1994-11-21 - Village Board Regular Meeting - Minutes 9598 11/21/94 MINUTES OF THE REGULAR MEETING OF THE VILLAGE BOARD OF THE VILLAGE OF BUFFALO GROVE, HELD IN THE COUNCIL CHAMBERS, 50 RAUPP BOULEVARD, BUFFALO GROVE, ILLINOIS ON MONDAY, NOVEMBER 21, 1994 CALL TO ORDER President Mathias called the meeting to order at 7:37 P.M. ROLL CALL Roll call indicated the following present: President Mathias; Trustees Marienthal, Reid, Rubin, and Hendricks. Trustee Braiman arrived at 7:43 P.M. , and Trustee Kahn was absent. Also present were: William Balling, Village Manager; William Raysa, Village Attorney; Lee Szymborski, Assistant Village Manager; William Brimm, Finance Director; Robert Pfeil, Village Planner; Carmen Molinaro, Director of Golf Operations; Val Kaleta, Food Service Manager; Paula Wagasky, Assistant Golf Professional; Police Chief McCann; and Joseph Tenerelli, Village Treasurer. APPROVAL OF MINUTES Moved by Rubin, seconded by Reid, to approve the minutes of the November 7, 1994 w Regular Meeting. Upon roll call, Trustees voted as follows: AYES: 3 - Marienthal, Reid, Rubin NAYS: 0 - None ABSENT: 2 - Kahn, Braiman ABSTAIN: 1 - Hendricks Motion declared carried. WARRANT #778 Mr. Tenerelli read Warrant #778. Moved by Rubin, seconded by Hendricks, to approve Warrant #778 in the amount of $2,230,190.57, authorizing payment of bills listed. Upon roll call, Trustees voted as follows: AYES: 4 - Marienthal, Reid, Rubin, Hendricks NAYS: 0 - None ABSENT: 2 - Kahn, Braiman Motion declared carried. COMMENDATION - BEVERLY SUSSMAN President Mathias read a commendation to resident Beverly Sussman for her selection to receive a Presidential Award for Excellence in Science Teaching. Mrs. Sussman came forward to be presented with the commendation and was congratulated by the audience and the Board. Trustee Braiman arrived at this time. ROUTE 83 President Mathias noted that he had sent a letter to IDOT regarding the Route 83 construction; he received a reply promising that the work would be done before the end of November. Trustee Reid commented on the STOP signs at Checker and Old Checker; he would like to see the location of these signs put in ordinance form; President Mathias stated that would be on the next agenda. 9599 11/21/94 Trustee Marienthal commented on the changes that were made. LAKE-COOK ROAD President Mathias presented an update on the Lake-Cook Road project. RESPITE CARE Trustee Rubin referred to an article in the Tribune regarding respite care services in which Buffalo Grove's program was noted; he will circulate a copy of the article. ROTARY CLUB Trustee Rubin noted that Wheeling and Buffalo Grove Rotary distributed food baskets last week, with the help of Stevenson High School students who volunteered their time. MANAGEMENT REPORT Mr. Balling noted the submission of the Management Report for October; there were no questions on same. BIKE HELMET LEGISLATION Mr. Balling explained the proposed legislation, and introduced Ivy Hall Middle School Principal John Mason. Principal Mason made a presentation to the Board outlining the events leading up to tonight's request to enact a bike helmet law; he reviewed the near fatal accident of an Ivy Hall student who was not wearing a helmet; students and faculty would like the Board to direct the Village Attorney to prepare an ordinance requiring bicycle riders to wear helmets. Jason Kessler, a friend of the student who was hurt, related how the accident affected students; students did a great deal of research regarding bike accidents and how helmets might have prevented many injuries. The Illinois General Assembly failed to pass a helmet law primarily because there are no helmet laws in any Illinois municipalities which would serve as an example; Ivy Hall students would like Buffalo Grove to be first and foremost in bicycle safety. School Board President Mark Spivak noted a resolution passed by their Board. Trustee Rubin stated that the Board should pass a helmet law, and stated that perhaps Rotary Club could participate in helping to purchase helmets for those who can demonstrate need. Trustee Braiman stated this should be referred to the Health Department for review, and the Northwest Municipal Conference should be notified of Buffalo Grove's efforts in this regard. Moved by Braiman, seconded by Rubin, to refer consideration of a bike helmet law to the Health Department for preparation of an ordinance. Trustee Marienthal stated that the Police Department should also be involved in ordinance preparation; he is in favor of the law. Trustee Reid concurs with comments made, and he believes we should follow the model that was used in the Illinois House to provide for the fine if it is collected, and use those funds to purchase helmets for those who can demonstrate a need. 9600 11/21/94 Trustee Rubin expressed appreciation to the students and faculty in bringing this matter to the Board's attention. Upon roll call, Trustees voted as follows: AYES: 5 - Marienthal, Reid, Rubin, Braiman, Hendricks NAYS: 0 - None ABSENT: 1 - Kahn Motion declared carried. President Mathias also thanked the students and faculty for their efforts in this matter, and stated that they will be notified when the ordinance is brought before the Board. SERVICE AWARD President Mathias asked Carmen Molinaro to come forward, after which he read a brief history of Mr. Molinaro's 20 years of employment with the Village; he reviewed comments made by Village staff about Mr. Molinaro. President Mathias presented Mr. Molinaro with a gift, and he was congratulated by the audience and the Board. Trustee Marienthal also congratulated Mr. Molinaro and presented him with a gift. PUBLIC HEARING - GROVE MEMORIAL CHAPEL At 8:10 P.M. , President Mathias re-opened the Public Hearing on The Grove Memorial Chapel annexation, which was continued from October 17, 1994 Mr. Balling stated that the Village Attorney is in possession of three executed copies of the Annexation Agreement. Mr. Raysa reviewed changes as outlined in Mr. Pfeil's memo to Mr. Balling of November 17, 1994; he stated that the document under consideration tonight is that certain draft dated 11/15/94, Grove Memorial Chapel, Firnbach Property, Buffalo Grove Road, Annexation Agreement. President Mathias asked if there were any other comments or questions from the Board or anyone in the audience; there were none. At 8:13 P.M. , President Mathias continued the Public Hearing until the ordinances are considered later on in the meeting. QUESTIONS FROM THE AUDIENCE President Mathias asked if there were any questions from the audience; there were none. CONSENT AGENDA President Mathias explained the Consent Agenda, stating that any member of the audience or the Board could request that an item be removed for full discussion; it was requested that Item XI. E. be removed from the Consent Agenda. RESOLUTION#94-51 - IDOT Grant Moved by Braiman, seconded by Hendricks, to Authorize Application for Mass Transportation Capital Assistance Grant through IDOT for the Wisconsin Central project. Upon roll call, Trustees voted as follows: AYES: 5 - Marienthal, Reid, Rubin, Braiman, Hendricks NAYS: 0 - None ABSENT: 1 - Kahn Motion declared carried. 9603 11/21/94 ORDINANCE #94-83 - GROVE MEMORIAL CHAPEL Moved by Marienthal, seconded by Reid, to pass Ordinance #94-83, amending the Village of Buffalo Grove's Zoning Ordinance concerning Special Uses in the B-5 Town Center Planned District allowing for a funeral home in the Commercial/Recreational Sub-district. Upon roll call, Trustees voted as follows: AYES: 5 - Marienthal, Reid, Rubin, Braiman, Hendricks NAYS: 0 - None ABSENT: 1 - Kahn Motion declared carried. ORDINANCE #94-84 - GROVE MEMORIAL CHAPEL Moved by Reid, seconded by Marienthal, to pass Ordinance #94-84, amending the Comprehensive Zoning Ordinance of the Village of Buffalo Grove as it concerns The Grove Memorial Chapel. Upon roll call, Trustees voted as follows: AYES: 5 - Marienthal, Reid, Rubin, Braiman, Hendricks NAYS: 0 - None ABSENT: 1 - Kahn Motion declared carried. President Mathias welcomed The Grove Memorial Chapel to the Village of Buffalo Grove. President Mathias closed the Public Hearing at 8:20 P.M. ORDINANCE #94-85 - MUNICIPAL CODE Trustee Reid reviewed the proposed ordinance, details of which are contained in Mr. Szymborski's memo to Mr. Balling of November 17, 1994. Moved by Reid, seconded by Rubin, to pass Ordinance#94-85, amending the Village of Buffalo Grove Municipal Code pursuant to recommendations of the Municipal Code Review Committee/Master Change Ordinance #2. Trustee Marienthal thanked the three Trustees involved in this process for all their work. Trustee Braiman commented on the long process in bringing this to fruition, and thanked the staff for their assistance. Upon roll call, Trustees voted as follows: AYES: 5 - Marienthal, Reid, Rubin, Braiman, Hendricks NAYS: 0 - None ABSENT: 1 - Kahn Motion declared carried. �./ ORDINANCE #94-86 - TITLE 19 Mr. Balling reviewed the proposed ordinance, details of which are contained in Mr. Pfeil's memo to him of November 17, 1994. Moved by Rubin, seconded by Reid, to pass Ordinance #94-86, amending Title 19 of the Municipal Code as it concerns land donations. 9604 11/21/94 There was discussion as to the dollar amount determined for land value. Mr. Raysa pointed out that anytime the Board takes action in regard to Title 19, the background information for the fair market value of the land has to be justified "uniquely attributable" to a development. Upon roll call, Trustees voted as follows: AYES: 5 - Marienthal, Reid, Rubin, Braiman, Hendricks NAYS: 0 - None ABSENT: 1 - Kahn Motion declared carried. School Board President Marc Spivak on behalf of District 96 stated that the district appreciates the continued support of the Village Board. Mr. Balling explained the criteria to be used in determining the dollar amount for Title 19 use. FY1995 GOLF OPERATIONS BUDGET Mr. Balling, Mr. Brimm and Mr. Molinaro presented the FY1995 Golf Operations Budget, details of which are contained in Mr. Balling's memo to the Board of November 17, 1994; they then answered questions from the Board. FY1995 FOOD SERVICE BUDGET Mr. Balling, Mr. Brimm and Val Kaleta presented the FY1995 Food & Beverage Operations Budget, details of which are contained in Mr. Balling's memo to the Board of November 17, 1994; they then answered questions from the Board. President Mathias thanked staff for the presentations and for their work in putting them together. RESOLUTION #94-50 - MARTIN SILBERNIK Mr. Silbernik came forward and President Mathias read the resolution commending him for his service as Plan Commission Chairman. Moved by Braiman, seconded by Reid, to pass Resolution #94-50, commending Martin Silbernik for service to the Village of Buffalo Grove as Chairman of the Plan Commission. Upon roll call, Trustees voted as follows: AYES: 5 - Marienthal, Reid, Rubin, Braiman, Hendricks NAYS: 0 - None ABSENT: 1 - Kahn Motion declared carried. WOODLANDS OF FIORE Moved by Marienthal, seconded by Reid, to defer the Appearance Commission recommendation on The Woodlands of Fiore - Ground Signs until all commission recommendations can be approved at the same time. It was noted that, in the future, if there are joint issues pending on a property, staff should hold all issues until all commissions have had the opportunity to act, so that all issues can be dealt with at one time. 9605 11/21/94 Upon roll call, Trustees voted as follows: AYES: 5 - Marienthal, Reid, Rubin, Braiman, Hendricks NAYS: 0 - None ABSENT: 1 - Kahn Motion declared carried.
