VILLAGE OF BUFFALO GROVE PLAN COMMISSION MINUTES

. The meeting was called to order at 8:00 P.M. on September 16, 1970.
I. Roll Call: Present-J. Guidotti, W. Berth, C. Genrich, M. Hoyt, S. Haarr, L. Gamm,
B. Spence, E. Fader, J. Yost, M. Stearn(Village Engineer)
Absent- H. Mendenhall, R. Heinrich
j At the direction of the Chairman, the regular order of business was varied and the
Babiarz Petition was considered. Mr. Michael DiVincenzo, the Principal of Aptakisic-
Trip, and Mr. Joseph Dulski, School Board member, were present. They advised the
Plan Commission as to the current expansion plans of the school. They are currently
seeking a 15 acre site for an aditional school.
The Chairman announced that letters of inquiry had been sent by him as follows:
1. Letter to Lake County Dept. of Public Works as to their plans to service
the Buffalo Grove area. There was no response.
2. Letter to the Village: ofBaffalo Grove as to its capacity to service the
area under consideration with sewer and water. There was no written response.
The Chairman announced that the park district had not indicated whether they desired
that four or five acre tract of land designated on the site plan as destined for
recreational use deeded to it.
Mr. Loftus, attorney for Babiarz, announced that he had been unable to obtain a
letter from Babin & Associates. He also announced that he had not been able to
obtain a traffic survey determining the impact of the proposed development on the
area for two reasons:
1. Time was too short.
2. As Lake-Cook Road has not yet been completed, a'traffic survey of that area
would be useless.
There next followed a discussion of the sewage problems, water problems asdidrainage
problems troubling that area. There was then submitted to the plan commission th$
following exhibits:
Exhibit A. - Pre-Annexation Agreement
Exhibit B.- Site plan of the proposed area
Exhibit C. - Architectural rendering of typical apartment elevation
Carl Genrich them presented the following motion: It is moved that the plan commission
recommend anproval of the petition for annexation and rezoning of that property
cUmmonly known as the Babiarz property and described in a pre-annexation agreement
marked Exhibit A and attached hereto based upon the proposed annexation agreement
marked Exhibit A, the site plan bf the proposed development marked Exhibit B and
an architectural rendering of typical apartment elevation marked Exhibit C, subject
to the following conditions: 1

1. That the following clause be added to section 1)4-page 9 of the pre-
anneaaticen agreement;In the event that the planned develppment(bdth
R9 and B3)is not substantially under construction on or before five
years from the date of execution of this agreement, Then the portion of
the land not substantially under construction-exclusi a of yard requirements ,
shall revert to an R1 district.
2. That the Village Board, should it approve tie petitio ers request, recognize
that a resonsibility to provide sewer and water servi a is being assumed.
3. That the developer will construct and maintain adequat storm water
retention facilities on the site.
The motion was seconded by M. Hoyt. On roll call *ote J. Yost and E. Fader
abstained. The rest of the commission Voted yes.
On motion duly made, seconded and unanimously carried, the plan commission recommends
that the Village Board reappoint H. Mendenhall and J. Guidotti to the plan
commission.

The Chairman announced that a public hearing date of October 7, 1970 had been
set for the land near the sewage treatment plant.
After some discussion of the new proposed swimming pool ordinan6e, the Plan
Commission felt it should be turned over to the Village Engineer due to its
technical nature. A full report was prepared by R. Heinrich.

The next item on the agenda was amending the existing fence ordinance. M. Hoyt
moved as follows; that the Plan Commission Reccommend to the Village Board that
section 7 of ordinance number 0-60-2 be redrawn to read asfollows, " The
President voting jointly with the Village Board shall vary and make exceptions to
this ordinance where it is shown by a preponderance of the evidence that there
will be no detriment to public health, safety or welfare by the granting of the
requested variation. Application for such variations shall first be submitted in
writing to the Zoning Board of Appeals for its review and recommendation. The
Zoning Board of Appeals shall submit its recommendation to the Village Board
in writing and the application shall then be placed upon the agenda of the Village
Board at the Board's earliest convenience." On roll call vote, E. Fader abstained
and the rest voted in favor of the motion.
The next item was approval of past minutes. The minutes of June 17, 1970;
July 1, 1970; July 15, 1970; and August 19, 1970 were approved with corrections
inserted on their face on motion duly made, seconded and carried. Approval
of the minutes of September 2, 1970 was tabled.
The Meeting adjourned at 10:30 P.M.
