VILLAGE OF BUFFALO GROVE PLAN COMMISSION MINUTES
The meeting was called to order at i:00 P.M. on July 1, 1970.
I. Roll Call : -Present - C. Genrich, M. Hoyt, S. Haarr, H. Mendenhall,
L. Gamm and R. Heinrich. Arnold Seeberg for the

_' At the direction of Chairman the regular order of business was altered
d and the first item considered were fence variation requests by Dana Johnson
' of 951 Checker Road and Mr. James Atkinson of. 921 Checker Road. Mr.
Gamm indicated that notice of fence variation had been distributed by him
to all people in line of site of the variation. Both homes are corner
lots . Several adjoining neighbors appeared and testimony in favor of the
variation request ,y s rsc�,G-=d' .
M. Hoyt , at the request of the acting chairman, interpret&lordinace
0-bO-2 section 7 , as requiring the party requesting a variation to
introduce evidence to show that if the requested variance is not granted
that there will be a detriment to public heath, safety or welfare.
With that as the stancio' the Plan Commission voted 3 to 2 with one
1 abstention for granting the requested variation as to the property owned
by James Atkinson of 921 Checker. Testimony was given indicating that if
fence were not allowed to extend beyond the side yard building line
bordering Spring Side Lane, the fence area would exclude the mud room
k, entrance to the home and thus possibly create a traffic hazard as to the
owners children running from that entrance directly into the street. The
f Plan Commission voted 3 to 3 on a motion to disapprove recommendation
of the purposed fence variation as to the property located 951 Checker
Road owned by Dana Johnson. The Plan Commission then voted 4 to 2 against
a motion recommending approval. There was no testimony indicating any
traffic danger with or without the variation. The Plan Commission then
voted to table further action on the request to July 15, 1970.
4 The fences in both gases were split rail and more ornamental then
functional, though'-quite with in our ornamental fence exception to the
fence ordinance. Attached and part of these minutes is a letter from
both petitioners and a rough sketch of the property involved. The Plan
Commission then passed the following resolution on a vote of 3 in favor
and 2 abstentions . The Plan Commission suggests that it is not happy
with the application of the fence ordinance the corner lots as the fence
ordinance now exist.
II Old Business

' It is noted that Randall Rathjen and Spence are both present as
, ` possible candidates for the Plan Commission. Upon motion duly made
*•� seconded and carried discussion of Mill Creek unit 2 was removed from
table. It was suggested that Mill Creek unit 2 be approved continQee f
upon the State of Illinois accident entrance approval and with a
letter from the Utility Company regarding easements. The Village

engineer stated that the supply of water in the area will not be a problem
when well # 2 is in operation. It was noted that no one from Miller
Builders was present . M. Hoyt mo, ed and S. Haarr seconded that further
consideration of Mill Creek Unit 2 be tabled to the next meeting. The
motion carried unanimously.
III. Size of the Plan Commission.
On motion made by R. Heineiricp and seconded by M Hoyt . It is the
recommendation of the Plan Commission the Village Board increase the
number of Commissioners from 0 members to 11 members due to the numerous
*pending matters and duties of the Commission. The motion carried with
3 in favor and 2 abstentions .
IV.
A letter from Richard J. Brown, Inc. , to Donald Thompson as to the law suit
between certain concerned citizens of Cambridge and the Village of Buffalo
Grove. That letter is hereby made part of the record . On motion duly
made and seconded and carried the meeting adjourned at 10 :51 P M

DEAR HOMEOWNER:
This is to inform you of a public hearing to be held on
July 1 at 8: 00 P.M. in the Municipal Building concerning
a request for a variation in the fence ordinance. The
owners of the homes at 951 Checker Road (northeast corner
Checker Road and Checker Drive) and 921 Checker Road
(northwest corner of Checker Road and Springside Lane)
have requested the Plan Commission for a variance to
permit the erection of a 42" high three log rail fence
that would extend along the sidewalks bordering their
homes from the rear of their side yards to the front of
the home (921 Checker Road) and to the rear of the home
(951 Checker Road) . This would be closer to the street
line than the 25 ft. permitted by the fence ordinance.
As a neighboring homeowner you are' invited to attend
the hearing and express your opinions.
