1960-08-04 - Village Board Regular Meeting - Minutes MINUTES OF A REGULAR MEETING OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK COUNTY, ILLINOIS, HELD THURSDAY, AUGUST 4th, 1960, AT 8:00 P.M., AT 182 BUFFALO GROVE ROAD, BUFFALO GROVE, ILLINOIS. The President called the meeting to order. On roll call the following were found present: President Bunescu; Trustees Bochniak, Walters, McGahan, Dorner and Frank Absent: Trustee Schreiber Trustee Bochniak moved that the minutes of the previous meeting held on Thursday, July 7, 1960, be approved as written. Trustee Frank seconded the motion. On roll call the vote was as follows: AYES: Bochniak, Walters, McGahan, Dorner and Frank NAYS: None Trustee Bochniak read the Treasurer's report for the period from July 7, 1960 thru August 4, 1960, showing cash in bank of $8,739.16 and motor fuel tax allotment of $3,085.84. Chief Barnett read the Police Activities report for the month of July and the man hours for the month. The Police Magistrate gave his reports for the months of June and July, stating that in the month of June, 1960, $34.00 in fines was turned over to the Village, and that in the month of July, 1960, $29.00 in fines was given to the Village. Plan:Commission - no report. Trustee Walters suggests that inasmuch as the Plan Commission is an important functioning body of the Village, that it give a report at each Board meeting. Warrant #30 was read by Trustee Bochniak. Trustee Walters moved that Warrant #30 in the amount of $1071.87 be approved as read. Trustee Bochniak seconded the motion. On roll call the vote was as follows: AYES: Trustees McGahan, Walters, Bochniak, Frank and Dorner. NAYS: None Chief Barnett reported on the newspaper receptacles on Buffalo Grove Road, stating that letters were mailed and all but two had been removed. He stated that he would follow up on these two. Chief Barnett stated that he has not had an opportunity to check into the rebate on gas purchases. Chief Barnett stated that they have not been enforcing the weed ordinance and that the Police Department has had no complaints on weeds. Trustee Walters stated he has had complaints about the area along the creek. l� l Trustee McGahan suggested that the Village should find someone who takes shorthand and has a typewriter to perform secretarial services for the 1.... Village officials. The Board agreed that the point is well taken, but that the Village is not ready for this yet. The Board recommended that the Dunhurst Currency Exchange be set up to register solicitors for the Village. The Clerk was authorized to have copies of ordinances made for the Police Department, the Police Magistrate and the Treasurer. Mr. Hooper was asked to follow thru on the street lighting for Unit V and along Buffalo Grove Road. Mr. Hupfel, Civil Defense Director - no report. The President read a letter dated August 1, 1960 from John D. Hooper, Village Engineer (Doc. #70) relating to the "green growth" on the oxidation lagoons and the erosion problem alohg the banks of Buffalo Creek. A discussion followed on creek filling and drainage. Mr. Venetianer, the Building Commissioner, stated that he issued 20 permits for July 11 garage and 9 house permits. Following discussion, the Building Commissioner was asked to check Bell Savings and Loan Association and to send them a report each month on the number of building permits issued. The President read the decision of the Zoning Board of Appeals (Doc. #71) which states in substance that the appeal of Mr. Timothy McCarthy for a zoning variation be denied on the primary grounds that it does not con- stitute a hardship. Mr. McCarthy objected to the decision, stated that he wished to build an attached garage that would extend 6 ft. in front of the house. The garage would not block the bedroom, bathroom and basement windows and the area behind would provide a patio area with maximum privacy. Mr. McCarthy objected to the manner in which the Zoning Board of Appeals handled his case and specifically in not notifying him that his appeal had been denied. The President called upon Mr. Goldthwaite, a member of the Zoning Board of Appeals, who stated that notice had been published, a public hearing was had, the neighbors had been consulted, the area had been looked at and measured to see how it would affect the lot, and the decision was made. Trustee Frank stated that since there is some question about the procedure and since the Board did not have all the facts available, he felt the matter should be tabled so that the Board could go into it, look at the `/ property and then render a decision. Thereupon, Trustee Frank moved that further discussion on the recommendation of the Zoning Board of Appeals in regard to the McCarthy Appeal be tabled until the next meeting. Trustee McGahan seconded the motion. On roll call the vote was as follows: ti.. AYES: Trustees Frank, Dorner, McGahan, Walters NAYS: Trustee Bochniak 1 Mr. John D. Hooper, Village Engineer, stated that the Buffalo Grove Home Builders have tendered the streets in Units II and IV, and all streets in Unit III except Bernard Drive, in Buffalo Grove Subdivision, for acceptance by the Village, and further that he recommends their acceptance by the Village of Buffalo Grove, subject to one years maintenance. (Doc. #72). Trustee Walters moved that a resolution be passed accepting the streets and curbs in Units II, III and IV, except Bernard Drive, subject to the one year maintenance provision. Trustee Bochniak seconded the $otion. Discussion followed. The roll was called and the vote was as follows: AYES: Trustees Bochniak, Walters, McGahan, Dorner and Frank NAYS: None The President read the recommendation of the Zoning Board of Appeals (Doc. #73) that Article 8, Par. .04 of 0-58-16 be amended to read that the existing fee of $2.00 be increased to $6.00 for all appeals related to all AA resident districts and all A resident districts; and that a fee of $25.00 be set for all appeals pertaining to Article 5, Par. B, Article 6, Par. C, and Article 7, Par. 3. The reason for this is the cost of publication, research work and cost of supplies. Trustee Frank recommended that this be incorporated in the new zoning ordinance. Trustee Bochniak read the Tax Levy Ordinance - 0-60-6. Following the reading, Trustee Walters moved that Ordinance 0-60-6, being the Tax Levy Ordinance be approved. Trustee McGahan seconded the motioh. On roll call the vote was as follows: AYES: Trustee Bochniak, Walters, McGahan, Frank, Dorner. NAYS: None The President read a letter of resignation as Lt. of the Police from Charles V. Grainer. A discussion followed in which Chief Barnett explained the dis- satisfaction of the Police Department because they do not have the proper facilities and must operate a Police Department out of their homes. Trustee Frank suggested that Lt. Gramer's resignation be held in abeyance for a week or two and that the Police meet with the Board and try to resolve this problem. The President read proposed Ordinance No. 0-60-7, being an ordinance amending 0-58-16, the Zoning Ordinance. The amendment relates to side yard limits. Trustee Walters moved that Ordinance No. 0-60-7, being an ordinance amending 0-58-16, the Zoning Ordinance, be approved as read. Trustee Dorner seconded the motion. On roll call the vote was as follows: AYES: Trustees Frank, Walters, Bochniak, Dorner, McGahan NAYS: None G �' A discussion followed on snowplowing for the coming winter. Trustee Frank offered to contact Country Service. President Bunescu said he will contact Dietz Bros. and Mr. Venetianer offered to contact Mitch. The President directed the Village attorney to prepare a proposed ordinance regarding various public license4 and particularly liquor licenses, to be submitted to the Board. Trustee Frank suggested that an ordinance be enacted requiring a contractor to post a $1,000.00 bond protecting the Village against damage to sidewalks, paving, etc. A discussion was had on abandoned automobiles in the Village. A discussion was had on Dutch Elm Disease in the Village, and the fact that one tree has the disease. The Village attorney was directed to write a letter to the property owner, Warren Malletee, advising him that the tree is a public nuisance and must be removed. Trustee McGahan moved that the meeting adjourn to Monday, August 8, 1960, at 8:30 P.M. 182 Buffalo Grove Road. Trustee Dorner seconded the motion and it was unanimously carried. Village Clerk
