The Public Hearing was called to Order at 8:05 p.m. The Public
Hearing on pre-annexation land use of a property currently owned
by the Wheeling Trust Bank was called to Order. Mr. Mark Beaubien,
an Attorney, and Mr. Ed Matus, a Realtor, appeared on behalf of
the owners of the property. A plat of survey was introduced and
that plat showed the land involved to be divided into pieces which
were marked "A" and "B". The piece marked "A" is proposed to be
zoned B-2 with special use for a gas station. It is 3.7 acres.
The piece of land marked R-9 is 5.1 acres and it is proposed to
development apartments on that piece of land. The owners of the
land offered to enter into a covenant with the Village providing
no buildings would be erected on any of the ground until the
placement of Lake Cook Road is established. They also offered
a covenant to build no more than 16 units per acre with a maximum
of 50% two bedroom units and no three bedroom units. The Commis-
sion asked that the Bank was prepared to submit an affidavit as
to ownership if asked and the representative of the owners agreed
to supply such Affidavit if required by the Board of Trustees. It
was represented to the Planning Commission that the owners of the
Land will develop the property themselves.
The Planning pointed out that the parcel marked "A" and in-
tended for B-2 zoning was only 3.7 acres and that 4 acres were
required as minimum acreage for B-2 zoning.
The Planning Commission suggested that a land donation might
be asked. Mr. Beaubien indicated that the owners would be adversed
to any land donation because there was very little land to begin
with in the plat. However, they did agree $100.00 per unit cash
donation. He also indicated that the owners would be willing to
covenant come back to the Planning Commission with plans for final
approval of the R-9 development relating to architecture, storm
drainage, and lay out and also agree that they would covenant that
no apartments would be placed above any of the businesses if any

were put in the B-2 zoning.
Mr. Beaubien indicated that they would present a new plat of
survey showing 4 acres in parcel "A" in Order to come within our
B-2 zoning regulations.
Mr. Beaubien came drawings as to proposed apartments structure
but refused to submit either the external or internal drawings as
exhibits.
The meeting unanimously adjourned at 9:10p.m.
