, and discussion
followed in regard to The Buffalo House. Mr. Phil Kupritz, of the firm of Jaeger,
Kupritz, Ltd. , presented drawings containing two pieces of information: (1) the plans
of The Buffalo House Restaurant, which he stated has to at this time undergo a major
inconvenience in that the widening of Buffalo Grove Road necessitates the building be
moved, and (2) an exterior prospective drawing which shows the restaurant as it presently
is and the addition as it is proposed will be put onto the building. These plans showed
the future proposed placement of the building and stated that new construction would be
necessary and would be placed directly behind the building, as they want to preserve the
character of the present existing two-story building as much as possible, with the exception
of adding natural wood siding and asbestos asphalt shingle roofing to enhance the structure.
He then discussed the proposed vegetation to be added, stating that they planned to include
in the vegetation two mature trees which are presently on the property. He stated that the
parking lot would have to be moved back and would be extended. Acting Chairman Helms
commended them on trying to save the building, and then asked questions regarding plans,
i. e. , if the parking lot could be screened from the view of the street, and questioned
the hardiness of some of the plant material. He also asked about the placement of
dumpsters, air conditioning units, etc. Mr. Kupritz stated that because of the slope
into the parking lot, it would be much lower than the street, making screening unnecessary
or impossible. The plant material, as Mr. Kupritz stated, had been used in his work in
Addison, and had worked out very well as far as hardiness. He also responded that
exhaust vents and any other mechanical equipment could hide behind and be placed in the
crotch of the back of the roof at the back of the building so that it would not be visible
to the street, and that the dumpster would go directly behind the building at the service
entrance, and that present vegetation would screen this from Lake-Cook Road, which
will run in back of the building.
Prospective Commissioner, Mr. Tolle, stated that caution should be taken in doing ex-
cessive grading not to disturb the two existing mature trees, since they are an integral
part of the proposed landscape design.

Acting Chairman Helms stated that if everything was completely acceptable ,
the Appearance Control Commission could give an automatic stamp of approval
by issuing a "Certificate of Appropriateness ," but because of lacking infor-
mation at this time and lack of members for a Quorum to vote to approve or
disapprove of the plan, this Board could make a summary, which report could
be taken directly to the Village Board. Acting Chairman Helms suggested tha
in the meantime Mr. Kupritz address himself to items such as the planting
plan, which seems thin, particularly in regard to softening of the parking
lot, the hardiness of some of the plantings , and the use of evergreens
rather than some of the deciduous ones .
Centex Homes Corp.
Discussion then turned to the Centex Development, with Commissioner Gramm
returning to the Board. Mr. Robert Fogarty, Construction Manager, and
Mr. David Wheatly, Vice President of Planning dnd Design, were present to
show pictures and plans for approval of models of two two-story models ,
two split-level models , and one raised ranch model , explaining details
of homes , elevations , types of materials to be used, etc. Acting Chairman
Helms asked questions pertaining to sump pump placements , and suggested
that this matter be carefully considered in an effort to prevent problems
in drainage in the development . He also brought up the question as to
where the mailboxes would be placed and it was the concensus that this is
left up to the postal service. It was stated that no landscaping would
be provided with the homes , that would be left up to the homeowner.
Mr. Fogarty stated that there would be a definite regulated mix of models ,
color schemes , etc. per block. The homes would be marketed for a range of
between $59 ,000 to $68 , 000 . It was then stated that Mr. Wheatley and
Mr. Fogarty could return for the next Appearance Control Commission meeting,
at which time the Architect would be able to give his opinion and a
concensus could be reached.
A motion was moved by Commissioner Gramm to have Mr. Russell Tolle appointed
to the Commission, and Mr. Helms seconded the motion. The motion carried
unanimously.
The meeting adjourned at 9 :45 P.M.

ORDINANCE NO. 76 -

LANDSCAPE ORDINANCE
SECTION 1 - APPLICABILITY OF ORDINANCE - The provisions of the following
sections are applicable to every lot with respect to which a zoning or building
permit is required for any new structure or enlargement of any existing structure
is hereby required.
SECTION 2 - LANDSCAPIWG AUTHORITY - The Village Manager or his authorized
representative is hereby empowered to inspect, regulate the planting, preserva-
tion and maintenance of trees on the parkways of the streets of Buffalo Grove.
Such authorization is subject to the review of the Appearance Control Commission.
No person shall plant any tree, shrub, or any other woody plant on any Village
parkway until the Director of Public Works has issued a permit for such planting.
SECTION 3 - LANDSCAPING SPECIFICATIONS -
A. All specifications in regard to species, preparation of seed bed etc.
will be listed in the appropriate chapter of the Manual of Practice and must be
followed when landscaping is done in Village Public Ways.
B. Minimum caliper of shade trees shall be 2 inches or as specified in
the Manual of Practice.
SECTION 4 - SPACING OF TREES - Spacing of trees shall be as follows:
A. All new planting in parkways shall conform to the following spacing
tables but not closer than within 30 (thirty) feet from the property line of a
street intersection.
1. Shade trees - typical trees will be 40 (forty) feet apart.
2. Smaller species trees will be planted proportionately closer

together as specified in the Manual of Practice.
B. Spacing of existing trees shall be brought into conformance with
the above table through normal attrition and gradual planned removal of
undesirable, diseased or dangerous trees.
C. Species variation -four different species of tree must be planted
per mile of street.
SECTION 5 - SAFEGUARDING TREES - The following safeguards should be
observed:
A. Construction: During any type of construction work, the owner or
contractor shall place such guards around all nearby trees on the parkway to
prevent injury to such trees. Guards are ideally to be at drip line but a
minimum of 20 (twenty) feet diameter and keep in good appearance. Acceptable
guard specifications are located in the Manual of Practice.
B. Wires in Trees: No person shall attach or connect without prior
approval of the Village Manager's authorized representative any electric or
other wire to any tree on a parkway, nor permit any such wire to come in contact
with a parkway tree.
C. Signs: No person shall attach any sign, placard, or poster without
prior approval of the Village Manager's authorized representative to any tree
growing in the parkway.
D. Materials around Trees: No person shall place or maintain upon the
ground around a parkway tree any surfacing or material which will impede free
passage of water and air to the roots.
SECTION 6 - PROPERTY OWNERS RESPONSIBILITY
• A. Boughs Projecting over Sidewalks: It shall be the duty of the owner
or person in possession or control of any piemises upon which any tree is located,
the boughs of which project over the sidewalk, in any public street in the
Village, to keep such trees so trimmed that such boughs shall not project over
such sidewalk at a height less than 8 (eight) feet above the sidewalk.
B. Trimming or Removing Trees: No person shall , without a written permit
from the Director of Public Works, remove, destroy, break, cut, deface, trim or
injure or interfere with any tree, shrub or woody plant growing in any street,
parkway, or Village public place.
SECTION 7 - DISEASED AND NUISANCE PLANTINGS
Nuisance: Any tree infected with a disease, as determined by laboratory
analysis that cannot be cured and is a danger to other trees, is hereby declared
to be a public nuisance and subject to abatement as such and it shall be unlawful
for the owner of the property within the Village whereon such a tree is situated

to possess or keep such a tree after notification of the discovery of the
infection.
Trees, or parts thereof, in a dead or dying condition that serve as
a breadding place for European Elm Bark Beetle (Scolytus Mullistuatus) , are
hereby declared to be a public nuisance and it shall be unlawful for the person
owning the property whereon the same is situated to possess or keep the same
within the Village.
SECTION 8 - NOTICES TO REMOVE TREES
A. NOTICE: The Director of Public Works or his representative shall
give to the owner of the premises where any public nuisance described in Section 7
shall be found, a written notice shall require the removal and proper disposal
of same within 21 (twenty-one) days following such notice, with removal and
disposal to be under the supervision of the Public Works Director of his
representative. The notice shall also advise the owner that unless such nuisance
is removed and proper disposal is in compliance with the terms thereof within
such 21 (twenty-one) day period', the Village will proceed with the removal and
disposal of such nuisance. Serving of such notice shall be by personal service
to the owner where he/she resides in the Village. Where the owner is a non-
resident or cannot be located within the Village, the notice shall be served by
registered mail, addressed to the owner at his last known address.
B. NEGLECT TO REMOVAL OF NUISANCE: If such owner shall neglect to abate
such nuisance and cause the removal and disposal of such tree or part thereof,
the Village, by its agents, servants or independent contractors engaged by this
Village, shall go upon such property to cut down, remove and cause the proper
disposal of such nuisance and the owner shall be assessed a sum equal to the
cost of such removal and proper disposal.
Agents, servants, employees, or independent contractors engaged by the
Village may go upon any private property in the Village for the purpose of
examining trees to detect a diseased condition for the purpose of removing a
small portion of any branch as a sample to be transmitted to a laboratory for
tests, for the purpose of spraying any tree, and for the purpose of removing
any diseased tree. Written notice shall be sent to the owner of the property
prior to any such action informing him of the nature and extent of the action to
be taken.

SECTION 9 - PRIVATE LAND PLANTING - Height: No person shall maintain any
hedge or shrub or tree along the sidewalk abutting his premises, that is within
30 (thirty) feet of the nearest right-of-way line of any intersecting street, at
a height greater than 2 (two) feet, nor shall any such person fail to keep such
hedge trimmed to the right-of-way line of any intersecting street, at a height
greater than 2 (two) feet, nor shall any such person fail to keep such hedge
trimmed to the right-of-way line. No person shall maintain any hedge, shrub or
tree anywhere upon his premises which interferes with the clear view of traffic
by drivers approaching an intersection. Corner lots may be treated as per
recommended in the Landscape Appendix.
SECTION 10 - DEVELOPMENT PLANTING
1. A planning scheme must be submitted for approval by the Appearance
Control Commission and Village Board of'Trustees for all commercial buildings,
planned unit developments, and industrial buildings. This plan must be prepared
by a landscape architect in accordance with the Appearance Plan of the Village of
Buffalo Grove.
2. A planting scheme shall be submitted for approval by the Appearance
Control Commission and the Village Board of Trustees if detached single family
homes in a standard subdivision are being sold with a general landscaping plan.
SECTION 11 - PENALTIES - Any person violating any of the provisions of
this ordinance shall be fined not less than $5.00 (five dollars) nor more than
$200.00 (two hundred dollars) for each offense. Each day during which a violation
of this ordinance continues shall be considered a separate and distinct offense.
Imposition of any penalty for a violation of this section shall not be construed
as a waiver of the right of the Village to collect the costs of removal of such
nuisance in accordance with the provisions of this section where it is necessary
for the Village to move such nuisance as herein above provided.
This ordinance shall be in full force and effect from and after its passage
and approval according to law.
