1971-11-03 - Plan Commission - Minutes PUBLIC HEARING BEFORE THE PLAN COMMISSION - Request by Mr . Jack L . Kemmerly for Annexation to the Village and B-1 Rezoning. (This was formerly the Stenholm property) . HELD ON NOVEMBER 3 , 1971 The meeting was called to order at 8 : 22 PM with Carl Genrich as Acting Chairman. Members present : Bud Berth, John Yost , Stan Haarr , Howard Mendenhall , Burt Harris , Carl Genrich and Betty Spence . Members absent : Evan Fader, Larry Gamm and Merrill Hoyt . Those present were informed that the Notice of the Public Hearing was published in the BUFFALO GROVE HERALD on October 15 , 1971 . Mr . Kemmerly of Kemmerly Real Estate was sworn in and he asked to be annexed to the Village and the property rezoned B-1 . He stated he would like to have water and sewer for his office . He also stated he planned to keep present building but make some changes to bring building up to Village code . He intends also to pave parking lot and add playground equipment for customers ' children. Mr. Kemmerly stated that if Three States Blvd. was opened he would like to add a small office building on the rear of the lot . John Yost asked if he was asking B-1 zoning for entire area, and he answered, "Yes . " Stan Haarr asked Mr. Kemmerly if he knew what size the added building would be ; he answered he did not , since it would not be in the immediate future , but it would meet Village Re- quirements . John Yost asked what classification under B-1 he was coming in under; he answered "Offices - Business and Professional . " Howard Mendenhall asked his proposed opening date ; he expressed desire for Thanksgiving if possible . Mrs . Beverly Berry of 3211 N. Betty Dr. appeared as a homeowner in the area and asked if objections which arose when this property was before the Commission before as the Stenholm property still existed. She stated five objections : November 3, 1971 Page 2 . 1 . Saturated septic fields . 2 . Spot zoning . 3 . Objecting to buildings more than two stories high. 4 . Not more than one or two businesses alike on the same street. 5 . Use restriction on back of lot . Mr . Genrich answered that the Plan Commission tends to follow the same broad policies consistantly. Stan Haarr stated that the Plan Commission has twice before recommended B-1 zoning for this property. Mr . Bob Simonson of 3408 N. Betty Drive , whose property is contiguous on south side of property, asked what provisions would be made for screening between parking lot and playground area and adjoining property. Mr . Kappe , 298 Dundee Parkway, which is directly across Dundee from Mr . Kemmerly, stated that he was very satisfied with a real estate office going in on that property. The Commission was recessed for ten minutes . Mr. Genrich called the meeting back to order and Mr. Mendenhall asked Mr . Kemmerly if his intent was to have a real estate office on that location, whether it was in Buffalo Grove or the County, and he answered, "Yes . " Mr. Genrich asked Mr . Kemmerly for the present time would he be willing to restrict building to present site and come before the Village before any additional building . He stated, "Yes . " Mr . Genrich also asked if he intended to hook up to water and sewer ; he answered, "As soon as physically possible , and I will pay. " Mr . Genrich asked if he would be willing to come into the Village under Annexation Agreement drawn up by Village Attorney, covering normal requirements of Village ; he answered, "Yes . " On motion duly made , seconded and unanimously carried, the Public Hearing was adjourned at 9 : 20 PM. November 3 , 1971 Page 3 . The regular meeting of the Plan Commission was called to order at 9 : 20 PM, immediately following the Public Hearing, and the audience was asked to stay if they liked. It was also noted that Mr. Bernie Friedman was present and is a candidate for the open seat on the Commission. The minutes of the October 20 , 1971 meeting were read and approved, on motion duly made , seconded and unanimously carried. Mr. Yost abstained. New Business : Mr. Berth stated that in the BUFFALO GROVE HERALD on Friday, October 22 , 1971 , there was a Notice of a Public Hearing to be held on November 10 , 1971 at 10 : 00 AM at the Lake County Court- house in Waukegan. The Petitioner is asking to be annexed into Buffalo Grove and the property is all in Lake County . Mr. Berth stated he would discuss the hearing with Village Manager and try to have someone present and report back to the Plan Commission . Howard Mendenhall made a motion that Plan Commission recommend to the Village Board approval of annexation and B-1 zoning with following conditions : 1 . Prior to any physical improvements , new building construction, major alterations to existing building or buildings , agree to return and present plans for approval at Public Hearing. 2 . Annexation Agreement with these stipulations . 3 . Immediately apply for water and sewer tap on, and bear cost of same . Stan Haarr seconded the motion. A roll call vote was taken and it was unanimously approved. Mr . Genrich stated that he would rather vote for a motion containing land usage restriction, which he thought was legal . Mr. Genrich recommended to Mr. Kemmerly that in his presentation to the Village Board he include : 1 . Site Plan on print of survey. 2 . Parking (Area/material) . 3 . Curb Cuts . 4 . Tot lot . November 3 , 1971 Page 4 . 5 . Plantings/Screening 6 . If Front remodeling - sketch. The agenda for the November 10 , 1971 workshop will include Planned Unit Development Ordinance and Zoning Ordinance Changes . The motion was made to adjourn by Mr. Berth and seconded by Mr . Haarr.
