1993-05-12 - Plan Commission - Minutes PUBLIC HEARING BUFFALO GROVE PLAN COMMISSION May 12, 1993 389 Indian Hill Drive, Special Use for a Child Day Care Home Vice Chairman Goldspiel called the meeting to order at 7: 30 P.M. in Room 24, Buffalo Grove Park District Alcott Center, 530 Bernard Drive, Buffalo Grove, Illinois, and read the Notice of Public Hearing as published in the Buffalo Grove Daily Herald, explained the format of the meeting, and swore in persons who were giving testimony at the hearing. Commissioners present: Mr. Goldspiel Mr. Krug Mr. Rosenston Mr. Samuels Ms. Genell Mr. Berman Commissioners absent: Chairman Silbernik Mr. Rhodes Ms. Howard Also present: Cecilia Woerner, 389 Indian Hill Drive Mr. John Marienthal, Village Trustee Mr. William G. Raysa, Village Attorney Mr. Robert Pfeil, Village Planner The following exhibits were presented by the petitioner at the public hearing: Exhibit A: Copy of child daycare license No. 195543-01 from the Illinois Department of Children and Family Services (DCFS) Exhibit B: Plat of Survey dated July 25, 1989 Ms. Cecilia Woerner stated that she has two of her own children at home and she receives two other children at her home. Mr. Pfeil noted that Brian Sheehan, the Village's Health Officer, had coordinated an inspection of the property and had issued a report dated May 12, 1993. Attachment A to this report cites various items at Ms. Woerner's property that would need to be addressed in order to satisfy Village codes relating to basic safety of the premises. These items include Buffalo Grove Plan Comm-Public Hearing-May 12, 1993-Page 1 improvements to the electrical system of the home to correct items that the Village inspectors believe are hazardous. Ms. Woerner noted that some of the electrical items refer to the basement area, and children in her care are not allowed in the basement. She indicated that she is getting estimates for correcting the electrical system. Vice Chairman Goldspiel inquired concerning how many children Ms. Woerner is allowed to care for by the Illinois DCFS, and for what time period her DCFS license is valid. Ms. Woerner said that her Illinois DCFS license allows her to care for a total of five children, and is effective for the period from October 15, 1992 to October -15, 1994. Commissioner Krug inquired if Ms. Woerner is caring for only two children who are not her own. Ms. Woerner indicated that she now cares for two children who are not her own, but sometimes she will care for three children. Commissioner Krug asked if the fence for the rear yard play area is four feet in height. Mr. Pfeil indicated that Mr. Sheehan has verified that the fence is four feet in height. Commissioner Samuels inquired if Ms. Woerner has received complaints from neighbors concerning her day care operation. Ms. Woerner stated that she has received no complaints, and her neighbors have expressed support for her activity. Commissioner Samuels asked about the hours that children are cared for at Ms. Woerner's home. Ms. Woerner said one child arrives at 7:00 A.M. and usually leaves at 5:00 P.M. ; the other child arrives at 8: 30 A.M. and leaves at 4: 00 P.M. She said that the parents bring the children to her front door. Commissioner Samuels asked if the basement portion of the home is excepted for child care by her DCFS license. Ms. Woerner indicated that the DCFS license excludes use of her children's bedrooms, and children are not allowed in the basement. Commissioner Samuels inquired about the rear play area and the equipment that is provided. Buffalo Grove Plan Comm-Public Hearing-May 12, 1993-Page 2 Ms. Woerner said the play area has a slide, a swing and a sandbox. She indicated that the patio will be repaired as required by the Village to ensure safety of the children. Commissioner Samuels asked if the rear yard play area is cleaned up after the children have been using it, such as picking up various toys. Ms. Woerner said the area is maintained and toys are picked up. Commissioner Samuels reviewed the standards of the Zoning Ordinance concerning child day care homes, including hours of operation, restrictions on outdoor play before 8: 00 A.M. , off-street parking and impact on the neighborhood, and he asked Ms. Woerner if she complies with all the standards. Ms. Woerner stated that she complies with the standards in the Ordinance. Commissioner Samuels asked if Ms. Woerner uses any outside help and what the ages are of the children in her care. Ms. Woerner indicated that the oldest child she takes care of is almost five years old, and the only assistant she uses is her twelve year old daughter who helps her during the summer. Commissioner Genell inquired if the DCFS license limits Ms. Woerner to caring for not more than five children. Ms. Woerner said that is correct for her current license; it is possible that she could qualify to care for additional children in the future. Commissioner Genell asked if Ms. Woerner has informed her neighbors that she is running a day care home; Ms. Woerner said she has talked to her neighbors, and no one has complained about the day care operation. II Commissioner Genell said it would be helpful if the Commission had information concerning the DCFS regulations for day care homes. Vice Chairman Goldspiel noted that DCFS regulations were reviewed by the Commission when the Zoning Ordinance was amended to classify day care homes as special uses. Ms. Woerner commented that the DCFS does a background check on persons who apply for a licence, and each home is inspected to determine if it is safe for children. Vice Chairman Goldspiel inquired what the Zoning Ordinance Buffalo Grove Plan Comm-Public Hearing-May 12, 1993-Page 3 stipulates as the number children that require a day care provider to obtain a special use. Mr. Raysa said that if more than three children are being cared for, a special use is required. Mr. Raysa noted that the Village is concerned with zoning issues that the DCFS does not address. He said the fact that day care homes are in residential districts makes it important to the Village that the impacts on adjacent properties and neighborhoods are carefully evaluated and controlled. He noted that the Zoning Ordinance has specific standards and criteria for day care homes, and the Village has the right to periodically inspect a day care home to verify that the conditions of the special use are being met. He noted that the Zoning Ordinance places a two year period of approval on day care homes, after which the special use must be renewed by the petitioner. He also noted tht the special use granted by the Village to a petitioner becomes void if the provider's DCFS license is revoked. Commissioner Rosenston asked Ms. Woerner if the items noted in Mr. Sheehan's report would be corrected at her property. Ms. Woerner stated that the items would be corrected. Raysa, Village Attorney Mr. Robert Pfeil, Village Planner The following exhibits were presented by the petitioner at the public hearing: Exhibit A: Copy of child daycare license No. 059089-05 from the Illinois Department of Children and Family Services (DCFS) Exhibit B: Plat of Survey dated September 7, 1972 Ms. Margaret Thron stated that in addition to being licensed by the Illinois DCFS she has also been licensed for the past ten years by the Jewish Children's Bureau of Chicago (JCB) . All of the children whom she cares for have been referred to her by the JCB. She indicated that she keeps an extensive file on each child, including information about parental permissions and medication schedules. An attendance sheet is also maintained for each child. She said that she conducts Buffalo Grove Plan Comm-Public Hearing-May 12, 1993-Page 1 fire drills regularly, and the safety of the children is her primary concern. Ms. Thron indicated that the children arrive at her home at 7: 15 to 8: 30 A.M. in the morning, and leave between 4: 30 to 6:30 P.M. She said that she has a la area in the fenced play rear yard of her home. She commented that the children do not make noise when playing in the yard. She said that there is adequate space on her driveway for parents to park when dropping off and picking up the children. Ms. Thron stated that she is providing high-qualitychild care and this is a P g needed service in the community. Ms. Thron noted that Brian Sheehan, the Village Health Officer, had coordinated an inspection of her property, and his comments concerning improvements that need to made to her property are Attachment B to his memo dated May 12 , 1993. Ms. Thron stated that she has already taken care of four or five items noted on Attachment B, and would be addressing the other items cited by Mr. Sheehan's report. Vice Chairman Goldspiel noted that the Health Officer's memo and Attachment B dated May 12, 1993 would be entered into the record of the hearing as Exhibit C. Commissioner Berman asked if anything on the property has changed since the plat of survey was done. He also inquired if any outdoor soundsystems are used, and if any employees work for Ms. Thron. Ms. Thron stated that no changes have been made to the property since the plat of survey was done, no sound amplification is used outdoors, and she has no employees. Commissioner Berman asked if outdoor play is allowed before 8: 00 A.M. , and if the fence is four feet in height. Ms. Thron said that outdoor play is not allowed before 8: 00 A.M. , and the fence is four feet in height. Commissioner Berman asked if Ms. Thron will make all the improvements to the property cited in Mr. Sheehan's report. Ms. Thron replied affirmatively. Commissioner Genell asked when the improvements would be done. Commissioner Samuels said that the Village would require the improvements to be done before the special use ordinance is approved by the Village Board. Commissioner Rosenston inquired if children are kept Buffalo Grove Plan Comm-Public Hearing-May 12, 1993-Page 2 overnight at Ms. Thron's home. Ms. Thron said that overnight care is allowed by her Illinois DCFS license, but she is not approved to provide foster care. She that she does not keep children overnight, and if an emergency arises requiring overnight care for a child, she g Y q g g has a list of providers who are approved to care for children overnight. Commissioner Krug cited item number nine of Attachment B to Mr. Sheehan's report, which indicates that the electrical panel in Ms. Thron's home is required to have a main breaker installed. He asked Mr. Raysa if the Village can require such an improvement to be made. He noted that other homes in this part of the Village have similar electrical systems to Ms. Thron's home. Mr. Raysa stated that the Village has the authority to require that a property be brought up to current code standards if an approval such as a special use is being requested. Commissioner Samuels inquired about how long Ms. Thron has been providing day care services at her home. Ms. Thron said she has been providing day care for ten years. She stated that she discussed her day care operation with Verna Clayton, the Village' previous Village Board President. Ms. Thron said she believed what she has been doing was an allowed use by the Village, and she found out only recently that a special use is required. Commissioner Samuels asked if Ms. Thron has received complaints from anyof her neighbors about her daycare P g operation. Ms. Thron said she has received no complaints from neighbors. Commissioner Genell inquired if the Village requires a fence or a landscape screen, and she asked if the Illinois DCFS has the same requirement. Mr. Raysa said that the Village's ordinance requires a fence, and this is intended to provide a screen from adjacent properties and keep the children safely within the rear yard play area. He said that he does not think DCFS requires a fenced play area, but the Village believes that such a requirement is necessary to minimize impacts on adjacent properties and to protect the children in their play area. Joe McDonald, 328 Melinda Lane, stated that he is concerned about the maneuvers that the school bus uses when leaving Ms. Buffalo Grove Plan Comm-Public Hearing-May 12, 1993-Page 3 Thron's home after dropping off and picking up one of the children in her care. He indicated that the bus backs up to Bernard Drive, and this is extremely dangerous for young children who may be playing on or near the street. Ms. Thron noted that the child is picked up and dropped off by the bus at her property, and is transported to a public school. Mr. Pfeil said that he would see if the Village can ask the school bus company to instruct the driver to stop backing up to reach Bernard Drive. Don Smith, 339 Melinda Lane, said he has lived at his residence for 27 years. He commented that Ms. Thron is a good neighbor, and her day care operation is not causing any traffic or noise problems in the neighborhood. He said that Ms. Thron keeps control over the children. Ward Brown, 1097 Miller Lane, said his step daughter is cared Ms. that Ms. Thron provides excellent for byThron. He said care and a nurturing environment. He said that concerning the school bus maneuver, that is up to the school bus company to and school district to control the driver and stop unsafe maneuvers. He said that he does not think the Village should require Ms. Thron to make extensive repairs to her home's electrical system. He said that it is up to the parents who bring their children to a home to determine if the home is safe for their children. Mr. Don Thron, 329 Melinda Lane, stated that good home day care is needed in the community, and Margaret Thron provides this type of care. Commissioner Samuels inquired if Ms. Thron has received an estimate for the electrical improvements needed at her home. Ms. Thron said she not yet received an estimate. Commissioner Samuels asked if the electrical items cited on Attachment B to Mr. Sheehan's May 12, 1993 report are considered hazardous by the Village's electrical inspector. Mr. Pfeil said that although he cannot represent with certainty how hazardous the electrical problems are, he believes that the Department of Building and Zoning and the Deputy Fire Marshal are citing substantive items that need correction to ensure that the home is safe for day care. Vice Chairman Goldspiel noted that a home day care provider is opening up the home to non-residents, and this type of day care is a business. He said that it is entirely reasonable to Buffalo Grove Plan Comm-Public Hearing-May 12, 1993-Page 4 require a greater safety standard for a residence where home day care is being provided than for other residences in the area. He noted that codes and standards change over time, and what was once considered acceptable for home electrical ' systems is not necessarily acceptable by the current codes. Commissioner Samuels said that although more people may be in a home where day care is being provided, he doesn't see how this creates a more dangerous situation than just a residential use. Commissioner Rosenston concurred with Commissioner Samuels that it appears that the Village may be requiring an expensive upgrade of the property although the same type of electrical system exists in other homes in the area. Vice Chairman Goldspiel stated that he accepts the technical staff report, and he believes that the improvements should be made as recommended by the Village's inspectors. Commissioner Samuels indicated that he is concerned that this may be a matter of an old code versus-a new code, and it is not clear to him that the electrical system in Ms. Thron's home poses a safety hazard for children who are in the home. Tammy Thron, 329 Melinda Lane, said that she is Margaret Thron's daughter, and she commented that children are not allowed to play in the basement of the home where the electrical panel is located. Commissioner Rosenston noted that governmental regulations always get more stringent over time, and this poses a problem for residents such as Ms. Thron who may now be faced with making costly repairs to her electrical service to meet current code requirements. Mr. Pfeil indicated that he would ask the Building and Zoning Department to explain their approach toward inspections of day care homes, and to clarify if items concerning electrical improvements are to address hazards or to meet current code standards. Mr. McDonald stated that he is an electrician, and the items cited by the Village concerning Ms. Thron's electrical service are important and would cost approximately $500. 00. Commissioner Samuels indicated that a petitioner for a special use for home day care should bear an undue economic burden to correct items that are not safety hazards. Commissioner Krug inquired if the Village had conducted a radon test at Ms. Thron's property. Buffalo Grove Plan Comm-Public Hearing-May 12, 1993-Page 5 1 I Mr. Pfeil said that a radon test is not part of the Village's inspection of a day care home. It was pointed out that there is no defined standard for what ' level of radon is acceptable in a home. Ward Brown commented that the burden should be on the Village's inspectors to document that items need to be corrected in a home to address basic safety conditions. Raysa, Village Attorney Mr. Robert Pfeil, Village Planner The following exhibits were presented by the petitioner at the public hearing: Exhibit A: Copy of child daycare license No. 197425-01 from the Illinois Department of Children and Family Services (DCFS) Exhibit El: Plat of Survey dated November 2, 1990 Ms. Sophia Farbman indicated that she has a license from the Illinois DCFS effective until January 15, 1995, and she is licensed to care for a maximum of seven children. She said that she is now taking care of two children plus her own child. She stated that she has extensive experience in providing care for children, including working at a commercial day care center and learning emergency first aid techniques. Commissioner Rosenston inquired if Ms. Farbman will be able Buffalo Grove Plan Comm-Public Hearing-May 12, 1993-Page 1 to make the improvements to her property noted on Attachment C to Brian Sheehan's memo dated May 12, 1993. Ms. Farbman indicated that the cited improvements would be made. Commissioner Rosenston asked about how many cars can park on Ms. Farbman's driveway. Ms. Farbman said that her driveway can accommodate three cars. Commissioner Rosenston inquired if the outdoor rear yard play area is fenced. Ms. Farbman said that the yard has a four-foot high chain link fence, but several segments have to be added to make it continuous around the rear yard. She indicated that playground equipment will be added to the rear yard. Commissioner Berman asked if all of the improvements noted on Mr. Sheehan's Attachment C will be made. Ms. Farbman stated that all of the improvements will be made. Commissioner Samuels inquired if Ms. Farbman has received complaints from neighbors about her day care operation, and he asked how long she has been providing care at her home. Ms. Farbman said that she has not received any complaints, and she has been providing care for about three weeks. Vice Chairman Goldspiel noted that Attachment C to Mr. Sheehan's memo dated May 12, 1993 citing improvements that need to be made to Ms. Farbman's property, would be entered into the record as Exhibit C. Vice Chairman Goldspiel inquired why carbon monoxide testing of the furnace was identified on Attachment C as an item that needs to be done at Ms. Farbman's home. Mr. Pfeil said that he would ask Mr. Sheehan why this item was cited. Mr. Raysa inquired if Ms. Farbman's Illinois DCFS license restricts the children to use only the lower level of her home. Ms. Farbman indicated that she is permitted to have the children only in the lower level of her home, which is the family room in her raised ranch home. Ms. Farbman said that the children she cares for at the present time are three and four year olds, but she is licensed to care for infants. Mr. Raysa asked if Ms. Farbman is aware of the Special Use criteria for home day care that was attached to Mr. Pfeil's memo dated May 7, 1993 to the Plan Commission. Ms. Farbman stated that she has read the criteria and standards for home day care in the Village's Zoning Ordinance. Commissioner Samuels commented that the petitioner has established that the criteria for a Special Use have been met, no objections from neighbors have been received, and the use will not adversely affect the health, safety or welfare Buffalo Grove Plan Comm-Special Meeting-May 12, 1993-Page 1 of the area. He said that there is a need in the community for good quality home day care. SPECIAL USE FOR A CHILD DAY CARE HOME AT 329 MELINDA LANE Moved by Commissioner Berman, seconded by Commissioner Samuels, to recommend approval of a Special Use for a child day care home at the property, zoned in the R-6A District, subject to making the improvements to the property cited in Attachment B to Brian Sheehan's memo dated May 12, 1993 . Commissioner Samuels commented that the Village staff should provide more details concerning Item No. 9 on Attachment B which requires a main breaker in the electrical panel. The staff should verify if this improvement needs to be done to correct a safety hazard. Commissioner Berman noted that the petitioner adequately addressed the criteria in the Zoning Ordinance concerning the requested Special Use for a child day care home. Commissioner Rosenston noted that the criteria limit home day care to between 6:00 A.M. and 8:00 P.M. , and the petitioner has stated that this standard will be met. Commissioner Rosenston commented that the Building and Zoning Department needs to provide more information concerning what is being evaluated in inspections of day care homes. He said the Commission needs to know if the inspections are to bring the property up to present codes or to identify significant life-safety items that need to be corrected to make the home safe. Commissioner Samuels concurred that such a clarification is needed so that petitioners will be required to make improvements to address life-safety items, but not be burdened with expensive renovations that are not needed for Buffalo Grove Plan Comm-Special Meeting-May 12, 1993-Page 2 safety. Commissioner Rosenston noted that the petitioner had adequately addressed the criteria in the Zoning Ordinance for a Special Use for a child day care home. CIOLINO CENTER - FINAL PLAT `./ Commissioner Samuels inquired when the zoning and site planfor this property were approved.Mr. Pfeil indicated that the property was annexed and zoned in 1988. Commissioner Samuels asked if the Special Use in the B-3 District had lapsed. Buffalo Grove Plan Comm-Special Meeting-May 12, 1993-Page 3 Mr. Pfeil indicated that the property is subject to an annexation agreement with a term of 20 years, so it would appear that the right to build the proposed building is still in effect. Commissioner Rosenston made a motion to recommend approval of the plat dated April 28, 1993 subject to provision of the interior angles as required by the Village Engineer. Commissioner Samuels commented that consideration of the plat should be tabled until the Village Attorney renders an opinion on the status of the B-3 Special Use zoning for the property. Commissioner Rosenston made a motion, seconded by Commissioner Berman, to defer consideration of the plat until a determination has been made that the zoning is still in effect and the approved plan is still valid. Commissioner Samuels noted that the Plan Commission needs to analyze this type of situation when an approved plan has not been implemented for a period of time-to ensure that the character of the area has not changed to the extent that the originally approved zoning is no longer appropriate for the site.
