1999-05-05 - Plan Commission - Minutes PUBLIC HEARING BUFFALO GROVE PLAN COMMISSION May 5, 1999 Petition for the approval of a Special Use to operate a Child Day Care Home 606 Hawthorn Road, in the R-5A One-Family Dwelling District Chairman Goldspiel called the hearing to order at 7:30 p.m. in the Village Council Chambers, Buffalo Grove Municipal Building, 50 Raupp Boulevard, Buffalo Grove, Illinois. Chairman Goldspiel read the Notice of Public Hearing as published in the Buffalo Grove Daily Herald, explained the procedure to be followed for the public hearing, and swore in all persons who wished to give testimony. Commissioners present: Chairman Goldspiel Mr. Krug Ms. Howard Mr. Samuels Mr. Trilling Mr. Ottenheimer Commissioners absent: None Also present: Mr. Alex Osetinski Mrs. Valentina Osetinskaya Mr. Jeffery Berman,Village Trustee Mr. William Reid, Village Trustee Mr. William Raysa, Village Attorney Mr. Robert Pfeil, Village Planner Mr. Osetinski stated they are requesting approval for a day care license and special approval in their home. Commissioner Samuels asked the petitioners if they are already operating a day care facility in their home. Mr. Osetinski stated yes. Commissioner Samuels asked how many children come to the home. Mr. Osetinski stated yes. Commissioner Samuels asked how many children are allowed under the State license. Mr. Osetinski stated eight children are allowed. Commissioner Samuels asked if the petitioners have read the ordinance requirements for day care homes. Mr. Osetinski stated yes. Commissioner Samuels asked what time the children come to the house. Mr. Osetinski stated the children come to the house at about 7:00 a.m. and stay to 5:30 p.m. Commissioner Samuels asked if there are any helpers for the petitioners. Mr. Osetinski stated it is just he and his wife. Commissioner Samuels asked if the parents drive to the home and drop off the children. Mr. Osetinski stated they have a large driveway and the parents come up the driveway. He noted he added a large area to the driveway several years ago. Commissioner Samuels asked how long children have been coming to the house for day care. Mr. Osetinski stated children have been coming to the home for about four years. He further noted his wife took special classes in order to get her license. Commissioner Samuels asked when Mrs. Osetinskaya received her license. Mr. Osetinski stated she received her license in 1993. Commissioner Samuels asked how longthe five children have been comingto their home. Mr. Osetinski stated they have been coming for about 4-5 years. He noted they first started with one child for about a year. After that two or three more children started coming slowly at first. Commissioner Samuels asked who lives in the house. Mr. Osetinski stated he and his wife live there. Commissioner Samuels asked if the parents ever park in the street. Mr. Osetinski stated no. supervised. Commissioner Samuels asked if the children play outside the home and if they are su p Mr. Osetinski stated yes. He noted he and his wife are always with them. Commissioner Samuels asked if the children are taken for walks around the block. Mr. Osetinski stated no. He further stated they have a playground in their yard. Commissioner Samuels asked if the neighbors are aware of this day care. Mr. Osetinski stated he went around to all his neighbors and told them of this day care quite some time ago. Commissioner Samuels asked if the street the home is located on is a normal Village street. Mr. Osetinski stated yes. Commissioner Samuels asked if the street is straight or if it curves. Mr. Osetinski stated it is straight. Commissioner Samuels asked how many rooms are in the house. Mr. Osetinski stated they have five bedrooms. Commissioner Samuels asked if there is a basement. Mr. Osetinski stated it is a bi-level home so there is no basement. Commissioner Samuels asked what parts of the house the children are in. Mr. Osetinski stated they go in the lower level. They have a large family room there with an eating area and sleeping area. Buffalo Grove Plan Commission-Public Hearing-May 5, 1999-Page 3 Commissioner Samuels asked how old the children are. Mr. Osetinski stated they are 2-3 years old. Commissioner Samuels asked if there is a bed for each child. Mr. Osetinski stated they have lots of beds. Commissioner Samuels asked where the people who bring their children come from. Mr. Osetinski stated they come from Palatine and Buffalo Grove and close areas. Commissioner Krug asked if the petitioners have any children of their own. Mr. Osetinski stated he has twins, 28 years old. Commissioner Krug noted the driveway appears to have room for only two automobiles. He asked how many people come to drop off/pick up the children at the same time. Mr. Osetinski stated there are one or two at most at the same time as the children come at very different times. He further noted his driveway can hold up to four cars. Commissioner Krug asked if this venture is the petitioners' only source of income. Mr. Osetinski stated yes. Commissioner Ottenheimer asked who Terry Osetinski is. Mr. Osetinski noted that is his son who no longer lives at the residence. Commissioner Ottenheimer asked if the backyard is fenced. Mr. Osetinski stated there is a metal fence around the backyard. Commissioner Ottenheimer asked if there are any bushes around the fence. Mr. Osetinski stated no. Commissioner Ottenheimer asked if there is any playground equipment in the backyard. Mr. Osetinski stated they have slides,teeter-totters and other equipment. Commissioner Ottenheimer asked what is the latest time of day parents drop off their kids. Buffalo Grove Plan Commission-Public Hearing-May 5, 1999-Page 4 Mr. Osetinski stated they parents start to pick up kids by 4:00 pm and are all gone by 5:15 p.m. He stated children start to arrive by 7:15 a.m. and the last to arrive is about 8:15 a.m. Commissioner Ottenheimer asked if there are other people waiting to bring children to this day care home. Mr. Osetinski stated no. Commissioner Ottenheimer asked if the petitioners plan to increase the number of children they have for day care if approval is granted. Mr. Osetinski stated an increase is not for them. Five or six children is quite enough for them. Commissioner Ottenheimer asked if the petitioners have ever operated any type of day care facility or been doing day care work before they came to Buffalo Grove. Mr. Osetinski stated she has been taking care of children for 22 years in Russia in a very large facility. Commissioner Ottenheimer asked if there have been any complaints from neighbors relative to this day care center. Mr. Osetinski stated never. Commissioner Ottenheimer asked if the driveway configuration is such that four vehicles can fit on the driveway at any one time. Mr. Osetinski stated yes. Commissioner Ottenheimer asked if the petitioners have experienced any kind of difficulties with parents dropping their kids off in the morning and not being able to get into the driveway. Mr. Osetinski stated no. Commissioner Trilling asked how many cars the petitioners own. Mr. Osetinski stated one car. Commissioner Trilling asked if the petitioner's car is parked in the garage. Mr. Osetinski stated yes. Commissioner Trilling asked if the granting of a license by the Village for six children would be Buffalo Grove Plan Commission-Public Hearing-May 5, 1999-Page 5 acceptable to the petitioners. Mr. Osetinski stated they would prefer to have the license for eight children. It is possible at some time they may have eight children for a short period of time if they come part time. He noted he is asking for a license for eight children from the Village just like their State license grants. Commissioner Trilling noted there is a very large evergreen next to the driveway. Mr. Pfeil stated it appears to be a large evergreen on the east side of the driveway. Mr. Osetinski stated that was correct. Commissioner Trilling noted the branches of the evergreen now extend 1-2 feet over and onto the concrete driveway. Mr. Osetinski stated he can cut some of the branches. Commissioner Trilling noted the branches need to be trimmed sufficiently to allow a passenger to come out of the car and also to allow cars pulling out to see down the street for both cars and pedestrians. Commissioner Trilling suggested the branches be cut 4-5 feet off the ground to allow for pedestrian sighting. Commissioner Trilling noted the operation of this facility should be harmonious with its surroundings. He noted the property should be maintained both physically and aesthetically to make the operation invisible to others. Chairman Goldspiel noted Mr. Sheehan's memo of May 3, 1999 states that all items found to require repair have been repaired. He asked if that is correct. Mr. Pfeil stated that is correct. Chairman Goldspiel noted the deck in the children's play area was constructed without a permit and is still not in conformance with the building and zoning codes and needs to be brought into compliance or removed. He asked how this item was fixed. Mr. Pfeil stated it was removed from the property. Chairman Goldspiel asked where the nearest day care home is located relative to the proposed day care use. Buffalo Grove Plan Commission-Public Hearing-May 5, 1999-Page 6 Mr. Pfeil stated the closest day care home approved by the Village is on Stillwell about 1500 feet to the east of the proposed use. Chairman Goldspiel asked if the plat shows the house as expanded. Mr. Pfeil stated the plat is dated 1993 and asked if it shows every improvement to the house. Mr. Osetinski stated this is the only plat he has. Mr. Pfeil stated he checked the building permit records and there is no plat more recent and there was no evidence of any other permits. Therefore, he believes this plat does correctly show the footprint of the house. Mr. Raysa noted the DCFS license was issued as of August 1, 1997. He noted the DCFS license also states the area used for children is to be the lower level only. Chairman Goldspiel noted the DCFS license requires outdoor play space for children so perhaps they are referring to the lower level portion of the house only. Commissioner Ottenheimer asked if there is a bathroom for the children on the lower level. Mr. Osetinski stated yes. He further noted they have a large family room area in the lower level as well as the eating area. Commissioners present: Chairman Goldspiel Mr. Krug Ms. Howard Mr. Samuels Mr. Trilling Mr. Ottenheimer Commissioners absent: None Also Present: Mr. Alex Osetinski Mrs. Valentina Osetinskaya Mr. Jeffery Berman, Village Trustee Mr. William Reid, Village Trustee Mr. William Raysa, Village Attorney Mr. Robert Pfeil, Village Planner 606 HAWTHORN ROAD - SPECIAL USE FOR A CHILD DAY CARE HOME IN THE R-5A DISTRICT Moved by Commissioner Samuels, seconded by Commissioner Krug to recommend approval to the Village Board of the petition for a Special Use to operate a Child Day Care Home in a single- family residence in the R-5A One-Family Dwelling District regarding the property commonly known as 606 Hawthorn Road, pursuant to the testimony given at the public hearing, subject to trimming and maintaining the evergreen on the east side of the driveway to ensure adequate visibility for motorists and pedestrians. L Commissioner Krug stated he believes the petitioner has met all of the requirements under Section 17.28.040 for criteria for Special Use,paragraph A, items 1 through 6 and he will therefore vote in favor of the petition. Buffalo Grove Plan Commission-Regular Meeting-May 5, 1999-Page 1 Commissioner Samuels stated the testimony has supported this petition adequately and that the special use criteria have been met. He further noted that the current petition could be used as a favorable example to other residential day care operators concerning how to operate a child day care home properly and in harmony with the neighborhood. He noted that the neighbors have not objected to this day care because it is seamlessly integrated into the neighborhood. He commended the petitioner for this fact and stated the petitioner should,however, have come to the Village earlier for the required zoning approval. However,as there was no objection from any neighbors, it is evident that there is no detriment to the neighborhood that would result if this use were granted. Chairman Goldspiel stated he is sensitive to the part of the ordinance that requires not putting too many day care homes in one area. The granting of this use raises the issue of whether this part of the Village is becoming saturated with child day care homes. He indicated that he would be reluctant to approve any more day care homes in this area. Chairman Goldspiel called for a vote on the motion and the vote was as follows: AYES: Krug, Howard, Samuels, Trilling, Ottenheimer, Goldspiel NAYES: None ABSENT: None ABSTAIN: None The motion passed 6 to 0. APPROVAL OF MINUTES Moved by Commissioner Ottenheimer, seconded by Commissioner Howard to approve the minutes of the public hearing of April 7, 1999. Chairman Goldspiel noted several corrections required on page 6 and noted one correction required on page 7. All commissioners were in favor of the motion as amended and the motion passed unanimously. Moved by Commissioner Samuels, seconded by Commissioner Krug to approved the minutes of the public hearings of April 21, 1999. All commissioners were in favor of the motion and the motion passed unanimously. COMMITTEE AND LIAISON REPORTS \../ Commissioner Ottenheimer attended the Village Board meeting on May 3, 1999 and noted the following items: 1. Approval of the Veterinary Specialty Clinic on Busch Parkway and Milwaukee Avenue. Buffalo Grove Plan Commission-Regular Meeting-May 5, 1999-Page 2 2. Proposed retail and service development in Lot 2 next to the Waigreens development on Lake Cook Road was rejected 3 to 2 due to serious issues with parking and easements 3. Referral of a Special Use by Nextel Communications for retail sales in the Industrial District on Johnson Drive in the Chevy Chase Business Park `./ CHAIRMAN'S REPORT Chairman Goldspiel noted a newspaper article The Daily Herald which discusses the benefits of including sidewalks in developments. FUTURE AGENDA SCHEDULE Mr. Pfeil noted the next meeting is scheduled for May 19, 1999 which will have two public hearings. PUBLIC COMMENTS AND QUESTIONS -None STAFF REPORT Mr. Pfeil stated he discussed the Commission's idea concerning increasing the amount of left turn capacity from Commerce Court onto westbound Deerfield Parkway with Mr. Kuenlder. Mr. Kuenlder said it is not feasible because the geometries would make it difficult to modify the current layout to provide dual left turns. He further noted there is opposing traffic on the north side of Deerfield because there is a driveway that is served by the signal. The signal would need some kind of split phasing to accommodate such a movement. The permanent intersection improvement will be completed by approximately September 1st this year, and improvement will add turning capacity to the intersection.
