1991-10-21 - Village Board Regular Meeting - Minutes 8226 10/21/91 MINUTES OF THE REGULAR MEETING OF THE VILLAGE BOARD OF THE VILLAGE OF BUFFALO GROVE, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, VILLAGE HALL, OCTOBER 21, 1991 President Mathias called the meeting to order at 7:34 P.M. CALL TO ORDER Those present stood and pledged allegiance to the Flag. Roll call indicated the following present: President ROLL CALL Mathias; Trustees Marienthal, Reid, Kahn, Rubin, Braiman and Hendricks. Also present were: : William Balling, Village Manager; William Raysa, Village Attorney; Lee Szymborski, Assistant Village Manager; William Brimm, Finance Director; Phil Versten, Administrative Assistant; Gregory Boysen, Director of Public Works; and Robert Pfeil, Village Planner. Moved by Reid, seconded by Kahn, to approve the minutes of APPROVAL OF MINUTES the October 7, 1991 Regular Meeting. Upon roll call, Trustees voted as follows: AYES: 6 - Marienthal, Reid, Kahn, Rubin, Braiman, Hendricks NAYES: 0 - None Motion declared carried. Mr. Brimm read Warrant #704. Moved by Marienthal, WARRANT #704 seconded by Reid, to approve Warrant #704, in the amount of � authorizing payment$1 659 800.73 a ent of bills listed. Upon roll call, Trustees voted as follows: AYES: 6 - Marienthal, Reid, Kahn, Rubin, Braiman, Hendricks NAYES: 0 - None Motion declared carried. President Mathias asked those in the audience wishing to ROUTE 83 make any comments with regard to the Route 83 expansion or Busch Road to sign a list being passed around. President Mathias read a Proclamation declaring Thursday, PROCLAMATIONS October 31, 1991 as "Trick or Treat Day" in the Village of Buffalo Grove, and a Proclamation praising the efforts of all those involved with the Buffalo Grove Park District's "Broadway Comes to Buffalo Grove". Both of these Proclamations appear on the Consent Agenda. President Mathias asked Commander Del Re and Chief McCann COMMENDATION to come forward, at which time he read a commendation regarding Commander Del Re's appointment as Lake County Major Crimes Task Force Commander. 8227 10/21'91 President Mathias noted the "Together We Can" Program at "TOGETHER WE CAN" Stevenson High School to fight substance abuse, and asked anyone interested in working on this project to contact him or Stevenson High School. President Mathias stated that he will be serving on an ROUTE 22 advisory panel called Strategic Area Panel to advise IDOT regarding the expansion of Route 22; the first meeting was held last week and was very successful. Trustee Rubin commented on the Open House at the Active SENIOR CITIZENS Agers' Senior Citizen's Club, which is a joint venture between the Village and the Park District. President Mathias noted that a Senior Citizen's Committee will be appointed in the near future. Trustee Marienthal commented on the work to be done at the PARK SITE park site on Buffalo Grove Road north of Aptakisic, and asked that staff contact Lexington to be sure that the work is completed. Mr. Balling noted the submittal of the Management Report MANAGEMENT REPORT for September. Trustee Reid asked a question regarding the Strathmore Shopping Center, which was answered by Mr. Balling. Mr. Balling commented on the negotiations regarding J.U.L.I.E. J.U.L.I.E. , details of which are contained in Mr. Rigsby's memo to him of October 15, 1991. Mr. Balling commented on the sign change re-naming the MUNICIPAL CAMPUS municipal campus to the "Clayton Municipal Complex", and stated that the proposed sign will be brought before the Appearance Commission. President Mathias asked if there were any questions from QUESTIONS FROM THE the audience; there were none. AUDIENCE President Mathias explained the Consent Agenda, stating CONSENT AGENDA that any member of the audience or the Board could request that an item be removed for full discussion; there were no such requests. Moved by Kahn, seconded by Braiman, to pass Ordinance ORDINANCE #91-86 #91-86, Granting a Variance to Section 14.20.070 of the (Variance to Sign Buffalo Grove Sign Code as it relates to a Ground Sign for Code) Furs by Michael, 146-150 W. Dundee Road. Upon roll call, Trustees voted as follows: AYES: 6 - Marienthal, Reid, Kahn, Rubin, Braiman, Hendricks NAYES: 0 - None Motion declared carried. 8228 10/21/91 Moved by Kahn, seconded by Braiman, to concur with the PROCLAMATION Proclamation declaring Thursday, October 31, 1991 as Trick (Trick or Treat) or Treat Day in the Village between the hours of 3 p.m. and 7 p.m. and reminding parents of a Buffalo Grove Park District Halloween Party on Friday, October 25, 1991 from 4 p.m. to 8:15 p.m. Upon roll call, Trustees voted as follows: AYES: 6 - Marienthal, Reid, Kahn, Rubin, Braiman, Hendricks NAYES: 0 - None Motion declared carried. Moved by Rubin, seconded by Kahn, to pass Ordinance ORDINANCE #91-85 #91-85, authorizing the reduction of the Emergency 9-1-1 (9-1-1) surcharge. President Mathias read the proposed ordinance, and details of same are contained in Mr. Szymborski's memo L/ to Mr. Balling of October 7, 1991. Upon roll call, Trustees voted as follows: AYES: 6 - Marienthal, Reid, Kahn, Rubin, Braiman, Hendricks NAYES: 0 - None Motion declared carried. Trustee Braiman read a statement of comments and ROUTE 83 observations as to how the proposed improvements to Route 83 came about. Details of the proposed resolution are contained in Mr. Pfeil's memo to Mr. Balling of October 17, 1991. Moved by Braiman, seconded by Kahn, to pass Resolution #91-77, supporting the IL Hwy 83 (Buffalo Grove Road to Arlington Heights Road) Street Improvement with the following additions: 1. Improvement of IL Route 83 from Buffalo Grove Road to Arlington Heights Road is supported. 2. The State of Illinois is encouraged to implement improvement on the section between Buffalo Grove and Arlington Heights Road concurrently with the improvement of the segment of the road between Arlington Heights Road and Route 45, which is scheduled for construction in 1992-93. 3. The two triangular property acquisitions at the Devlin Road intersection with Illinois Route 83 should be eliminated. 4. All property acquisition from the single family lots along the northeasterly side of Illinois Route 83 between Busch Road and Devlin Road should be eliminated through the application of the following measures which are listed in order of priority for utilization: a. Eliminate roadside ditches and right-of-way acquisition which results from grading which the ditches require. b. Utilize concrete retaining walls, if applicable, to eliminate right-of-way acquisitions which are other- wise necessitated due to grading requirements. c. Move the sidewalk closer to the back of curb with a concrete barrier or guardrail installed where needed to provide proper pedestrian safety. 1 8230 10/21/91 d. Eliminate the dual right-turn from westbound Busch Road to northbound Illinois Route 83. e. Provide only a single lift-turn land for south bound traffic on Illinois Route 83 to turn eastbound onto Busch Road. 5. All property acquisition along the southwesterly side of IL Route 83 between Checker Drive and point 1,100 feet southeasterly shall be eliminated with the deletion of any proposed roadside ditches and the land acquisition which resultant grading would require. 6. In order to mitigate road related noise to the greatest degree possible, the following elements should be incorporated into the project: a. Provide median trees and parkway trees planted at 35-50' spacing. b. Provide 8' tall board-to-board fence along all single-family residential lots with any existing fences being removed on all single-family properties where such construction and the acceptance of subsequent ownership and maintenance is acceptable to the involved individual property owner or with the ownership and maintenance by the state. c. Perform a speed study promptly upon completion of the project in an effort to establish warrant for a 35 MPH speed limit. d. Construct the road surfaces in a manner using appropriate substances to reduce noise to the greatest extent possible. 7. The State of Illinois is urged to proceed quickly to implement other improvements, including adding lanes to Route 22 between existing four-lane section of Buffalo Grove Road, I-94, and adding lanes to Deerfield Road east of Milwaukee Avenue. Lee Carpenter, 126 Morningside Lane West, stated that the proposal is good news, and is very well done; he believes that the double left-turn lane from Route 83 onto Busch must be eliminated, and will probably take away a great deal of the complaints. In answer to a question from Mike Sarleto, 921 Checker Drive, staff noted that the traffic engineer does not expect an increase in traffic past Willow Grove School; he also stated that "shall" should be used in place of "should" wherever possible. Giselle Roberts, 1118 Brandywyn Court, stated that her property is at the corner of Route 83 and Busch Road, and explained how the improvement will affect her property; she asked the Board to stand behind the proposed resolution and protect the property owners. Elliot Katz, 1106 Sandhurst Court, stated that he believes 8231 10/21/91 making the road four lanes will merely encourage traffic, not reduce it; he does not agree with the premise that reducing traffic congestion enhances the quality of life. David Haft, 1137 Devonshire, commended the Board on their actions; he asked if the Village had any indication as to IDOT's reaction to this proposal. Mr. Balling answered Mr. Haft's question. President Mathias stated that he will be meeting with IDOT regarding this proposal, not just mailing the resolution to them. A resident of 1109 Devonshire stated that he is against providing four lanes on Route 83. Trustee Rubin stated that a copy of the resolution would be forwarded to state officials and representatives urging them to go along with the Village's resolution. Trustee Reid stated that elimination of the double-left turn lanes is a critical issue; he will vote for the resolution because he believes it supports the Village's position; he wants staff to clearly carry the message that, if the Village's recommendation on the double left-turn lane is not viewed, his support for the rest of the resolution would be withdrawn and he would vote Ij against any change on Route 83. Trustee Marienthal stated that, if these comments are not incorporated into the plan, the Village should request IDOT to come back out and give the Village a reason=ason for same. Upon roll call, Trustees voted as follows: AYES: 6 - Marienthal, Reid, Kahn, Rubin, Braiman, Hendricks NAYES: 0 - None Motion declared carried. Mr. Balling reviewed the proposed resolution, details of which are also contained in Mr. Pfeil's memo to Mr. Balling of October 7, 1991. Moved by Rubin, seconded by Reid to pass Resolution #91-78, supporting the Busch Road/Busch Parkway/Deerfield Parkway (IL Hwy 83 to Milwaukee Avenue) Street Improvement. Trustee Kahn stated that he does not believe the parallels can be drawn between Arlington Heights Road and Busch Road; Arlington Heights Road actually goes somewhere - Busch Road basically does not go anywhere. He understands 8232 10/21/91 the need for an improved traffic flow, but he does not want it to be at the expense of people who live along that road nor the people that live beyond that part of the road on Checker. The proposal will make a real nice four-lane highway through Buffalo Grove with no beginning and no end other than two two-lane roads either way. He would like to see staff look at it in a different manner, i.e. improving the geometrics at any four-way intersection which take into account the fact that the Village is working with other villages to get Route 22 expanded; Busch Road is a Village road, and he would like to see it stay that way. Trustee Marienthal stated that the improvement to Busch Road parallels Buffalo Grove Road between Hintz and Palatine Roads; that road was re-designed and re-constructed and is four lanes in each direction, and it seems to function very well without taking additional right-of-way from property owners. Trustee Rubin echoed the comments already made. Larry Reiner, Park Board President, commented on the affect this will have on their property. The Park District would appreciate any support possible in getting children safely across the street. Mr. Balling stated that this road might be better served with a good three-lane road to allow for a turn lane. Wes Reins, 48 Canterbury Lane, borders on Busch Road and stated he supports resurfacing the road, but he cannot support a five-lane road; the traffic only occurs during rush hours; the bottleneck will still exist at Deerfield Road; he is not against the entire project if it is necessary, but he believes that several issues need to be addressed. A resident bordering Busch stated that air polution will increase if the road is widened; the timing of the project is wrong' the value of his property will keepin P P Y decrease; mind that this is a Buffalo Grove street. Paul Silver, 1165 Russellwood Court, stated that no one is in favor of the proposal; there are a number of schools in the area, creating hazards for children; this is not a state road, which is intended to be a major thoroughfare - it is a residential area; this proposal is not needed; he would strongly support rebuilding the road, and he would support the three-lane configuration. Jim Flatley, representing a property owner at the northwest corner of Busch Parkway and Corporate Grove Drive stated that this will have a very negative effect on 8233 10/21/91 III this property; his biggest objection is that it takes away the frontage of the property; it affects the access to the property; they need some assurance that visibility will not be blocked by a structure. Herbert Stoltz, 40 E. Canterbury Lane, complimented the Board for listening to their constituents; he supports the three-lane configuration. Burt Hamilton, representing the Sport Mart parcel, stated that he agrees with the comments made by Mr. Reins. Lee Carpenter, 126 Morningside Lane West, stated that he is pleased to see that the Plan Commission and the Village Board have listened to the residents. President Mathias stated that the Trustees and Commissioners also live in the Village and travel the same roads, so they have the same concerns as other residents. President Mathias polled the Board, asking them to indicate how many lanes they would like to see from Route 83 to Weiland: Marienthal - 3 lanes Reid - 3 lanes Kahn - 3 lanes Rubin - 3 lanes Braiman - 3 lanes Hendricks - 3 lanes It was noted that the Board supports 3 lanes, with the improvements at all the intersections. President Mathias polled the Board asking them to indicate how many lanes they would like to see between Weiland Road and Deerfield Parkway: Marienthal - 3 lanes Reid - 5 lanes (because of the rail station) Kahn - 5 lanes Rubin - 5 lanes (would like to see a proposal for 3) Braiman - 5 lanes Hendricks - 5 lanes President Mathias stated that, unless there is objection, he assumes the above polling includes the Santucci property. President Mathias summarized that staff is being asked to prepare a new resolution for Busch Road to be a three-lane road between Route 83 and Weiland and a five-lane road between Weiland and Milwaukee. 8234 10/21/91 Mr. Balling commented on possible problems at the intersections. The re-draft of the resolution will be on the agenda at the November 4, 1991 meeting. Trustee Rubin and Trustee Reid withdrew the original motion. Moved by Rubin, seconded by Reid, to refer this to staff for the presentation of the resolution in conformance with the pollings. : AYES: 6 - Marienthal, Reid, Kahn, Rubin, Braiman, Hendricks NAYES: 0 - None Motion declared carried. President Mathias stated that the minor plan change for TOWN CENTER the Town Center has been removed from the agenda. Mr. Balling reviewed this situation to date, details of THE BILLS which are contained in Mr. Pfeil's memo to him of October 16, 1991. Mike Scarmelo, 348 Hazelwood Terrace, representing The Bills explained to the Board why this system is important to the association. Mr. Reiner stated that he had attended the test, and he was very impressed with the proposed sound system. Moved by Rubin, seconded by Kahn, that The Bills Football be allowed the system demonstrated, not on the test dates, but for the play-offs on November 2 and 3, 1991, and November 9 and 10, 1991 ball games for the times specified in the letter dated October 18, 1991 from The Bills, with the understanding that this is a one-time test, not an approval for the next season, subject to BGRA being prohibited from using their current system. Trustee Kahn stated that he was present at the test, and he does not think the system will have a big impact over the noise of the crowd; he is pleased with the commitment of the Park District to stop the BGRA from using their present equipment in the future. Trustee Reid stated that the Board was led to believe that the lights at Emmerich would be upgraded; he is not ready to subject residents to any more intrusion from Emmerich Park. Trustee Braiman stated that the Park District Board should do everything they can to commit to improving the lights at Emmerich Park. 8235 10/21/91 Joanne Lachman, 216 Raupp, stated that the Bills had been denied the right to use the speakers, which they did anyway, so she does not have much confidence in anything they say; she believes the boys are there to play ball, not to hear a sound system; she believes the neighborhood is being abused. Gary Gilmeister, 196 Raupp, stated that The Bills representatives contradict themselves; they have used the system even though theyhave been instructed not he y g to; believes the property values in the area are at stake. Ray Charlette, 962 Burgess Circle, stated that this park is too close to residential, and he thinks that perhaps these games should be held at other parks in the Village; he supports the test. A gentleman from 465 Glendale stated he was able to hear the noise when the previous test was performed. Trustee Braiman amended the motion to limit the use of the sound system on the test dates solely to announcement of names and scores at the end of each quarter, understanding that, if they violate that, any future requests would be denied, i.e. a violation on November 2nd or 3rd would suspend use on November 10th and 11th. Trustee Kahn seconded the amendment. Trustee Kahn asked that staff inform the same residents of the upcoming tests. A gentleman from 199 Raupp stated that he believes the upcoming test is a stall tactic; he agrees with the comments regarding finding a new park; he believes the neighborhood is getting stuck with too much noise. There was discussion as to who would monitor this. Upon roll call, Trustees voted as follows on the amended motion: AYES: 4 - Marienthal, Kahn, Rubin, Braiman NAYES: 2 - Reid, Hendricks Motion declared carried. Mr. Balling reviewed a report on the preliminary findings WATER CONSERVATION of the water conservation efforts, details of which are contained in Mr. Boysen's memo to him of October 17, 1991. Moved by Kahn, seconded by Reid, to move to Executive Session to discuss employment compensation of officers and litigation. Upon roll call, Trustees voted as follows: 8236 10/21/91 AYES: 6 - Marienthal, Reid, Kahn, Rubin, Braiman, Hendricks NAYES: 0 - None Motion declared carried. Moved by Kahn, seconded by Braiman, to adjourn the ADJOURNMENT meeting. Upon voice vote, the motion was unanimously declared carried.
