Zoning Ordinance Review
August 5, 1981
Chairman Shields called the Regular Meeting to order in the Municipal
Building, 50 Raupp Boulevard, Buffalo Grove at 7:4+0 P.M.

Because there were not enough members of the Plan Commission present for a
Quorum, Chairman Shields closed the Regular Meeting at 7:41 P.M. and stated
that there would be an informal discussion.
ZONING ORDINANCE REVIEW
Mr. Truesdell - This has been a joint venture between Mr. Hrubyand myself.

He has been helpful in determing the day to day items and the problems
that face the Zoning Board of Appeals. We have a first draft of the Zoning
Ordinance and this is a starting point for discussion. The Zoning Board of
Appeals and the Appearance Commission have received copies of the ordinance.
Our original intent was for a format change. Article XIII, which is now
Article XII, is under the jurisdiction of the Zoning Board of Appeals.
Mr Truesdell then proceeded to review his memo of July 29, 1981 to the
Plan Commission, Zoning Board of Appeals and the Appearance Commission titled
Zoning Ordinance Review.
At 8:00 P.M. Commissioner Reid arrived. Since there was now a quorum Chairman
Shields reconvened the Regular Meeting.
Mr. Truesdell stated that Mr. Raysa has received a copy of the proposed
Zoning Ordinance and was going over the legal technicalities.
Article II - Rules and Definitions
Home Occupation - It was determined, after some discussion, that this definition
would be restructured.

In response to a question from Commissioner Shifrin, Mr. Hruby stated that
the Village of Buffalo Grove does not have any licensing requirements for a
nursery school.
Commissioner Shifrin felt this was something that should be monitored very
carefully.
Auto Laundry - Commissioner Glover felt that the definition for auto laundry
should be expanded.
Signs - Commissioner Glover felt there should be some regulation regarding
the size of flags and their pole heights.
Article III - Use Districts
In response to a question from Commissioner Shifrin, Mr. Truesdell replied
that regarding the R6 and R6A sections, big homes were going onto small lots
and it was felt that larger rear yards should be required. R6 was amended
to require a large rear yard. The R6A was established ...s a grandfather district.
Article IV - General Provisions
No Commission Discussion
Article VI - Special Uses
Mr. Truesdell - Staff feels that if a special use is more of a land use issue,
rather than a requested variance, it was more appropriate that the Plan
Commission review it. At this time it has been left blank in the ordinance.
We have added some examples of solar energy incentives in the PUD section. We
listed the type of changes that a developer may make without coming back before
the Plan Commission for a public hearing.
Article VII - Accessory Building
This is under the scrutiny of the Zoning Board of Appeals. The Zoning
Board of Appeals deals with this on a regular basis, They have requested
and have scheduled a special meeting on August 18, 1981 to discuss this section.
We have added a height restriction of 12' in a residential district but we
are going to change that to 15' .

Article IX - (Article VIII in new draft) Drivewa;s and Off-Street Parking and
Loading Facilities
Mr. Truesdell responsed to a question from Commissioner Kaszubowski concerning
Section 4.7 and 4. 8, stating that he had gone through a number of zoning
ordinances of surrounding towns and tried to pick out what seemed the most
reasonable ordinance regarding parking space. There are some assumptions
built into our ordinance. It assumes that there will be people who will not
carpool or take mass transit. In the current ordinance there are pavement
standards for parking. They are not in the new ordinance because we do not
feel the zoning ordinance is an appropriate place for them.
Article X (Article IX in new ordinance) - Residential Districts
Mr. Truesdell - Our attempt was to eliminate the number of pages one had to
go through to get the information desired. R1 through R6 had the same uses
so we put it into table form. The height, weight and bulk requirements were
put in a table form also. There were some requirements in R5 and R6 for
side yards, that have been eliminated and replaced in the Accessory Section.
Article XI (Article X in the new ordinance) - Business Districts
No Commission discussion.
Article XII (Article XI in the new ordinance) - Office and Industrial Districts
Commissioner Kaszubowski - I assume if the Village Board passes the B-5
Ordinance the portion of this ordinance that deals with the B-5 will be
changed.
Mr. Truesdell - That is correct.
Commissioner Reid - Regarding Transistional Yards, the Plan Commission
discussed stockade fencing as opposed to landscaping or berming. We felt that
stockade fences were not always in the best interest of a transistional yard.
Commissioner Shifrin - We felt a living fence or a cyclone fence were a better
use.
Mr. Truesdell - It was felt that a living fence had not been successful.
It is possible that we could leave in a requirement for a fence and if the
builder wanted somethingelse he could
go for a variance.

Mr. Hruby - There is a problem with all of the bushes taking hold and providing
a good screen. If you want the bushes to mature to 6' you have to plant them
far enough apart or you will choke off the roots. Then you have a gap in
between. If the bushes do not measure 6' you are in violation of the ordinance.
I believe in the past it was felt the fence would be a maintenance problem
and the current ordinance requires that the fence be maintained.
Article XIII (Article XII in the new ordinance) - Zoning Board of Appeals
This article is under the jurisdiction of the Zoning Board of Appeals. Other
than a land use, anything in the zoning ordinance can be varied. There is
specific criteria to be met in order to obtain a variance.
Articles XIV, XV, XVI, XVII (Articles XIII, XIV, XV, XVI in the new ordinance)
No changes have been made to these articles.
Article XVIII - Fees
This article has been eliminated and will be replaced in the appropriate
section of the Municipal Code.
APPROVAL OF MINUTES
Commissioner Glover moved approval of the July 15, 1981 Public Hearing minutes
with Commissioner Kaszubowski seconding. Approval was unanimous with
Commissioner Shifrin abstaining.
Commissioner Glover moved approval of the July 15, 1981 Regular Meeting minutes
with Commissioner Reid seconding. Page 2, paragraph 10 Change commends to
comments and add The requested change was the configuration of the proposed
building; Page 5, paragraph 15 change extension of to proposed north exit on;
Page 6, paragraph 2 change 5" to 5'.
LIAISON REPORTS
Commissioner Kaszubowski attended the Village Board meeting of August 3, 1981.
The Board discussed:
1) The school donation issue and how to resolve the problem of funds not used
for growth purposes.
2) The homeowners from the Westwood subdivision requested the removal of a
berm and a stockade fence to replace it.
3) Unity Savings came in for a request to change the size or the models of
the Commons. The Appearance Commission denied their request and the
Village Board upheld the Appearance Commission's denial.

FUTURE AGENDA
Mr. Truesdell stated that at the August 19, 1981 meeting there would be
further discussion of the Zoning Ordinance.
ADJOURNMENT
Commissioner Kaszubowski moved adjournment with Commissioner Shifrin seconding.
Chairman Shields adjourned the meeting at 9:30 P.M.
