Exhibits presented during the hearing were as follows: Exhibit A - Preliminary Plan dated December 19 , 1990 Exhibit B - Building elevations dated December 19 , 1990 Exhibit C - Sketch depicting road plan dated December 19 , 1990 Buffalo Grove Plan Comm.-Public Hearing-December 19, 1990 Page 1 Exhibit D -' Preliminary Engineering Plan dated December 10, 1990 Exhibit E - Conceptual landscaping plan dated December 5 , 1990 Mr. Marc Schwartz stated that he is the attorney representing Deerfield Bakery in the process of annexing the property to Buffalo Grove and obtaining zoning approval for the proposed bakery operation. He noted that the site plan has been re- vised during the Plan Commission workshop process. Mr. Sch- wartz said that Mr. Bennett would review the proposed site plan and other exhibits, and he would explain the variations that are being requested. Mr. Bennett stated that the proposed bakery would include production, wholesale, retail , and office uses. The produc- tion facility would occupy approximately 8, 700 square feet of the first floor, the storage area would be 3,000 square feet, the retail area would be 2,000 square feet, and the office use would occupy an area of 2,250 square feet on the second floor of the building. Mr. Bennett stated that variations to the Village Zoning Or- dinance are requested concerning lot area and the south yard setback. He said that the B-5 District requires a lot area of ten acres, and the Deerfield Bakery site is only 1 .86 acres. A yard of 25 feet is required along the south property line, and a variation to allow a yard of twelve feet is re- quested. Mr. Bennett said the 25-foot yard is required be- cause the property south of the site is currently zoned resi- dential by Lake County. Buffalo Grove's Comprehensive Plan designates this area for commercial use, and the variation would not be needed if the property were zoned commercial . Mr. Bennett said the petition includes a request to allow the wholesale and production uses in the B-5 District as special uses and to allow a drive-through service lane as a special use. The Zoning Ordinance would need to be amended to add these uses as special uses, and the Town Center land use map in the Zoning Ordinance would need to be amended to include the Deerfield Bakery site as a Commercial Sub-dis- trict. Mr. Bennett stated that a variation of the Development Or- dinance is requested to allow a side slope of 4: 1 instead of 6 : 1 in the stormwater detention area. Mr. Bennett described land uses adjacent to the site, noting that the Village ' s future post office is to the north across Checker Road, and the Town Center retail area is east of the Buffalo Grove Plan Comm.-Public Hearing-December 19, 1990 Page 2 site. An unincorporated parcel zoned for residential use by Lake County is south of the site, and south of that parcel is an unincorporated parcel zoned for commercial use. Mr. Bennett noted that the Lake County Division of Trans- portation requires a dedication of a 12-foot wide strip of . land along Buffalo Grove Road, and this is accommodated on the proposed site plan. Mr. Bennett stated that the proposed building would be ap- proximately 16 ,850 square feet in area, and would include storage, production, retail , and office areas. A trash enclo- sure of 950 square feet would be within the building. The proposed drive-through lane would be on the north side of the building, and an "escape route" will be provided using brick pavers for customers who need to leave the drive-through lane. Mr. Bennett said the plan provides 63 parking spaces, although the Zoning Ordinance would require 37 spaces based on the proposed areas allocated for production, storage, re- tail , and office uses. Mr. Bennett reviewed the building elevations stating that the design is a "country European appearance. " He indicated that the exterior of the building would use materials including stucco, wood, and cedar shingles. Mr. Bennett stated that me- chanical equipment would be concealed by the roof. ti.. Ruth Anne Buckley reviewed the landscaping plan. Ms. Buckley said the plan uses native elements to achieve color in the spring, fall , and summer, and to provide charm in the winter. She indicated that some of the existing trees on the site will be part of the plan , and a number of new trees and shrubs will planted. Annuals and native grasses will also be used in the plan. She commented that people driving on Buff- alo Grove Road adjacent to the site will see the landscaping, not the parking lot. She said that plant material will be used to "soften" the appearance of the east parking lot and the south area of the site. Mr. Schwartz stated that the requested variations are needed in order to develop the site, which is relatively small and narrow. The lot area variation is needed because the B-5 Dis- trict requires a minimum area of ten acres, and the developer does not have the capability of expanding the site. The re- quest for a 12-foot south yard is consistent with the varia- tion granted to the existing Town Center retail area. He not- ed that the petition includes a request to amend the B-5 Dis- trict to allow the bakery to include production and whole- sale operations, and to allow a drive-through service lane. These operations would be special uses in the B-5 District. Buffalo Grove Plan Comm.-Public Hearing-December 19, 1990 Page 3 Commissioner Rosenston asked if the Village Engineer recom- mends approval of the proposed variation for a 4: 1 side slope in the stormwater detention basin, and he asked if the 63 parking spaces on the plan account for the driveway area needed to provide access to the area south of the site. Mr. Kuenkler said the side slope variation is acceptable, and similar slopes have been used in other developments in the Village. Mr. Bennett said the 63 parking spaces on the plan do not ac- count for the driveway access to the south, but some spaces could be eliminated from the plan without creating a parking variation since the ordinance requires 37 spaces. Mr. Pfeil noted that if all of the building were converted to retail use, approximately 68 parking spaces would be re- quired. Commissioner Rosenston asked how the trash enclosure would be serviced, and he asked about the hours of operation of the bakery. Mr. Bennett said trash would be removed from the enclosure by having trucks enter the dock area of the building. Mr. Kurt Schmitt stated that baking operations would begin at 3 :00 a.m. , with the retail hours being from 6:00 a.m. to 6 : 30 p.m. The bakery would have a total of 40 to 50 employees, some of whom would be part-time workers. Approximately 20 em- ployees would be at the site at one time. Commissioner Rosenston asked what would be the predominant draw for customers to the facility, and he asked if the bak- ery would have a seating area for customers. Mr. Schmitt said customer traffic to the bakery would vary, with donuts being a typical purchase in the morning, and cakes in the afternoon. He stated that he is not sure if the bakery would have a sit-down area for customers. He said the drive-through area would be used for customer pick-up of lar- ger orders. Commissioner Rosenston inquired why a 25-foot yard can't be provided on the south side of the site. Mr. Bennett stated that parking would be lost if the yard were expanded to 25 feet. Commissioner Goldspiel asked for an explanation of the pro- duction and storage uses. Buffalo Grove Plan Comm.-Public Hearing-December 19, 1990 Page 4 Mr. Kurt Schmitt said the storage area would be used for raw ingredients including flour, sugar, and cardboard boxes. �,. Materials such as cake circles are bought in large quanti- ties. He explained that in the baking process, the dough needs to "rest" before it is baked. Some of the products at the Buffalo Grove operation would be shipped to the Deer- field operation for baking and distribution to stores such as Sunset Foods and other food stores. Commissioner Goldspiel asked about the pattern of truck traf- fic to and from the site. Mr. Schmitt stated that most trucks used in the operation would have 12-foot beds, and are typically a converted pick- up truck. Two trucks would be parked in the garage of the building. Semi-trailers would come to the site occasionally to deliver paper goods. Shorter semi-trailers would deliver flour and other materials. Commissioner Goldspiel asked if parking will be adequate for employees, and if there would be enough parking if a restaur- ant were located at the site. Mr. Pfeil said the plan provides adequate parking for employ- ees based on the Zoning Ordinance standard of two spaces per three employees for wholesale and manufacturing uses . There :.� would be adequate parking for a restaurant use, assuming that a large portion of the building would be used for bakery pro- duction and wholesale storage space. Commissioner Goldspiel asked how access to the property south of the site can be coordinated with the Village's street planning goals for the area. Mr. Pfeil said one alternative for the future street system for the area would be to extend Church Road east of Buffalo Grove Road. A connection to the Town Center parking lot from the Church Road extension is probably feasible. There are two places where the Deerfield Bakery site can connect to the property to the south; these locations are the parking lot east of the bakery building, and the parking lot west of the building. The Village's traffic consultant recommends that the access should be west of the bakery building. Commissioner Braiman asked if easements should be required for both locations so that the Village can evaluate the best location when development south of the bakery is more de- fined. Mr. Schwartz said his client may be willing to consider pro- .. . viding easements at both locations . Buffalo Grove Plan Comm.-Public Hearing-December 19, 1990 Page 5 Commissioner Goldspiel inquired about odors that would be produced by the bakery operation. Mr. Schmitt said the bakery will not produce much odor out- side of the building because exhaust from the ovens will be kept inside the building. The ovens have a separate fire chamber from the baking ovens. Exhaust from the ovens is blended with air inside the building by fans. He said that odor from the ovens would be neglible. Commissioner Goldspiel asked for an explanation of the drive- through service lane. Mr. Schmitt said the drive-through would primarily serve customers picking up large orders, and he indicated that he doesn ' t anticipate that the drive-through will serve a lot small orders. The drive-through is intended to service insti- tutional customers picking up large orders, and usually boxes would need to be loaded into the customer's car or truck. Commissioner Goldspiel asked if the drive-through will have a speaker for ordering. Mr. Schmitt said there would not be a speaker, but the drive- through would serve customers who had not called to place an order. Mr. Bennett noted that the drive-through would have stacking space for nine vehicles, and the owner does not think the drive-through will have a large number of vehicles waiting to pick up orders. Commissioner Goldspiel asked why the variation for the 12- foot yard on the south side of the site is justified. Mr. Schwartz said the Town Center retail development was giv- en this type of variation, and the future use of the property south of Deerfield Bakery will probably be commercial , not residential . Commissioner Goldspiel commented that the building setback and the buffer yard on the proposed site plan are less than what the Village requires in its other commercial and indus- trial zoning districts. He said that the fact that the prop- erty south of the bakery site is unincorporated and may be used for commercial development is not sufficient reason to grant the requested yard variation for the bakery site. Mr. Schwartz said the bakery site is very narrow, and it is not feasible to develop the property without the yard varia- tion. Buffalo Grove Plan Comm.-Public Hearing-December 19, 1990 Page 6 Commissioner Rosenston suggested that the bakery site could be expanded by acquiring additional property to the south. Mr. Schwartz said his client only controls the proposed site, and the owner to the south has not indicated a willingness to .sell any property at a reasonable cost. Commissioner Goldspiel said the proposed bakery operation is an industrial use that is not appropriate for Town Center. He said the drive-through would be on infringement on adjacent residential properties. Mr. Bennett commented that the bakery would be designed to have a residential appearance, so he thinks it will fit in well with the adjacent area. Commissioner Braiman asked if the area where access may be provided to the property south of the bakery site is wide enough for adequate traffic movement. Mr. Kuenkler said an adequate access aisle can be provided on the bakery site. Commissioner Braiman said the sidewalk on the plan should be extended to connect to the east parking area on the site. `.. Chairman Sheldon asked if the sidewalk along the south side of Checker Road will be connected to a sidewalk in the Town Center retail area. Ms. Buckley said the sidewalk on the bakery site is designed to link up with the sidewalk north of Checker Road serving the site where the new post office will be constructed. Mr. Schwartz said the developer will try to accommodate good planning for a sidewalk system, but the developer wouldn't want to build a sidewalk along the south side of Checker Road that did not connect to any other sidewalk. Commissioner Rosenston commented that it appears that Town Center does not have a sidewalk along the south side of Chec- ker Road. Commissioner Braiman asked if an adequate tree preservation plan has been submitted for Village review. He noted that some trees that are located where the parking lot will be built are probably worth saving and relocating. Mr. Pfeil said the Village Forester has reviewed the tree survey and landscaping plan, but the Forester and the project landscape architect need to discuss the condition ratings Buffalo Grove Plan Comm.-Public Hearing-December 19, 1990 Page 7 that were assigned to some of the trees in the survey. The Village Forester thinks some trees were given poor rat- ... ings although only minor problems in growth or health were described. The Forester has specific recommendations con- cerning which trees on the site should be preserved. Commissioner Braiman said the south elevation of the build- ing needs to be improved to provide a better appearance, and more landscaping is needed in this area. Commissioner Charlette asked what building materials would be used for the building. Mr. Bennett said brick, half-timber trim, and cedar shake siding would be used. Commissioner Charlette asked if the garage door would be aluminum. Mr. Bennett said the garage door would be aluminum, but it would be painted to match the other building materials. Commissioner Charlette asked about the lighting plan for the parking lot and building. Mr. Bennett said those areas will be lighted, but a plan hasn't been developed for lighting. The plan will be submit- ted for Appearance Commission review. Commissioner Howard said the drive-through takes away from the pedestrian concept of Town Center, and she asked if the sidewalk along Checker Road will be at least ten feet from the road as recommended by Village staff. Mr. Bennett said he would work with Village staff to properly locate the sidewalk. Commissioner Rhodes asked if the Fire Department had comment- ed on the plan. Mr. Pfeil said he had received oral comments from the Fire Department, and there were no major problems with the plan. Commissioner Rhodes said he thinks the drive-through lane is a good feature of the plan because it will eliminate some foot traffic in the parking lot. . He inquired about signage proposed for the site. Mr. Bennett said a pylon sign will be requested, and a hang- ing sign is proposed for the north elevation of the building. Buffalo Grove Plan Comm.-Public Hearing-December 19, 1990 Page 8 Commissioner Rubin said he thinks the drive-through lane is a good idea, and the Deerfield Bakery will draw people into Town Center. He requested that the Village Attorney address ..� the point of sale issue of products produced and sold from the bakery's Buffalo Grove location so that the Village would receive as much sales tax revenue as possible from the opera- tion. �,, Commissioner Braiman suggested that some of the proposed par- king area could be "banked" as a landscaped area to provide more green area on the south side of the site. The parking could be added later if it were needed. Mr. Schwartz said it would be more costly to add the parking later instead of doing the entire parking lot as an initial improvement. Mr. Schmitt said he wants to be sure he has adequate customer parking, and he would prefer to build all the parking as part of the initial improvements to the site. Commissioner Braiman indicated that he wants to make sure that the buffer to the south lot line is as large as possible to protect the adjacent land use, particularly if it contin- ues to be residential . Commissioner Charlette asked if the bakery would have Sunday hours. Mr. Schmitt said the bakery would be open from 7:00 a.m. to 1 :00 p.m. on Sundays. Mr. Raysa commented that signs on the site plan are not ap- proved by the Plan Commission, and are subject to approval by the Appearance Commission. He noted that the Commission needs to consider if the B-5 District will be amended to allow the proposed production, storage, and wholesale uses as permitted uses or as special uses. If a special use is be- ing requested, the petitioner needs to show that the criteria for a special use have been met. Mr. Schwartz stated that the proposed use meets the Village's special use criteria because it will serve the public conven- ience, it will not be detrimental to the public, it will be in harmony with the orderly development of the B-5 District that it will be part of, it will not diminish or impair the use of adjacent properties, it is in accordance with the Village's Comprehensive Plan, utilities are available to serve the development, parking areas will be adequately sized for the use, and traffic congestion will not be created. Some residents addressed the Board with their con- cerns about the proposed plan to widen Lake Cook Rd. 2 . A citizen appeared before the Board to inform them that Wal-Mart is proposing to annex the parcel at the southeast corner of Lake Cook Road and Weiland Road to the Village of Wheeling. 3. The Otis West parcel on Route 83 was annexed to Buff- alo Grove. 4. The proposal to add an anchor building to the Town Center retail area was referred to the Plan Commis- sion. 5. The proposed Harris Bank at Woodland Commons was referred to the Plan Commission. 6 . An ordinance changing the Village's restrictions con- cerning outdoor water use was discussed, and public meetings will be held to review the ordinance. DEERFIELD BAKERY, BUFFALO GROVE ROAD/CHECKER ROAD Chairman Sheldon asked Commissioner Braiman to make a motion for discussion. Moved by Commissioner Braiman, seconded by Commissioner Rosenston , to recommend approval of the proposed amendment of the B-5 District to add production and wholesale bakery oper- ations and a drive-through service lane as special uses, amendment of the B-5 Land Use map to designate the property in the Commercial Sub-district, approval of the Preliminary Plan, approval of a special use for a bakery including pro- duction and wholesale operations and a drive-through service lane, with the finding that the development meets the criter- ia for a special use set forth in Section 17 .28.060 of the Village Zoning Ordinance, with the following variations, sub- ject to the following conditions, and pursuant to the exhib- its presented at the public hearing: 1 . Amendment to Section 17 .44.060.C. 1 .e. of the Zoning Ordinance to add production and wholesale bakery operations and a drive-through service lane for a bakery as special uses; Buffalo Grove Plan Comm.-Regular Meeting-December 19, 1990 Page 2 2. Amendment to Section 17 .44.060 of the Zoning Ordin- ance to designate all of the Deerfield Bakery site in the Commercial/Recreational Sub-district on the Town Center Land Use Map; 3. A variation to Section 16 . 50.040.C. 3. of the Devel- to allow a side slope of 4: 1 in the stormwater deten- tion basin ; `"/ 4. A variation to Section 17 . 44. 060. D. 1 . b. of the Zoning Ordinance to allow a lot area of 1 . 86 acres in the B- 5 District; 5. A variation to Section 17 .44.060.D. 1 . k. of the Zoning Ordinance to allow a south yard width of 12 feet; Subject to the following conditions: 1 . Easements providing access to the property south of the Deerfield Bakery site shall be provided in the east and west parking lots of the bakery property; 2. Trees on the site shall be preserved in accordance with the recommendations of the Village Forester; 3. A screen shall be provided along the south side of the site; 4. The south elevation of the proposed building shall be redesigned to improve the architectural appear- ance. Commissioner Rubin asked if the sales tax issue should be ad- dressed in the motion. Commissioner Braiman amended the motion, seconded by Commis- sioner Rosenston, that the Village staff shall try to garner as much point of sale tax revenue from the operation as pos- sible. Commissioner Rhodes spoke in support of the motion stating that the site plan and architectural design are very good, and the development will be an asset to the Village. Commissioner Goldspiel said he has two concerns about the project. One concern is that the building is too close to the residential district to the south, and he raised the issue of whether or not the Village could legally allow the pro- posed setback variation. The other concern is the issue of Buffalo Grove Plan Comm.-Regular Meeting-December 19, 1990 Page 3 the development of Town Center. The planning concept for the east side of Town Center along Buffalo Grove Road was that parcels would be combined to allow the coordination of development. The area south of the Deerfield Bakery site should not be developed for commercial use because the Vill- age:already has enough retail uses. This area should be used for relatively dense residential development, and the Vill- age's Comprehensive Plan should be updated to encourage this type of residential use. Commissioner Goldspiel said the Deerfield Bakery operation is an industrial use, not a com- mercial use, and it could influence the type of uses that will be proposed to the south. He stated that the Deerfield Bakery use radically changes the character of Town Center. Commissioner Braiman noted that the Deerfield Bakery develop- ment is being recommended for approval as a special use, so the Village can control development of the site, and addi- tional special uses in the area would be carefully reviewed by the Village. He said the Deerfield Bakery development will be good for the Town Center, and will be a benefit to the Village. He commented that stores such as bagel shops pro- duce items that are shipped out to other locations, but the shops are still considered to be retail stores. He said the Deerfield Bakery operation is not a manufacturing use. Commissioner Braiman amended the motion, seconded by Commis- sioner Rosenston, to stipulate that the special use for the Deerfield Bakery is valid only for the owner now petitioning the Village for approval . Commissioner Rosenston asked if this means that the special use ends if the business is sold to a different owner. Mr. Raysa said the special use would terminate if the busi- ness were sold by the present petitioner. Chairman Sheldon commented that the Village is trying to con- trol future use of the building, but at the same time not im- pose a hardship on the current owner. Mr. Schwartz said the limitation of the special use to just the current owner is an unfair restriction on the Schmitt family. Commissioner Goldspiel commented that if the use is accept- able, the zoning approval should not be tied to ownership of the property. Commissioner Rubin suggested that the use should be limited to the amount of area allocated for production, rather than being tied to ownership of the property. Buffalo Grove Plan Comm.-Regular Meeting-December 19, 1990 Page 4 Commissioner Braiman amended the motion, seconded by Com- missioner Rosenston, to stipulate that the special use allows production, storage, retail , and office uses on the property in the amounts as represented on the Prelim- inary Plan presented at the public hearing, and changes to the amount of building area used for each specific use are subject to Village approval . Chairman Sheldon called for a vote on the motion as amended. The vote was as follows: AYES: Rhodes, Howard, Braiman, Rosenston, Rubin, Charlette NAPES: Goldspiel ABSTAIN: None ABSENT: Krug The motion carried 6 to 1 . BUFFALO GROVE TOWN CENTER, UNIT 4 (MICHAEL REESE HMO) - PLAT OF SUBDIVISION Moved by Commissioner Goldspiel , seconded by Commissioner Braiman, to recommend approval of the plat dated December 13, 1990. Commissioner Goldspiel asked if the plat conforms to the ap- proved site plan, and if building setback lines from the two access roads adjacent to the site should be shown on the plat. Mr. Pfeil said the plat conforms to the approved site plan. Mr. Kuenkler said it would be acceptable to show a 25-foot building setback line from both of the access roads. Commissioner Goldspiel amended the motion, seconded by Com- missioner Braiman, to stiplulate that the recommendation to approve the plat is subject to revision of the plat to show a 25-foot setback line from both of the access roads adjacent to the property.
