Truesdell, Village Planner APPROVAL OF MINUTES Commissioner Reid moved approval of the February 3, 1982 Regular Meeting minutes with Commissioner Davis seconding. Page 1, paragraph 6 and 7 add approval was unanimous with Commissioner Davis abstaining. Paragraph 8 add "water pipeline" after "build" and add "to its customers" after "water". Page 2, paragraph 1 change " 37:000,000 to $67,000,000" add "plus interest" after "Evanston. "; change "had" to "issued"; change ' 'or that" to "the pipe- line"; add Water before Bonds; add after "obligation bonds" because the Water Commission is unable to sell their bonds because of the interest. "; delete "a" and add "the" between "taxes and water"; change "bill" to "bills" Page 2, paragraph 2 change Sieberg to Seeberg; Page 3, paragraph 1 change "state" to "estate"; paragraph 2 change "that had" to "that she had"; Page 4, paragraph 5 after "storm sewers" add as it was not economically feasible"; paragraph 7 change %anatarf to "sanitary"; paragraph 8 to be removed; Page 5, paragraph 9 change "stated that" to "asked if"; Page 9 paragraph 7 change "that they" to "that surveyors markers". - 2 - COMMITEEE REPORTS Commissioner Reid attended the February 8, 1982 Village Board meeting which also consisted of a public hearing on the Grove Shopping Center. It was approved. DEVELOPMENT ORDINANCE Commissioner Goldspiel expressed his concern with section 16. 10. 120. Mr. Boysen stated that the standards allowed materials to be used that were comparable to those in the catalogue. Commissioner Goldspiel felt it should be so stated in the ordinance. Mr. Raysa felt there would be no problem here. Commissioner Goldspiel expressed concern regarding Cable TV easements. Mr. Raysa stated that Cable TV has been defined as a utility. There is a bill before the state legislature stating this. The suggestion was made at the North West Municipal Conference that all developers and owners be required to put an easement for Cable TV on their plats. To formalize that Development Ordinance.Mr. Raysa felt it should be put in the ve opnent i n e. In response to a question from Commissioner Goldspiel, Mr. Raysa stated that the Cable Franchise Ordinance says that the Village will give to our franchisee any right, title and interest that we may have to an easement. We do not guarantee or warrantee that they have the right to use that easement. In response to a question from Commissioner Goldspiel, Mr. Raysa said he looked at the franchise agreement and the Franchise Ordinance and one of those areas that is covered is when the franchise expires or if the franchisee goes bankrupt. It says there are options. One option is the Village has the right to purchase those wires at market value. If we do not exercise that option, or give the franchise to someone else, the set price will be made at that time and the franchisee is bound to purchase those wires. Commissioner Goldspiel stated his personal feeling is that he would have to vote against the Development Ordinance with that stipulation in it and also against any plat that contains an easement for Cable TV. He felt the Village was on thin ice on this issue. Commissioner Davis asked if someone could be denied a permit to build a satellite dish because the Village has an agreement for Cable TV. Buffalo Grove Plan Commission Regular Meeting March 3, 1982 - 3 - Mr. Raysa stated that if you can meet the Village ordinances you can put up a satellite dish. In response to a request for copies of exhibits for sections 406, 407, 506, and 507, Mr. Boysen distributed them. Commissioner Goldspiel pointed out that in 16. 10. 110,the definition of developer, he felt it should include someone who just wants to subdivide and plat. Commissioner Goldspiel pointed out that on page 61, paragraph F after "program" the word "results" should be inserted. HIGHLAND GROVE UNIT NUMBERS 4 and 5 Commissioner Goldspiel requested the opportunity to inspect a copy of the original document approved for this plat. He noted there is a legend on both of these plats that indicates a 5' wide sidewalk easement hereby reserved for and granted to the Village of Buffalo Grove. These lots have been shortened by another 5' and he did not remember anything as extensive as this in previous discussions. In response to a question from Commissioner Goldspiel, Mr. Kuenkler stated that Fabish Drive is a minor street and Highland Grove Drive would be a collector street. In response to a question from Commissioner Sheldon regarding Highland Courts North and South, Mr. Kuenkler stated that this had been reviewed by both the Fire and Police Departments and the problem has been solved with consecutive numbering. Commissioner Sheldon stated that there are a number of homes in the Village that are in violation of the ordinance regarding street numbers. Mr. Truesdell would check into the ordinance regarding street numbers and get back to the Commission. In response to a question from Commissioner Goldspiel, Mr. Kuenkler stated he had reviewed both of the plats for Highland Grove Units 4 and 5 and found them in order. Commissioner Sheldon moved recommending to the Village Board approval of the Plat of Subdivision for Highland Grove Unit Number 4, dated July 12, 1979, with Commissioner Davis seconding. Buffalo Grove Plan Commission Regular Meeting March 3, 1982 - 4 - Discussion: Commissioner Goldspiel stated that he proposed to vote against any plat that has on it an easement for Cable TV which is not supported by Village Ordinance. He felt there was not any statutory justification to do so. In response to a question from Commissioner Davis, Mr. Kuenkler stated that the plats for Schwaben Center and Chatham Manor both had easements for Cable TV. 1 Commissioner Davis asked that if we do not have an easement requirement in an ordinance how can it be on a plat. Mr. Raysa stated that the Elgin case calls Cable TV a utility. In response to a question from Commissioner Goldspiel, Mr. Raysa stated that using the Elgin case he is saying Cable TV is a utility and can be 1 put on a plat under easements. Commissioner Sheldon moved recommending approval of the Plat of Subdivision of Highland Grove Unit Number 5, dated July 12, 1979, to the Village Board. Commissioner Davis seconded the motion. AYES: Commissioners Sheldon, Davis, Reid, Krug NAPES: Commissioner Goldspiel ABSTAIN: Commissioner Kaszubowski ABSENT: Commissioner Glover The motion passed 5 - 1. Commissioner Goldspiel stated that the reason for his no votes was related solely to the easement for Cable TV and not the plat. BUFFALO GROVE CENTER Mr. Truesdell stated that the plat appears to be in order with a few minor Buffalo Grove Plan Commission Regular Meeting March 3, 1982 - 5 - changes. The Jewel/Osco building was moved and a few signatures were missing. Commissioner Davis moved recommending approval of the final Plat of Subdivision for the Buffalo Grove Center, dated February 25, 1982, to the Village Board. Commissioner Reid seconded the motion. Discussion: Commissioner Goldspiel questioned the absence of language indicating vacating a portion of a subdivision. Mr. Dieter stated they are subdividing another part of a subdivision which ends it. Mr. Raysa stated he could go along with the surveyor on this. In response to a question from Commissioner Goldspiel regarding lighting in the parking lot, Mr. Truesdell stated that is normally gone over by the engineer and the Appearance Commission. The Plan Commission is not approving those lights tonight. He further stated that he had no problem with the parking now that the building had been moved. In response to a question from Commissioner Kaszubowski, Mr. Truesdell stated the plat had been looked at in relation to Exhibit A. Commissioner Goldspiel questioned the notation "N. I. C. " on the two out buildings. Mr. Dieter felt it could mean "not in-contract". In response to a question from Commissioner Krug, Mr. Truesdell stated the park- ing spaces have been moved but they are still in compliance with the requirements for handicap parking. He would have to double check the building code but the building department does check that every requirement is met. Commissioner Goldspiel recommended that the motion be revised to indicate that approval of Out Buildings C and B not be included in the approval of the plat. The motion was so amended. Buffalo Grove Plan Commission Regular Meeting March 3, 1982 - 6 - Commissioner Goldspiel again stated that he voted against approval of the plat solely because of the Cable TV easement and not because of the plat. In response to a question from Commissioner Sheldon, Mr. Eisenberg stated they will break ground in April, 1982 and open in November, 1982. PLAT OF DEDICATION - BUFFALO GROVE ROAD Commissioner Goldspiel moved recommending approval to the Village Board of the Plat of Dedication for Buffalo Grove Road, dated January 18, 1982. Commissioner Reid seconded the motion. AYES: Commissioners Goldspiel, Sheldon, Davis, Reid, Kaszubowski, Krug NAYES: None ABSTAIN: None ABSENT: Commissioner Glover The motion passed 6 - 0. WYNNEDALE Mr. Freedman stated this plan will be developed by Lexington Development Corporation. It is a substantially improved plan over the last one, which was approved in concept. It has eliminated the construction north of the creek. The density has been reduced from 288 units to 250 units and the two buildings at the north eastern end have been removed. Mr. Glyman stated the developer has one access point at Arlington Heights Road with two outbound and two inbound moving lanes turning into three major areas of development. The units range from six to fourteen units to a building in a two story variety. The garages are enclosed. Approxi� mately 600 of the units will have garages. However, the developer is not firm on this. There is a centrally located clubhouse facility with a pool. Open space and setbacks are consistent with the zoning. They are proposing private streets. The detention is centrally located in the northern part of the site. Along the southern property line they have tried not to front or back any of the units up to the parking lot of the Trammel Crow Office Park. They are trying to take maximum exposure of the golf course. Mr. Freedman responded to the statements made on the memo to the Plan Commission from Mr. Truesdell dated February 26, 1982 titled Wynnedale Subdivision - Staff Review. PAGE 3 - 3) West Side of Plan - Third Item - Installation of right turn deceler- ation lane, They feel this should not be required because there is insufficient room Buffalo Grove Plan Commission Regular Meeting March 3, 1982 - 7 - for it. It is a fairly recent installation and it is a burden on the plan. Mr. Piggott stated they feel there is a limited amount of space in the right-of-way with a 5' bike path. It could be put in with a very tight bike path to the road. There is no right turn lane provided on Arlington Heights Road or Dundee Road or along Route 83. Neither is there a right turn lane on Checker Road or Bernard Drive. Mr. Goldspiel pointed out that everything south of Lake/Cook Road is at a reduced speed. Mr. Piggott pointed out that the bike path would be very close to the deceleration lane. Mr. Truesdell stated that this was a comment from the Village Manager. Staff feels it was something that would add to the functional ability of Arlington Heights Road. In terms of Checker Road, there is a plan to put a traffic signal there. In response to a question from Commissioner Davis, Mr. Truesdell stated that staff checked the site distance for this development and they found no problem with it. In response to a question from Commissioner Davis, Mr. Truesdell stated the right turn lane was omitted on the old plan because of an oversight. 4+) South Property Line - Using Office Detention As A Recreational Facility Mr. Freedman stated they are against this. They do not want to mix a residential area with a business park. There are some legal problems involved with this. Mr. Truesdell stated the thought was that there would be a large open area back there open to the residents along with the bike path coming up to the business park and there is the possibility it would be good if that facility could be used for something other than a green area. In response to a question from Commissioner Davis, Mr. Truesdell stated he believed the Park District is now giving some kind of credit for de- tention areas. 5) Infrastructure - Third Item Mr. Freedman stated some of the sidewalks in the interior streets do not connect. They felt with the nature of the size of these streets it is Buffalo Grove Plan Commission Regular Meeting March 3, 1982 - 8 not necessary to extend the sidewalks. You could walk across the paved areas. Mr. Truesdell pointed out that in certain areas they dead end and staff felt it would be good to connect the sidewalks up. PAGE 4 - Planning Department 1) Item Two - Provision Of A Bridge Over Buffalo Creek Mr. Freedman - We would like to have the opportunity to study this further. From the standpoint of engineering we feel it would be difficult to span that creek with a bridge and comply with your ordinance. We do not want to create any problems with the IDOT permit. If those two matters can be provided for we are amenable to providing the bike path in that fashion. We do need some kind of relief from your Flood Plain Ordinance or we will have to run a bridge some 220 feet. Commissioner Sheldon stated that she lives on Burnt Ember Lane. This site will be within walking distance of schools. The children walking to school could go down Arlington Heights Road. Once they get to the inter- section of Checker Road and Arlington Heights Road they would have to cross to get to the sidewalk on the north side. Her child can jump the creek. Mr. Davis stated the children will go over the bridge to get to school. However, there is the problem of getting them from the bridge up Checker Road. Mr. Freedman did not think that was a problem provided the other aspects of the plan can be worked out. They could extend the sidewalk. Mr. Truesdell felt the sidewalks should be connected up. Fire Department - 1) and Planning Department 1) Item Four Mr. Freedman stated they did not feel that a second access point should be made on Arlington Heights Road. They are prepared to provide some sort of emergency access further south through the business park. There is not enough room to do that between the three cul-de-sacs. Item Three Mr. Freedman stated they are amenable to dedicating the main streets in the development provided that the right-of-way is varied from 43. 5 feet. They are agreeable to constructing the sidewalks from four to five feet but would request that the sidewalks be constructed on one side of the street. Buffalo Grove Plan Commission Regular Meeting March 3, 1982 - 9 - Item Six Regarding the increase of the setback on the eastern edge of the plan Mr. Freedmen felt that the setback can be increased but they did not know if it can be increased to 50'. They will have to look into that. Mr. Freedman referred to the memo from Mr. Kuenkler to Mr. Truesdell dated February 19, 1982 titled Proposed Development Arlington Heights Road and Checker Drive Concept Plan Review. Comments Item One - Provision Of Detention For The Park They have considerable problem with this. Mr. Freedman then briefly reviewed the history of this site. He stated that this northern piece was being donated to the Village. It will be vacant land. Inasmuch as there is some compensatory storage that is going to be provided they are going to regrade, those areas that are regraded will be reseeded. They do not feel they should be required to put in detention. Commissioner Davis pointed out that the referendum that failed on this site was to keep it as prairie or in its natural state. Mr. Kuenkler pointed out that the ordinance requires detention and there is no variation authority in the detention law. Mr. Raysa stated he would take a look at the ordinance regarding this question. Mr. Truesdell stated the Park District submitted some comments after :.his memo ;as written. One comment was that the bridge would have to be ten feet wide so that they could get their lawnmowers over it. They also asked if the compensatory storage design north of the creek will be of such a nature that it could be used for recreational purposes. Mr. Freedman stated they were in agreement with the rest of the staff report. Mr. Bianchini briefly explained the product. He stated that because of the physical character of the property there are a number of problems and it necessitated a redesign o2 the product. These are units similar to coach houses but without garages. They can step the buildings down in increments to conform with the land. They are proposing to keep some of the open park with buildings of an architectural flair similar to those at the International Village. The parking facilities are tucked into the ground. The colonial design is a combination of siding and brick. It is a stacked unit. They have designed a product that will give better utiliza- Buffalo Grove Plan Commission Regular Meeting March 3, 1982 - 10 - tion of the corner units. They will all have their own entrance. The other units will have common entrances. The size of the unit will average a little over 1,100 square feet. The price will probably be in the area of the high fifties to the high sixties. In response to a question from Commissioner Sheldon, Mr. Bianchini stated that each unit will have a balcony. Mr. Freedman stated this piece of land has had problems for many years. One of the goals of the Village was to get it developed with a reasonable density and get the land north of the creek dedicated to the Village. You are getting that with this plan. This is really an opportunity to develop this piece with an excellent developer. In response to a question from Commissioner Davis, Mr. Bianchini stated they will start construction as soon as the engineering is approved. In response to a question from Commissioner Davis, Mr. Freedman stated that Lexington Development Corporation will be the sole owner of the property and they will develop it. They nave the financial resources to develop it. In response to a question from Commissioner Sheldon, Mr. Bianchini stated the overall theme is basically a colonial exterior with brick and siding that are compatible. The roof is a normal composition shingle that looks like shake. In response to a question from Commissioner Sheldon, Mr. Bianchini stated that there will be dumpsters but they are not noted on the plan. Utilities will be in the buildings. They have not designed the locations of the air conditioning units yet. In response to a question from Commissioner Davis, Mr. Bianchini stated the units will have gas heat. In response to a question from Commissioner Goldspiel, Mr. Freedman stated the major problem that stopped the other plan from going ahead was the grading of the area north of the creek. Then the market changed. Mr. Piggott stated they have about 30' of grade differential on the site. They wound up encroaching on the flood plan. They had a problem with the detention. There would have had to be a 14' retaining wall and they could not market something like that. It was unbuildable. In response to a question from Commissioner Goldspiel, Mr. Piggott stated that in the new plan they drop building levels as the grade drops. They will have a lot of relief on the site but will not have a 14+' retaining wall. Buffalo Grove Plan Commission Regular Meeting March 3, 1982 1 - 11 - Commissioner Goldspiel stated that the profusion of garages reminded him of a Chicago alley and it seems to be a very congested street scape. Mr. Glyman stated that in certain situations were the garages parallel the road system the area directly in front of the garage or street side of the garages will be bermed and landscaped. It will look like a fence element set in the landscape. The developer is not sure how many garages he is going to offer. Bather than put the garages fifteen feet away from the units they pulled them to the other side of the drive so that there would be some space. When they did cluster garages it could be possible to set the garages adjacent to the office park screening the residential area from the office park. The area could be landscaped near the garages. Mr. Bianchini stated they are not sure how many garages they are going to put in. Commissioner Goldspiel stated the two problems with this plan were the traffic pattern, which seemed to him a difficult one and a need for pedestrain access for the school or bus service. The cul-de-sacs, garages and townhouse area has a problem in his opinion. The buildings should not be parallel to each other. It seems to be an undesirable plan at the present time. Mr. Bianchini stated one of the reasons the coach houses work is that everyone of the units looks out onto the green belts. They tried to maximize the distance between buildings. From the inside out it is very important for the people to get these green belts working. Mr. Truesdell pointed out the next workshop on this project would be scheduled as soon as the landscape and phasing plans were received. DEVELOPER CHECK LIST 1 Deceleration Lane 1 Commissioner Davis stated that he did not see the need for the right turn lane. There is none on Checker Road or anywhere along Arlington Heights Road. Mr. Truesdell stated the Village Manager stated he is not sure if the county would give a permit for the deceleration lane. They will investi- gate it further and get back to the Plan Commission. In response to a question from Commissioner Davis, Mr. Bianchini stated they are bringing the storm water to the property line. Mr. Truesdell pointed out that a 20" water main on Arlington Heights Road and a 16" water main along Checker Drive were required. Buffalo Grove Plan Commission Regular Meeting March 3, 1982 - 12 - Mr. Bianchini stated they are prepared to build that. South Property Line Commissioner Reid stated she felt the developers point was well taken on that issue. Sidewalk System Commissioner Goldspiel felt that they need an indication or a study of pedestrain access. Mr. Bianchini stated that the landscape plan will show how this will work. In response to a question from Commissioner Davis, Commissioner Goldspiel stated he considered a bike path for pedestrain use. Emergency Access from the Business Park Commissioner Reid felt a secondary access through the business park was a good idea. In response to a question from Commissioner Davis regarding leaving the land north of the creek in its natural state, Mrs. Knaak stated she did not think the Park District said they did not want to accept that. They would leave it passive and as open land. Regarding the fact that it would be left to the Village rather than the Park District, Mrs. Knaak said she had no recollection of that. Mr. Truesdell stated he would have a meeting with Mr. Piggott on this before the next workshop. Bridge and Bike Path Mr. Truesdell felt it was essential to the bike path route that it be connected up. Mr. Freedman stated they will study it. Dedicate Streets If They Could Be Made 43.5 Feet Wide Commissioner Goldspiel felt the Village should continue its policy of requiring all streets to be dedicated. Regarding the right-of-way Commissioner Goldspiel would like to hear eventually from the engineering people as to the problems that would arise. Buffalo Grove Plan Commission Regular Meeting March 3, 1982 - 13 - Sidewalk Going From Four to Five Feet On One Side Of The Street Mr. Truesdell stated he looked at the standard right-of-way and it should be required specifically in subdivisions for single family. In this case the front of the buildings face the street, at the most some of the sides of some of the buildings face out into the street. They all face the green open belts. He did not feel it was necessary. Therefore, they have enough room for the utilities. Commissioner Goldspiel wanted to see the whole picture before allowing this. Emergency Access To The South And Back Of The Cul-de-sacs Mr. Truesdell felt if there were some type of access in case the roadway was blocked it would help solve this problem. Mr. Glyman responding to Commissioner Goldspiel's comments, pointed out that there were no narrow streets. They all are twenty-seven feet wide. There is nothing that is substandard. Commissioner Goldspiel pointed out the Village has a policy of no cul- de-sacs over five hundred feet. He felt this plan contained some of these. If there was some pedestrain access it would also provide emergency access and improve the plan. East Side Of The Property Increased Between 30' and 50' Mr. Truesdell stated the idea was to save the tree line and put the bike path in. The trees on the site near the buildings are dead or dying. The rest of the trees are within two hundred feet of the creek and they will stay. Mr. Glyman pointed out the trees will not be inhibited by the engineering. They are basically wet land trees and will survive. Detention For The Land To The North Mr. Raysa is going to look into this point. Commissioner Goldspiel pointed out that the Park District has yet to comment on this. MC DONALD'S RESOLUTION Chairman Shields pointed out the property is zoned but they need to get a special use to have a restaurant there. They need a variation on the parking which is probably the hardest thing for them to get. They have to Buffalo Grove Plan Commission Regular Meeting March 3, 1982 • _ 14 _ get the parking somewhere. The people from Longfellow and Cooper Schools have been very concerned about the children crossing the street and with the prospect of having a fast food store in a residential area. The neighbors have a petition with three hundred signatures on it. Commissioner Sheldon asked why the Village of Buffalo Grove hasn't gone to their meetings and protested. Mr. Truesdell had attended the last meeting . They are at the very beginning of the process. They had not had a staff review yet. Chairman Shields stated that as of Sunday, February 28, 1982, the Arlington Heights Plan Commission had not met on it and it had to go to the Village Board. In response to a question from Commissioner Goldspiel, Mr. Truesdell stated they have not received a sign package yet. They felt it would be in next week. They will notify us when it comes in. Chairman Shields stated this particular lot was zoned commercial against the protests of Buffalo Grove and the property owners. The concession was that they were going to have a twenty-five foot landscape easement There is a residential lot across the street and next to the proposed restaurant. Commissioner Sheldon moved that the Plan Commission recommend approval of the proposed resolution for the Arlington Heights Mc Donald's to the Village Board. Commissioner Sheldon volunteered to go to the meetings in Arlington Heights that pertain to this issue and Mr. Truesdell will notify her when he receives the agendas. Chairman Shields asked the prospective Plan Commission candidates to introduce themselves. There were three. FUTURE AGENDA Mr. Truesdell stated that there is nothing ready for the March 17, 1982 meeting. On April 7, 1982 there will be a rescheduling of the public Buffalo Grove Plan Commission Regular Meeting March 3, 1982 - 15 - hearing on the Development Ordinance. ADJOURNMENT Commissioner Davis moved adjournment with Commissioner Krug seconding. The vote was unanimous. Chairman Shields adjourned the meeting at 10:33 P.M.
