ITT.Communications and Bills 1 . A letter from William Dettmer requestinga change in ordinance to allow for the erection of for sale signs at residences was read . 2. A letter from President Thompson, as to the Metropolitan. Flood Control Ordinance was read . 3. It was announced that Stan Haarr ' s commission expires in September TV. Reports of Officers and Committees . 1 . It was announced that the Village Board Hearing on Babiarz ' s Petition for annexation would take place on September 24 , 127') at '.:0O P. M. 2 . It was announced that a sidewalk was being put in on Arlington Heights Road near the Levit'LModel Homes . The direction of Chairman Chairman regular order of business was then interrupted and a hearing on the requested fence variation took place. The petitioner was Charles A . Junkunc, 930 DorneliffCRoad , Buffalo Grove. Mr. Larry Gamm announced that he had given notice by letter to the surronding home owners . That notice is hereby made a part of this record . A letter from Mr. Junkunc to the Chairman of- the Plan Commission with an accompanying site plan was presented to the Plan Commission and is hereby made a part of this record . It was noted that no one in the audience appeared to oppose the requested variation. The variation requested was extending the side yard of the petitioner which fronts on Twisted Oak Lane 12 feet beyond the building line tiof his home. Such a variation was requested in order to give the fence an appearance of WletrIsl. Other reasons are also stated in the letter to the Plan Commission. Na one appeared to oppose. There then ued a discussion of what the requisite burden proof upon the Petitioner in order to be granted a fence variation. At the request of Mr. Berth and M. Hoyt suggested the following construction of the fence ordinance. A. home owner need only 'show that the granting of the requested variation will cause no detriment to public health safety and welfare if granted . A straw poll of the Commissioners was taken and that construction of the ordinance carried by a vote of 5 in favor and 4 against. Toe petitioner stated that a picket fence was going to be put up which would leave 50% visibility through the fence. H. Mendenhall , mo-ed that the requested variation be granted as stated in the letter and exhibit . M Hoyt seconded it and on roll call vote , based upon the above construction of the fence ordinance, the Plan Commission recommended approval of the variation unanimously. / -2- There was next presented to ,the Plan Comm i ssio a request for fence variation from Mr. John W. h of-1 Forest ( Court , Buffalo Grove . Illinois . A formal letter from Mr. n with a Platt Survey was read into ¢� the record and hereby made a part. of this re ord . Mr. H. Mendenhall stated r that he had distributed notice to the surrj ring neighbors of the fence g7; ,, variation in hearing. A chain-link fence is p(oposed . H. A _- letter detailing what occurred at that point was read into, the record and attached to the minutes and made a part of. A letter from Meritex, Building Corporation who owns the adjoining lot to the petitioner objecting to the ii fence was also presented to the Commission, Mrs . Walter Pratt of W4 Forest. Way Drive appeared and objected to the variation. The Petitioner then produce, a petition signed by his immediate neighbors approving the variation as requested . It was noted that Meritex apparently violated zoning and building codes and placing the petitioners home in a peculiar location on the lot . It was also rought to the attention of the Commissioners the petitioners .have a .� 1Lio ctive child who requires the added fence yard area . The petitioner also said that he would amend his request for a fence variation 4 so as to end the fence five feet from the sidewalk. H. Mendenhall moved to disapprove recommending the fence variation and Mr . S . Haerr seconded it . That motion failed on roll call vote of 4 in favor and 5 against . Mr. R. Heinrich then moved to approve the fence variation request as amended . L. Gamm seconded it . That motion carried 5 in favor and It against \ It was announced that a minority report would be submitted to the Board of i Li Trustees concerning this request of variation. t V. Fence Variation Requested by Mr. Dana Johnson. I On motion duly made seconded and carried that request for variation was removed from the table. The letter of June 12, 1970) was re-introduced to the Commission as well as sketches of the fence. After a very brief discussion and again based on the new construction of the fence ordinance , R. Heinrich moved that the Plan Commission recommend the granting of the fence variation. H. Mendenhall seconded the motion. On roll call vote with W. Berth absteinin_i the motion carried unanimously. VI Final Platt Approval of Ston.egate Apartments It was noted that there was a slight change in original Platt plans that ;is instead of two three story walk up apartments there was going to be one r larger three story elevator building. Total number of units would remain the same altho there were to be more one bedroom units and less two bedroom units . Ali around parking was also provided . The developer agreed to put a screening area between the multi family and single family areas . The Village Attorney had in Gated that the change in 'Vie Platt Plan was significant enough to ublic hearing. J . Gui.do' noved for the approval for the Final Platt Plan which had been marked Exhibit B. R. Heinrich seconded the motion and the L..., motion carried unanimously. t VII The Consideration of _applicants for Two Vacancies on the Commission F' Mr. John Yost was considered first , he is a professional engineer employed by likedwiwilmamia _ who specializes in s',/V i TAfti E 'oineer. i ng. Also considered was Mr. Pader supervisor in film editing for NBC News who resides at -23l Checker Drive. After considering the men the Executive Session , the P1.an. Commission reconvened in public and motion duly made seconded and unanimously carried on voice %ote , the Plan Commission recommended for appointment `'or two vacancies on the Commission Mr. John Yost and Mr. Edward Fader.
