1966-01-20 - Village Board Regular Meeting - Minutes 830 MINUTES OF A REGULAR MEETING OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COUNTIES OF COOK AND LAKE, ILLINOIS, HELD THURSDAY, JANUARY 20, 1966, AT THE MUNICIPAL SERVICE CENTER, 150 N. RAUPP BLVD. , BUFFALO GROVE, ILLINOIS. U The meeting was called to order at approximately $:20 P.M. All present stood and recited the Pledge of Allegiance to the Flag. The Clerk called the roll and the following were found present: President Farrington; Trustees Weiskopf, Marsh, Wilhelm, Lewis, Palmer ABSENT: Trustee Huxhold Village Attorney Richard Raysa was present and Village Engineer John Hooper was absent. It was moved by Trustee Marsh and seconded by Trustee Palmer that the minutes of the meeting of January 6, 1966 be approved as submitted. The motion was unanimously carried. President Farrington asked that Public Improvement Committee check the condition of Checker Road and remind the snow plowers to plow that road also. Mr. Norb Schmaus of the Amvets was then recognized. He presented a Flag to the Park Commissioner, Jeremy Brown, stating that the flag has been flown over the Capitol building, along with a certificate from Senator Paul Douglas so stating. President Farrington thanked Mr. Schmaus and asked that he extend thanks to everyone connected with it. There were no Committee report. Fire and Health Committee Chairman was absent and Police and Traffic did not have a quorum at their meeting because of illness . OLD BUSINESS A letter from the Attorney (Doc. #66-01) was then read stating his opinion of the Zoning Ordinance. Trustee Marsh requested that each member of the Board be furnished with a copy. Following the reading, Mr. Raysa stated that the problem, if someone wants to test it when the attempt is made to develop cluster zoning, rid 831 becomes a question of what to do with the open space area. Is the Village to maintain it, can the Village maintain it, and who holds title to it? Trustee Weiskopf then moved that the Street and Sidewalk Ordinance be untabled. Trustee Wilhelm seconded the motion and it was unanimously carried. The Street and Sidewalk Ordinance was then discussed at length. Various questions were asked and Trustee Marsh moved that Section 18 referring to maintenance of sidewalks by homeowners be deleted. Trustee Palmer seconded the motion. On roll call the vote was as follows: AYES : Trustees Marsh, Palmer NAYS: Trustees Weiskopf, Wilhelm, Lewis Thereupon Trustee Marsh moved the Ordinance be tabled. There was no second to the motion. The following fees were decided upon and added to the Ordinance. There will be a $15 .00 fee for driveway permits other than residential, said residential fees to be $5 .00. In the section referring to snow removal, parking will be prohibited for 24 hours after a 2 inch snowfall. The word 'bond' on the first page was changed to ' certificate of insurance ' Thereupon Trustee Palmer moved that Ordinance 0-66-1 be approved as corrected. Trustee Weiskopf seconded the motion and it was unanimsouly carried. Copies are to be duplicated and kept on file in pamphlet form for publication. Business License Ordinance is still in Committee. Food and Food Establishment Ordinance is with the Attorney. Traffic Survey at St. Mary' s is not yet complete. 832 President Farrington then stated that Board members had met with the Village Board of Wheeling on Tuesday relating to storm water that will be picked up because of the annexation of Brown' s property. He stated the purpose of the meeting was to clarify whether Wheeling would allow Buffalo Grove to tap on to storm water sewers in the 2 areas where inlets will be discharging. He stated approximately 25 to 30 people attended the meeting complaining of the fact that they are being flooded now and with the connection there would be more flooding and most were very irate. Consequently, nothing was accomplished and the result of the meeting was that the Village Engineers of both Villages and the Engineer for the developer would meet and review the entire water shed to see if they can come up with something mutually satis- factory. President Farrington stated he suspects that there will be problems in reaching an agreement but Wheeling does have drainage problems that must be corrected. President Farrington then stated that John Hooper is meeting with the County of Tuesday in regard to Buffalo Grove Road. He should come back with a schedule as to starting time for the widening of the road. Mr. Raysa, Village Attorney, then stated that in reading recent statutes, there is now no limit as to the size of a Village before qualifying for Civil Service. However, if a Village wants to come under Civil Service a petition signed by 1/8th of the registered voters must go to the County for a referendum vote. Also, with respect to Special Assessment Cases, Mr. Raysa stated there is a case law on the fact that if the engineering is completed, it can be charged back to the property owner if he decidled to put in the improvement on his own. Mr. Raysa then stated he attended the hearing regarding Buffalo Utility Company' s request for apermit to extent water and sewer lines. He stated it was for the Brown Subdivision. He stated, however, that he went on record to say that the Village intended to put in water and sewer facilities and that Buffalo Utility has no franchise nor has ever had one. Mr. Raysa also stated he has a fair number of the papers prepared for the Bond issue and an Ordinance must be passed to start work on it. He stated, however, that the Board must officially accept and approve the plans and specifications and cost estimates . He also stated he must revamp the maturity dates on some of the paper 833 work since the issue will be approximately $250,000.00 slightly higher than he had originally anticipated. He stated the plans and specifications should also be on file in the Village Clerk' s office after their acceptance so that anyone can examine them. The Attorney was asked to estimate his portion of the fees so that a more accurate estimate of the cost can be made. President Farrington then stated that a meeting was held with the developer and the builder in Unit 7 near the new school. It has developed that a road will go in and it would not pay to put in the gravel walkway as originally thought since March 1st is given as an estimated date to start construction. Mr. Gill has been notified of this possibility. NEW BUSINESS President Farrington then read a letter from the Salvation Army stating they wish permission to hold their Annual Doughnut Day in the Village on June 10, 1966. Trustee Marsh moved the Salvation Army be granted permission to hold their annual doughnut day in the Village and the provisions outlined in the ordinance be waived. Trustee Wilhelm seconded the motion and it was unanimously carried. Upon the recommendation of the Police and Traffic Committee, President Farrington promoted Kenneth Roberts to the rank of Sergeant. Trustee Marsh moved the appointment and promotion be confirmed. Trustee Wilhelm seconded the motion and it was unanimously carried. Trustee Marsh asked that thought be given to having another census. It was pointed out that there is a statutory limitation regarding frequency of special census and perhaps later in the year, the population will increase sufficiently to warrant one. President Farrington also asked that the Finance Committee look into the possibility of franchising the garbage collection or perhaps awarding it on a bid basis since there will be an application from a third scanvenger service shortly. Cliff Burmeister a member of the audience was then recognized and asked whether further thought had been given to placing a sign at the entrance to Mohawk Court indicating that there is no outlet. The Police and Traffic Committee was directed to look into it. ffi,.5 834 There being no further business and no further questions from the audience, Trustee Wilhelm moved the meeting be adjourned to Wednesday, January 26th at 8:00 P.M. at the Municipal Service Center, Trustee Marsh seconded the motion and it was unanimously carried.
