1965-10-11 - Village Board Regular Meeting - Minutes MINUTES OF AN ADJOURNED MEETING OF THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COUNTIES OF COOK AND
LAKE, ILLINOIS, HELD MONDAY, OCTOBER 11, 1965, AT THE MUNICIPAL
SERVICE CENTER, 150 N. RAUPP BLVD., BUFFALO GROVE, ILL INOIS .
In the absence of the President, Senior Trustee Eugene Huxhold
called the meeting to order at approximately 8 :20 P.M. The
Clerk called the roll and the following were found present :
Trustees Huxhold, Marsh, Wilhelm, Lewis, Palmer
ABSENT: President Farrington (arrived 8:40 P.M.)
Trustee Weiskopf (arrived 9:00 P.M.)
Trustee Marsh moved we dispense with formalities. Trustee Wilhelm
seconded the motion and it was unanimously carried.
Trustee Huxhold then stated the purpose of the adjourned meeting
was to try to resolve a solution to the recommendation of the
Zoning Board of Appeals to grant a variation to which certain of
the neighbors objected. Discussion following was related to
the dimensions of the house and lot and how much encroachment
there would be.
People present at the meeting were Mr . J. L. Davero, the petitioner,
Mr. King, purchaser of the home from the petitioner, and Mr.
Kenneth Lewis, neighbor objecting and Mr. Collins, purchaser of
Mr. Lewis's home.
Mr. Collins stated he was not aware of the exact encroachment
therefore could not give an opinion as to whether this would
influence his decision to purchase Mr. Lewi's home. Mr. Lewis felt
that the sale of hishome would be affected and also stated that it
is his understanding that the intent of the zoning is to keep
houses a certain number of feet apart and he did not feel there
was a hardship involved which would require the encroachment.
President Farrington arrived and was present for the meeting.
A recess was called to allow time for Mr. Lewis to secure his plat
of survey and for Mr . Lindholm, another neighbor to arrive since
Mr. Lewis stated Mr. Lindholm may also have an objection. Mr.
Davero stated he had spoken to Mr. Lindholm and he had no objections.
Meeting was reconvened at 9 :00. Trustee Weiskopf arrived and was
present for the meeting.
Mr. Lindholm arrived at this time and was asked to voice his
opinion. Mr. Lindholm stated he was unaware of what was happening
until the evening before when Mr. Lewis asked him what his feelings
were. He stated he then inquired of the village Clerk what the
situation was. He also stated he has no particular objection as
long as the encorachment is divided evenly between the lots and
not all on his side.
Following reading passages from the Ordinance and much further
discussion, Trustee Wilhelm moved the variation be granted with
an encroachment of four feet permitted, space to be divided equally
between the two lots. Trustee Huxhold seconded the motion.
Discussion followed. It was pointed out that this would require
the petitioner to shorten the proposed house by one foot. Trustee
Wilhelm felt this was not unreasonable in view of the objections
of the neighbor. The Clerk called the roll and the vote was as
follows:
AYES : Trustees Weiskopf, Wilhelm
NAYS : Trustees Huxhold, Marsh, Lewis, Palmer
Trustee Marsh moved the variance be denied. Trustee Wilhelm
seconded the motion. on roll call the vote was as follows :
AYES : Trustees Marsh, Wilhelm
NAYS : Trustees Huxhold, Weiskopf, Lewis, Palmer
Trustee Huxhold moved we accept the Zoning Board of Appeals
recommendation. Trustee Lewis seconded the motion. Discussion
followed with Trustee Marsh pointing out that the recommendation
was not in conformance with the Zoning Ordinance and therefore
the granting of the variance would be illegal. The Clerk called
the roll and the vote was as follows:
AYES : Trustees Huxhold, Lewis, Palmer
NAYS : Trustees Weiskopf, Marsh, Wilhelm, President Farrington
President Farrington qualified his Nay vote by stating that in
view of the fact that there is some question as to the conformance
with the Ordinance and if litigation evolved, he would "hate to
be crucified by our own ordinance" and stated he hoped someone
would make a motion which would conform to the Ordinance.
Trustee Weiskopf moved the variation begranted to allow building
of a house that does not come closer than 6 feet to either side
yard. Trustee Wilhelm seconded the motion. on roll call the
vote was as follows:
AYES : Trustees Wiekopf, Marsh, Wilhelm
NAYS : Trustees Huxhold, Lewis, Palmer, President Farrington
Trustee Weiskopf pointed out that this would be in conformance
with the remainder of the Village regarding side yard requirements.
The purchaser of the home from the petitioner stated he would not
be satisfied with one foot less house. Trustee Palmer moved that
we accept the recommendation of the Zoning Board of Appeals. Trustee
Huxhold seconded the motion. The wisdom of making a motion that
had just been defeated was brought out and Trustee Palmer withdrew
his motion and Trustee Huxhold his second.
Following further discussion, Trustee Palmer moved that a 59' house
be allowed on the property in question with a 52 foot side yard
on either side of the house. Trustee Huxhold seconded the motion.
On roll call the vote was as follows :
AYES : Trustees Huxhold, Weiskopf, Wilhelm, Lewis, Palmer
NAYS : Trustee Marsh
The motion was declared carried by the Clerk.
Trustee Marsh moved the meeting be adjourned and Trustee Weiskopf
seconded the motion. The motion was unanimously carried.
