1962-06-07 - Village Board Regular Meeting - Minutes LINUTES OF A REGULAR MEETING OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK COUNTY, TLLTNOIS, HELD THURSDAY, JUNE 7 TH, 1962, IN THE LOUISA MAY ALCOTT PUBLIC SCHOOL IN BUFFALO GROVE, Tt.LTNOIS. The President called the meeting to order at approximately 8:00 P.M. The roll vas called and the following were found present: President Farrington; Trustees Frank, Gillen, Weiskopf, Marsh Absent: Trustees Bochniak, Huxhold Trustee Marsh moved that the minutes of the previous regular Board meeting held on May 17, 1962 be approved. Trustee Weiskopf seconded the motion. Trustee Gillen requested that the minutes be amended to read that Trustee Gillen inquired about the erection of a closed porch on a home on Hiawatha Avenue, and the Building Commissioner informed him that he had not yet checked on the 25 ft. front lot line for this home, and he was going to check and report at the next Board meeting on whether or not this porch encroached on the lot line. (5th page-15th par.) Trustee Marsh amended his motion to include Trustee Gillen' s correction. Trustee Weiskopf seconded. On roll call the vote was as follows: AYES: Trustees Gillen, Weiskopf, Marsh . L... NAYS: None ABSTAIN: Trustee Frank The Police Magistrate gave his report, as follows: court activities for March: cases continued from February, 121 cases for March, 11; convictions 11; dismissals, 6; continued to April, 6; total turned over to Village Clerk, $78.00. Court activities for April: cases continued from March, 6; cases for April, 33; convictions, 33; dismissals 4; continued to May 2; total turned over to Village Clerk, $238.00. Court activities for May: cases continued from April, 2; cases for May, 19; convictions 15; dismissals 2; continued to June, 6i total turned over to the Vifinge Clerk $182.00. The Police Magistrate stated that Tony Sansone has been his court clerk for over a year, and that from now on he may give the Police Magistrate's report to the Board. The Treasurer read his report for the month of May, 1962, showing cash in bank of $14,558.34 and motor fuel tax allotment of $11,822.34. Trustee Huxhold arrived for the meeting. Trustee Weiskopf read Warrant #52. Trustee Gillen moved that Warrant #52 in the amount of $1628.55 be approved. Trustee Weiskopf seconded the motion. On L._ roll call the vote was as follows: AYES: Trustees Frank, Huxhold, Gillen, Aeiskopf, Marsh NAYS: None The Police activities report for the month of May was read. There was no report from the Fire and Rescue Squad, however, it was stated L that the engine of the ambulance is being rebored by the men; that they are doing all the work on the engine; and that they hope to have it finished by this weekend. Civil Defense Director Hupfel read the long range plan for Civil Defense. He also stated that all Civil Defense equipment must be kept under lock and key and that he needs a place to store this equipment. Trustee Bochniak arrived for the meeting. Park Commission Chairman Stoltenberg reported that the back stop is completed; the field is about 90% complete and that men' s softball will start Monday. The Basketball and volley ball backstop are not completed. Public Relations Committee - no report. A discussion followed on the dedication of the park. A misunderstanding has arisen between Public Relations Committee and the Board as to whether or not Public Relations is to work with the Park Commission on the dedication. Trustee Gillen stated that Public Relations will be glad to assist in getting the dedication well published, but will not perform any other service in connection with the dedication. The President suggested that the Chairman of the Park Commission work with the Recreation Association and any interested member of Board so that this can be accomplished this summer. The Chairman of the Finance Committee read his report. The Chairman of the Plan Commission read his report. There was a discussion on the housing of commercial vehicles. Trustee Frank was called upon and gave his report on the spraying of DDT by the Northwest Mosquito Abatement District. The report was rather lengthy and he read from numerous articles on the harmful effects of spraying DDT, stating that it is harmful not only to birds and trees but to humans as well, and that its effect on the mosquito is questionable. He recommended that the Northwest Mosquito Abatement District discontinue spraying the Village and substitute other methods for mosquito abatement. On an informal roll call it was the majority decision of the Board that such a resolution be adopted, and the attorney was requested to draft one. It was stated that the builders have agreed to distribute the Safety Committee Report to new residents at the time of occupancy. Trustee Marsh stated that he has received a settlement from one of the two insurance companies involved in the accident to the ambulance and that he will make another attempte to collect from the second insurance company. Trustee Marsh stated he has nothing further at the moment on Mr. Garbacz. Mr. Hooper, Village Engineer, gave a report on the hearing for rezoning certain property for use as a sanitary land fill and garbage disposal incinerator, which property is within the 1-1/2 mile radius of the Village limits. Following discussion, the President read a Resolution (No. R-62-8) which sets forth the Village's objections to the rezoning of this property. Trustee +eiskopf moved that Re solution R-62-8 be adopted. Trustee Marsh seconded the motion. On roll call the vote was as follows: AYES: Trustees Frank, Bochniak, Huxhold, Gillen, Weiskopf, Marsh NAYS: None The President read proposed Ordinance No. 0-62-12, being a Nuisance Ordinance. Trustee Weiskopf moved that Ordinance No. 0-62-12, being a Nuisance Ordinance, be passed as read. Trustee Bochniak seconded the motion. Following discussion, Trustee Frank moved that the motion be tabled and that the Nuisance Ordinance be referred to the Safety Committee for their report. There was no second to the motion. The roll was called and the vote was as follows: AYES: Trustees Bochniak, Huxhold, Gillen, Aeiskopf, Marsh NAYS: Trustee Frank The President read a Resolution (No. R-62-9) directing the Northwest Mosquito Abatement District to stop spraying the Village and to use other methods for mosquito abatement. Trustee Bochniak moved that Resolution No. R-62-9 be adopted as read. Trustee Marsh seconded the motion. On roll call the vote was as follows: ti..r AYES: Trustees Frank, Bochniak, Huxhold, Gillen, Weiskopf, Marsh NAYS: None The Village Attorneystated that the Petition to Deannex from the Rural Park District is now being put together. The President read a proposed Agreement for Easement between the Village and the Buffalo Utility Company. He stated no action would be taken on this Agreement and the proposed Ordinance until the Buffalo Utility Company has indicated its acceptance of the Agreement. The President stated that the final pigt or® e7 was presented to the Village Attorney and the Village Engineer tw�o77 ago r review, and he asked for a report. Mr. Raysa spoke at length on the easements to the Buffalo Utility Company as shown on the plat and stated his objections. Trustee Huxhold moved that the plat be referred to the Plan Commission. Trustee Bochniak seconded the motion. Discussion followed. Trustee Bochniak stated that he agrees with Mr. Raysa's objections and that the easements should be worded so as not to jeopardize the Village's position on ownership of the lines. He also spoke about the 6=' new Illinois law that land set aside for public use must be acquired within one year by the Village and stated he would like to see this time extended. Trustee Bochniak asked if this final plat had been referred to the Plan Commission and if it conforms to the corrections made on the preliminary plan. It was stated that the final plat had not been submitted to the Plan Commission and that now the 31 day time limit under the Ordinance is up and some action must be taken by the Board. Trustee Marsh stated he is in accord with Trustee Bochniak and would prefer to see the final plat disapproved until such agreement can be worked out that is acceptable to the Village counsel and the Plan Commission. Trustee Frank stated that the final plat was presented five weeks ago and should have been referred to the Plan Commission for dis- cussion at its regular meeting. Trustee Marsh moved that the motion before the Board be tabled. Trustee Gillen seconded the motion. On roll call the vote was as follows: AYES: Trustees Frank, Bochniak, Gillen, ,7eiskopf, Marsh NAYS: Trustee Huxhold Trustee Marsh moved that the final plat as submitted to the Village Board at this time be disapproved. Trustee Gillen seconded the motion. A discussion was had on giving reasons for disapproving the plat. Trustee Marsh amended his motion to read that the Board disapprove at the present time the final plat as submitted because of the absence of easements necessary for the sanitary and storm sewer systems and the question of the legality of the grant of the easement of Buffalo Utility Company as it exists on the plat as submitted. Trustee Gillen seconded the amended motion. The Village Engineer was asked for a clarification of this motion and stated that easements for storm drainage were left out between lots 3 8-39 and 29-30 and easements for sanitary sewers were left out between lots 39-40 and 28-29. The roll was called and the vote was as follows: AygS: Trustees Bochniak, Huxhold, Gillen, Weiskopf, Marsh NAYS: Trustee Frank A discussion was had on the parking of commercial vehicles in driveways. The Village Attorney was asked to review the proposed street and sidewalk ordinance. A discussion was had on amending the Zoning Ordinance restricting the parking of vehicles of a certain tonage. Trustee Gillen asked if there was any report on the erection of the enclosed porch on the home on Hiawatha. The President stated that he believes the owners are going to the Zoning Board of Appeals and that an automatic citation has been issued which will be suspended pending the outcome. The President read the report of the Zoning Board of Appeals recommending that the variation requested by err. Joseph Sansoni in the location of an accessory building be denied. A discussion was had on the facts in this matter. Questions were asked of fir. and Mrs. Joseph Sansone, present at the meeting. Trustee Marsh moved that the recommendation of the Zoning Board of Appeals be accepted. Trustee Gillen seconded the motion. On roll call the vote was as follows: AYES: Trustees Bochniak, Huxhold, Gillen, n rsh NAYS: Trustee Weiskopf ABSTAIN: Trustee Frank At the request of the Zoning Board of Appeals, the President appointed Mr. Fred Porter to the Zoning Board of Appeals. Trustee Huxhold moved that the appointment be approved. Trustee Weiskopf seconded the motion. On roll call the vote was as follows: AYES: Trustees Frank, Bochniak, Huxhold, Gillen, tfeiskopf, Marsh NAYS: None The President read the resignation of William L. Breson as Chief of the Buffalo Grove Fire Department. Trustee Gillen moved that the resignation be accepted. Trustee Bochniak seconded the motion. On roll call the vote was as follows: AYES: Trustees Frank, Bochniak, Huxhold, Gillen, Weiskopf, Marsh NAYS: None Trustee Marsh moved that the Board extend to Mr. Breson its vote of thanks for the fine job in organizing and creating the Buffalo Grove Fire Department and Rescue Squad, and that a copy of this motion be forwarded to Mr. Breson. Trustee Frank seconded the motion. On roll call the vote was as follows: AYES: Trustees Frank, Bochniak, Huxhold, Gillen, Weiskopf, ?Marsh NAYS: None The President appointed Peter Cangelosi as a member of the Regular Deserve Police. Trustee Huxhold moved that the appointment be approved. Trustee Weiskopf seconded the motion. Trustee Frank moved that the motion be amended to include the phrase that Peter Cangelosi be put on the force and be considered the lowest ranking permanent reserve officer, and that his prior service be not counted toward his seniority or longevity. Trustee Bochniak seconded the motion. On roll call the vote was as follows: AYES: Trustees Frank, Bochniak, Huxhold, Gillen, Weiskopf, Marsh NAYS: None The roll was called on the motion as amended and the vote was as follows: AYES: Trustees Frank, Bochniak, Huxhold, Gillen, W'deiskopf, Marsh NAYS: None 167 The President made the following reappointments to the Plan Commission: Eugene J. Racette, Chairman for a period of 1 year to terminate 5-31-63 ti... Charles V. Gramer, Vice-Chairman for a period of 1 year to terminate 5-31-63 George Krug, member, for a period of 1 year to terminate June 14, 1963 Alex Stasel, member, for a period of 1 year to terminate June 14, 1963 Trustee Huxhold moved that the appointments be approved. Trustee Weiskopf seconded the motion. On roll call the vote was as follows: AYES: Trustees Frank, Bochniak, Huxhold, Gillen, Weiskopf, Marsh NAYS: None Trustee Gillen moved that the Board authorize an additional expenditure up to $100.00 for the repair of the engine on the ambulance. Trustee Huxhold seconded the motion. On roll call the vote was as follows: AYES: Trustees Bochniak, Huxhold, Gillen, 'reiskopf, Marsh NAyS: Trustee Frank Trustee Huxhold stated there is a hole in the street in front of 291 Raupp. He suggested the handyman be directed to check on this hole, fill it, and if it keeps settling to keep filling it. Trustee Weiskopf read a bank resolution to put the President's signature on the bank account. Trustee Weiskopf moved that the bank Resolution (No. R-62-10) �..� be adopted. Trustee Marsh seconded the motion. On roll call the vote was as follows: AYES: Trustees Frank, Bochniak, Huxhold, Gillen, Weiskopf, Marsh NAys: None On the recommendation of the Public Safety Committee, the President appointed Paul Soucy as Chief of the volunteer Buffalo Grove Fire Department. Trustee Bochniak moved that the appointment be approved. Trustee Gillen seconded the motion. On roll call the vote was as follows: AYES: Trustees Frank, Bochniak, Huxhold, Gillen, Weiskopf, Marsh NAYS: None Trustee Huxhold moved that the meeting adjourn. Trustee Marsh seconded the motion and it was unanimously carried. Village Clerk boot
