1966-02-24 - Village Board Regular Meeting - Minutes MINUTES OF AN ADJOURNED MEETING OF THE PRESIDENT AND BORD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COUNTIES OF COOK
AND LAKE, ILLINOIS, HELD THURSDAY, FEBRUARY 24, 1966, AT THE
MUNICIPAL SERVICE CENTER, 150 N. RAUPP BLVD. , BUFFALO GROVE,
ILLINOIS.
The meeting was called to order at approximately 9:25 P.M.
The Clerk called the roll and the following were found
present:
President Farrington; Trustees Huxhold, Weiskopf, Marsh,
Wilhelm, Lewis, Palmer
The Village Attorney and Village Engineer were also in
attendance.
Trustee Marsh moved we dispense with formalities, seconded
by Trustee Huxhold and unanimously carried.
Trustee Weiskopf stated he 'understood the purpose of the meeting -
zoning Ordinance discussion. Thereupon Trustee Huxhold moved
Ordinance 0-66-4 be adopted. Trustee Wilhelm seconded.
Discussion followed.
Trustee Marsh then stated that the Attorney' s opinion regarding
the proposed Ordinance was enlightening but in his opinion,
provides sufficient doubt to reject the passage of the Ordinance.
He quoted several paragraphs of the Attorney' s letter (Doc. #66-01)
and stated that from a legal standpoint he could not vote
for passage since there is no enabling legislation in the
State and no other city or village has such an ordinance and
he feels Buffalo Grove is not in a position to become a test
case.
President Farrington then presented illustrations which
explained the idea of cluster planning. He stated the
prime question in everyone' s mind is what to do with the
open spaces and how to guarantee that they will remain open.
Trustee Weiskopf then stated that from a Planning standpoint
he felt the Ordinance was a good one, but he, too felt that
the Village is not in a position to defend it legally.
Trustee Huxhold felt that since there is not any enabling
legislation now, perhaps our Representatives should be asked
to propose such legislation in the State legislature.

Village Engineer, John Hooper, then stated that the probability
of having to defend the Ordinance is remote. The entire
Glen Grove approach was on this basis with this type of
planning in mind.
Mr. Albert Fran , a member of the audience, was then asked
his opinion on the Ordinance. He stated he is Vice-President
of the Home Builders Association, a Director of the Home
Builders Association of Illinois, Home Builders Association
of Chicago and the National Association of Home Builders and
each of these has been studying the concept of cluster
planning on a Nation-wide basis and have expended much money
to this purpose. He stated that they are trying to convince
Village Boards to adopt Ordinances allowing such zoning and
planning. He stated they have literature available for study
and if requested, their representative will attend a meeting
and show a movie and make a presentation regarding the type
of cluster planning being discussed. He stated if there is
good control it can work but if there is poor control it will
bring trouble. He stated from a planning point-of-view, it
is what all modern planners are recommending. He stated
he would be happy to gather what information he can and
give it to the Board for their perusal and if they so desire,
he would try to arrange for the presentation by the representa-
tive.
Trustee Marsh moved the motion adopting be tabled. Trustee
Weiskopf seconded the motion. On roll call the vote was
as follows:
AYES : Trustees Huxhold, Weiskopf, Marsh, Lewis, Palmer
NAYS: Trustee Wilhelm
Trustee Weiskopf stated that if the Board is in concurrence
with the type of zoning, namely, cluster planning, he cannot
see the purpose of getting a movie which will discuss that
I'I subject. He stated he would like more information regarding
the legal aspects .
Trustee Palmer then stated that tabling the motion and waiting
for information will mean a delay in either accepting or rejecting
the Ordinance and there is still a need for copies of the
present zoning ordinance. A member of the Plan Commission
stated that some of the members do not have copies and many
of the copies are well worn.
Thereupon Trustee Palmer moved that the Board authorize
reproduction of 50 copies of the Zoning Ordinance at a
cost not to exceed $500.00. Trustee Wilhelm seconded
the motion and on roll call the vote was as follows:
AYES : Trustees Weiskopf, Marsh, Wilhelm, Palmer
NAYS: Trustees Huxhold, Lewis
Trustee Weiskopf then stated he had two bills that were
apparently insurance claims and questioned whether Trustee
Marsh would check into the reason for the delayed payment.
Trustee Marsh stated he was going to the insurance company
office the next day and stated that the bill from George
Poole had been straightened out.
There being no further business and no questions from
the audience, Trustee Wilhelm moved themeeting be adjourned.
Trustee Huxhold seconded the motion and it was unanimously
carried.
