1972-10-04 - Plan Commission - Minutes PLAN COMMISSION /0151/72 le" PUBLIC HEARING - PLANNED UNIT DEVELOPMENT (PUD) /Cff--+/ )� ORDINANCE HELD ON OCTOBER 4, 1972 Chairman, Carl Genrich, called the Public Hearing to order at 8 : 30 P.M. He read the Notice of Public Hearing and entered it into the record as being published in the Buffalo Grove Herald. Commissioners Present: Chairman Genrich Mr. Gamm Mr. Van Engen Mr. Haarr Mr. Friedman Mr. Fader Mr. Yost Commissioners Absent: Mr. Harris Mr. Mendenhall Also present were Mr. Arnold Seaberg, Village Engineer, Mr. Richard Raysa, Village Attorney, and developers, Mr. Fred Hillman, Mr. Paul Swanson and Mr. Al Foss. Commissioner Haarr was asked to summarize the PUD Ordinance. Then Chairman Genrich asked if the developers present would like to make a statement. Mr. Hillman stated he feels the proposed Ordinance is an excellent Ordinance and was carefully worked out. There is nothing a devel- oper could call severe. He said he wondered if Section 3, para- graph C and D where developers will not pose undue burdens on public services of the community, did not open a "Pandora' s Box" . He said Paragraph E on the point about ownership should be clarified regarding before and after development. He said the phrase "public facilities" in Paragraph F was ambiguous. Paragraph G regarding financial guarantees should be readily determined as to be stated in the Ordinance. He said on Page 78F, the last paragraph is unclear. On Page 781 , Paragraph 10 and 11, he feels we are asking the developer to come in with full-blown legal documents at the preliminary stage and would like it modified to more general terms. On Page 78 N, Paragraph C, he would like to have added "architect" because not all developers use qualified landscape planners. On Page 78P, 6. 5, he feels this states that the developer can start building as soon as the Plan Commission approves a development without going to the Village Board. V Mr. Raysa commented that Page 78C, Paragraph E, could be rewritten. On Page 781 , he feels the intent was outline form. The Plan Commission members said their intent in Page 78P, Section 6 . 5 was that they have the final approval on a final plan. /6/ '/72 PUD Public Hearing October 4, 1972 Page 2 Mr. Raysa said to leave this in but the Board may not agree. Mr. Swanson said he did not understand Page 78E Paragraph A regarding density. This was discussed. Mr. Foss said this Ordinance is too ope to interpretation and should be clarified so there are no questions or arguments. He said some- times it is possible to build 35-40 density and not hurt the area and in some cases is benificial because higher buildings do not generate many children, V this Ordinance does not allow for high- rises . Mr. Raysa said he feels the Plan Commission did a good job. There is no perfec t ordinance so he thinks we should get it passed first and correct the deficiencies as they arise. He agreed there could be a few clarifications. Mr. Hillman said he would like to see a "bonus system" to the extent that a developer with a really good plan might be awarded a higher density as a bonus to encourage these superior developments . Chairman Genrich stated that Mr. Grossman, the Village Planner, could not be present but has given the Plan Commission his comments of the Ordinance. Recess was called at 9 : 25 and the meeting reconvened at 9 : 40. There were no comments or objections on the Zoning and Subdivision Ordinance changes. Commissioner Haarr made the motion that the minutes of the meeting of September 6 be approved as written. Commissioner Friedman seconded the motion. Motion carried. Commissioner Haarr made a motion, seconded by Commissioner Friedman, that the minutes of the meeting of September 20 be approved with the following corrections : Page 1, paragraph 3, should read "Commissioner I'Iaarr reported that there will be some problem with the fence on the Frank property and recommends that the tennis courts and maintenance building should be rezoned to R-9 Special Use, making it part of the PUD. " The \./ last line of this paragraph should read "four (4) acres" . On Page 4 , fifth line from the bottom, should be "School District" . The last sentence on Page 5 should be "Commissioner Yost' s proposals as presented by Commissioner Haarr. Commissioner Yost seconded the motion and it passed unanimously. Commissioner Van Engen made a motion the meeting be adjourned at 11 : 20 P.M. Commissioner Haarr seconded the motion. Motion carried.
