1982-04-05 - Village Board Regular Meeting - Minutes 6016 4/5/82 MINUTES OF THE REGULAR MEETING OF THE VILLAGE BOARD OF THE VILLAGE OF BUFFALO GROVE, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, VILLAGE, HALL, APRIL 5, 1982. President Clayton called the meeting to order at 7:33 P.M. CALL TO ORDER Those present stood and pledged allegiance to the Flag. Li Roll call indicated the following present: President Clayton ; ROLL CALL Trustees Marienthal , Stone, O' Reilly, Hartstein, Gerschefske, and .— __— Schwartz. Also present were: William Balling, Village Manager; William Raysa (arrived at 8:20 P.M.) , Village Attorney; James Doyle, Assistant Village Manager; William Brimm, Finance Director; Gregory Boysen, Director of Public Works; Raymond Rigsby, Super- intendent of Public Works; Ingrid Park, Staff Planner; Fire Chief Wayne Winter; Deputy Police Chief Arthur Voigt ; and Paul Kochendorfer, Village Treasurer. Moved by O' Reilly, seconded by Hartstein , to approve the minutes APPROVAL OF of the March 15, 1982 Regular Meeting. Upon roll call , Trustees MINUTES voted as follows : �R AYES: 6 - Marienthal , Stone, O' Reilly, Hartstein , Gerschefske, Schwartz NAYES : 0 - None Motion declared carried. Mr. Kochendorfer read Warrant #475. Moved by O' Reilly, seconded WARRANT #475 by Marienthal , to approve Warrant #475 in the amount of $535,415.22, - authorizing payment of bills listed. Upon roll call , Trustees voted as follows: AYES : 6 - Marienthal , Stone, O' Reilly, Hartstein , Gerschefske, Schwartz NAYES: 0 - None Motion declared carried. President Clayton noted the resignation of Lorraine Kirby from APPEARANCE the Appearance Commission. Mrs . Clayton read a Certificate of COMMISSION Appreciation to Mrs. Kirby and thanked her for her years of service to Buffalo Grove. President Clayton then appointed Kathleen Krippes to the Appearance Commission for a term to expire April 30, 1983. Moved by Schwartz, seconded by Hartstein , to concur with President Clayton 's appointment. Upon voice vote, the motion was unanimously declared carried. L/ President Clayton noted Certificates of Appreciation to be BDDC given to Carl Genrich, Howard Mendenhall , Thomas Mahoney, Carmelo Cea, Patrick Shields , and Gary Glover for their years of service as members of the former Business District Development Commission. 6017 4/5/82 Mr. Balling noted that the IEPA periodically evaluates municipal CERTIFICATE OF water systems, and has taken the opportunity to evaluate the COMMENDATION water system of Buffalo Grove. The results of this evaluation (Joseph Rowland) show that Buffalo Grove has one of the best water systems the IEPA has ever inspected. Mr. Joseph Rowland and the water section were particularly cited for an exemplary job of record keeping, and overall performance of the system. President Clayton asked Mr. Rowland, Mr. Boysen, and Mr. Rigsby to come forward as she read a Certificate of Commendation to Mr. Rowland for his valued service to the Village of Buffalo Grove. Mr. Rowland stated that George Dixon and Frank Tripicchio were also responsible for the excellent rating given to Buffalo Grove. President Clayton asked that the Board's appreciation also be expressed to those gentlemen , and again thanked Mr. Rowland for his service. President Clayton noted that the Village did receive notice TRAFFIC SIGNAL from IDOT that the traffic signal at Route 83 and Busch/Checker (Busch783/-- has been awarded to Aldrich Electric, and should be in operation Checker) by late summer. Mr. Balling explained the procedure to be used in delivering BOARD PACKETS Board packets to the President and Trustees. Mr. Balling noted that there will be a Workshop meeting scheduled FUTURE AGENDA for Monday, April 12, 1982. T 1' President Clayton explained the Consent Agenda, and stated that CONSENT AGENDA any member of the Board or the audience could request that an item be removed for full discussion. There were no such requests. Moved by O' Reilly, seconded by Stone, to approve Resolution RESOLUTION #82-16, a resolution establishing a policy regarding interest #82-16 earnings of funds on deposit in Village of Buffalo Grove's (Corporate Corporate Purpose Bond, Series 82 Bond and Interest Fund. In Purpose Bonds) conjunction with the 82-83 budget, the Village Board requested a resolution establishing a policy of reserving interest earnings for water fund purposes. Upon roll call , Trustees voted as follows : AYES: 6 - Marienthal , Stone, O' Reilly, Hartstein, Gerschefske, Schwartz NAYES: 0 - None Motion declared carried. Moved by O'Reilly, seconded by Stone, to pass Ordinance #82-13, ORDINANCE amending Chapter 10.04 Vehicle Licenses of the Buffalo Grove #82-13 Municipal Code. In conjunction with the 82-83 budget, the (Vehicle Board authorized increasing the license fee beyond the deadline Licenses) date for purchase. Upon roll call , Trustees voted as follows : AYES: 6 - Marienthal , Stone, O' Reilly, Hartstein, Gerschefske, Schwartz NAYES : 0 - None Motion declared carried. 6018 4/5/82 Moved by O'Reilly, seconded by Stone, to approve Resolution RESOLUTION #82-17, a resolution accepting the joint agreement for R.O.W. $2-17 --- acquisition (Buffalo Grove Road improvements - Lake/Cook to (R.O.W.) IL 83) . This resolution permits IDOT and FAU funds to be utilized for R.O.W. acquisition in connection with the Lake County Buffalo Grove Road construction program. Upon roll call , Trustees voted as follows: AYES: 6 - Marienthal , Stone, O'Reilly, Hartstein, Gerschefske, Schwartz NAYES: 0 - None Motion declared carried. Moved by O'Reilly, seconded by Stone, to pass Ordinance #82-14, ORDINANCE an ordinance amending 2.28 of the Buffalo Grove Municipal Code #82-14 (Fire & Police Commission) . This ordinance clarifies the TFire & Police probationary period for original appointees to the police and Commission) fire departments. Upon roll call , Trustees voted as follows: AYES: 6 - Marienthal , Stone, O' Reilly, Hartstein , Gerschefske, Schwartz NAYES: 0 - None Motion declared carried. Moved by O'Reilly, seconded by Stone, to pass Ordinance #82-15, ORDINANCE an ordinance authorizing the sale by Public Auction of personal #$2-1S property owned by the Village of Buffalo Grove (vehicles and (Sale by equipment) . This ordinance permits the Village of Buffalo Grove Public Auction) to participate in the NWMC vehicle and equipment auction on 5/8/82. Upon roll call , Trustees voted as follows: AYES: 6 - Marienthal , Stone, O' Reilly, Hartstein , Gerschefske, Schwartz NAYES: 0 - None Motion declared carried. Moved by O' Reilly, seconded by Stone, to award the contract for AWARD OF FY82-83 mosquito abatement program to Clarke Outdoor Spraying. CONTRACT Staff recommends an annual contract for mosquito abatement be TMosquito again awarded to Clarke Outdoor Spraying in the amount of Abatement) $16,486.67. This amount represents the same cost to Buffalo Grove as paid last year. Moved by O'Reilly, seconded by Stone, to accept the Appearance 1ST FEDERAL Commission recommendation for 1st Federal of Chicago (revised OF CHICAGO elevation and landscaping) . President Clayton read a Proclamation designating May 2, 1982 WALK WITH to be WALK WITi1 ISRAEL DAY in the Village of Buffalo Grove. ISRAEL PROCLAMATION President Clayton read a Proclamation designating April 22, GIRL SCOUT 1982 as GIRL SCOUT LEADER'S DAY in Buffalo Grove. LEADER'S_ PROCLAMATION President Clayton read Resolution #82-18, establishing Fabish RESOLUTION Drive in Buffalo Grove in recognition of past Village President #f2-1$ Edward A. Fabish. Mr. Fabish was present, and Mrs. Clayton ' abish Drive) told him that he would receive the original copy of the Resolution, as well as a map showing the street location. Moved by Gerschefske, seconded by Marienthal , to pass Resolution #82-18. Upon voice vote, the motion was unanimously declared carried. Moved by Gerschefske, seconded by Stone, to pass Resolution RESOLUTION #82-19, adopting the Fiscal 1982-83 Program Budget for the /182-19 Village of Buffalo Grove. Upon roll call , Trustees voted as M 2-83 Program follows : Budget) AYES : 6 - Marienthal , Stone, O' Reilly, Hartstein, Gerschefske, Schwartz NAYES: 0 - None Motion declared carried. L 6020 4/5/82 Trustee Hartstein noted pending House Bill 160 which would, HOUSE BILL 160 in effect, deprive any Home Rule or non-Home Rule community from passing any type of legislation that they saw fit, in their own community, relating to handguns. Trustee Hartstein stated that the rights of communities should be protected in the future to legislate what they feel are appropriate measures for dealing with public welfare on the local level . Mr . Hartstein urged the passage of a resolution urging the strong rejection of HB160. President Clayton stated that the Northwest Municipal Conference has gone on record opposing this bill . Trustee Stone stated that he, also, did not wish to see any Home Rule powers taken away. Trustee O' Reilly heartily concurred with the passage of a resolution opposing the bill . Trustee Schwartz echoes Trustee Hartstein 's sentiments. Moved by Hartstein, seconded by Schwartz, that the Village of Buffalo Grove Village Board urges the General Assembly to reject House Bill 160, and if such bill is adopted, would urge the Governor to veto any such legislation. Upon roll call , Trustees voted as follows: AYES: 6 - Marienthal , Stone, O' Reilly, Hartstein, Gerschefske, Schwartz NAYES : 0 - None Motion declared carried. Trustee Hartstein explained the concern raised that bus traffic BUS TRAFFIC ON is creating an undue burden on local streets. After discussion LOCAL STREETS by the Transportation Commission and staff, a recommendation was made that all new bus service be concentrated on arterial streets , but that the current routes remain the same. Trustee O'Reilly stated that she disagrees with the recommendation, and she would like to eliminate all non-rush hour routes from the interior streets. Mr. Glenn Ahrenholz, Chairman of the Trans- portation Commission, stated that there are school students that use the bus during the non-rush hours. He also reviewed the discussions which have taken place at the Transportation Commission. Trustee Marienthal stated that his thoughts were basically the same as Trustee O' Reilly's; he also discussed the possibility of smaller buses or a Dial-A-Ride type service. Mr. Marienthal cited some points in Ingrid Park's memo to Mr. Balling of March 18, 1982. Mrs. Park stated that studies show that people generally do not walk further than 1/4 of a mile to reach public transportation. Discussion on the bus routes followed. Moved by Hartstein, seconded by Schwartz, that the Village of Buffalo Grove urge Nortran , in consideration of future routes, to review and take into consideration the policies specified in Paragraph 1 of the March 18, 1982 memo. Trustee Hartstein then amended the motion to be directed to both Nortran and the Village 6021 4/5/82 of Buffalo Grove Transportation Commission. Trustee Schwartz seconded the amendment. Upon roll call , Trustees voted as follows: AYES: 6 - Marienthal , Stone, O'Reilly, Hartstein, Gerschefske, Schwartz NAYES: 0 - None Motion declared carried. Mr. Ahrenholz stated that the Transportation Commission will pursue the use of lighter buses with Nortran. Trustee Stone reviewed the Police Service to the Village of POLICE SERVICE Long Grove. Mr. Raysa arrived at this time. There was TO THE T[LAGE discussion regarding a possible resolution regarding Buffalo OF LONG GROVE Grove's response to Long Grove police calls. Deputy Chief Voigt stated that Police Department policy now is that an officer will respond to a call from the Lake County Sheriff's Department for Long Grove only when it appears to be a life-threatening situation. Both Mr. Raysa and Deputy Chief Voigt preferred that this be a policy decision , and not put in the form of a resolution. Trustee Stone did ask that the Board be apprised of any responses made by the Police Department in Long Grove in the future. It was pointed out that Vernon Hills answers calls in the northern part of Long Grove. Deputy Chief Voigt clarified the fact that the Buffalo Grove Police Department does not use radar in Long Grove; if a traffic stop is made in Long Grove, it is in pursuit of a violation committed in Buffalo Grove. Mr. Balling pointed out that Buffalo Grove has every right to enter Long Grove in any law enforcement exercise that affects our community. Mr. Raysa noted that the Lake County Sheriff' s Department does bill Long Grove for services performed in that community. Mr. Raysa also stated that, if Long Grove does not choose to sign the agreement prepared by Buffalo Grove, he will send the agreement by Certified Mail , return receipt requested , insuring that Buffalo Grove has proof that Long Grove is aware of this agreement. Letters will be sent to Long Grove and the Lake County Sheriff's Department confirming that the Village of Buffalo Grove is not required to, expected to, or will be relied upon to furnish Police protection or respond to a request for Police assistance to the Village of Long Grove or its inhabitants. The Village Board will be kept apprised of happenings regarding this situation. Fire Chief Wayne Winter reviewed the Fire Department 's proposal SMOKE DETECTOR for getting smoke detectors installed in every residence in PROGRAM the Village, and the Department 's desire to sell the detectors at cost, and install them if there is a need. He also explained the procedure for a computer listing to remind residents to check the batteries in the smoke detectors periodically. Lengthy dis- cussion followed regarding possible liability to the Village if they were to follow the proposed procedures. Mr. Raysa then cited 6022 4/5/82 some examples of possible liability to the Village. There was also discussion of other safety information being dis- tributed to residents, such as the maintenance of fireplaces. The Smoke Detector Program will be investigated further, and a report will be made to the Board at a future date. President Clayton read a Proclamation designating the month PARAMEDIC of May as PARAMEDIC PACKET MONTH in the Village of Buffalo PACKET Grove, and commended the National Council of Jewish Women PROCLAMATION for their efforts in this program. Mr. Raysa commented on Resolution #82-17 regarding R.O.W. RESOLUTION #82-17 acquisition for Buffalo Grove Road improvements , stating that, if it becomes necessary, IDOT will do the condemnation for the R.O.W. , notwithstanding the contract. Moved by O' Reilly, seconded by Hartstein, to adjourn the ADJOURNMENT meeting. Upon voice vote, the motion was unanimously declared carried. The meeting was adjourned at 9:10 P.M.
