Roll Call : Present - J. Guidotti, W. Berth, C. Genrich , M. Hoyt , Haarr, H. Mendenhall, L. Gamm, R. Heinrich . j Spence, M. Stearn ( for Village Engineer) , and Tillage Trustees , A. Thorod , E. Fabish. Absent - None The public hearing on the pre-annexation petition of the property owned by Michael J. Babiarz under Trust Number 4214 with the Marquette Nationa Bar as Trustee was then heard . The public notice printed in the Buffalo r Aq0 was then read . Mr. Loftus appeared as the attorney on behalf of the petitioner. Following individuals were then sworn to give testimony - Charl.es R. Fletcher, Michael Babiarz , Mr. William Kittel . A site plan of the project was presented and is attached as part of this record. The piece of property involved borders on both Buffalo Grove Road and Route h3. It is just north of Checker Road . The parcel of property is divided into two pieces. A 12.5 acre piece to be zoned B3 and 10.LL acre piece to be zoned R9. Mr. Loftus indicated that the firm of*kbeiPbnd Assoc . , r Land Planners , indicated that there is a need in the area for B3 Stripe Commercial Plan Development . He stated that Mr. Babiarz is prepared to � invest time, money and effort in the development of this property to meet this need . He indicated that it was impossible to say when construction would start on the property as there was apparently little chance of obtairin sewage treatment from the Lake County of Public Work Department . The Village engineer indicated that there was not sufficient capacity in the Village sewage treatment plant to handle the project . There was also the possibility there was not sufficient water at this time either. Mr. Loft:,is 4 indicated as shown on the site plans that the B3 would be developed e primary for a indoor motion picture theater, a medical center, and a >! restaurant , and a strip shopping center. t The R9 portion of the land would contain 156 dwelling units and several 4 three-story or perhaps two-story apartment buildings . They will surround a planned green area in the center approximately 3 acres upon which a swimming pool is projected . Mr. Kittel testified that he would be willing to take a deed to that 3 acre green portion of that property if it was moved to the northwest corner where might be poLi ssible at aL,late1r d tRe to tie it to another piece of property on yet :� cIA" Ti.and` a Village directly north of t piece o ' property in question. The developer indicated that he would il-,.on be ti willing to move that 3 acre private park site to that area but wanted to l= leave it in the center surrounded by his buildings so as to provide the best scenic presentation and use of property by his proposed apartment L,,i, dwellings. However, he did indicate that he would be willing to deed that property as such to the park district exceptiqsa4. reserving the small amount necessary toerect a private pool . Mr. Kittel for the park district did not ; indicate w " 1%tthe park districtlWe would be willing to take a deed to that land for public park under those circumstances . t -2- Mr. Edward Gershefski of Prairie View, Illinois was then sworn and testified in opposition to the plan. He did not oppose the proposed use of land but dwas merely concemed with drainage from that area effecting his property which fronted on Route 33 just south of the proposed development. Mr. Joe Likum of Route 1 , Prairie View, waslocated just across from the property on Route 'i3 was concerned with drainage and not the land use. Mr. John Colk raised some questions pertaining to the availability of sewage which were answered by the Village Engineer. Mr. Lee Likum residing across form the opposed development was concerned with what would happen to the drain tile system that was presently on the property and which served to drain property .-� east of the pfvposed development. Mr. Michael O 'Brien of Buffalo Grove ask certain questions concerning the tax base property and how, it would effect the Village. Mr. Hitzman of the School Board projected that 90 children would be attending schools as a result of the development . He said the cost of this with 6 would be ,$100,000.00 to educated those 90 children. He also said he was not sure if the pifrpose 3 site development was in the School District gab or in the Aptakisic-Trip School District- o —Lfl -e . He suggested a possible monetary donation to the School District to defray the inital cost of education. Mr. Guidotti then question the petitioner concerning possiblity of retention basin, the possiblity of deeding land to the Park DistriiiMy the absence of a traffic survey Qs required by our ordinance. Mr. o asked several questions concerning the possiblity of an easement infringement as to the U. S. Highway bordering the property. Mr. Hoyt suggested several changes in the Pre-Annexation Agreement relating to Plan Commission Control of the development at a later date and pr.' or to building permits being issued . As an example of the types of ` `f _ , the Gershefsky annexation / petition is referred to . Mr. Loftus had no objections to any of the `., provisions that were in the Gershefsky Pre-Annexation agreement and agreed to re-draft his own Pre-Annexation agreement and conforming with that one. Mr. Heinrich asked several questions concem.ng the need of the area for a small retail strip center. He also informed the commission that he had talked to the`Tlteacer developer referred to by the petitioner a�i�d discovered from them that they were not interested in putting up the7ea1er on a small strip shopping center site. The public hearing was then adjourned. CORRECTION & APPROVAL OF PASSED MINUTES : immediately following the ad-journment of the public hearing the regular meeting of the Plan Commission of buffalo Grove was ca]pd to order. On Roll Call Vote all were present. First item on the agenda was the approval of the minutes of August 5, 1970 with certain spelling corrections and that motion carried by voice vote. COMMUNICATIONS & BULLETINS • Next on the agenda were communications and bills. A letter from President Thompson was submitted to the Plan Commission relative to the Metropolitan Sanitary District of Chicago ' s recommendations within the necessity of , Flood Control was read into the record . A press release relating to the " ,„..w Metropolitan Sanitary Districts pepposed requirement of stormrettention basins were also made part of the record . A letter from the Director of Inspectional Services relative to the current ordinaces forbidding for sale signs was read into the record . It was noticed by one of the Plan Commissioners that Ordinace #0-67-17 amending our sign ordinance apparently allows for sale signs . On motion duly made sconded and carried Plan Commission decided to request a construction from Village Attorney , Richard Rata as to the effect of the current amendment . A letter from the legislative committee with regards to pi 'vvos.dt pool ordinance and the purposed ordinance itself was distributed to the Plan Commission. fir. .5-f1.<. • I -3- 001, A letter from Homefinders Realtors protesting because struction of our ordinance prohibiting for sale signs was read into the records . A letter from the Northwest Cooperative Mental Assoc. was also read into the record and Mr. Hoyt was appointed to contact that Association to discover excaltly what kind 1izxi-44- Q,z_Ihe desired with the Village of Buffalo Grove Plan Commission. LA,�..► '.• OLD BUSINESS : Mr. Carl Genrich moved to table further consideration of Mr. Babiarzts Pre-Annexation Petition. The motion seconded and carried six in favor and two against and oneab 'tention. Further consideration was tabled to ""`/ September lb, 1970 due to the desire of the Commissioners, obtaining more information and to allow the petitioner to re-draft his Pre-Annexation Agreement according to the suggestions of Mr, Hoyt.
