1979-06-27 - Plan Commission - Minutes SPECIAL MEETING BUFFALO GROVE PLAN COMMISSION NNE 27, 1979 Chairman Shields called the meeting to order at 7:45 P.M. at the Municipal Building, 50 Raupp Boulevard. Commissioners Present: Chairman Shields Mr. Harris Mrs. Sheldon Mr. Davis Mr. Goldspiel Mr. Button Commissioners Absent: Mr. Glover Mr. Shifrin Mr. Kelly Also Present: Mr. Bart Delaney, Planning Coordinator Mr. Jim Truesdell, Staff Planner Chairman Shields stated that the Public Hearing on Wynnedale scheduled for this evening, was cancelled because the developer failed to send out the notices to adjacent property owners. The hearing has been rescheduled for July 18. APPROVAL OF MINUTES Commissioner Button made the motion the minutes of the Public Hearing of May 30, 1979, be approved with corrections. Commissioner Davis seconded the motion. Corrections are as follows: First Page, Paragraph 5, line 6: instead of "in the site plan", it should read "from the site plan". Upon voice vote, the minutes were approved, with Commissioners Button, Harris and Sheldon abstaining. Commissioner Goldspiel made the motion the minutes of the Regular Meeting of May 30, 1979, be approved with corrections. Commissioner Button seconded the motion. The corrections are as follows: Page 2, paragraph 2: Should read "bumps" instead of "bumpers". Upon voice vote, the minutes were approved, with Commissioners Button and Harris abstaining. Buffalo Grove Plan Commission Special Meeting June 27, 1979 -2- 1 Commissioner Button made the motion the minutes of the Public Hearing of June 6, 1979, be approved with corrections. Commissioner Goldspiel seconded the motion. The corrections are as follows: Page 2, paragraph 5: First line should read "interim trailer facility". Upon voice vote, the minutes were approved, with Commissioner Davis abstaining. Commissioner Button made the motion the minutes of the Regular Meeting of June 6, 1979, be approved with corrections. Commissioner Goldspiel seconded the motion. Corrections are as follows: Page 3, paragraph 4: The second line should read, "he said the trees are in good condition and will probably survive". Upon voice vote, the minutes were approved, with Commissioner Davis abstaining. COMMITTEE REPORTS Commissioner Goldspiel stated the Transportation Committee is starting work on a survey of Village residents to find out what their transportation needs are, and it should be sent out in a month or two. Commissioner Sheldon questioned the Parking Ordinance draft handed out this even- ing, which is different than the draft put together by,the Parking Ordinance Subcommittee. Mr. Delaney stated the Police Commander Gozdecki reviewed the ordinance and said this is what we need. The emphasis of this draft ordinance handed out this evening is on commercial vehicles. It states that they will keep a view from the apron of the driveway open. Point No. 6 says you must stay within one (1) foot of the sidewalk. Commissioner Sheldon asked who drafted this ordinance. Mr. Delaney said he, along with Mrs. Clayton and Mr. Gozdecki. Commissioner Sheldon stated she would still like to see a joint meeting with the subcommittee and the Village Board. They had requested suggestions from the Trustees and had only heard from three of them. Chairman Shields stated the Village Board is anxious to go ahead on this matter, and that perhaps some of the Trustees who have not responded may not have an opinion on it and are waiting for our recommendation. Commissioner Goldspiel stated that our job as a Plan Commission is to make a recommendation and not to poll the Village Board and go by that. Commissioner Harris explained that the ordinance that was given to the subcommittee by the Board on which they held a Hearing, was so different and they were unable to find a common meeting ground. Rather than come up with something the committee didn't want or come up with something they knew the Village would not agree on, they suggested a joint meeting. Buffalo Grove Plan Commission Special Meeting June 27, 1979 -3- Chairman Shields stated that no one objects with that in principle, but both groups are very busy and this is time that needs to be spent on other things. Commissioner Goldspiel made the motion that the Parking Subcommittee be directed to take the original ordinance that was forwarded to the Plan Commission and annotate each section of that ordinance with comments as to whether it is a good section or bad section along with changes recommended and present that to the j Plan Commission no later than its next meeting, for action. Commissioner Sheldon seconded the motion. Commissioner Shifrin arrived at 8:15. More discussion followed regarding the parking ordinance. Commissioner Goldspiel stated that discussions of this matter are spread over so long a time that we cannot go to a set of minutes and see what we think about it. Commissioner Harris said the Plan Commission told the subcommittee to revise the ordinance in accordance with the zoning setback restrictions and to treat it in the same manner that a building is treated. Commissioner Goldspiel add- ed that these vehicles don't move. They sit there re'o driv_w_y and obstruct sunlight and vision. Commissioner Shifrin stated this ordinance is out of date because people now use vans and campers as family automobiles. Commissioner Goldspiel said he would like to ammend the above motion to say the committee report back no later than this evening. Upon a voice vote, the motion was unanimously passed. Commissioner Button requested a poll of the Commission on the concept of the revisions, with a "yes" vote meaning in favor of the concept. The Commissioners were polled and were unanimously in favor of this concept. Commissioner Sheldon requested this matter be tabled until the end of the meeting. WYNNEDALE Since there was no Public Hearing, this matter was not discussed. DUNDEE ROAD POLICY Chairman Shields stated that the Plan Commission had worked up a policy regarding development on Dundee Road. A copy of this policy was distributed so the Commis- sioners can make changes or reaffirm it. After discussion, it was decided to leave it the way it is. Buffalo Grove Plan Commission Special Meeting June 27, 1979 COMPREHENSIVE PLAN GOALS & POLICIES Commissioner Shifrin stated he would like to commend the staff in incorporating the suggestions of the Plan Commission in the Comprehensive Plan. Commissioner Goldspiel said, regarding page 2, no. 6, do we really want to have as a goal, comment about lifestyle? He stated he would like to have it taken out because how can we implement a goal regarding lifestyle? Commissioner Goldspiel stated that, regarding the limiting of curb cuts as stated in the transportation policies on page 8; if this is done to the extreme, as was done along Arlington Heights Road north of Checker Road, we have the problem of people not having easy access to public transportation. Commissioner Davis stated he would like to see a minimizing of curb cuts on collector streets as well as major streets. After some discussion, it was agreed to word the policy as follows: Traffic safety should be an important consideration in design of transportation. Mrs. Clayton arrived at 8:55. The Commissioners requested that the Wynnedale Public Hearing be scheduled for July 25 because several Commissioners would not be able to be present on July 18. STAFF REPORTS Mr. Delaney distributed a map showing Lake County's proposed realignment of Weiland Road. The Plan Commission was asked to make a recommendation to the Village Board. Commissioner Button suggested Weiland Road come out on Busch Road instead. After some discussion, Commissioner Harris made the motion the Plan Commission recommend to the Village Board the conceptual approval of the joining of Prairie and Weiland Roads. Commissioner Shifrin seconded the motion. Upon voice vote, the motion was unanimously approved. Chairman Shields called for a recess at 9:15. Commissioner Goldspiel had to leave. Chairman Shields reconvened the meeting at 9:30. President Clayton stated that, regarding the Parking Ordinance, she felt it is important, but there are many matters more important and it probably has had Buffalo Grove Plan Commission Special Meeting June 27, 1979 5- more time than it should have had. PARKING ORDINANCE Commissioner Harris stated there are a couple of changes to the ordinance. The first is on page 2 in the center of the page. The word "including" should be changed to "excluding". In the next paragraph, the "grandfather clause" means that if it is impossible to store the vehicle as outlined above, then vehicles registered by such and such a date would be exempt from these requirements. We do not want to create a hardship on people who presently own these vehicles. Mr. Delaney stated this was left out because there is a section in our Nuisance Ordinance. President Clayton said Commander Gozdecki had said that section addressed the problem in the same way, however, he had no objections to the derelict clause being proposed. This would make it better because under the Nuisance Ordinance, it would have to be declared a public nuisance before they can act on it. This already declares it a public nuisance. Commissioner Davis stated that, regarding the draft Mr. Delaney distributed tonight which makes mention of vehicles up to 35', we feel we should go with 28' . Also, he said, the draft says the area should be maintained free of ob- noxious weeds. We would like to see them on paved pads because we have seen some that have fallen over. Commissioner Harris stated that the ordinance passed on to the committee singled out multi-family as having to provide a place to park such vehicles. We didn't feel this was fair. The: outline we received tonight does not include multi-family developments. He said he would also like to point out that many homeowner associations have their own requirements regarding the parking of these vehicles. Commissioner Harris made the motion the Plan Commission recommend to the Village Board the adoption of the revised ordinance prepared by the Committee together with a list of the reasons for the revisions. Commissioner Davis seconded the motion. Commissioner Button drafted the list which states: The attached document details the Commission's best concensus in the form of changes to the draft ordinance concerning the parking of commercial and re- creational vehicles. The Commission has prepared these recommendations in the light of the follow- ing points of legislative philosophy: 1. Make possible a workable ordinance to protect the residents of the Village as per the statement of purpose in the original draft ordin- Buffalo Grove Plan Commission Special Meeting June 27, 1979 -fi- ance (as revised 12/11/78) where parking of certain categories of vehicles might constitute a public nuisance. 2.. To provide revisions to the draft ordinance using the same basic notions of restrictions provided in the original draft (as revised) to define these restrictions in such a way as to make them clearly enforceable and understandable. 3. To provide revisions which would be consistent with current zoning and planning practices so that the parking of recreational and com- mercial vehicles would not violate line of sight considerations. 4. To provide the greatest measure of protection possible to current owners of such vehicles. Upon voice vote, the motion was unanimously passed.
