1989-08-02 - Plan Commission - Minutes REGULAR MEETING BUFFALO GROVE PLAN COMMISSION Home Child Care Zoning Ordinance Amendment Recreational Vehicles in Residential Zoning Ordinance Amendment Manchester Greens Phase I August 2, 1989 Chairman Sheldon called the regular meeting to order at 7:30 P.M. in the Municipal Building, 50 Raupp Boulevard, Buffalo Grove, Illinois. Pfeil, Village Planner APPROVAL OF MINUTES None COMMITTEE & LIAISON REPORTS None PROPOSED AMENDMENT TO HOME CHILD CARE SECTION OF ZONING ORDINANCE Commissioner Rubin proposed that the Commission recommend keeping in place the home occupation ordinance and then having a provision for special use for home care that numbers more than 3 children. You could then have an additional number of children that would have to be in compliance with the State statutes. Commissioner Krug arrived. Commissioner Rubin further suggested that possibly every three years you would have to renew this special permit. The Village would be issuing some type of permit that would have to be regulated. He would not have a problem with the State Statute as it is. Some type of provision should be made for the change in neighborhood. He noted that there was no one in the audience objecting to increasing the number of children in a home day care center over 3 and this item has been well published in the papers. Commissioner Braiman felt the Commission should consider the zoning where the children are located, i.e. , single family, multi-family and transportation problems. This care should be specified to be "for profit" home child care. Consideration should be given to the number of children to be counted, would that include those living in the home? Commissioner Rosenston concurred with what had been said and further there should be a provision for outdoor play area for child care and some type of provision whereby the Village is not liable. Mr. Sheehan stated that currently home day care exceeding the Village's home occupation standards exists in the Village but the Village was unaware of it until recently. There are quite a few day care homes with 3 or fewer children. He did not feel the Village would want to regulate homes with 3 children in the home. Inspection of 3 or under would present an undo burden and the Village does not have the manpower for this. Commissioner Rhodes felt the operators of the 3 or 4 home day care centers the Village is aware of should meet with representatives of the Village and discuss what is involved in this type of day care. Through this cooperative effort something could be compiled for the Commission's review. Chairman Sheldon suggested that the larger day care centers could be represented at this meeting also. If this ordinance regulates other home occupations, the Village should be careful not to legislate these occupations out of compliance with the ordinance. Commissioner Krug suggested that a sign be installed in the front and back of a licensed home day care center. Several Commissioners throught signs would not be advisable. Mr. Sherman felt that those operating outside of the law should be into the brought into compliance. He was in favor of the special permit for over 3 children in a home day care center. Ms. Rothblum felt it would be impossible for the Village to inspect every home that cares for children under varied circumstances. Buffalo Grove Plan Commission - Regular Meeting - August 2, 1989 - Page 2 Ms. Kozlowski stated that she is regulated by the State and is inspected on a regular basis. When she started up her day care she had to advertise, now she has a waiting list. There is a need for this type of day care. Ms. Bieniek worked for a large day care center several years ago and they provide good care. However, she does it out of her home now. She uses her van to transport children in her care to lessons, museums, library or the park. The children that she takes care of are mostly school age. Ms. Fleming felt that several years ago home day care centers took care of more than 8 children without problems. Ms. Lenzini was interested in the special permit requirements. Ms. Sundh was interested in obtaining a copy of the home day care ordinances reviewed by the Commission. Ms. Pikula explained the activities she provided for her day care children, many of whom were pre school age. Mr. Bieniek stated his wife has had day care in his home for several years and he works nights. The children do not make enough noise to wake him up from his sleep. Mr. Pfeil will meet with the Village attorney and try to incorporate the points discussed at this meeting into a document that the Commission can review. This document would be in accordance with the State's regulations. It would keep the existing ordinance but would allow for the use of the backyard for outdoor play for a home day care and have a special use permit created for children in excess of 3. This permit would have a regular renewal date. This item will have another workshop when said document is prepared. Chairman Sheldon called a recess at 8:30 P.M. and reconvened the meeting at 8:41 P.M. ZONING ORDINANCE AMENDMENT FOR RECREATIONAL VEHICLES IN RESIDENTIAL DISTRICT Ms. Tegler submitted her pictures of vehicles parked in several locations in the Strathmore subdivision. She wished to have these pictures returned to her. The Commission concurred that the discussion would not be limited to just recreational vehicles but other items that are parked in a residential district. Mr. Foss felt that recreational vehicle parking was not dangerous but parking of vehicles should not be in an unsightly way. Residents should be allowed to pursue their dreams. They should be allowed to have recreational vehicles in the Village. He cautioned against having this parking restricted to a concrete base or residents could fill in the area around and in back of their homes. People who own recreational vehicles usually only keep them for 5 years. The concrete these vehicles would be required to park on would not be broken up and taken away, but remain. The concrete would also be inviting more problems, i.e. , parking of many vehicles or several cars. Enforcement Buffalo Grove Plan Commission - Regular Meeting - August 2, 1989 - Page 3 of this ordinance has been left up to the Building Department and it should be enforced by the Police Department. During the summer there is a much more significant problem than in the fall when children leave for school and take their vehicles with them. Most people store boats during the winter. In response to Commissioner Rubin, Mr. Pfeil read the section of the ordinance that refers to recreational vehicles. In response to Mr. Foss, Ms. Tegler stated that when someone calls the police non-emergency number to complain about recreational vehicles, no record is kept, therefore there have been no complaints noted. In response to Chairman Sheldon, Mr. Pfeil stated the Village attorney pointed out that the Village has the right not the duty to enforce subdivision convenants under newer annexation agreements but in older subdivisions where ordinances were composed in the 60's and 70's, there is no provision in the language for this. It is a civil matter between the property owners. Commissioner Rubin felt the Village should allow a percentage of coverage of asphalt or concrete for parking of these vehicles in a driveway. He was concerned with family's having many cars and their parking on the grass. Commissioner Braiman suggested that the Commission should consider multi-family parking and this issue. Chairman Sheldon suggested that a time limit be considered for parking of these vehicles. Ms. Tegler stated the Ordinance allows a 35' length for recreational vehicles and felt this was too long. Mr. Pfeil will talk to Chief McCann about enforcement and how it can be handled. He will research and draft some language for the Commission's review for the next meeting on this subject. MANCHESTER GREEN - PHASE I, FINAL PLAT Moved by Commissioner Rhodes, seconded by Commissioner Krug that the Plan Commission recommend to the Village Board approval of Manchester Greens Phase I Final Plat dated July 17, 1989, sheet 7 of 9 AYES: Krug, Rhodes, Howard, Rosenston and Charlette NAYES: Braiman ABSTAIN: Rubin ABSENT: Goldspiel The motion passed 5 - 1 - 1.
