1978-10-23 - Village Board Committee of the Whole - Minutes `./ SUMMARY OF COMMITTEE OF THE WHOLE OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, ILLINOIS, HELD MONDAY, OCTOBER 23, 1978, AT THE MUNICIPAL BUILDING, 50 RAUPP BOULEVARD, BUFFALO GROVE, ILLINOIS. President Fabish called the meeting to order at 7:30 P.M. Those present were President Fabish; Trustees Rech, Bogart, Marienthal , Stone, Mendenhall , Kandel . Also present were William Balling, Village Manager; William Raysa, Village Attorney; Thomas Fennell , Director of Planning and Development; and William Sommer, Assistant Village Manager. PETITION/PARKING COMMERCIAL VEHICLES Jerry Thompson, 3 Weidner Court, presented a petition bearing 71 signatures which stated "THE COMPLAINT: -Commercial vehicles parked in the driveway and/or on the lawn at 863 Bernard Drive. The vehicles consist of a 3-axle dump truck, a commercial pick-up truck, and a commercial trailer. -Maintenance on one or • more of these vehicles has occurred almost every weekend since the new residents took occupancy in August, 1978. The maintenance has been noisy and disruptive. The 'bed' of the dump truck was often left in the dump position unattended. -The dump truck, on a daily basis, is started in the early A.M. hours , normally between 4:00 A.M. and 6:00 A.M. Besides the loud noises at such early hours, there has been additional commotion on the village streets. Often the dump truck is 'towed' by the pick-up truck in order to start it. -A safety hazard occurs when the driver of the dump truck parks the vehicle in the driveway of 863 Bernard Drive. The vehicle first pulls onto Windsor Drive, heading north, then backs across Bernard Drive into the residence. The residents of 863 Bernard Drive have demonstrated a total lack of consideration of neighboring households. The 'undersigned ' are concerned with the degradation of the village in general . There is a financial concern related to property values and marketability of real estate. The 'undersigned' are concerned about the safety of the many children who walk the sidewalks of the village and cross the village streets. The 'undersigned' are frustrated with the noises and disturbances caused by the cranking of commercial vehicles at odd hours and with the pounding of metal against metal . The 'undersigned' expect immediate cessation of all disturbances and nuisances created by the occupants of 863 Bernard Drive." Mr. Balling stated that after discussing this matter with Mr. Thompson this afternoon, he advised the Police Department that this situation should be considered a blatant violator of the. Zoning Ordinance and a citation should be issued. Mr. Raysa suggested that the violator also could be cited for violation of the Disturbance of the Peace Ordinance or the Nuisance Ordinance. Trustee Mendenhall stated that the committee appointed to study the situation of parking of vehicles, other than passenger cars, in a residential zoning district will submit an ordinance for Board consideration on November 13. The proposed ordinance prohibits parking of commercial -vehicl es over a certain size. BLUE RIBBON COMMITTEE/WILLIAMSBURG ON THE LAKE ACQUISITION ' Trustee Stone reviewed the Land Acquisition Referendum Fact Sheet, dated revised October 17, 1978, which was prepared by the Blue Ribbon Committee/Williamsburg on the Lake Acquisition and the staff. During the review, the following changes were made: ) COMMITTEE OF THE WHOLE OCTOBER 23, 1978 PAGE TWO 1 . Page 1 - under Alternative Land Use - the following sentence will be added to alternatives #1 and #2: "The Village will be responsible for installing the 20" water main." 2. Page 1 - under Alternative Land Use - the following sentence will be added to alternative #3: "Owner would be responsible for installing the 20" water main." 3. Page 2 - under Cost of Purchasing Land - first paragraph - change last sentence to read "It is expected that these bonds will be issued for a 15-year period with a rate of approximately 5.8% based on a prime rate of 10%." 4. Page 3 - under Present and Future Village Open Space - second paragraph - figures to be changed to be based on current annexations and the additional 65.5 acres that has been commited to service that additional residential population (to be figured from the Illinois School Consulting Service population projection figures) . Then a ratio will be developed. The sentence, "These figures, however, do not include the 350 acre Buffalo Creek Forest Preserve adjacent to the proposed land acquisition" will remain in the paragraph. Trustee Stone stated that this fact sheet will be presented at the League of Women Voters forum to be held on Monday, October 30, 1978, at 8:00 P.M. , in the Council Chambers. He then reviewed the format of the forum. HEALTH CARE FACILITIES MEETING Mr. Balling reported that the Health Care Facilities meeting to be held with the Village of Wheeling and the City of Prospect Heights has been rescheduled to • November 13, 1978, from 7:30 P.M. until 8:45 P.M. It was decided that if the President of the Board of Health would like to attend the meeting, he should be invited to attend along with the Village Board. It further was decided that the resolution opposing the Wheeling-Buffalo Grove Hospital should be placed on the November 6 agenda so it may be presented to the Village of Wheeling at the meeting. RECENT NEWS ARTICLE Trustee Mendenhall read a statement in which he stated that on last Friday, October 20, 1978, the Buffalo Grove Herald printed a story on the front page in which they quoted him out of context and printed an error in content. After some discussion with the editor, a correction was printed but it was buried on page 5. He hoped future Herald articles would be better researched and more accurate. PROPOSED. CONDOMINNIUM CONVERSION,ORDINANCE Mr. Balling `st led-t"haf Thee-rental developments in Buffalo Grove are considering condominium conversion and recommended that a regulatory ordinance be passed to protect the existing tenants and to insure that codes and standards are met. He felt some legislative action should be taken to support a moritorium on conversions until the ordinance is passed. ♦./ LJ COMMITTEE OF THE WHOLE OCTOBER 23, 1978 PAGE THREE �.s The Board reviewed a memo, dated October 19, 1978, from Mr. Fennell , and a memo, dated September 21 , 1978, from Mr. Raysa regarding the concept of a Condominium Conversion Ordinance. Mr. Balling stated that the Plan Commission considered this subject on October 18 and recommends 1) it is important that the Village have a policy of supporting rental housing as well as family ownership so that there will be a range of housing and lifestyles in the Village, 2) Board should give some consideration to whether or not it would be advantageous to the Village to develop legislation to control rental apartment ownership conversions to condominium ownership, and 3) consider assuming jurisdiction and ownership of the private internal street systems in some of the rental developments. Mr. Raysa stated that the Village cannot put a restrain on the property by saying it may not be converted to condominiums. The Village's authority would lie within the Building Codes. After much discussion, it decided that staff should draft a Condominium Conversion Ordinance for the Board to consider. The draft ordinance should contain 1) items listed in Mr. Raysa's memo, dated September 21 , 1978, 2) some statement that the property will not become a liability to the Village, 3) major points in the Municipal League article which was attached to Mr. Raysa 's memo, and 4) streets have to brought up to Village standards before making them public. Copies of Condominium Conversion Ordinances adopted by other communities also will be distributed to the Board for review. FLOOD CONTROL COMMITTEE Trustee Rech announced that the Flood Control Committee will meet on Wednesday, October 25, 1978, in the Conference Room to discuss a Soil Erosion Ordinance.
