1991-10-28 - Village Board Committee of the Whole - Minutes SUMMARY OF COMMITTEE OF THE WHOLE OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, ILLINOIS, HELD MONDAY, OCTOBER 28, 1991, AT THE MUNICIPAL BUILDING, 50 RAUPP BOULEVARD, BUFFALO GROVE, ILLINOIS CLERK PRO-TEM Moved by Braiman, seconded by Kahn, to appoint Jane Olson Clerk Pro-Tem for tonight's meeting. Upon voice vote the motion was unanimously declared carried. ROLL CALL President Mathias called the meeting to order at 7:30 P.M. Roll call indicated the following present: President Mathias; Trustees Marienthal, Reid, Kahn, Rubin, Braiman, Hendricks. Also present were: William Balling, Village Manager; William Raysa, Village Attorney; Lee Szymborski, Assistant Village Manager; William Brimm, Finance Director; Phil Versten, Administrative Assistant; Robert Pfeil, Village Planner; and Joe Tenerelli, Village Treasurer. VILLAGE PRESIDENT'S REPORT No report VILLAGE MANAGER'S REPORT No report CABLE TELEVISION COVERAGE OF VILLAGE BOARD MEETINGS Phil Versten, Administrative Assistant, reviewed his memo to Lee Szymborski of October 24, 1991. Cablecasting of the Village Board meetings would involve 7-8 producer hours per board meeting, instead of the previous number of 12. This will allow more hours per year to produce other programs as public information needs dictate. Cablecasting of Village Board meetings will make programing available to cable subscribers as well as non-subscribers by making tapes available to check out at libraries. Mr. Balling would like the Board to determine if they want Village Board and Plan Commission meetings taped on a regular or spot basis; live or on tape? The time needs to be reserved quickly or the programming slot will be lost to other Villages. The meetings will be broadcast to all Villages. Will the cable television presence be helpful to the process of the meeting; will it help or hurt the participation of residents in the meeting? Does it discourage participation of the public who do not want to be part of the television process? Should public broadcast be tape delayed or live and should it include Board and Plan Commission meetings? Further discussion took place concerning the affect on the meeting process, cost of production, public information and public education. The Board was polled. "YES" indicates Staff should proceed with this issue and bring back a contract with recommendations. REAL ESTATE TRANSFER TAX Mr. Balling introduced the proposed Real Estate Transfer Tax Ordinance. Staff would like direction from the Board in three areas: 1. Should there be exemptions? If so,for whom? 2. Should the buyer or seller pay? 3. Sufficiency of rate at $3/$1000 The ordinance will take effect March 1, 1992. Lynn Callahan representing local realtors presented her thoughts on the tax. The Board discussed the three areas requiring direction. Mr. Brimm reviewed the internal procedures to administer the transfer tax ordinance. Village Attorney Raysa explained that exemptions of any type may be declared by the courts to have created a special beneficial class and could be declared invalid and any fees collected would be returned. He is not comfortable recommending to Board exemptions because of the magnitude and doubts of the legitimacy of the classifications. "YES" indicated there should be an exemption for those 65 and over. "NO" indicates there should not be an exemption for those over 65: NO: Marienthal, Reid, Rubin, Braiman, Hendricks YES: Kahn President Mathias polled the Board: Should there be an exemption for those who sell and buy within Buffalo Grove? "YES" indicates there should be an exemption or refund. "NO" indicates there should not be an exemption or refund. YES: Marienthal, Kahn NO: Reid, Rubin, Braiman, Hendricks The ordinance will be prepared for the November 4, 1991 Village Board meeting. The ordinance will be in effect for all transfers where the deed or conveyance of property is recorded on or after March 1 , 1992. PROPOSED BOUNDARY AGREEMENT WITH THE VILLAGE OF LINCOLNSHIRE President Mathias introduced the subject concerning the proposal from Lincolnshire. It is a matter of negotiations. He informed the Board that he and Trustee Rubin are in meetings with the Village President and Trustee from Lincolnshire. Trustee Rubin, in talks with Lincolnshire Village President has been told that Lincolnshire is ready to discuss widening of Route 22. Trustee Marienthal listed his concerns with the Lincolnshire proposal. Negotiations with Lincolnshire should concern the train station location, boundaries, and the widening of Route 22. President Mathias concurred with Trustee Marienthal's areas of concern and requested that the Board authorize the continuation of negotiations with Lincolnshire. Staff is requested to draft a proposal for Buffalo Grove's response to Lincolnshire based on comments tonight. ADJOURNMENT Moved by Reid, seconded by Braiman to adjourn.
