Haarr seconded to approve the minutes of the Public Hearing of November 12; approved unanimously. . J. Guidotti moved and S. 727aarr seconded to approve the minutes of the regular meeting of November 19; approved unanimously. Chairman Berth briefly summarized actions taken by the ViiI.Ce 'Board in their meetings of November 24 and December 1. He said that comments were made concerning the Clemente property that indicated it could be approved as a non-conforming use in accordance wit!: Article V of the Zoning Ordinance. Because of the large crowd (appron 50 to 60 people) in attendnnce to hear Richard Brown's prop‘. ed chances in his R-9 multiple f.,.,.wi.l%! development north of the Cadaridge subdivision, Chairman Berth delayed discussion of old business to later in the evening and asked Mr :17.31 .,V to present his proposal which is summarized as follows: a. Ordinance No. 68-42 re-classified 2385 acres from 12,2 to a-9 district in accordance with Exhibits:A,B, and C which showed 4 buildings of 4 stories each that contained a total of 550-1 and bedroom apartment units. b. Mr. Brown requested approval to substitute Exhibits A.L3 and C':!. for Exhibits A,B and C. Exhibit AA is an architects sketch pin of the area dated 9-12-69 showing 7 buildings of which 2 are ideatifiee: as 6 floors. Exhibit BE is an architect's rendering of a tyice.l. 4 story building. Exhibit CC is a data sheet which shows ahtotal of 512 units identified as apartment homes, more commonly called con.f.o :LnL:..:Lb, c. Brown - That is essentially correct except that the village can stop it. (b) Mr. Berth - Public hearings are held for all :ire-annexation • requests and •are published in the newspaper. The public has opportunity to voice their opinions at those hearings Q. Mr. John Walker -. If drainage from Dundee Road is taken into the lake, what will this do to the drainage in my back yard? • A. Mr. Brown - Drainage will be away from your house. Q. iL. Jim Bradshaw - What are the chances of their being no 6 story buildings? A. Mr. Brown - About 50-50. Q. Mr. Tom Rappel - What is the height of the highest building? A. Mr. Brown - About 60 feet. Q. Mr. Rappel - Can 't something be done to correct the water 'problem before this development is built? A. M.r. Berth - This will be considered. Mr.. John Smythen - If this plan is accepted, what guarantee- is there that no further buildings will be added later? ' A. Mr. Brown - The ordinance contrors this... Exhibit CC limits it to 512 units. Q. Mr. Lang - I appeal to Mr. Brown to give serious consideration to chan'Jin�'' the 6 story concept. • a��.a2i A. I will study this and possibly move one if not both buildi.n s • Q. Mr:. Walter Fuller - I am concerned aboutthewatersupply about vest i/i J and drainage problem. What will prevent water from draining back to my property? A. Mr. Berth - The Village Engineer approves drainage plans Q. Mr. Fuller - Will the viilage assure no drainage problem? A. Mr. Berth - Cannot guarantee this. , Q. Mr. Marty Clifford - If accepted, will Mr. Brown be held :o his plan? A. Mr. Berth - Yes. Q. Mr. Clifford - If not accepted, will he be held to his previous plan? A. Mr. Fabish - No, he can revert to R-9 and build anything then. At this point Chairman Berth ended the receipt of questions from the audience. J. Cuidotti moved�y to table action yyo�` this :efcuestuntil the i e::t meeting on December 17 to give Mr. Brown n an opportunity to meet with his architect for considering relocating the 6 story buildings. S. Haa.rr seconded the motion. At this point '.sir. Brown stated that he would relocate the 6 story building at the south end to the north- west corner but will have to check into the second one. The motion was voted on without change with yes votes from M n 3rr, Z i .zew_t v and Cuidotti. Mendenhall voted no. It passed 3 to 1 . After the motion passed, Mr. Brown said he is withdrawing his offer to move the one building and left the• meeting. Back to old business, Chairman Berth said that the Plan Commission s,ould start a liaison with the Zoning Board of Appeals and invited all members to attend a Board meeting to be held December ii . Chairman Berth presented his report on the R-9 height limitation study and. said that since the Plan Commission al:.'eady submitted this matter to the Village Board who did not respond favorably, it should be dropped at this time and brought up again vent May. Chairman Berth suggested that work shop sessions to review ordinance changes should start again after the ist of the year. It was noted that two professed applicants to fill vacancies on the Plan Commission were in attendance, Mr. Larry Gaamm was at his • second meeting and Mr. John Walker at his first , J.
