President Mathias recognized those appointees in the audience and thanked them for their willingness to serve on this Committee. PARK DISTRICT GRANT President Mathias noted that the Park District recently received a grant application in the sum of $119,000 for the Cherbourg Park from the Illinois Department of Conservation; he congratulated Park Board President Hedlund on receiving those funds. TELEPHONE AREA CODE President Mathias noted that Ameritech is in the process of proposing a change in the area code, wherein neighbors could have different area codes, creating an undue hardship. The Northwest Municipal Conference is in the process of filing a petition with the Illinois Commerce Commission to intervene, and they are asking for financial help from member municipalities to help defray the cost of this intervention, with Buffalo Grove's cost being approximately $200. Municipalities and citizens are also being asked to write to the ICC and Ameritech voicing displeasure with the proposed change. Upon roll call, Trustees voted as follows: AYES: 6 - Marienthal, Reid, Rubin, Braiman, Hendricks, Moons NAYS: 0 - None Motion declared carried. 9636 2/6/95 SCHOOL CONNECTIONS/FUTURE DIRECTIONS The Village Clerk reported on a meeting that she and Phil Versten attended this evening at Wheeling High School featuring an overview of District 214's Tech Prep and Northwest Suburban Career Cooperative programs; this invitation is another positive recognition in response to our Civics Forum. MUNICIPAL ELECTION The Village Clerk reported that the ballot placement lottery took place on January 23, 1995 at 5:00 P.M. The Village President and the Village Clerk are running unopposed. There are seven candidates for three Trustee positions, and their placement on the ballot is as follows: Brian Rubin, Philip Horn, Louis Eisenberg, Gerard Moons, Louis Windecker, DeAnn Glover and John Marienthal; she again noted that this will likely be a low-turnout election and a few votes will make a difference, so she urged residents to study the positions of the candidates and be sure to vote on April 4, 1995. Registration closes on March 6, 1995, and all Village residents can register to vote at Village Hall, as well as Township and County offices. PEOPLE, PLACES & ISSUES President Mathias noted that Lt. Governor Kustra is a guest on this month's People, Places & Issues, which will be broadcast on Channel 6 throughout the months of February and April; Lt. Governor Kustra presented information on the Governor's programs. INFORMATION SYSTEMS Mr. Balling introduced and welcomed Robert Giddens, Management Information Services Director, who began work for the Village today. CORPORATE PURPOSE BONDS Mr. Balling reported on the closing of the Corporate Purpose General Obligation Bonds - Series 1995 on January 30, 1995, details of which are contained in Mr. Brimm's memo to him of January 30, 1995. President Mathias congratulated Mr. Brimm for the excellent handling of this issue. Moved by Hendricks, seconded by Reid, to accept the Notification of Sales of $3M General Obligation Corporate Purpose Bonds - Series 1994. In answer to a question from Trustee Reid, Mr. Raysa noted that it is the opinion of Chapman & Cutler that there cannot be legislation which interferes with pre- existing contracts, and therefore, any retroactivity would not affect a bond that had been issued prior to the enactment of the new legislation; we have a written opinion that our bond is valid in all respects. ORDINANCE #95-16 - CHECKER DRIVE Mr. Balling stated that, in his initial presentation, he will refer to both Items A. and B. on the agenda; he reviewed studies and discussions that have taken place; he reviewed the survey responses; and he reviewed the two proposed ordinances, details of which are contained in Mr. Kuenkler's memo to him of January 25, 1995. Trustee Rubin stated that he has no problem with the proposed ordinances, but he does not believe they go far enough. Moved by Reid, seconded by Rubin, to pass Ordinance #95-16, amending Chapter 10 of the Municipal Code lowering the speed limit on Checker Drive between IL Route 83 and Arlington Heights Road to 25 MPH. Upon roll call, Trustees voted as follows: AYES: 6 - Marienthal, Reid, Rubin, Briaman, Hendricks, Moons NAYS: 0 - None Motion declared carried. ORDINANCE #95-17 - CHECKER DRIVE Moved by Reid, seconded by Rubin, to pass Ordinance #95-17, amending Chapter 10 of the Municipal Code creating a turning restriction at Arlington Heights Road on to eastbound Checker Drive between the hours of 7:00-8:30 A.M. 9640 2/6/95 Trustee Reid stated that he has a problem with this type of ordinance; roads are built to carry traffic and we need to work within that framework; he can support this restriction, but without adequate police enforcement, neither of these ordinances will be effective. Chief McCann stated that Checker Drive is heavily enforced; he is committed to ensuring that any modifications made by the Board to the ordinance are strictly enforced. Trustee Marienthal stated that there must be enforcement of the truck traffic restrictions. Trustee Rubin stated that he believes that erecting a couple of STOP signs on Checker will be very effective. Mr. Balling commented on the warrants for STOP signs along that road, and he would recommend against additional STOP signs. Trustee Rubin suggested lengthening the hours for the turning restrictions to 6:30-9:00 A.M. Trustee Braiman suggested approving what is before the Board now, possibly adding the warranted STOP sign at Checker and Old Checker, wait to see what affect these measures have, and then re-evaluate the situation in a few months; he does not believe the staff proposals will alleviate the problem without creating too great a burden for residents. Trustee Hendricks agrees with Trustees Rubin and Braiman; he would consider this Phase I, to be evaluated, and perhaps adding further turning restrictions or STOP signs in Phase II. Trustee Moons believes the roads are made for the people who live there; he would like to see "Local Traffic Only" signs erected, as well as prohibiting left turns on to southbound Arlington Heights Road. Several residents made the following comments: Extend the hours for restricted turning from 6:30-9:00 A.M. Agreement with the speed limit reduction. Diversion of traffic will only increase the volume of traffic zigzaging its way through the Strathmore subdivision. The issue should concern itself with residents living on or immediately near Checker Drive, not throughout the entire subdivision. There should be signs noting "Local Traffic Only" for Checker Drive. Turning restrictions are not good, as they can hinder traffic flow for the residents; STOP signs are good; lowering the speed limit is good. Turning restrictions are a problem for the residents; STOP signs will be \./ beneficial. The Board was thanked for addressing this issue; STOP signs will help; the hours for turning restrictions should be extended. President Mathias stated that Village streets are public, and cannot be closed to non-residents. 9641 2/6/95 President Mathias polled the Board: "YES" indicates favor of the proposed ordinance, but not necessarily the time frame that is in it; "NO" indicates favor of no restrictions at any time: YES: 6 - Marienthal, Reid, Rubin, Braiman, Hendricks, Moons NO: 0 - None President Mathias then asked the hours of restriction favored by each Trustee: 6:30-9:00 A.M. - Marienthal, Rubin, Braiman, Hendricks, Moons 7:00-8:30 A.M. - Reid Moved by Moons, seconded by Marienthal, to pass Ordinance #95-17, with the turning restriction hours be extended to 6:30-9:00 A.M. President Mathias polled the Board: "YES" indicates favor of STOP signs at Checker Drive and Checker Road; "NO" indicates opposition: YES: 6 - Marienthal, Reid, Rubin, Braiman, Hendricks, Moons NO: 0 - None CHECKER DRIVE Moved by Marienthal, seconded by Reid, to pass Ordinance #95-18, amending Chapter 10 of the Village of Buffalo Grove Municipal Code to add a STOP sign at the intersection of Checker Drive and Checker Road. Several residents made the following comments: The STOP sign will not deter people; they don't want non-resident cars in the subdivision at all. The STOP signs will not deter anyone; the turning restrictions will be more beneficial. The STOP signs at this point are premature. The STOP signs will back up traffic at the intersection, making it difficult for nearby residents to exit their driveways. Cut through traffic on other streets in the subdivision should be measured before implementation of STOP signs. Checker Drive was not designed to have STOP signs; this measure is premature. �./ Make it difficult for traffic on Busch Road before getting to Route 83. Implementation of left turn restriction at Checker and Arlington Heights Road in the evening. Trustee Reid suggested deferring action based upon the comments from the audience and the recommendation from the staff, referring the question back to the staff to review the issue of STOP signs along Checker, and look at alternatives; also, by deferring, residents will have had an opportunity to see the results of the lower speed limit and the turning restrictions. 9642 2/6/95 Moved by Reid, seconded by Hendricks, to defer action on STOP signs until staff has a chance to re-evaluate. Upon roll call, Trustees voted as follows: AYES: 6 - Marienthal, Reid, Rubin, Braiman, Hendricks, Moons NAYS: 0 - None Motion declared carried. Trustee Reid suggested putting some signage on Route 83 east of Checker indicating it is a local traffic street so that cars will not get locked into the left turn lane; he believes the time to review the truck traffic would be now, during construction season. In answer to a question from a resident on Checker, Chief McCann stated that she should call the Police Department if she sees trucks that are not allowed to be on Checker. President Mathias stated that he believes a realistic follow-up period would have to be 4-6 months. Trustee Rubin confirmed that staff will do counts on the auxiliary streets; he also asked that some type of a map be put together to point out alternate routes to get people in and out of the subdivision during peak hours. Trustee Braiman stated that he would like to also see signage indicating local traffic before Route 83 on Busch. Mr. Balling commented on the requested signage. Trustee Moons asked about signage on Arlington Heights Road and Checker; Mr. Balling again responded. Trustee Marienthal also stated that the truck traffic should be monitored, particularly at Checker Drive and Checker Road because it is a real problem which occurs every day. Lake County Commissioner Stolman reported on the progress of the traffic signal at Checker Road and Buffalo Grove Road. President Mathias thanked Commissioner Stolman for his efforts on behalf of the Village. There was also discussion on working with IDOT on the timing of the traffic signal at Route 83 and Arlington Heights Road. President Mathias polled the Board: "YES" indicates favor of proceeding with an ordinance for turning restrictions for afternoon hours at Checker Drive onto Arlington Heights Road; "NO" indicates deferring action on same: YES: 2 - Rubin, Moons NO: 4 - Marienthal, Reid, Braiman, Hendricks BICYCLE HELMETS Moved by Hendricks, seconded by Reid, to pass Ordinance #95-18, amending Title 10 of the Municipal Code requiring the use of protective bicycle helmets for children under the age of 16. Mr. Balling brought the Board up to date on the proposed ordinance, details of which are contained in Chief McCann's memo to him of January 27, 1995, and Mr. Raysa reviewed his preparation of same. 9643 2/6/95 Trustee Rubin stated that, although he is very much in favor of children wearing bicycle helmets, he does not believe it should be legislated; he does not want small children to be put in the position of being "arrested"; he would be strongly in favor of a resolution encouraging the wearing of helmets; he believes the ordinance would be difficult to enforce; he would like to see the Police Department go into the schools and encourage the wearing of helmets. Trustee Braiman noted the number of lives that were saved when seat belt laws went into effect; he believes the children who do not wear helmets now because it is not "cool" would wear them if it were the law; he does not believe that it would be difficult to enforce or the Police Department would "arrest" children, but would instead encourage them to wear the helmets. Trustee Reid stated that he had been at the Board of Health meeting where this was discussed, and Sgt. Dunne made it very clear that the Police Department would address this primarily as an educational program rather than an enforcement program; he could support this if it would help parents get their children to wear helmets. Trustee Marienthal believes this should be passed; he believes it will take a long advertising campaign by the Village, the Police Department and the schools; if it saves the life or injury for just one child, it will be worth it. Trustee Rubin stated that he believes all these goals could be accomplished by an educational program. Trustee Braiman thanked District 96 for bringing this to the Board's attention, and is disappointed that the other school districts in the area did not issue a resolution in favor of the proposed ordinance. Richard Bird, 420 Checker Drive, stated that he is an avid bicyclist, and he always wears a helmet; he believes the ordinance should apply to anyone who rides a bicycle. Philip Horn, 443 Ferndale, agrees with Trustee Rubin; he believes that this is overly intrusive; he agrees that public safety awareness program would be to the benefit of everyone. Another resident stated that enforcement would be very difficult; this should be done through school educational programs; this would mean that Wheeling or Long Grove residents could not ride through Buffalo Grove without a helmet. Mr. Mason, School District 96, stated that statistics show that education and resolutions do not have the same effect that the law does; head injuries are profound, and he believes that the community needs to take a stand. President Mathias stated that, although he is aware that the school district passed a resolution urging voluntary compliance, he wondered why the district did not make it mandatory to wear helmets while on school property. Mr. Mason stated that the school board was divided, but they did not want to preempt an ordinance passed by the Village Board; the school district would support a Village ordinance, and would help in whatever way possible with enforcement. Chief McCann reported on the draft enforcement that has been put together by the Police Department. A resident stated that he does not see his son wearing a helmet, and he would not be enforcing it; he does not believe the Village should be telling parents what their children should be wearing. 9644 2/6/95 Upon roll call, Trustees voted as follows on the motion: AYES: 3 - Marienthal, Braiman, Hendricks NAYS: 4 - Reid, Rubin, Moons, President Mathias Motion defeated. Trustee Rubin asked that a resolution urging the wearing of bicycle helmets be prepared. �•/ President Mathias stated that he believes this can be handled in a different way; he thinks an educational program by the Police Department is definitely needed; he is troubled by the fact that the school district asking the Board to pass the ordinance did not make it mandatory to wear a helmet on school grounds; at this point, he would prefer to try an educational program first. Trustee Moons stated that he can see having a law requiring everyone to wear helmets, but not just one for children; he does not believe we should have a law and then not enforce it. President Mathias stated that a resolution will be on the agenda for the February 21, 1995 meeting. RESOLUTION #95-6 - FIRE TRAINING FACILITY Moved by Hendricks, seconded by Rubin, to pass Resolution #95-6, approving a fire training facility agreement between the Village of Buffalo Grove, the Village of Wheeling and the Long Grove Rural Fire Protection District. Chief Allenspach reviewed this agreement, details of which are contained in his memo to Mr. Balling of January 25, 1995; he stated that he does not foresee any additional staff being added because of this agreement. President Mathias appointed Chief Allenspach to serve as the official Buffalo Grove representative for this venture. KINGSWOOD UNITED METHODIST CHURCH Trustee Reid recused himself for this item because he is a member of Kingswood United Methodist Church. Bruce Hoffman, representing the church, reviewed the request of the church, details of which are contained in Mr. Pfeil's memo to Mr. Balling of February 2, 1995. 9645 2/6/95 Moved by Rubin, seconded by Braiman, to refer the Kingswood United Methodist Church, Dundee Road, to the Plan Commission. WILKINS PROPERTY Scott Inbinder, Indevco, Inc. , noted that they have revised the site plan in accordance with comments made by the Board at the last meeting. The site planner then reviewed the changes that were made; he answered questions from the Board regarding the parcel to the south, the zoning and side yard setbacks. Details of this proposal are contained in Mr. Pfeil's memo to Mr. Balling of February 2, 1995. Moved by Hendricks, seconded by Braiman, to refer the Wilkins Property, Prairie Road to the Plan Commission.
