1973-10-08 - Village Board Regular Meeting - Minutes 2882 10/8/73 MINUTES OF THE REGULAR MEETING OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, HELD MONDAY, OCTOBER 8 , 1973, AT THE MUNICIPAL BUILDING, 50 RAUPP BLVD. , BUFFALO GROVE, ILLINOIS. v President Armstrong called the meeting to order at approximately 8 :15 P.M. Those present stood and recited the Pledge of Allegiance to the Flag. The Clerk called the roll and found the following present: President Armstrong; Trustees Shirley , Rathjen, Mahoney, Rech, Driscoll. Trustee Osmon arrived at 8 :40 P.M. Also present was Daniel Larson, Village Manager. Richard Raysa, Village Attorney, arrived at approximately 9 :00 P.M. 1. Minutes of October 1, 1973 Trustee Rathjen moved the minutes of October 1, 1973 , be approved as submitted. Trustee Driscoll seconded the motion, and a roll call vote found the following: 1 AYES: Trustees Rathjen, Mahoney, Rech, Driscoll NAYES: None ABSTAIN: Trustee Shirley ABSENT: Trustee Osmon 2. Standing Committee Reports Environmental Control Committee Trustee Rech questioned the proposed use of the $2 ,500 contribu- tion of the Park District for the improvement of the White Pine Strip. After discussion, President Armstrong requested Mr. Larson to work with Mr. Crosland of the Buffalo Grove Park District to arrive at an agreeable solution. 3. Questions from the Audience Aspen Ditch Mr. John Molitor, 1141 Twisted Oak Lane, stated that the home- owners on the Aspen ditch north of Twisted Oak request the Village to take immediate action to force Levitt to comply with the terms of the agreement for the improvement of the ditch decided upon by the Village Engineer, Levitt representatives , and the homeowners. He also requested a resolution establishing the complete filling of the ditch as one of the highest priorities of Village improvements. 2883 10/8/73 President Armstrong requested Mr. Larson to contact Mr. Campbell of Levitt and Mr. Seaberg to arrive at a solution to the problem. Trustee Rech asked if Mr. Molitor was aware of the possibility of erecting a cyclone fence around the ditch. He responded that he did not know if he would favor a fence. One resident stated that his entire side yard is torn up because the bulldozer is used in the area. He requested that his yard be repaired before winter. Young Citizen' s Request Debbie Schmalzer, representing twenty young people in attendance, stated that the group congregate on the corner of St. Mary' s and Marylu each evening and that the Police ask them to not meet there. She requested that the Emmerich Park building be open so that they may have a place to get together. President Armstrong explained that the park building belongs to the Park District and suggested they contact them for permission. He also suggested they work with Mr. Robert Bogart and Mr. Norman Katz in their efforts to establish a Teen Center. He then scheduled an appointment for two representatives of the group to meet with Mr. Larson, Chief Walsh, and Officer Weidner on Tuesday, October 9 , 1973. Trustee Osmon arrived at this time. Sidewalk to Twin Grove School In response to a question from the audience, President Armstrong stated that the resident on Twisted Oak Lane whose home had the sidewalk easement on the north side and was going to move it to the south side has turned the matter over to his attorney because there is a question if there ever was an easement on his deed. Trustee Shirley stated that if the easement is not on the deed, Levitt misrepresented the matter to the Board. 4 . Committee of the Whole Swimming Pool/701 Silver Rock Lane Trustee Driscoll moved the item regarding the swimming pool and side yard set back at 701 Silver Rock Lane be removed from table. Trustee Osmon seconded the motion, and a voice vote found the following: AYES: Trustees Shirley, Osmon, Rathjen, Mahoney, Rech, Driscoll NAYES : None The motion carried. 2884 10/8/73 President Armstrong reported that the opinion of the Village `-� Attorney is that a permit is required for the pool and that the location must conform with Section 429. 4, which requires a six foot set back from any rear or side property line. Burton Harris reviewed the schedule of events which took place with regard to the construction of the pool. He requested permission to move the pool three feet from the side property line, which would be five feet from his neighbor' s fence. Inspector Gard reviewed his report of September 12 , 1973 . He stated that he had advised Mr. and Mrs. Harris of the require- ments of the Village, and placed a stop work order on the pro- ject until a permit was obtained. He stated that the pool was never moved to comply wi h the codes even though the ymer was advi do so. Mr. Seim stated that he had objected to the pool because the fence was not completed and that he himself finally closed the fence between his property and Mr. Harris ' . Trustee Osmon moved Mr. Harris ' request for a variance in the side yard set back of the Building Code be denied. Trustee Driscoll seconded the motion. In response to a question fromTnstee ahoney/ r. Bennett, Mr. Harris ' neighbor, stated that the Code should speak for itself and be enforced. In response to a question from Trustee Rech, Mr. Harris stated that the pool would not be taken down during the winter. A roll call vote found the following: AYES : Trustees Shirley, Osmon, Rathjen, Mahoney, Rech, Driscoll NAYES: None The motion carried. At Mr. Harris ' request, Trustee Osmon moved the Village allow the drained pool remain up until June 1 , 1974 . Trustee Driscoll seconded the motion, and a roll call vote found the following: AYES : Trustees Osmon, Mahoney, Driscoll, President Armstrong NAYES: Trustees Shirley, Rathjen, Rech The motion carried. 2885 10/8/73 Driveway Variation/786 Aspen Drive President Armstrong stated that at a public hearing it was the unanimous decision of a quorum of the Zoning Board of Appeals members that approval be granted for variation of the Zoning Ordinance for the purpose of a circular driveway at 786 Aspen Drive. Mr. Jerome Floss, 786 Aspen Drive, stated that because he is a small contractor, he has a small van, and because he lives near a school, backing his van out of his driveway presents a safety hazard. Mr. Dettmer stated that the public hearing was published in the Buffalo Grove Herald and notices were sent to nearby property owners , and that no objectors came forward. Trustee Shirley moved the Board abide by the recommendation of the Zoning Board of Appeals and approve the driveway variation request. Trustee Osmon seconded the motion, and a roll call vote found the following: 227, AYES: Trustees Rathjen, Mahoney, Rech, President Armstrong L_. C —YES : Trustees Shirley, Osmon, Driscoll The motion carried. St. Mary' s Church Easement Upon review, Trustee Osmon moved the Village accept the ease- ment from St. Mary' s Church on Buffalo Grove Road to the Village sanitary sewer lift station located on property owned by Al Frank and Associates. Trustee Shirley seconded the motion, and a voice vote found the following: AYES : Trustees Shirley, Osmon, Rathjen, Mahoney, Rech, Driscoll NAYES: None The motion carried. American Education Week At the request of Dr. Gilbert of High School District 214 , President Armstrong proclaimed October 21 - 27 , 1973 , as American Education Week. Trustee Mahoney moved the Board concur with the President' s proclamation. Trustee Osmon seconded the motion, and a voice vote found the following: AYES: Trustees Shirley, Osmon, Rathjen, Mahoney, Rech, Driscoll NAYES : None The motion carried. 2886 10/8/73 Refuse Pick Up Trustee Shirley reported that Buffalo Grove Disposal trucks are beginning their pick up as early as 5 :30 A.M. in some parts of the Village. President Armstrong stated that he would contact Mr. Raupp to request their work to begin at a ( more reasonable hour. Mill Creek Park Trustee Osmon reported that there has been a reinstitution of conversation between Miller Builders and the homeowners relative to additional park area.
