1989-08-16 - Plan Commission - Minutes REGULAR MEETING BUFFALO GROVE PLAN COMMISSION Knopf ' s Subdivision, Lots 1 & 2, Block 2 Vernon Township Property August 16, 1989 Chairman Sheldon called the regular meeting to order at 7:59 P.M. in Clipper's Restaurant, 48 Boulevard, Buffalo Grove, Illinois . Pfeil , Village Planner APPROVAL OF MINUTES Moved by Commissioner Coldspiel , seconded by Commissioner Rhodes, to approve the Regular Meeting minutes of August 2 , 1989 . Approval was unanimous in favor and with Commissioners Rosenston and Charlette abstaining and the motion passed. Moved by Commissioner Goldspiel , seconded by Commissioner Rhodes, to approve the Regular Meeting minutes of July 19, 1989. Approval was unanimous in favor with Commissioner Coldspiel abstaining and the motion passed. COMMITTEE & LIAISON REPORTS Commissioner Howard attended the August 7, 2989 Village Board meeting. There was an informal question and answer session prior to the meeting for Village residents. The following items were discussed: 1 . Residents concern about the park district's aquatic center on Buffalo Grove and Busch Roads. 2 . Residents concern about the number of strip shopping centers in the Village and empty stores. At the Regular Village Board meeting the following items were discussed: 1 . A resolution encouraging Buffalo Grove store owners to package merchandise in paper or bio-degradable plastic bags. 2 . The Village manager reported on the grading for Westchester Subdivision. A resident reported that this grading caused more problems for him. 3 . Village consideration to temporarily close a portion of Port Clinton Road at Sandelwood or restrict traffic on portions of Sandelwood and Acacia because of the cut through traffic in that area. 4 . Motion passed to remove decorative wall at Dundee and Parkview. 5. Preliminary Plan for site lighting and landscaping for the Crossings Shopping Center. 6. There was a preapplication conference on property at Buffalo Grove Road and Route 83. 8 . Commissioner Rhodes asked that Zierks Home Furnishing Wall sign be deferred from the consent agenda. KNOPF'S SUBDIVISION: LOTS 1 & 22 BLOCK 2 Moved by Commissioner Goldspiel , seconded by Commissioner Rhodes that the Plan Commission recommend to the Village Board approval of annexation and zoning in the R-2 District of the Knopf' s Subdivision Lots 1 & 2 with the following variations to Lot 2 only: Zoning Ordinance - Section 17.30.020.b (to allow a front yard of approximately 25.5 feet instead of 30 feet, and to allow side yards of approximately? feet [west] and 2 .6 feet [east] instead of 10.5 feet) with the understanding that the variations apply to the existing buildings and those structures on Lot 2 and if a structure is replaced, the variation would not apply to any new building or structure on that lot. That it being understood that the alley to the south of the property will also be annexed to the Village that it be agreed that the owners of Lots 1 & 2 would maintain the alley until such time as the alley may be vacated. Discussion: Mr. Bodenstein agreed they would like to annex the alley into the Village. AYES: Goldspiel , Krug, Rhodes, Howard, Braiman, Rosenston and Charlette NAYES: None ABSTAIN: None ABSENT: Rubin The motion passed 7 - 0. VERNON TOWNSHIP PROPERTY Mr. Peterson stated they are asking for annexation of 10.5 acres. They are contiguous on the north to Village of Vernon Hills, and on the west and south to Buffalo Grove. They would like to utilize Buffalo Grove water and sanitary sewer, police and fire services. Buffalo Grove Plan Commission - Regular Meeting - August 16, 1989 - Page 2 Outlots 15G, 15E, and 15D will at some time be deeded to the Village of Buffalo Grove and then conveyed to Vernon Township. Outlot 15F was to be a school site in District #103 . The District would rather have a cash donation and when this is paid to them by Vernon Township, the land will be deeded to over to Vernon Township. This will give Vernon Township 5 to 6 acres more. The Township proposes to construct soccer and ball fields on the park site. Buffalo Grove Park District is looking at this as a joint program. Easements are provided for 12 ' water main for expansion to the east side of the tracks. They have deeded property for the completion of Buffalo Grove Road. There will be an easement across the property for the 10' sewer to go to the east side of the tracks. He explained the area that would connect up with the Village water system. They have asked to keep one well for irrigatione purposes and §Mr. Kuenkler is in agreement. They propose to expand their parking lot for additional parking. There is no water retention in the parking lot. He reviewed the buildings on site. They are only giving an easement for the sewer line that would be put in by someone in the future in the middle of the site depicted by arrows on the exhibit. There are lights on the ball fields which will be designed not to shine on the residential areas. There is not nor will there be a speaker system. The tennis courts are not planned to be lighted. Mr. Pfeil stated the buildings on site have not been inspected by the Village. Mr. Kuenkler will verify the stormwater detention for the next meeting. Mr. Anderson stated that on the east side of the Main Street along the tracks they have installed a third lane for parking. Chairman Sheldon suggested consideration be given as to where residents would park when they came to this facility and that the pedestrian traffic should be looked into. Commissioner Rhodes stated the annexation agreement should have language stating that the tennis courts could not be illuminated and the ball fields that are lighted should be constructed so that they do not shine on the residential . Commissioner Braiman would like to know where the Vernon Township boundaries are. Commissioner Goldspiel would like to see the easement on the path through. A five foot sidewalk on Main Street needs to be added to the plan. He suggested connecting the access easements with the Buffalo Grove sidewalk on the top of the plan. Staff will have to analyze the parking to see if it conforms with the Village ordinances. CHAIRMAN'S REPORT The street lights on Checker Road are still not hooked up. Commissioner Krug questioned an advertisement for a tent sale by the Long Grove Chocolate Shop as to whether this went against the ordinance. Skelton, Village Attorney Mr. R. Pfeil , Village Planner Chairman Sheldon read the notice of the public hearing as published in the Buffalo Grove Herald and informed the audience of the format the meeting would take. She then swore in Mr. Bodenstein. The exhibits were those contained Mr. Pfeil ' s memo to the Plan Commission titled Knopf' s Subdivision, Lots 1 and 2, Block 2 and Petitioner' s Exhibits 1 and 2 . Mr. Bodenstein, with the aid of the Plat of Survey and Plat of Annexation, outlined the location of the site. He further explained what was presently on the site at this time. They are requesting variations for the existing structures for the front yard and side yard setbacks. After annexation they may develop Lot 1 with a single family home, which will be in compliance with the Village ordinances. The 12 ' alley was never vacated. The owner has indicated it is part of his back yard and he intends to continue to maintain as it is presently maintained. After annexation to the Village the owner will tap into Village water and sewer and close down his well . The owner's fence line is half way across the alley. The alley was dedicated at the original annexation. Second Street was never fully dedicated. The only variations are for the existing house and garage on Lot 2 . The home on Lot 2 is approximately 80 years old. There are homes on Lots 6 and 7 south of the site. Mr. Pfeil stated the alley is dedicated but not vacated. It would have to be annexed and then vacated. When it is annexed the the Village's boundary automatically goes to the south side of the alley. It may be better to wait for Lots 6 and 7 to be annexed before vaccating the alley. It is platted but not improved and does not provide access to any of the properties including Lots 3 and 5. When Lots 1 and 2 are annexed, all of the adjacent alley would be annexed. If vacated at the that time 6' of the alley would be part of Lots 1 and 2 in Buffalo Grove and 6' would be part of the 2 lots that are not in Buffalo Grove. It may be better to wait until Lots 6 and 7 come into the Village and vacate at that time. Staff has to discuss with the Village attorney whether there would be any problem with vacation now or later. Mr. Pfeil will talk to the Village attorney to see if alleys have to be paved and if that would require a variation in this instance. Mr. Anderson stated that Vernon Township never had nor do they have plans for the alleys. Chairman Sheldon closed the public hearing at 7:58 P.M.
