1981-08-19 - Plan Commission - Minutes REGULAR MEETING BUFFALO GROVE PLAN COMMISSION Zoning Ordinance Reivew Articles I, II, III, and IV August 19, 1981 Chairman Sheldon called the Regular Meeting to order in the Municipal Building, 50 Raupp B oulevard, Buffalo Grove at 7:42 P.M. Commissioners Present: Chairman Sheldon Mr. Goldspiel Mr. Button Mr. Davis Mr. Glover - arrived at 9:00 P.M. Mrs. Reid Mrs. Kaszubowski Commissioners Absent: Mr. Shields Mr. Shifrin Also Present: Mr. J. Truesdell, Village Planner APPROVAL OF MINUTES Commissioner Kaszubowski moved approval of the August 5, 1981 Regular Meeting minutes with Commissioner Reid seconding the motion. Page 3, paragraph 1 insert after Commissioner Kaszubowski "concerning section 4.7 and 4. 8"; Page 4, paragraph 7 delete unused and insert "funds not used for growth purposes". The minutes were unanimously approved with Commissioners Goldspiel, Sheldon, Button, and Davis abstaining. COMMITTEE AND LIAISON REPORTS Commissioner Davis attended the Village Board meeting of August 17, 1981 at which the Park District asked for variations and for an increase i-n the land provided for the park which were granted. The schools udistricts asked for an in- crease in the donations by the developers which was not granted. There was a discussion of how the money donated for the schools. The Village could not mon- itor it so a holdharmiess clause was put in. Mr. Truesdell stated the major concern was that the Village Attorney wanted a holdharmless added to the Village Ordinance. He believed that now when the money comes into the Village it will be put into an account. When a request is made for those funds it will have to state the use for them. Commissioner Button moved that the Plan Commission recommend to the Village Board that they draw up a document requesting the appropriate legal authorities of Cook and Lake Counties investigate the situation surrounding the possible or reported misappropriation of $61,000,000 from the RTA suburban account. Commissioner Goldspiel stated that there had been a change of law and as far as he knew there was not a misappropriation. - 2 - Discussion Commissioner Goldspiel suggested that this was a matter for the expertise of the Transportation Commission. Commissioner Button amended his motion to also recommend the Village Board secure the advice of the Transportation Commission. Vote AYES: Commissioners Button, Davis, Sheldon NAYES: Commissioners Goldspiel, Reid ABSTAIN: Commissioner Kaszubowski ABSENT: Commissioners Shields, Shifrin The motion passed 3 - 2. ZOMING ORDINANCE REVIEW - ARTICLES I, II, III, and IV Mr. Truesdell briefly reviewed what had taken place at the August 5, 1981 meeting regarding the Zoning Ordinance. Article I Commissioner Goldspie1 ieit that it, should be referred to with a date to distinguish this revision from other revisions of the ordinance. The Commission concurred. Article II Section 2. 1, a, 4. - Accessory Buildings and Use Commissioner Goldspiel questioned the statement "accessory off-street parking facilities as are premitted to locate elsewhere". Mr. Truesdell stated that this is referred to and regulated further on in the ordinance in Article VIII. Section 2. 1, b Commissioner Goldspiel stated the limitations on accessory use under b are not inclusive. Mr. Truesdell stated this is further regulated in Article VII, Buffalo Grove Plan Commission Regular Meeting August 19, 1981 - 3 - In response to a question from Chairman Sheldon, Mr. Truesdell replied that there is no definition for swiming pools because staff felt it really was not necessary. Page 5 -Auto Laundry Commissioner Kaszubowski preferred the definition for Auto Laundry as referred to in Mr. Truesdell's memo of August 12, 1981 to the Plan Commission titled Zoning Ordinance and would like to see it included here. There was some discussion as to whether the number of stalls should be stated in the definition of Auto Laundry. It was determined that Mr. Truesdell would research this further. Page 5 - Basement Chairman Sheldon questioned why there was a definition for basement on page 5 and a definition for cellar on page 7. Mr. Truesdell replied that they differ in that a basement is considered a story whereas a cellar is not. Page 6 - Building Height In response to a question from Commissioner Goldspiel,Mr. Truesdell replied that the previous definition was not clear as to the height of the building. It really depends on the type of roof. To try to clarify that we said the highest point of the building determines the height. Commissioner Goldspiel stated that when you put this with the definition for Grade referred to on Page 10 under A and B you run into the problem of where the building meets the ground. We could have a problem with people mounding around the base of the building to make it higher. Mr. Truesdell will further disucss this point with the Building Department. 1 Page 4 - Airport, Major Mr. Truesdell suggested that this definition be dropped. The Commission concurred. Page 7 - Bus Lot Mr. Truesdell felt that this definition should be dropped as it is not used anymore. The Commission concurred. Buffalo Grove Plan Commission Regular Meeting August 19, 1981 - 4 - Page 8 - Court Commissioner Goldspiel questioned the statement "other than a yard on the same lot with a building". Mr. Truesdell - I feel if we add in "required" it would clarify that. Dwelling Commissioner Goldspiel asked if this definition excluded trailer or mobile homes and if they are regulated somewhere else in the ordinance. Mr. Truesdell - The ordinance does not list that as an allowable use any- where in its text. If a builder wanted to build a mobile home park the ordinance says that this cannot be done. Page 9 - Dwelling Detached Chairman Sheldon questioned the terms "open space". Mr. Truesdell replied that would be regulated by yard requirements. Family Chairman Sheldon asked what happens if unrelated people just want to live to- gether. Mr. Truesdell - That is covered under this definition but I will pull out the census definition for household and if that is acceptable will insert it here. Commissioner Goldspiel suggested looking up how the word family is used else- where in the Ordinance. He further suggested that the word "his" be changed where it refers to domestic servants. Page 10 - Frontage In response to a question from Commissioner Goldspiel, Mr. Truesdell replied that there is a definition on page 13 for frontage and this one can be dropped. The Commission Concurred. Buffalo Grove Plan Commission Regular Meeting August 19, 1981 - 5 - Grade Commissioner Goldspiel stated that there will not be many instances of Sections A and B but we should think about how we will handle the situation if there are no sidewalks at the building site. Mr. Truesdell stated that he would talk to Mr. Frank Hruby of the Building Depart- ment about this matter. Page 11 - Home Occupation In response to a question from Commissioner Kaszubowski regarding the restruct- uring of this definition, Mr. Truesdell replied that he was still working on it. Page 12 - Hotel or Motel Chairman Sheldon questioned why the term compensation was not used in this definition. Mr. Truesdell - We could a) change it to a building use for lodging of 3 or more persons used for compensation, b) could also put a period after temporary guests and drop the compensation term along with the rest of that sentence. The Commission agreed to b. it Institution Chairman Sheldon questioned if an institution was always non-profit. Mr. Truesdell agreed to look into this. Householder Mr. Truesdell suggested dropping this definition. The Commission concurred. Commissioner Goldspiel asked Mr. Truesdell to explain the term reverse corner lot. Mr. Truesdell replied that a reverse corner lot is when the rear yard of one house faces the side yard of another house. Page 14 - Non-Conforming Use Commissioner Goldspiel stated that the language suggests carrying forward non- conforming uses from previous editions of the ordinance. Buffalo Grove Plan Commission Regular Meeting August 19, 1981 - 6 - Nursery, Day and Nursery School Commissioner Kaszubowski stated that Commissioner Shifrin felt that this definition did not cover a mother who was taking children into her home. The other question was the ages stated in the ordinance. I think we should take the age limitation out. Commissioner Goldspiel stated that some nursery schools also take children of school age. Mr. Truesdell stated that he would further research this. Commissioner Button asked if there was a need for a definition for open space. It was determined that Mr. Truesdell would look for a definition of open space that was suitable. Page 15 - Owner Mr. Truesdell stated that this definition was taken directly from the Recreational Vehicles Ordinance. Chairman Sheldon asked how this would pertain to a structure or dwelling. Mr. Truesdell stated he would go through the ordinance and check if we use "owner" anywhere else in the Zoning Ordinance. Parcel Delivery Station Mr. Truesdell suggested deleting this definition because it is not used. The Commissioner concurred. Parking Area, Private Commissioner Goldspiel felt that this definition should be expanded. Mr. Truesdell - We could say "storage of private passenger and recreational vehicles". Chairman Sheldon - What we are saying is you can park recreational vehicles at single family locations but you cannot have them at apartment buildings. Page 16 No Commission comments Buffalo Grove Plan Commission Regular Meeting August 19, 1981 - 7 - Page 17 - Railroad Right-of-Way Mr. Truesdell suggested it be limited to a strip of land with tracks or intended for tracks. The Commission concurred. Page 18 - Ringelmann Number Commissioner Goldspiel suggested tying down Ringelmann Number and Ringelmann chart. Mr. Truesdell stated there are specifics we can tie that down to. Page 19 - Story, Half Commissioner Goldspiel stated that there is no definition for wall plates as used in this definition. He also asked the definition of pergolas. Mr. Truesdell replied it is an arbor or a trellis. 1 Terrace, Open Commissioner Goldspiel felt that the term "rather" as referred to in this defin- ition was not an artistic word. Page 20 - Yard Commissioner Goldspiel stated this definition referrs to 'Lowest level upward", I am not sure what that means. Mr. Truesdell stated he would look into that. Page 21 No Commission comments ARTICLE III No Commission Comment Buffalo Grove Plan Commission Regular Meeting August 19, 1981 - 8 - ARTICLE IV Section 3A - Building Height, Bulk and Lot Coverage Commissioner Davis stated that we do not make a provision for a satellite re- ceiving station. Many of the condominiums and apartment buildings will go to those rather than go to cable. Mr. Truesdell - That will have to be looked into. Page 27 Commissioner Goldspiel suggested that there might be a need for a Section 11. It seems we have had problems from time to time regarding plans and annexation agreements expiring and reverting back to R-1 zones. We should have some kind of a catch all for reversions. Mr. Truesdell - Normally that is covered in the annexation agreement. I will talk to Mr. Raysa, the Village Attorney, about that. FUTURE AGENDA Mr. Truesdell stated that at the September 2, 1981 meeting there will be three items on the agenda. 1. The final plat of subdivision of the Schwaben Center. 2. The Town Center sign package. 3. Continued discussion of the Zoning Ordinance. ADJOURNMENT Commissioner Davis moved adjournment with Commissioner Reid seconding. Chairman Sheldon adjourned the meeting at 9.30 P.M.
